  • 공사장에서 발생하고 있는 먼지는 현장 근로자뿐만 아니라 인근 주민들의 건강에 치명적인 영향을 미치고 있다. 공사장 인근 주민들이 환경분쟁조정위원회에 먼지피해에 대한 피해배상을 청구하고 있지만 공사장 먼지피해 수인한도 초과여부를 확인하기 위한 측정, 예측, 평가가 어려워 먼지피해에 대한 보상이 제대로 이루어지지 않고 있다. 공사장 먼지관리의 법적기준이며 먼지 저감에 대한 구체적인 방법을 제시하고 있는"비산먼지 억제조치기준"의 준수 등을 점수로 평가하여 일정 점수 이하인 경우 피해배상액을 차등 적용하는 방안을 제안한다. 본 안이 제도화된다면 건설사는 먼지피해 배상액 지출을 줄이기 위해 현재보다 한층 더 먼지 저감 노력을 강화할 것이기에 먼지 발생을 획기적으로 줄일 수 있어서 현장 근로자 및 인근 주민들의 먼지피해를 최소화할 수 있으며, 먼지로 인한 환경, 보건 법규위반예방과 쾌적한 작업환경으로 노동 생산성 확보와 먼지로 인한 피해 배상액 지급 등 손실을 줄일 수 있을 것이라고 생각한다.

A Study on the Realization of Dust Damage Compensation Calculation for the Prevention of Dust Damage in Construction Site (공사장 먼지피해 예방을 위한 먼지피해 배상액 산정 현실화 방안 연구)

  • Purpose: Even if a damage is applied to the dust of the construction site containing the first-class carcinogen, it is dismissed or 5~30% of the amount of noise damage compensation is paid., Because of such loopholes, some construction companies are neglecting the dust management of the construction site, and the damage of the workers and the residents in the construction site continues. Method: The purpose of this study is to examine the problems of the calculation criteria of damage compensation amount of construction site dust, the measurement of dust concentration, the analysis of measurement data (the data of electric signboard measuring device by the mining scattering method), the prediction and evaluation methods such as modeling, and to suggest improvement measures. Result: It is found that it is impossible to calculate the amount of damages from dust damage in the construction site by calculating the current dust damage compensation amount and dust concentration modeling and measurement. Conclusion: It will receive an application for compensation for damage within the site where damage is expected (about 100m in the straight line and the boundary line of the site), and present a method of calculating the amount of compensation that differentially evaluates dust damage to the degree of dust management and compliance with dust-related legal standards.

Study on the North Korean Law in Estimating the Damages caused by Personal Injury (북한법상 인신사고에 대한 손해액 산정기준)

  • Inter-Korean exchanges and cooperation, in the process, will inevitably lead to various legal disputes, one of which is the issue of compensation for personal injury. The purpose of this study is to present the standards of settlement of disputes between the residents of North and South Korea by examining the North Korean compensation law on the calculation of damages due to personal injury and comparing it with the South Korean compensation law. Understanding the North Korean compensation law is a critical and urgent task, as exchanges and cooperation between the two Koreas are expected to increase in the future. For the South Korean compensation law does not have specific provisions on the estimation of damages, the specific methods and standards for estimating damages are determined by court precedents. The South Korean courts categorize the damages caused by personal injury into active property damages, passive property damages and emotional distress damages and calculate the amount of each damages. On the other hand, the North Korean Compensation for Damage Act stipulates the categories of damage by dividing the cases of personal injury into 1) infringement of health(§41), 2) disability due to infringement of health(§42), and 3) death resulting from human infringement(§44). In addition, the North Korea Compensation for Damage Act specifies the calculation of compensation for damages(§43, §51). Furthermore, South Korea widely acknowledges emotional distress damages for personal injury, whereas North Korea does not recognize emotional distress damages in principle.

