사진저작물, '필연적 인용' 가능하다

  • 영상시대, 책에도 사진저작물의 이용이 늘어나면서 저작권 문제가 새로운 쟁점으로 떠올랐다. (본지 제231호 참조) 출판사들은 사진저작물의 이용 한계와 범위에 대해 정확히 모른 채 제작을 해온 것도 사실이다. 이 글에서 필자는 "본문과 필연성이 인정되는" 인용의 경우, 별도로 저작권자의 허락을 받지 않아도 사진저작물으 이용이 가능하다고 해석하고 있다. 이같은 해석은 저작권 문제에 새로운 논쟁의 단초가 될 수 있다. 많은 관심을 바란다.

  • 배자에 의해 인간복제가 가능하다는 외신은 그 진위가 어찌되었든 오래전부터 계속되어 오던 과학과 철학 혹은 윤리에 관한 논쟁을 다시 도마위에 올려놓는 계기가 되었다. 과학의 발전경로와 그에 따른 많은 영향들은 미래 인류의 존엄성을 폭넓게 좌우할 것이다. 이런 의미에서 '인간성의 과학'은 오늘날 윤리적인 한 기준이 될 법하다.

  • 지난 7월말 네덜란드 헤이그에 모인 세계 1백78개 국가의 대표들은 2002년 7월의 리오 지구정상회담 10주년 이전까지 교토 세계기후의정서를 발효하기로 합의했다. 그러나 교토의정서의 효율성에 대해 의문을 제기하는 과학자들도 있다. 의정서의 기반이 되고 있는 지구온난화 예측의 불확실성이 더욱 확대되고 있기 때문이다. 기후모델을 둘러싼 불확실성 논쟁은 쉽게 풀 수 없는 숙제로 남아있다.

The Opposition and Disputation between Pelagius and Augustine -Focused on Free-will- (아우구스티누스와 펠라기우스의 대립과 논쟁 - 자유의지를 중심으로 -)

  • In Medieval and Christian history, disputation between Augustine and Pelagius originated from different perspectives regarding the free-will of humans and the grace of God. This debate has continued throughout the Middle-Ages and the Reformation to date. In this regard, the purpose of this article is to investigate the implication of opposition and disputation between Augustine and Pelagius on today's society. Overemphasis on human capacity and free-will leads to humanism, while the arguments supporting the grace of God can encourage evasion of the ethical obligations of humans. Augustine and Pelagius had opposing views on this subject. Pelagius emerged in the Roman Empire, emphasizing the ethical responsibility of humans with free-will. On the other hand, Augustine argued that human nature and free-will had been damaged. With a pessimistic outlook on human capacity, he emphasized the grace of God. Shocked by the self-indulgence and ethical negligence of the Church of Rome which was the center of Christian nations at that time, Pelagius strongly urged Christians of the Roman Church to take moral responsibility. However, the theology of Augustine justified the status quo of the Roman Church while Pelagius focused on the necessity of an ethical life of humans based on free-will. Viewing Pelagius' strict moralism as a humanist view that emphasizes human capacity and action, Augustine showed strong opposition to such a view and instead emphasized God's grace. Pelagius was condemned as a heretic as his belief in free-will did not follow Augustine's Doctrine of Grace. However, Pelagianism penetrated Christian history and still poses a threat to Christianity to date. Societal corruption and depravity is still prevalent in today's society as it was in the time of Pelagius. South Korea for instance is exposed to serious moral corruption and a lack of social responsibility as shown in the sinking of the MV Sewol in April 2014. For those reasons, Christian society emphasizes Christian ethics and requires an honest leader who will set an example of Christian life. In this light, I want to examine the implications of disputation between Augustine and Pelagius on today's society.

A Literature Review on Trauma from Occlusion (교합성 외상에 관한 논쟁의 고찰)

  • Trauma from occlusion (TFO) is a pathologic alterations which develop in the periodontium as a result of undue masticatory force. The purpose of this article is to review the controversies about TFO. There are evidences that TFO is a risk factor in the progression of periodontitis. Tooth mobility should be reduced by selective occlusal adjustment. TFO can be developed dependent on the masticatory pattern, occlusion and anterior overbite in sound periodontal conditions. Secondary TFO may aggravate unstable occlusion. If "loss of posterior support" was occur, the problems were worsen. Extrusion, migration, rotation and pathologic deviation can be resulted. Opposite contention is the "shortened dental arch" concept. However, these two concepts persue the occlusal stability together. To treat TFO adequately, exact diagnosis and multi-disciplinary treatment should be needed.

The Influence of Korean Collectivism(Uri, we-ness) on Interpersonal Communication Behaviors (한국적 집단주의(우리성, we-ness)가 대인 커뮤니케이션에 미치는 영향에 대한 연구)

  • It was argued that the collectivism found among Koreans are quite differenct from the collectivism defined by Western theories. The study aims to define the dimensions of the Korean collectivism (Uri, we-ness) and to examine the influence of Uri dimensions on various interpersonal communication behaviors. Result found that Uri was composed of six dimensions: Mental support, group-selfishness, group-skepticism, individual sacrifice, group-oriented attitude, and emotional intimacy. The six dimensions were able to be integrated into positive collectivism (mental support, group-oriented attitude, emotional intimacy) and negative collectivism (group-selfishness, group-skepticism, individual sacrifice). It was found that positive collectivism generally influenced on constructive communication behaviors while negative collectivism generally influenced on deconstructive communication behaviors.

