미국의 사이버보안 역량 강화를 위한 연방법률 발전 현황 분석

  • 미국의 사이버보안 관련 법률은 1987년 컴퓨터보안법이 제정되는 시점이 본격적인 시작이라고 할 수 있다. 1990년대에는 컴퓨터 및 인터넷의 발전으로 정보보안의 중요성이 대두되었으며 법률은 데이터 보호 및 프라이버시 중심으로 제정되었다. 2002년 국토안보부 설립을 위한 국토안보법의 제정을 통해 본격적인 국가 사이버보안 정책을 시작할 수 있는 토대를 마련하였다. 전자정부법(2002) 부속법률인 연방정보보안관리법(FISMA 2002)은 연방기관들의 사이버보안 관련 임무를 구체화하여 국가차원의 사이버위협 대응을 체계적으로 할 수 있었다. 2014년 연방정보현대화법(FISMA 2014)으로 개정되어 지난 10여년간의 시행착오를 바로잡는 노력을 진행하고 있다. 2015년 사이버보안법(Cybersecurity Act 2015), 2018년 사이버보안 및 기반구조보안기관법(CISA 2018)을 제정하여 국가 사이버보안 체계를 획기적으로 발전한 미국의 사이버보안 법률의 추진 현황을 살펴봄으로써 우리나라의 법체계의 발전방향에 대해 고찰해 보도록 한다.

  • As the 'hyper-connected society' has emerged through the 'Fourth Industrial Revolution, public interests as well as social dangers have increased. Above all, the risk of infringement of information, including confidential personal information, is dramatically increasing. As the hyper-connected society has been realized, even if only one of the internet devices is hacked, there would be a danger that the ripple effect of such a hacking spreads to the whole network. Therefore, the necessity and importance of information security, including cybersecurity, has been increasing. In other words, the stability of cyberspace and internet space is becoming more important. As a result, the Korean government is seeking to build a legal system related to information security, which would be able to cope with the information infringement problem in the hyper-connected society. However, it seems that the government is still struggling with the direction of building such a legal system. In this context, a comparative review examining the legal systems of advanced foreign countries will provide meaningful implications as to what kinds of legal policies we should devise and implement for information security. In particular, the U.S. legislative act that actively responds to the cybersecurity violations is worthy of reference. For this reason, this article systematically analyzes the current status of the U.S. cybersecurity laws. Especially, this article focuses on the "Cybersecurity Information Sharing Act of 2015"(hereinafter "CISA"), that was recently enacted by the U.S. congress. The CISA prescribes the systemic and detailed information-sharing between national and private entities. The CISA, that actively promotes information-sharing, is full of suggestions for us, in that information-sharing is an effective way to properly realize information security in today's hyper-connected society.

A Comparative Study on Information Security Management Activity of Public Sector in USA & Korea (미국과 우리나라의 정보보안관리 활동 비교연구)

  • USA is strengthening the information sanity by managing federal agency's information and information system systematically. For this purpose, US government put the Federal Information Security Management Act into the E-Government Act of 2002. According to the FISMA, it is required to have information security management plan for ail federal agencies. In addition that, Inspector Generals of these agencies should assess the status of their agency and report the result to the office of Management and Budget. Collecting all the reports from each agency, OMB should report to GAO on general status of information security of federal agency. It is helpful to provoke the information security as a necessary activity to realize the E-government. Comparing these efforts with our system will give us good implications to get more idea to secure our information system.

A Study on the Laws and Regulations in Korea through the Analysis of Cybersecurity Workforce Developing Laws and Regulations in U.S. (미국 사이버보안 인력 양성 법·규정 분석을 통한 국내 법·규정 개선 방안 연구)

  • In 1987, Computer Security Act was enacted, requiring computer security awareness and practical training for federal workforce. This is the beginning of US development of federal cybersecurity workforce. It has been strengthening the development of federal cybersecurity workforce policy by establishing OPM regulations and OMB circulation in cases where it is difficult to define by law. Through GISRA 2000 and FISMA 2002, which has been improved, it played a central role for development of federal cybersecurity workforce for more than 10 years. Since then, FISMA 2014 has been enacted as a necessity for supplementing technology and policy. In 2014, the importance of cyber security personnel in US federal agencies has been increased even more, by enacting a single law on cybersecurity workforce twice. We will review the current state of Korea's development of cybersecurity workforce by reviewing and analyzing the development and federal cybersecurity workforce in the United States.

  • As ICT is becoming a major social infrastructure, the need to strengthen cyber capabilities are emerging. In the major advanced countries including the United States, has a continuing interest in strengthening cyber capabilities and has studied in enhancements of cyber capabilities. The cyber capability assessment is necessary in order to determine the current level of the country, establish policy directions and legislations. The selection of criteria has very important meaning to suggest future policy direction as well as an objective assessment of cybersecurity capabilities. But there are variable criteria for national cyber capabilities assessment such as strategy, legislation, technology, society and culture, and human resources. In this paper we perform the analysis of criteria for the other country's cybersecurity assessments including the U.S. and Europe. And we proposed the criteria for the national cybersecurity assessment reflecting the our country's characteristics.

