건축물 화재에서의 피난대책은 Passive 대책과 Active 대책으로 대별될 수 있다. Passive 대책은 수동적이고 소극적인 개념으로 공간적 구조체인 특성에 따라 건축법규에서 규율하고 있는데 반하여, Active 대책은 능동적이고 적극적인 개념의 설비적인 측면에 따라 소방법규에서 규율하고 있다. 따라서 양 법규간 피난기준이 상호 대체적 기능보다는 소방법규에서의 보완적 기능이 보다 더 강하다. 본 연구는 피난기준이 건축법규와 소방법규로 이원화되고 관련설비에 대한 설치기준이 관계법규에 혼재됨에 따라 양 법규간의 상호기능보다는 기준적용의 혼선, 기준간 충돌 등의 문제점을 도출하고 효율적이고 합리적인 피난기준 적용을 위한 대책방안을 제시하고자 한다.

Factors causing traffic accidents are various and traffic law violations can be among them. The efforts to increase traffic law obedience rates of drivers are common in many other countries to reduce traffic accidents, and one of generally applied methods is to increase the amounts of violation fines. Expensive levels of traffic law violation fines could have drivers choose "obey the law" in their decision-making stages since they are economically better-off by following the law. In this sense, this study has developed an economic model to verify whether the current levels of the traffic violation fines of Korea are effective for drivers to choose "obey-the-law" decisions. Speed violations and traffic signal violations have been selected for the case study to verify the relationships between "expected probabilities of being-caught" and "levels of violations fines".

본 논문에서는 전기자동차의 고전압 시스템의 안전성을 확보하기 위한 법규 규제안 생성 방법론을 제시하였다. 법규가 기술적으로 모든 영역을 빠뜨리지 않고 정의하고 있는지를 파악하기 위한 방법으로 법규분포분석법(Regulation Distribution Analysis Method)과 법규 완전도 분석법(Regulation Completeness Analysis Method)을 제시하였다. 자동차 설계와 생산에 있어서 법규/규제는 중요한 이슈가 되고 있다. 원칙적으로 법규는 자동차 승객과 환경을 보호하는 목적으로 생성되고, 이윤 추구 중심의 시장에서 놓칠 수 있는 기술적 항목들을 규제할 수 있도록 한다. 매연 배출 정도, 매연 모니터링 시스템, 전기 안전성과 같은 항목이 그 예이며, 향후 연료전기자동차 양산을 앞두고는 고전압 안전성과 관련된 규제 또한 필요하게 될 것으로 파악된다. 그러나 규제 항목에서 미정의된 부분이 있는지를 확인하는 체계적인 방법이 없어 본 논문에서는 기술적인 파라미터를 중심으로 규제항목을 검토하는 방법론을 제시하였다.

Maritime legislation encompasses a wide range of laws related to the maritime field. A significant number of laws that can be called maritime legislation have been enacted and implemented in domestic legislation. For all types of legislation, including maritime legislation, the meaning of the legal provisions must be clear for those who abide by the law, those who study the law, and those who enforce legislation. Nevertheless, the potential for considerable confusion exists because the definition is not stipulated in relation to the 'Route' specified and regulated in various maritime legislation. Further, the exact meaning of numerous cases is difficult to understand and can be interpreted in various ways. Adding to the confusion is the use of different terms with similar meanings. The maritime field changes and becomes more diverse, and many related maritime legislations are being enacted or amended to reflect this situation. The, authors propose to specify clear route definitions in individual legislation and replace parts that may cause unnecessary misunderstanding with similar terms. The authors believe that the confusion in compliance and enforcement of maritime legislation can be minimized .if these proposals are implemented.

자동차의 대중화에 따른 자동차교통량의 증가는 교통사고의 증가를 가져 왔으며 이것을 방지하기 위한 여러 대책이 검토되어 왔다. 특히 미국, Europe제국, 일본 및 호주 등과 같은 자동차 선진 국에서는 자동차에 기인하는 안전, 배기, 굉음 등이 사회환경에 미치는 영향, 즉 자동차가 사회에 미치는 마이너스면을 가능한 한 줄이기 위해 일찍부터 자동차에 관한 각종법규가 제정, 정비 되어 왔다. 또한 근년의 석유위기로 인하여 에너지의 국가적인 절약을 목적으로, 자동차의 연료 경제성에 관한 법규도 제정되었다. 자동차의 기술개발 중에서 안전성을 확보하기 위한 제연구 및 그 우선도는 높은 비중을 차지하게 되었으며, 그 결과 자동차의 안전기술은 매년 비약적으로 진보하여 사고회피성능, 충돌시의 탑승자보호성능, 화제대책등 각 분야에 걸쳐 많은 발전을 하여 왔다. 안전성을 높이기 위해, 차체의 강도를 높이면 중량이 증가하여 연비가 나빠지게 되며, 또 배출gas가 악화된다. 즉 여러 요인이 상호간섭 하여 영향을 주게 되므로 법규의 내용을 지키 기에 많은 어려움이 있다. 따라서 비상한 연구와 노력이 필요하다. 특히 최근에는 자동차가 인 간사회에 미치는 영향이 크고 자동차(특히 승용차)가 기술이나 지식, 경험에 있어서 그다지 숙 련되지 않은 사람들도 사용하는 대중상품화되어 각종의 법규제도 점점 강화되어 가는 경향이 있다. 따라서 각국의 법규에 일치하면서 사회나 구입자의 요구에 부음하고 구내자동차의 수출을 촉진시키기 위해서는, 각국법규에 대한 면밀한 검토와 이에 대한 대응책이 필요하다. 여기서는 자동차의 안전에 관한 개요 및 이에 관련된 각국의 법규를 개략적으로 소개하고자 한다.

