Meaning and Conceptual Tension Contained in the Definition of Social Services Prescribed by Recently Amended Framework Act on Social Security (개정 사회보장기본법의 사회서비스의 의미와 개념적 긴장)

  • This paper aims to analyze the meaning and conceptual tension contained in the definition of social services prescribed by recently amended Framework Act on Social Security(FASS) by examining various terminologies of social services in Korea. In Korea the term of social services has had at least four meanings since it has begun to be used during Participatory Government. Of these, the meaning of social services in FASS is closest to 'social serives as social-jobs'. While, as has this meaning, social services in FASS is defined as very comprehensive one, it also has its conceptual tension. On the one hand, FASS comes to have the orientation to include immensely wide fields such as welfare, health, employment, housing, culture and environment within social service. However on the other hand FASS still has the orientation to limit social services to traditional social welfare services. Unless re-amending the recently amended FASS, the conceptual tension resulted from these two conflicting orientations will be likely to continue. And this might raise the need both to reform the organization of Ministry of Health and Welfare and exiting delivery systems of social services and to develop theoretical and practical principles providing basis for tailored social services, which in turn poses important challenges to social welfare discipline. To meet these challenges it is necessary to cooperate between micro and macro approaches.

Debating Universal Basic Income in South Korea (기본소득 논쟁 제대로 하기)

  • Since 2016, public and political interest on basic income has been increased beyond academic interest. The recent debate on basic income has expanded on issues regarding to the concrete implementation of basic income moving further than the debate on conception of the basic income in the abstract level. This study examines major critiques of basic income which was raised from social policy area and makes a counter-argument on these critiques. Major points summarized as follows. First, the problem of jobs and social insurance exclusion is not serious enough to call for basic income. Second, existing social security systems will be crowded out by excessive financial burden if basic income is introduced. Third, policies to cultivate citizens' capacities to cope with a technological change should be given priority over basic income. This study disputes these critiques by counter arguing four points. First, it is necessary to reconstruct welfare state based on basic income, given the labor market changes, such as long-term trend of employment change, newly emerging employment of platform companies, and inconsistency of platform labor and social insurance. Second, hypothesis of crowding-out effect on social security system is just a criticism that can be applied to the basic income initiative of the right-wing. Also, it is unable to find a logical basis or evidence of this hypothesis from the historical process of welfare state development or previous studies. Third, it is necessary to discuss how to reconfigure existing social security system and basic income which are complementary to each other and also have consistency with labor market as a configuration, not as a matter of choosing between basic income and social security system. Fourth, de-laborization does not mean a refusal to labor but a free choice, and the basic principle of social security is not needs but right. In conclusion, in order to develop more productive debate on basic income, it requires more sophisticated discussion and criticism from the point of view of the distributive justice; the debate on the sustainability of social insurance-centered welfare states; and debates on the political realization of basic income.

Exercising the Rights of Self-Defense and Using Force in Response to North Korean Provocations (북한의 군사도발에 대응한 군사력 사용과 자위권 행사)