The Normative Meaning of Cybersecurity Information Sharing Act(CISA) of 2015 (미국 사이버안보 정보공유법(CISA)의 규범적 의의)

  • The Cybersecurity Information Sharing Act(CISA) of 2015, enacted in December 2015, is one of the greatest achievements of cybersecurity legislation in the United States. The promotion of cybersecurity information sharing is one of the tasks to improve cybersecurity governance in Korea. So it is an important issue to be addressed in cybersecurity legislation in Korea in the near future. CISA has many implications for cybersecurity legislation in Korea. Nevertheless, it is difficult to find preceding research that explain the content of CISA and study its normative meaning in Korea. Therefore, in this paper, the contents of the CISA is identified and its normative meaning and implication is found in five categories: definition of terms, establishment of information sharing procedures and conditions, promotion of voluntary information sharing by the private sector, checks on the executive branch and report to the Congress, and other matters. CISA facilitates information sharing based on willingness, while eliminating the side effects that may arise in the information sharing process. It is necessary to appropriately apply the good points of CISA to the cybersecurity legal system in Korea.

  • Since the September 11, 2001, the United States has shift their national security policy for homeland from preventing or/and reducing foreign threats to ensuring domestic security. We learned from recent incident, 1.25 Internet Disaster, that it is urgent to establish cyber security policy for our nation. In this paper; therefore, I analyze the US homeland security policy, the Homeland Security Act of 2002 establishment, and cyber security-related part in this act.

A Study on Establishment of Cyber Threat Information Sharing System Focusing on U.S. Case (사이버 위협정보 공유체계 구축방안에 관한 연구 - 미국 사례를 중심으로 -)

  • Today, information sharing is recognized as a means to effectively prevent cyber attacks, which are becoming more intelligent and advanced, so that many countries such as U.S., EU, UK, Japan, etc. are establishing cyber threat information sharing system at national level. In particular, the United States has enacted the "Cyber Threat Information Sharing Act (CISA)" in December 2015, and has been promoting the establishment of a legal and institutional basis for sharing threat information and the implementation of the system. Korea is sharing cyber threat information in public and private sectors mainly through the National Cyber Security Center(NCSC) and the Korea Internet & Security Agency(KISA). In addition, Korean government is attempting to strengthen and make legal basis for unified cyber threat information sharing system through establishing policies. However, there are also concerns about issues such as leakage of sensitive information of companies or individuals including personal identifiable information that may produced during the cyber threat information sharing process, reliability and efficiency issues of the main agents who gather and manage information. In this paper, we try to derive improvement plans and implications by comparing and analyzing cyber threat information sharing status between U.S. and Korea.

  • In March 2017, the State of New York became the first state to implement regulation specific to cybersecurity for financial institutions. Unlike previous regulations regarding information security, it has set a minimum requirements to establish cybersecurity program based on risk assessment results, protect Nonpublic Information, designate of CISO, and report to regulatory entity. This paper presents a need for a new cybersecurity policy in Korea by examining newly adopted cybersecurity regulation in the United States. Finally, the paper identify policy suggestions based on the United States's approach as they have successfully implemented the program.

  • 7.7 DDoS공격과 3.4DDoS공격, NH금융전산망마비사건, 네이트 해킹 사건 등은 해킹이 개인적 문제를 지나서, 사회와 국가적인 이슈로 부상되고 있다. 중국은 대학에서 해킹 기법을 가르치고, 인민해방군에 국가일꾼이란 소명의식을 주고 있다. 북한은 지도자의 지시로 노동당과 북한군에서 사이버부대를 직접 교육 운영하고 있다. 미국은 외국으로부터 사이버 공격을 당할 경우 이를 '전쟁 행위'로 간주해 미사일 등으로 대응한다는 방침을 세웠다. 이와 같이 해킹은 국가사이버보안 정책에서 다루어져야 할 필요성이 있다. 본 연구에서는 해커의 변천, 해킹기술과 방법, 해킹 툴, 그리고 해킹 사례를 살펴본다. 또한 해킹 동향 분석에서 해킹기술 동향 분석, 해커(사람) 동향 분석, 해킹 지역(국가) 동향 분석을 통하여 해킹 인력의 조직화, 해킹 기술의 집적화, 해킹 조직의 집중화 연구를 한다. 그리고 국가사이버보안정책에서 해킹에 대한 '국자사이버보안법 시행령' 제정, 국가사이버보안 자문회의, 국가사이버보안 협력회의, 해킹 프로세스 전략, 해킹 전략 추진 방법론, 사이버협력국, 해킹 작전국, 인력 양성국, 해킹 기술국에 관한 저자의 개인 의견을 제안한다.