유엔에서 협약한 국제거래법규는 국가간의 물품매매 계약시에 지대한 영향을 행사하며 앞으로의 국제거래법에서 중요한 표준규범이 되리라 전망된다. 특히 국제거래법규는 영미법의 표준거래규범과 유사한 점이 많지만 세부적으로 살펴보면 상이점 또한 지대하다고 하겠다. 본 연구는 국제거래법규의 형성과정을 영미법을 근간으로 하고 있는 표준거래규범의 측면과 대륙법적 측면에 대한 이론적 구성을 계약형성과정을 통하여 세부적으로 검토하고자 한다. 아울러 국제거래법규의 입법취지의 이해를 돕고자 유엔에서 협약했던 유사한 국제거래규범들의 입법에 관한 역사를 연대순으로 정리하였다. 본 연구의 결론은 계약형성과정에서의 이론적 구성이 대륙법적 측면보다 영미법의 표준거래규범 측면에 있다는 것이다. 그러므로 본 연구는 영미법의 표준거래규범(U.C.C)과 더불어서 물품거래 계약시에 지대한 영향을 미치는 국제거래법규(CISG)에 대해서 근접적인 접근방식으로 고찰하였다.

본 연구는 자동차 충돌 시험에 관련된 항목 중 현재 많은 연구를 하고 있는 측면 충돌 시험 평가에 대한 법규를 지원해주기 위한 시스템 구축에 관한 것이다. 2003년 상반기 국내 최초 충돌 시험을 실시한 바 있고 전 세계적으로 측면 충돌 시험은 자동차 안전성 평가의 기본이 사항이다. 측면 충돌 시험은 각 국가별 상이한 법규와 시험 방법을 가지고 있기 때문에 각각의 내용을 인지하는 것은 자동차 충돌안전에 있어서는 필수 사항이다. 이번 연구는 측면 충돌 시험과 관련된 법규와 측면 충돌 시험 평가 결과값(별의 개수)을 가지고 평가에 대한 내용을 설명하고 이해를 지원해주는데 목적을 두고 있다.

This study was to investigate and analysis the library-related laws and regulations enacted by local governments. As a result, library regulations are investigated all 629 cases in nationwide survey. Among them, library-related ordinances are 393 cases, library-related regulations are 187 cases, and library-related anweisung are 43 cases, such as the order was followed. The Library ordinance 393 cases consist of library management ordinance(205 cases), small library ordinance(101 cases), reading promotion ordinance(49 cases), and so on. The 32 local governments did not enact the Library laws and regulations. And the 40 local government did not enact Library management ordinance. It is suggested that local government did not enact library-related laws should be established the library laws as soon as possible.

Recently, the trend has been for buildings to become larger and more sophisticated, and this has created safety issues. Because the buildings are big it takes lots of time to check building codes related to anti-disaster and safety manually, and there is the high possibility of making mistakes. Due to these problems, according to a study, 83% of architecture and construction workers believe that an automated code-checking system is needed. This study researches past automated code checking systems and research activity, and using Building Information Model (BIM) technology, determines the feasibility of developing a system to automatically check domestic codes related to egress and anti-disaster. This paper describes the necessity of an automated building code checking system and expected effects. It then reports whether the methods used in previous studies can be deployed in domestic building code checking and discusses problems and limitations. It also suggests an alternative approach. Although this study covers limited codes related to egress, we need to find out what is needed for automatic general code checking system and do further studies for that.

This study suggests the basic data of the establishment and revision of local laws and regulations by analyzing the status and content of local laws and regulations related to public libraries focusing on Daejeon Metropolitan City. For this purpose, first, this study investigates the theoretical background of the type, nature, and procedure of establishing local laws and regulations. Secondly, this study analyzes the content of local laws and regulations related to public libraries classified into three parts, that is, metropolitan governments, local governments and school districts. Finally, this study points out the problems and solutions in relation to the structure of administration, the rank and position of library directors, and the organizations of public libraries.
