A Study on Similar Trademark Search Model Using Convolutional Neural Networks (합성곱 신경망(Convolutional Neural Network)을 활용한 지능형 유사상표 검색 모형 개발)

  • Recently, many companies improving their management performance by building a powerful brand value which is recognized for trademark rights. However, as growing up the size of online commerce market, the infringement of trademark rights is increasing. According to various studies and reports, cases of foreign and domestic companies infringing on their trademark rights are increased. As the manpower and the cost required for the protection of trademark are enormous, small and medium enterprises(SMEs) could not conduct preliminary investigations to protect their trademark rights. Besides, due to the trademark image search service does not exist, many domestic companies have a problem that investigating huge amounts of trademarks manually when conducting preliminary investigations to protect their rights of trademark. Therefore, we develop an intelligent similar trademark search model to reduce the manpower and cost for preliminary investigation. To measure the performance of the model which is developed in this study, test data selected by intellectual property experts was used, and the performance of ResNet V1 101 was the highest. The significance of this study is as follows. The experimental results empirically demonstrate that the image classification algorithm shows high performance not only object recognition but also image retrieval. Since the model that developed in this study was learned through actual trademark image data, it is expected that it can be applied in the real industrial environment.

Development of Valuation Model on Trademark Rights for Intellectual Property Revitalization (지식재산권 활성화를 위한 기업상표권 가치평가 모형 개발)

  • Intellectual property rights play a key role in employment creation and income generation plays an important role, especially in the creative economy. Many companies are ultimately increasing efforts to boost the company's financial performance, such as maximizing profits by building a strong brand assets amid committed to brand management in this paradigm. Reasonable evaluation and commercialization of technology transactions, financial assistance, investment decisions, trademark brand value for the reactivation (revitalizing) for the purposes of M & A, litigation, brand strategy will be said to be very important. In spite of the importance, the awareness of the property and the capabilities to assess are hardly sufficient. Thus, this study, targeting companies with valid trademarks for value assessment, conducted case analysis by cost method and income approach; the analysis presented the result from 2.05 million by the cost method to 2.7 million by the income approach applied to a variable discount rate and adjustment contribution. However, now that the implication was drawn from a single company, further studies covering case study and application plan according to scale and type of diverse company groups should be continued.

A Study on the Relationship between Branding and Business Strategies of Korean Start-ups (한국 벤처창업기업의 상표와 비즈니스 전략간 연관성 분석)

  • Recently, the importance of trademarks as a core resource of corporate competitiveness to protect and differentiate products and services is increasing. Global companies are focusing hard to secure trademark rights to manage brands that reflect their core values and to respond to increasingly frequent trademark disputes, while start-ups and individuals are working hard to secure trademark to run stable businesses and attract investment funds. Meanwhile, this study conducts an empirical analysis to identify the relationship between the brand and business strategy of domestic venture startups. The analysis data used was the response data of 2,230 corporate companies from the 2021 Venture Business Precision Survey, and the propensity score matching method, structural equation model analysis, and binomial logit analysis were used as analysis methods. As a result of the analysis, it was confirmed that domestic venture startups' trademark ownership does not make a significant difference in terms of the level of business strategy. This was confirmed to be because the brands of domestic venture start-ups mainly advance their business strategies only through the internal competency process, while the advancement of business strategies through the external competency process is very minimal. Meanwhile, it was confirmed that the level of cost advantage strategy among the business strategy levels of venture start-ups strengthens the tendency to hold trademarks, indicating that the higher the completeness of the cost advantage level, the more likely it is to expand trademark ownership for stable sales and supply of products and services through trademark ownership and to convert to high value-added in the future.

  • 최근에 시행된 개정 상표법에서는 여러 가지 새로운 내용들이 추가 또는 변경되었다. 그 중에 해석상 실무적으로 혼란이 있을 수 있는 것으로서, 상표사용의사확인제도, 법정손해배상제도, 전용사용권등록의 효력발생요건 폐지 등을 거론해 볼 수 있겠다. 이와 같은 제도들은 실무상이나 그 해석에 있어서 일반 국민들과 기업관계자 등에게 낯선 제도들이고, 그 제도의 운용에 관한 이해도 분명하게 이루어져 있지 않은 상황이기도 하다. 따라서, 이하에서는 이와 같은 상표사용의사확인제도, 법정손해배상제도, 전용사용권등록의 효력발생요건 폐지에 관한 주요 내용과 해당 제도들의 쟁점이 될 수 있는 사항들에 대하여 구체적으로 살펴보고자 한다.

국내 인터넷 도메인네임 분쟁의 유형별 사례분석

  • 본 연구의 목적은 국내 · 외 인터넷 도메인네임 분쟁의 유형을 사례별로 분석하여 도메인 사용권을 둘러싼 분규를 해소 및 예방하고, 국제적인 도메인네임 분쟁 발생시 국내 기업 등이 불리한 처우를 받지 않도록 하는 적정한 분쟁 해결 방법을 모색하는데 있다. 아직까지는 대부분의 국가에서 도메인네임 분쟁과 관련된 법이 제정되어 있지 않기 때문에 특정 회사명 또는 상표명을 사용하는 경우 분쟁이 발생하면 해당회사 또는 상표권 소유자에게 우선권이 있는 것으로 판결을 하는 추세이지만, 국내 ·외적으로 판결에 일관성이 있는 것은 아니다. 본 논문에서는 도메인네임 분쟁에 관한 법원의 소송 판례를 분석하고, 외국의 도메인네임 분쟁 해결 사례와 국내 사례를 분석하여 향후 분쟁 발생시 대처방안을 모색하도록 한다

  • 코로나 19(Covide-19)이후 가상과 현실이 융·복합 되어 사회·경제·문학활동과 가치 창출이 가능한 메타버스가 차세대 핵심산업으로 부상하고 있다. 이에 자사 보유 기술, IP(Intellectual Property) 등을 활용하여 메타버스 플랫폼을 구축하고자 하는 기업들이 증가하여 지식재산권을 둔 법적 이슈들이 새롭게 나타나고 있다. 따라서 본 논문에서는 상표권 침해를 보호하기 위하여 딥 러닝 기반 객체 탐지모델인 YOLOv5 모델을 활용한 메타버스 환경에서의 상표권 탐지 시스템을 제안한다.
