A study of factors affecting citation of patents: Focusing on US automotive patents (특허의 피인용에 영향을 끼치는 요인에 대한 연구: 미국 자동차 특허를 중심으로)

  • The number of citations in a patent is one of the indicators of the qualitative value of a patent. In this study, negative binomial regression model analysis was performed focusing on 47,354 US patents of 14 global top automotive makers in order to examine the major factors affecting the number of patent citations. As a result of the review, it was found that, elapsed years since filing, the number of patent claims, the number of claim letters, the number of inventors, the number of patent family countries, and the number of patent families, as well as IPC diversity, had a positive and significant effect on the number of citations. The results of this study are expected to provide a basic basis for considering the IPC diversity index together in analyzing and evaluating future patents and establishing strategies for creating excellent patents.

The Determining Effects of the Backward Citations on the Attributes of Patent Quality : Using the Korean Patent Citations (특허의 질적 특성에 특허인용이 미치는 효과 분석 : 한국 특허의 전후방 특허인용관계를 중심으로)

  • This paper aims to contribute to estimating the value of a patent by explaining the unobservable attributes of patent quality using observable patent citation indices. The paper first constructs patent citation data and identifies firm, university, and research institute among assignees, and then tries to explain attributes of patent quality using backward citation indices. Backward citation indices carrying information about technological sources which a given patent is based on turn out to be good predictors of forward citation indices carrying information about attributes of patent quality. Finding the functional relationships between attributes of patent quality and backward citations will lead to the improved estimation and prediction of patent value. It is found out that backward citation indices are strongly correlated the technological diversity of a patent. The paper also suggests that with whom an organization chooses to collaborate affects the attributes of patent quality.

Self-Disclosure and Confidential Responsibility of Professor Regarding Employee Invention (직무발명에 대한 교수의 자기 공개와 비밀유지 의무에 관한 연구)

  • A professor is an employed as a member of a college, and his invention is transferred to the Industry-Academic Cooperation Foundation (IACF). A professor often reveals his inventions in a thesis or at a symposium before the IACF applies for a patent. Such self-disclosure could be in violation of the confidential responsibility. This study analyzes the number of patent invalidation trials as well as self-revealed patent applications raised in connection with the confidential responsibility. This study also scrutinizes cases to figure out whether the confidential responsibility was breached depending on the time of the self-disclosure both before and after the succession of an invention. In addition, side effects that could accompany self-disclosure are investigated. In the case of the self-disclosure by the professor, an invention to which the college belongs fails to secure patent right or it is hard to obtain comprehensive right. Even if rights were secured, it could be invalidated. Furthermore, they could infringe the confidential responsibility of employees under the Invention Promotion Act, and also could contravene the confidential responsibility specified by the Enforcement Decree of the unfair Competition Prevention if the succession of the invention is confirmed. Therefore, colleges should manage self-disclosure of employee invention and take appropriate action.

  • Recently patented rights affect the competitive power of each country. Specially the situation of that country will be superiority if one country has lots of basic invention patents in advanced technology. In the near future, research results in universities or research institutes should be involved with patent application so that the investment of research funds improves our technology. Alloy is used to adjust magnetic characteristic in invention for magnetic recording medium. In this case there must be cautious in make out the patent claims of invention about such alloys. The patent for alloy invention is considered with following standard. (1) composition range and structure aspect according to the need of a composition metal (2)characteristics of the alloy and for use.

  • As crude oil with heavier and/or highly oxidized components prevails, purification technologies such as desulfurization, denitrilization and demetalization have become important issues to control contents of sulfur and other impurities affecting the quality of petroleum. Also, the importance of catalyst technologies related with crude oil purification has been emphasized to control the production and yield of products. In this paper, technology trends of impurity removal such as sulfur, nitrogen and metal components from crude oil and catalysts related with purification of crude oil were studied through patent analysis. The patents published or registered in Korea, U. S. A., Japan, and Europe from mid 1970's to 2009 had been analyzed based on the application tendency, the distribution of major applicants, and their active indices, etc. The technology flow was figured out to see the technology trends.