  • Diese Abhandlung untersucht Jacobis ${\ddot{U}}ber$ die Lehre Spinoza und den von diesem veranlassten Spinoza-Streit. Damit sie $enth{\ddot{u}}llt$ zuerst Jacobischen Zusammenhang zwischen transzent und immanent und folgt auf seine Wirkungsgeschichte in der Moderne. Ich rekonstruiere den Streit zwischen Jacobi und Lessing und danach interpretiere dessen Rezeption durch Hegel und Schleiermacher. Lessing stellt anstatt der traditionellen Begriffe der Gottheit ἑν ${\kappa}{\alpha}{\iota}$ ${\pi}{\alpha}{\nu}$ auf. $Demgegen{\ddot{u}}ber$ behauptet Jacobi Salto mortale um ihn ${\ddot{u}}berschreiten$ zu $k{\ddot{o}}nnen$, indem er Lessing als Pantheist und Atheist bestimmt. Salto mortale bei Jacobi ist der Sprung zu dem ${\ddot{U}}bernat{\ddot{u}}rlichen$ und dem Glaube. Der Streit zwischen Jacobi und Lessing ist der zwischen dem Naturalismus und ${\ddot{U}}bernaturalismus$ und $dar{\ddot{u}}berhinaus$ der zwischen dem Athismus und Theismus. $W{\ddot{a}}hrend$ die Natur der Inbegriff der Bedingten ist, ist Gott der absolute Anfang der Natur $au{\ss}erhalb$ des Naturzusammenhangs. $W{\ddot{a}}hrend$ Spinoza Gott im $nat{\ddot{u}}rlichen$ Zusammenhang begreift, $fa{\ss}t$ Jacobi den im ${\ddot{u}}bernat{\ddot{u}}rlichen$ auf. Deus sive natura bei Spinoza $ver{\ddot{a}}ndert$ sich Gott im Menschen bei Jacobi. Gott im Menschen ist nichts anders als das Prinzip des Lebens und das aller Vernuft. In diesem Zusammenhang $fa{\ss}t$ Hegel Gott als Geist denn Subjekt des Lebens auf und $h{\ddot{a}}lt$ das Wesen des Geistes $f{\ddot{u}}r$ die sich selbst vermittelnde Bewegung. Dies zeigt sich als die Spinoza ${\ddot{u}}berbietende$ Immanenzphilosophie. $Demgegen{\ddot{u}}ber$ behauptet Schleiermacher die Einheit des Endlichen und Unendlichen in der $religi{\ddot{o}}sen$ Anschuung. Die Verbindung von Mensch und Gott ist die im Endlichen immanent bleibende Anschauung der $g{\ddot{o}}ttlichen$ Eigenschaft. Dies zeigt das transzendente im immanenten.

A Debate of Fan-Jin(范鎭) and Sima-Guang(司馬光) about Le(樂) and Lu(律) (범진과 사마광의 악(樂)·율(律) 논쟁)

  • Le 樂 is important in Politics of the Kings. It is the same in Nothern Song period(北宋). There was an argument about Le 樂 and Lu 律 in Nothern Song Period. Those who argued were Fan-Jin(范鎭) and Sima-Guang(司馬光). They argued for 30 years. Fan-Jin insists that a standard of weights and measures is Lu and a standard of Lu is the fundamental tone of twelvenotes scale, Hwang-Jong 黃鍾. On the other hand, Sima-Guang insists that a standard of Lu is weights and measures and a standard of Le is Equilibrium and Harmony, Zonghe 中和. Fan-Jin thinks it is possible to restore a Sage King's music through the right standard of Lu. But Sima-Guang thinks it is impossible. Sima-Guang believes that the only way to restore a Sage King's music is to complete Zonghe. And Fan-Jin thinks Zonghe is the work of the king whereas Sima-Guang thinks Zonghe is the order of man and everything. The key point in the argument is Lu and Zonghe. Fan-Jin regards Lu as the basis of music, whereas Sima-Guang regards Zonghe as the basis of music. Lu is a tangible law and Zonghe is a intangible law. Although the argument between the two ended in a stalemate, the argument shows the difference between the scholars at the time.

Hegel's Philosophy of Law and Communitarianism - Focusing on Morality and Ethics - (헤겔의 법철학과 공동체주의 - 도덕성과 인륜성을 중심으로 -)

  • This thesis aims to examine the discussions on communitarianism and liberalism, which was actively debated post-1990's in the West. The paper will focus on the concepts of morality and ethics of Hegel's "Philosophy of Law" in order to connect the discussions on communitarianism and liberalism to our society's political reality. Specifically, through the introduction of Hegel's point of view, this paper will shed new light co the concept of communitarianism, which was viewed from the perspective of political philosophy within the West post-1990's. Through "Philosophy of Law," Hegel imbues a critical and fundamental meaning to modern ethical-political order. For Hegel, Kant's acceptance of morality has a foundational and compositional meaning for the concepts of law and nation. This paper will discuss this topic within the boundaries of Hegel's morality and ethics and regard this as a chance to look back on our political situation with a regretful introspection. International and national reviewers tend to regard the various perspectives of Hegel's philosophy of law as inspirational. However, it seems that the fundamental introspection of why our reality must adhere to his philosophy is lacking. Based on this concern, the paper aims to examine Hegel's "Philosophy of Law" to apply his perspectives to our political reality for a fundamental self-evaluation.
