International Hull Clauses(IHC(2003)) which have replaced the old system, Institute Time Clauses, Hull(ITCH), used more than 100 years in the shipping industry that did not fit the reality of the market and customs was announced in 01/11/2003 and was intended to supplement the existing issues to reflect the terms that had been used. IHC(2003) was composed of systematical and logical phrases to minimize the conflict which happened between the insured and the insurer after the incident. But IHC(2003) is being ignored by both the insured and the insurer in the shipping industry due to the differences in both positions. In addition, the studies about IHC(2003) in local academics are very low and many companies in the shipping industry are using both systems, IHC(2003) and ITCH so the usage of IHC(2003) is not so activated. Thus, this study will examines the main features and the compositions of IHC(2003) and compare IHC(2003) with ITCH(1983) in some provisions in both systems and then derive some similarities from the both systems and finally would suggest the necessity and validity of active use of IHC(2003).
Incoterms is a standard transaction terms and conditions which is established to provide goods delivery, cost and risks between the seller and the buyer as a principle concerned. Incoterms is made of international rules about regular uses of transaction terms and condition. It removes uncertainty of misunderstanding and applying rules, commercial customs and etc, between nations. Incoterms does not have an enforcement like an unified rules or an agreements established between different nations. Therefore, it is just considered as a standard formal terms and conditions from International Chamber of Commerce. For those reasons, validity of Incoterms applies only when parties of contract come to an agreement not by officially adopted or applied by law in each nation. Incoterms 2010 contains specific and clear articles which is fixed version of incoterms 2000, it has insufficient points on insurance contract article. Though, insurance contract belongs to sales contract, it sustains independence itself. It is difficult to sustain perfection until establishment of insurance contract and expiration by fixing the articles. As a result, it is necessary for sellers and buyers take a full responsibility of making complete insurance contract. This paper is written for those reasons in this filed.
For a contract of insurance to be valid, the insured needs to have an insurable interest. This means that someone taking out insurance must stand to gain a benefit from the preservation of the subject matter of the insurance or to suffer a disadvantage should it be lost. Although the principle is simple, the detail is difficult. English Law Commission proposed some changes to provide certainty on the rule of insurable interest in LCCP 201. This article is, therefore, designed to examine the proposals for reforming trends in English insurance contract law. The proposals on Law Commission in summarized as following. First, LC proposed to retain the requirement for insurable interest because it was thought to fulfil four useful functions. Secondly, LC proposes to repeal the Marine Insurance Act 1788 and the Marine Insurance (Gambling Policies) Act 1909 to confirm that the requirement of insurable interest applies to all forms of insurance. Thirdly, LC proposes to retain the provisions on insurable interest in the Marine Insurance Act 1906. Finally, LC proposes to define insurable interest and thinks that full definition of insurable interest should remain flexible.
On payment of the insurance money the insurer is entitled to be subrogated to all right and remedies of the assured in respect of the interest insured in so far as he has indemnified the insured. The purpose of subrogation is to prevent the assured from recovering more than once for the same loss, e.g. where goods are lost owing to a collision, the assured cannot claim the insurance money from the insurer and then sue the owners of the ship that negligently caused the collision. Under the doctrine of subrogation the right to sue owners of the negligent ship passes from the assured to the insurer on payment of the insurance money. The insurer is subrogated to the assured 'rights against the carrier under the contract of carriage. To defeat the cargo underwriters' subrogation righters, the carriers inserted in their B/L a clause allowing the carriers to have the "benefit of the shipper's insurance. But, in the Hague Rules, Hamburg Rules, Rotterdam Rules, its makes void any clause that assigns a benefit of insurance of the goods in favour of the carrier. In practice the insurer asks the assured to sign a letter of subrogation and retains the documents in order to prosecute the rights subrogated to him.
전자무역 해외시장조사, 계약, 신용조사, 거래알선, 결제, 보험, 운송 등 무역거래 전반의 프로세스를 통합하여 구매효율성을 높이고, 시간단축 등을 통해 전자무역 업무의 효율성 및 생산성을 높일 수 있는 장점을 가지고 있다. 본 연구는 전자무역업무의 몰입 요인인 무역업체 종업원이 해외시장조사업무의 몰입, 상역업무의 몰입, e-LC업무의 몰임, 통관업무의 몰입, e-B/L 및 Logistics업무의 몰입, 결제 및 e-Nego업무의 몰입 등을 개발하여, 전자무역업무의 성과에 미치는 영향을 분석하고 있다. 분석결과, "해외시장 조사업무의 몰입", "e-LC업무의 몰입", "통관업무의 몰입"과 "e-B/L 및 Logistic 업무의 몰입" 그리고 "결제 및 e-Nego업무의 몰입"의 요인들은 전자무역 성과에 유의한 영향을 미치고 있다. 반면 "상역업무의 몰입"은 전자무역 성과에 유의한 영향을 미치고 있지 않다는 분석 결과가 나왔다. 본 연구에서 나타난 바와 같이 전자무역은 무역업체에게 유효한 효과가 있기 때문에 글로벌 전자무역과 시스템 개발에 노력해야 하며, 각 관련부처간의 시스템 연계의 통일화를 기해야 할 것이다.
