A Study on the Characteristic and Improvement Method of Private Consignment of Social Welfare Facility(Organization) (사회복지시설(기관)의 민간위탁제도 특성 및 개선방안에 관한 연구)

  • Since the introduction of local autonomy system, various specific theories and practical approaches for private commission system have been common concerns and interests of the fields practicing social welfare. In the discussion about private consignment system of social welfare facility and organization, both of private section and government have shown different opinions from various aspects such as related regulation, consignment procedure, proper period and consignment condition. According to the discussion about the consignment system of social welfare facility, the purpose of this study is as follows. The first purpose is to suggest the current status of private consignment of social welfare facility and the characteristic and issue of consignment procedure by considering domestic & overseas literatures about the characteristic of private consignment system. The second purpose is to find out the general characteristics and current statuses of consignment process and system of social welfare facilities (organizations) located in Gyeonggi-do area. The third purpose is to draw the current status and general problem of field consignment system and suggest the practical alternative plan and improvement method of private consignment system of social welfare facility in the future. The result of researching private consignment process by head and manager of social welfare facility (organization), private consignment agreement and its conclusion process and current consignment system improvement method revealed that the number of reconsigned (over 1~3 times) facilities was more than that of initially consigned facilities and senior welfare facility and general social welfare center were most frequent in private consignment organization. In addition, as an improvement method of current private consignment process, the consideration on each organization and standard was required for new consignment and reconsignment and the problem of fairness and objectiveness was indicated when deliberation committee was organized in private consignment process. Besides them, it was found that consignment period shall be adjusted on the basis of facility type and business characteristic and the problems such as worker's succession, worker's transfer and service disconnection were suggested when consignment organization was changed. For conclusion and suggestion, the study suggested the establishment of common standard about private consignment, alternative plan of private consignment process issue and improvement method of consignment period issue.

A Study On The Exploring Alternatives In After-School Program According To The Application Of Contract Law (방과후학교에서 계약법 적용에 따른 대안 모색)

  • This research aimed at investigating policy change process of after school contracting out and suggesting future alternative. Also, this research conducted a literature search for the research data related to policy and related regulations. As the result of investigation, the Ministry of Education established management plan for after school, however there have been changes in policy, e.g. contracting out was executed from 2004 to 2008 upon autonomy of unit school through school steering committee deliberation(consultation), while standardized procedure was conducted, which was suggested in 'After school operation guideline', produced in cooperation between the Ministry of Education and municipal ministry of education from 2008 to 2015, while since 2016, contract law should be applied when after school contracting out is adopted. Policy change since 2016 is based on the legal necessity that contract law should be followed as the contract size of after school contracting out has become larger along with necessity of clarity of after school contracting out. Nevertheless, there's a worry that quality of after school education could be degraded due to lowest price bidding. The government suggested an alternative to prevent excessive price competition by paying a regular rate of basic price as personnel expenses, however this research suggested a plan to enact an ordinance in regard of specialty of after school educational activities and cities and provinces as the fundamental solution plan.

An Institutional Approach for Application of the Contracting-out in City Parks - Focused on the Case Study of City Park Management of Seongnam City - (도시공원의 민간위탁 적용을 위한 제도적 방안 - 성남시 도시공원 운영사례를 중심으로 -)

  • One of the most fundamental jobs of contemporary government is to look into various ways of providing its citizens with the best service work. This study aims to establish a procedure through which to consign the management of city parks to private companies, thus inviting participation and satisfaction on the part of citizens. In particular, this procedure includes creating a system of selecting private managing companies, for instance, specifying standards of selection and assembling selection committees. The results of this study can be summarized as follows. First, city parks can be managed better by private companies than by local governments in terms of cost cuts, personnel training, business efficiency, and know-how accumulation. The legal background for this is found in central and local legal articles. Second, it is recommended that the selection committee be composed of 6 to 9 members, both insiders and outsiders. In addition to selecting private managing companies for contracting-out, the committee should under take the role of consulting on how to perform and revise selecting standards, so that they can continue to improve these procedures. Third, the decision on private management should be noticed in advance and be made based on standards considering each local government's condition. These standards should consider the aspects of the public good, cost saving, quality of service, managing supervision, and citizen participation. The committee's assessment takes into account both the quality and the quantity of the standards. Fourth, the contracting-out for city park management should follow the order of: announcing consignment and receiving applicants, organizing selection committees and assessing applications, selecting and contracting, midterm evaluation, and re-announcement and re-consignment. To run city parks through the contracting-out is expected to increase the number of park visitors. Additionally, private consignment will involve a participation of diverse citizenship, thus playing an important role in city parks' building of a green-culture community.

The Application of Regional Innovation and Cooperative Governance Perspective for Village Building-Related Ordinances: Focusing on Relevant Ordinances of Chungcheongnam-Do Area Where Contract-Out Type Intermediary Support Organizations are Established and Operated (마을 만들기 관련 조례에 대한 지역혁신 및 협력적 거버넌스 관점의 적용:충남지역 민간위탁형 기반 중간지원조직 설치・운영 지역의 관련 조례를 대상으로)

  • The subject of this study is whether the relevant ordinances of Chungcheongnam-do's five local governments, operating intermediary support organizations for contracted-out community building, comply with the regional innovation and cooperative governance-based perspective. The examination results are summarized as follows. About the normative system: first, village building does not present that it is a participation- and cooperation-based collective activity of various related actors; second, the cooperative governance-based implementation system was not presented as a key term; third, "numerous relevant subjects' participation" and "democratic decision-making and cooperative promotion" are not presented as basic principles; fourth, the subjects are limited to residents and the administration, and only their responsibilities are presented. About the effectiveness system: first, the establishment of a master plan, a primary means, and the establishment of an in-charge department and collaboration system in the administration are presented as optional provisions; second, the nature of the relevant committees and intermediary support organizations is not presented as "public-private cooperation-based system"; third, the area of the function and authority of the relevant committees is limited to review and consultation. Fourth, the related information about the intermediary support organization structure and system, the establishment and operation of the secretariat, and the practical operation of the center is not presented. In sum, to make related ordinances become institutional grounds with stronger effectiveness, reconstructing them by strictly applying the perspectives of regional innovation and cooperative governance is necessary.