수의학강좌 - 환경분쟁(소음.진동.먼지 등)으로 인한 가축피해에 미치는 영향과 최근 배상액 산정기준

  • 최근 국내의 각종 공사장부근에서 일어나는 가축에 대한 환경분쟁(소음, 진동, 먼지 등)피해를 호소하는 농가가 지속적으로 늘고 있으나, 피해 농가의 피해를 입증할 수 있는 객관적인 자료가 부족한데 따라 보고서를 작성하는 데 여간 어려웠던 적이 한, 두번이 아님에 많은 아쉬움을 가졌다. 각종 공사로 인해 가축 사육 장소인 목장(농장)내 도로개설 및 관통으로 인한 목장의 지속여부, 겨울철 수렵시기에 총성으로 인한 한우 성장지연, 육질 저하 등에 미치는 영향, 태양광 발전소가 축사 인근에 있어 사육 한우가 성장지연 등의 피해를 호소하는 농가가 있으나, 이에 대한 관련 연구자들의 많은 연구가 이뤄졌으면 한다. 그런 가운데서 우리 임상수의사들의 관련 자료나 정보를 입수하여 보다 적극적으로 대처하여 피해 축산농가들에 대한 보상에 도움을 줘야 하나, 피해 목장내 사육가축의 진단서나 소견서등 발부요청에 미온적이거나 회피하는 경우들을 적잖게 목도를 하고 실망감을 감출 수가 없었다. 진단서 등의 각 항목의 기재 내용의 누락, 여러 마리를 한 장(1두 1매 원칙)에 작성한다거나 유 사 조산시 정확한 월(일)령의 비기재, 환경분쟁과 관련된 피해사실의 누락이나 전혀 무관한 병명으로 발급하는 경우 및 수의사법 등에서 승인된 양식을 이탈하여 임의로 작성하는 등의 예를 간혹 보아왔는 터라 개선이 시급하다 하겠다. 임상 수의사들이 발급하는 진단서나 소견서 등은 어디까지 관련 전문가나 법원 등의 감정시 어디까지나 참고용으로 활용되고, 발급에 따른 제 비용은 인정될 경우에는 피해농가들에게 되돌려주며, 절대적으로 피해를 주는 일이 없다는 것을 강조해두고 싶다. 따라서 필자는 환경분쟁사건을 현지조사내지는 보고서를 작성하면서 아직도 우리 임상 수의사들은 새로운 분야에 대한 능동적인 대처가 더더욱 요구되는 시기에 수동적이거나 미온적으로 대하는 사례에 안타까움을 호소하며, 환경분쟁시 가축에 미치는 영향과 최근 새로이 제시된 배상액의 산정기준을 소개하여 도움을 주고 싶다.

  • 중국 최고인민법원은 '특허권 침해분쟁 소송사건 심리에 적용하는 법률에 관한 약간의 문제 해석'에서, 특허청구범위의 해석, 특허실시행위, 비침해항변, 침해배상액의 산정, 생산방법의 추정, 비침해확인의 소에 대하여 규정하고 있다. 이 사법해석은 2010년 1월 1일부터 시행되어 지식재산권 침해분쟁을 운영하는 기준으로서 활용되므로, 각 규정의 내용 및 의미를 제공하고자 한다.

  • The study is concerned with providing the improvement method on making a reasonable and scientific decision on the damages accrued from the bid rigging in the construction work. According to the review on the precedent studies and decision cases on the damages caused by bid rigging, the representative problems include the insufficiency of the classification system on the damage calculation method and the omission of the necessary stage in the damage determination process. First, the improved classification system on calculating the damages caused by bid rigging is presented with the application to the bid rigging in the construction work by adding the ratio factor in addition to the damage calculation parameters such as price and cost. Second, the standard procedures organized with six stages is presented as the process required for determining the damages if the indemnification for bid rigging is claimed. The study becomes the foundation for resolving the problem with the undue burden on a party and for preventing the opportunity loss by resolving a dispute early through the improvement classification system and standard procedures presented in the study.

A Study on the Legal Assessment and Cases of Damages under CISG (국제물품매매계약에 관한 UN협약(CISG)상 손해배상액 산정기준의 해석과 적용)

  • CISG article 74 establishes the general formula applicable in all cases where an aggrieved party is entitled to recover damages. It provides that damages for breach of contract comprise all losses, including loss of profits, caused by the breach, to the extent that these losses were foreseeable by the breaching party at the time the contract was concluded. An aggrieved party may claim under article 74 even if entitled to claim under article 75 or 76. The latter articles explicitly provide that an aggrieved party may recover additional damages under article 74. Articles 75 and 76 apply only in cases where the contract has been avoided. Article 75 measures damages concretely by reference to the price in a substitute transactions, while article 76 measures damages abstractly by reference to the current market price. Article 76 (1) provides that an aggrieved party may not calculate damages under article 76 if it has concluded a substitute transaction under article 75. If however, an aggrieved party concludes a substitute transaction for less than the contract quantity, both articles 75 and 76 may apply. Pursuant to article 77, damages recoverable under articles 74, 75 or 76 are reduced if it is established that the aggrieved party failed to mitigate losses. The reduction is the amount by which the loss should have been mitigated. Article 78 entitles a party to interest on the price and any other sum that is in arrears.

Regression Models for Determining the Patent Royalty Rates using Infringement Damage Awards and Inter-Partes Review Cases (손해배상액과 무효심판 판례를 이용한 특허 로열티율 산정 회귀모형)

  • This study suggested quantitative models to calculate a royalty rate as an important input factor of the relief from royalty method which has the characteristics of income approach method and market approach method that are generally used in the valuation of intangible assets. This study built a royalty rate regression model by referring to the patent infringement damages cases based on royalties, i.e., by using the royalty rates as a dependent variable and the patent indexes of the corresponding patent right as independent variables. Then, a logistic regression model was constructed by referring to inter-partes review cases of patent rights, i.e. by using not-unpatentable results as a dependent variable and the patent indexes of the corresponding patent right as independent variables. A final royalty rate was calculated by matching the royalty rate from the royalty rate regression model with a not-unpatentable probability from the logistic regression model. The suggested royalty rate was compared with the royalty rate obtained by the traditional methods to check its reliability.