This paper draws implications on the ship finance of the Korean ECAs for shipbuilding industry from the perspective of WTO ASCM through studying the trade disputes on export credits. In consideration of the underwriting practice on the case-by-case basis, the ECAs' law regimes and their ship finance programs as such would be judged not conferring a benefit. The ship finance of international commercial banks could be treated as a market benchmark for the purpose of determining the existence of benefit in the ECA ship finance. The ECAs share securities with international commercial banks for the same exposure to the risks in a syndicate. Therefore, WTO DSB would rule that the ECA ship finance confers no benefit for individual transactions. The items (j) and (k-1) of ASCM Annex I are not allowed to interpret a contrario.
전자무역은 인터넷, EDI 등 디지털 수단을 이용하여 국가간 상품과 서비스를 매매하는 상거래 활동 및 이를 지원하는 활동을 말한다. 특히, 무역의 전부 또는 일부가 컴퓨터 등 정보처리 능력을 가진 장치와 정보통신망을 이용하여 이루어지는 거래를 말한다. 무역업무는 무역관계당사자 즉, 은행, 보험회사, 운송회사, 선박회사, 세관, 검사소, 조합 협회 등과 사이에서 이루어지는 거래이기 때문에 복잡한 업무의 가치체인을 가지고 있다. 따라서 1건의 무역업무의 실현시키기 위해서는 다양하고 복잡한 가치체인 속에서 업무의 영속성을 가지고 있어야 한다. 현재 전자무역은 전통적인 무역장벽의 축소 및 제거에서부터 복잡한 무역절차에 의해서 초래되는 보이지 않는 무역장벽을 제거 또는 축소하는 방향으로 전개되고 있으며, 절약되는 시간과 비용(직접비용과 간접비용)을 국제경쟁력을 높이는데 활용하자는 데에 관심이 모아지고 있다. 궁극적으로 글로벌 기업들은 다양한 수단 즉, 인터넷, 모바일 등을 이용하여 새로운 글로벌 수요를 창출하기 위한 방법을 모색하고 있다.
한국과 중국 모두 세계시장에서 재화무역에서는 수출경쟁력이 있고 서비스무역에서는 경쟁력이 없으나 양국은 서비스무역 비중이 확대되고 있고 FTA논의를 통해 양국간 서비스무역은 더욱더 확대될 전망이다. 이런 배경 하에서 본 논문은 한 중간 서비스산업의 부문별 수출경쟁력을 측정하는데 그 목적이 있다. IMF의 BOP 통계수치를 이용하여 한 중 양국의 서비스 무역에 대한 수출경쟁력을 측정하기 위해 무역특화지수(TSI), 수정현시비교우위(RSCA)지수와 국제시장점유율(IMS) 및 수출증가율을 사용해서 서비스무역의 국제경쟁력을 부문별로 비교분석하였다. 그 결과 한국은 운송서비스, 금융서비스, 특허권 등 사용료, 개인 문화 오락 부문 등 4개 부문에서, 중국은 여행서비스, 통신서비스, 보험, 컴퓨터 및 정보, 기타 사업서비스 부문 등 5개 부문에서 국제경쟁력을 가지는 것으로 평가되었다. 건설부문은 비교우위를 판정할 수 없었다. 그러나 중국이 비교우위를 가지고 있는 통신서비스와 컴퓨터 및 정보서비스부문은 비교우위격차가 축소되어 서비스무역의 국제경쟁력 강화노력이 이루어지면 중국보다 경쟁력에서 우위에 설 수 있다.
본 연구는 스마트 무역계약의 체계적 문헌고찰을 통해 스마트계약과 블록체인 기술을 활용한 무역계약의 디지털화와 자동화에 관한 연구 동향과 이론적 배경을 파악하고, 기술적 측면과 법적 측면에서의 도전 과제와 해결 방안을 분석하였다. 스마트 무역계약은 블록체인을 기반으로 한 자동화된 계약 시스템의 개념을 무역과 관련된 거래에 적용한 것이다. 기술적 측면에서는 스마트계약 플랫폼의 개발, 블록체인 네트워크의 확장성과 성능 개선, 보안 및 개인 정보 보호 등을 다루었고, 법적 측면에서는 스마트계약의 법적 구속력, 계약 조건의 자동 이행과 이의 실현 가능성, 계약 당사자의 책임과 의무 등을 다루었다. 스마트 무역계약은 국제무역, 공급망 관리, 금융, 보험, 에너지 등 다양한 산업 분야에서 적용 사례가 발견되고 있으며, 이를 통해 무역금융의 용이성과 공급망의 효율성 향상, 비즈니스 모델 혁신에 이바지할 수 있는 것으로 확인되었다. 그러나 스마트 무역계약의 한계점으로는 법적 규제와의 상호작용 문제, 기술적 측면에서의 도전 과제 등이 있으며, 후속 연구에서는 실증 연구, 비즈니스 모델 혁신, 법적 쟁점 해결, 보안과 개인 정보 보호, 표준화와 협력, 사용자 경험 연구 등 다양한 측면을 고려해야 할 것으로 판단된다.
