A Study on the Current Issues and Improvements for Document Delivery Services based on the Information Service Networks: Focus on Copyright Issues (국내 정보서비스 협력체를 통한 원문복사서비스 현황과 개선 방안 연구: 저작권 문제를 중심으로)

  • This study analyzes the copyright problems of document delivery services based on interlibrary loan which are operated by KERIS and KISTI according to the agreements with KORRA. As a result of the study, we found that there are limitations of the libraries and copyright works to implement the document delivery services. Also, the electronic document delivery is the only between librarians and there is no provisions in the agreements for individual users who are not affiliated to libraries. This study suggests introduction of the ground provision for the interlibrary loan in the Copyright Act of Korea and development of authoritative guideline for details of document delivery services. Also, the study suggests that end users to request documents could be print out it but the library have to install systems to avoid copyright infringement. Finally, the study proposes the copyright fee based model for the document delivery services for individual users.

  • Since the England's Parliament revised the British copyright law and enacted the first copyright exception specifically for libraries (user or service) in 1956, copyright exceptions applicable to libraries have been an important part of world copyright laws through the last few decades. Copyright exceptions for libraries are a critical legal tool to preserve intellectual and cultural heritage, promote equitable access to knowledge and information to the public, and to support learning and research. Based on these reasons, this study analyzed and compared the current state of copyright structure and limitations or exceptions for library in six major countries(United States, United Kingdom, Germany, France, Japan, and Republic of Korea).

A Study on Limitations on the Right of Reproduction and Right of Communication to the Public in Digital Networked Environment (디지털 복제권 및 전송권 제한에 관한 연구)

  • It has been criticized that the right of reproduction and right of communication to the public in the Copyrigt Act of Korea, which was amended in the year of 2000 in line with new environments around digital networks, limited the limitation to author’s property right in private use and library exemption too much. Solving the problem above, this study analyzes comparatively WCT, Amended Proposal for a Directive on Copyright and Related Rights in the Information Society, Copyright Law of the United States of America, Copyright Amendment(Digital Agenda), and Copyright Act of Korea. Based on the results from related case analyses and a survey on how stakeholders view copyright issue, in addition, this study presents a reasonable way of limiting rights of reproduction and rights of communication to the public.

A Study on the Legitimacy on the Copyright-Using Charge Regulations for the Performing Cinematographic Works in Public Libraries (공공도서관의 영상저작물 공연에 대한 저작권료 징수 규정의 타당성 고찰)

  • This study analyzed the legitimacy issues of the current regulation for the copyright-using charge and the plans to revise the regulation for the performing the cinematographic works in the public libraries. Also, this study investigated the current situation of the performing the cinematographic works and the size of auditoriums in the 84 public libraries in Gyeonggi province with information on the library websites from February 2012 to January 2013. As a result, this study suggested that yearly charging for the performing the cinematographic works to the less than 6 months after publishing will be suitable than the current monthly charging. Also, this study suggested that the copyright agency for cinematographic works should increase the number of copyright works received in trust.

  • The study aims to discuss on legal prospects of digital collections' fair use through an analysis of treaties and legislations domestic and international. Based on analysis of leading researches and literature, it discusses legal principles of fair use and defines digital collections' concept and types. For understanding the actual legal system on fair use, limitations and exceptions of copyrights which are presented in treaties, such as 'Berne Convention for the Protection of Literary and Artistic Works' and'Copyright Convention', each nation's laws, and judicial precedents. Especially, a legal dispute between 'Technische $Universit{\ddot{a}}t$ Darmstadt' and Eugen Ulmer KG, which debates on library's rights for digitizing their collections without the rightholder's permission, is analyzed. As a result, this study analyzes its implications for the improvement of the existing copyright system in Korea.

Legal Review and Copyright Clearing Methods for Document Delivery Service of Foreign Copyrighted Works (해외 저작물의 원문복사서비스를 위한 법적 검토 및 권리처리 유형)

  • Based upon the provision of limitation of copyrights, libraries may provide the document delivery service which supplies copies of journal articles and book chapters owned at other libraries by request of users. However, more proactive information service is required as more users want to use the digital delivery of documents published overseas. This study reviews copyright law of Korea and international conventions related to the document delivery service. It then examines foreign cases to see how overseas information centers clear copyrights. Finally this study suggests that copyright clearance methods be adopted to make a proactive information service. Through those methods, a new information service model may be planned, which meets various information needs while protecting copyright.

  • The study has Proceeded through examining and analyzing related laws and articles on library exemption relating to reproduction and transmission in digital environment. First of all, the study investigates and analyzes in detail the changes and characteristics of the regulation of library exemption in WCT, EU, U.S., Japan, and Australia. After analyzing of the article 28 in current Copyright Act and amended proposal for Copyright Act in Korea, it found the regulation to be inadequate. As a result of the legal analysis, this paper is proposing a revised plan of the article 28 in the Copyright Act of Korea.

  • The ownership of scholarly communication, i.e. copyright is very important to solve the problem of access to many academic journals in network environment. The purpose of this article is to give a conceptual model for the open access based scholarly communication. The main point of this model is for the authors of research paper to retain copyright on their works and to license the work whenever it is reproduced or redistributed for non-profit use with academic purpose. And library have to construct full text journal databases under this open access license.

  • The digital copying and digital transmission are rapidily Increasing with the innovation of information technology and the development of networking technology. But It Is Inevitable to limit copyright for the public benefit and cultural development In the digital environment in like manner with the analog environment. First, this study examinated the international trends and legulations relating to the copyright limitations In the U.S. and Japan for the fair use. Second, it dealed with the problems of the digital copying relating to the temporary storage In RAM and screen display that are recently becoming international issues. Third, it concretely explored and analyzed the problems according to the application of the fall use of the private copying, the library copying, and the copying for the purpose of school education in the network environment. In conclusion, to solve these problems that Is occurred from legulations In the analog environment Is needed the revision of the existing copyright law in Korea. Finally, this study suggested 'the copyright collecive management system' and 'the private copying levy system' as the systemic devices to control the digital private copying.

Analysis of Copyright Cases on Archives in National Archives of Korea(NAK) (국가기록원의 소장기록물 저작권 요청 사례 분석)

  • The National Archives of Korea(NAK) has arranged and operated 'Guidelines on Operating Copyright for Archives' and 'Regulations on Operating Reference Room' to protect the copyright for archives. However, the Guidelines and the Regulations only provide application to the Copyright Act and principles on internal managing copyright without presenting copyright issues for each type of archives. Therefore, additional detailed guidelines have to be arranged for the users to access to copyright issues easily by presenting them the standards of judgement or principles on copyright issues for each type of the archives to facilitate the use of archives collected already. We also need to define the details on Copyright Act and Moral Rights Act to collect archives. This study is an prior analysis for that purpose. Lively discussion and way of operation in an aspect of the copyright in relation to private records should be sought in the future.
