미국에서는 보잉사와 맥도널 더글러스사가 합병하여 세계 최대의 초 맘모스 항공기 제작업체가 탄생한데 이어 여타의 항공기 메이커들도 속속 합병 또는 매수되어 독과점 체제가 정비되고 있다. 이에 대항하듯 유럽세인 영국, 프랑스 독일등의 합작기업인 에어버스사는 이러한 미국의 거대 독과점 체제에 맞서 세계시장 절반 점유 목표를 내걸고 정면 대결할 뜻을 밝혀 세계의 여객기 시장은 보잉과 에어버스의 각축으로 집약되게 되었다.

독일의 독점금지관련 법제는 크게 기업의 불공정 경쟁행위를 규제하기 위하여 1909년에 제정된 부정경쟁방지법(UWG:Gesetz gegenden Unlauteren Wettbewerb, AUC:Act against Unfair Competition)과 제 2차대전 후 금융자본에 의한 기업의 카르텔과 콘체른의 성행으로 독과점의 폐해가 심해지자 독과점 규제의 실효성을 위하여 1957년 제정된 경쟁제한금지법(GWB:Gesetz gegen Wettbewerbs Beschrankungn, ARC: Act against Restraints of Competition)이다. 부정경쟁방지법은 부당한 거래거절이나 부당한 거래방해 행위, 부당한 차별적 취급 및 기만적인 광고 등 기업의 영업활동과 관련한 불공정경쟁행위 규제가 주된 목적으로서 민사절차에 의한 손해배상소송 등에서 활용되고 있으며 경쟁제한금지법과 중복되는 분야(부당한 거래거절 등)에 대하여는 행정벌의 부과를 규정하고 있어 경쟁제한금지법과 상호보완적 관계를 유지하고 있다. 따라서 본고에서는 독일의 경쟁제한금지법의 내용에 대해서만 살펴보기로 한다.

This study empirically analyzes the relationship between market structure and R&D activities. Especially, the outcome of R&D activities could be imitated or plagiarized by nearby competitors before it is protected legally through patenting, it would work as a club good and its market structure need to be defined at the geographic level of city, county or ward rather than the whole nation. According to the regression results of this study using Survey on Technology Statistics of Small- and Medium-Sized Firms, individual firms' R&D investment is more active when market structure of area(city, county, or ward)-industry(two-digit industry) is monopolistic or oligopolistic rather than competitive. However, as the variable representing market structure is redefined over a geographic scope of 16 metropolitan areas or provinces, 6 regions, or the whole nation, the relationship between market structure and R&D activities seems to become weak. Moreover, when the R&D expenditure is divided by its source, more active R&D spending in a less competitive market is observed as long as it is procured by internal fund of the firm in question.

The purpose of this paper is to start off a debate in the current situation in which there exists two different logics about a newspaper company expanding their business field to the broadcasting market. In order to analyze the implications of the phenomenon, three points are raised and analyzed. First, Chosun-Ilbo, Jungang-Ilbo and Donga-Ilbo, who had a permission to get into the broadcasting arena, did not make their logic based on the fact while deriving the public opinion to be optimistic. Second, they strictly held their frames in order to support their logics which were an overall deregulation, to stimulate the economy and to create jobs without introducing various perspectives. Third, broadcasting of three major newspaper companies could monopolize the public sphere rather than contributing to the diversity of public opinions against three existing broadcasting companies KBS, MBC, SBS.

민간용 여객기 제작사로 미국에서 쌍벽을 이루던 맥도널 더글러스사가 보잉사에 합병되어 작년 8월부터 새 보잉사가 발족하여 미국에서 민간여객기 제작은 드디어 보잉사에 의해 독점되었다. 한편 유럽에서는 지금까지 에어버스사의 경쟁력을 키우기 위해 여러가지를 보완하여 명실공히 유럽의 유일한 여객기 및 수송기 제작사로 자리를 굳혔다. 따라서 100석급 이상의 여객기 제작사는 세계적으로 미국의 보잉사와 유럽의 에어버스사라는 양체제로 집약되었다.

미국에서의 항공기 운항업계에 대한 규제완화 여파로 우리나라 등 각국에도 규제 완화의 바람이 불고 있다. 항공기 제조업계는 기업의 통합과 구조 조정이 급진전하여 소수 정예의 과점 상황으로 나아가는가 하면 운항업계에서는 대규모 회사에 의한 독과점 체제가 무너지고 있다. 이런 배경 아래 항공기 사고에 대해서도 사고 조사가 제3자에 의하여 공정히 행해질 것을 바라는 소리가 높다.