  • 본 논문은 자위권 사용과 군사력 사용 간의 관계를 분석하고 이를 한반도 서해에서의 한국과 북한 간 해상긴장 상황에 적용시킨 이슈를 다룬다. 국가가 행사하는 자위권(self-defense: 自衛權)은 기본적으로 전쟁 방지를 위한 기본적 원칙이다. 그러나 이는 군사력 사용(Use of Forces: 軍事力 使用) 또는 무력행사(武力行事)이라는 측면에서 칼의 양날과 같은 결과를 낳는다. 즉 자위권 행사로 전쟁의 확산을 방지하는 반면에 자위권 행사로 상대방에 대한 적성(敵性)을 인정해 주는 경우이다. 반면 북한의 군사도발은 전방향적이며, 1953년 한반도 정전협정 위반이다. 1953년 정전협정 체결 이후 양국은 서해 북방한계선(NLL)에서의 군사적 충돌을 거쳤으며, 이는 과연 한국이 자위권 차원에서의 방어태세와 군사력 사용 측면에서의 대응태세 간에 괴리가 존재하고 있다는 것으로 나타나고 있다. 당연히 피해를 받는 곳은 한국이며, 이는 서해 북방한계선에서의 남북한 해군 간 대결국면에서 나타나고 있다. 이에 본 논문은 자위권을 국가 차원 행사하는 수준과 작전에 투입된 현장 작전 지휘관 차원에서 행사하는 수준으로 구분하여 다룬다. 서해 북방한계선 부근 수역에서의 북한의 해상 군사도발에 대해 현장 작전 지휘관이 행사하는 자위권은 대한민국 정부 차원에서의 자위권 행사와는 다르면, 이 문제를 국제법을 중심으로 분석하기에는 너무나 많은 제한점이 있다. 현행 국제법상 국가 자위권 문제는 군사력을 동반하는 문제로서 그 행사요건이 매우 애매모호하고 까다롭다. 그러나 현장 작전지휘관의 자위권 행사는 단호해야 하며, 이는 군사력 운용으로 나타나야 한다. 실제 서해에서의 남북한 대결국면에서의 대한민국 해군의 자위권 행사는 정전협정에 의거 제한되고 있으며, 이는 2010년 북한의 천안함 침몰과 연평도 폭격도발 시 대한 민국 해군과 해병대의 대응에서 증명되었다. 현재 대한민국 국방부는 현장 작전 지휘관에서 소위 '선제적 자위권 행사' 부여 필요성에 대한 논의를 진행 중으로 알려져 있다. 이에 따라 선제적 자위권 행사를 위한 조치들을 제도화하는 움직임을 보이고 있다. 예를 들면 2013년 발표된 대한민국 합참과 유엔사령부/한미 연합사령부/주한미군사령부 북한 군사 도발에 대한 대응계획(ROK JCS and UNC/CFC/USFK Counter-Provocation Plan)이 이를 간접적으로 증명하고 있다. 선제적 자위권은 행사에 있어 몇 가지 원칙을 요구하고 있으며, 이에 대한 합법성 문제는 아직 해결되고 있지 않다. 따라서 이 문제와 북한 군사도발 시에 대한 대한민국의 선제적 자위권 행사 간 연관성 문제를 어떻게 해석할 수 있는가에 대한 연구가 필요한 실정이다. 평시 군사력 사용에 따른 무력행사의 적법성은 그 인정이 대단히 어려운 것이 현실이며, 이에 따라 북한의 군사도발에 대한 가장 효율적 방안이 선제적 자위권이라면, 이에 대한 법적 대응이 무엇인가에 대한 제도적 근거를 필요로 할 것이다.

Civil Law Study on the Arbitrary Uninsured Medical Benefits (임의비급여 진료행위에 관한 민사법적 검토)

  • There are three types of benefits in the National Health Insurance Act of Korea. Those are the treatment benefit, statutory uninsured medical benefits and arbitrary uninsured medical benefits. Recently the Korea Supreme Court changed its past legal theory and permitted the arbitrary uninsured medical benefits under the strictly exceptional conditions. According to the Supreme Court's decision, the existence of procedural difficulty, the medical necessity and the patient's consent are necessarily required in order to allow the legal exceptions in arbitrary uninsured medical benefits. Among the three requirements, the doctor's explanation and the patient's fully informed consent are the most important essentials in this legal conflict. The requirement concerning the doctor's explanation and the patient's consent roles like a hole in the ice as a breathing hole in the arbitrary uninsured medical benefits. The most cases dismissed after Supreme Court Decision 2010DU27639, 27646 Decided June 18, 2012. were due to the defect of three requirements.

A Study about the efficient Control against the sexual violence in medical area (의사의 성범죄에 대한 최근 의료법 개정법률안 검토)

  • It is a general recognition that more serious criminal acts in a certain area of society should be given more serious condemation than the same general crimnal act. In particular, considering the purpose of the medical treatment and the trust relationship between the doctor and the patient, the sexual violence by doctor in medical field can not be placed on the same line as that of the general public. But the special legislation to solve this through criminal legal sanctions is not desirable. The basic principle of criminal law ist ultima ratio, so the principle of supplementality. It means to try to solve by all possible means and finally to enter with punishment. A flat and hasty Reaction without the considering of the speciality of medical treatment will cause serious cracking in that area. In addition, it will not be able to expect desirable results in legal practice by breaking down the legal system. Rather, administrative regulation is more efficient than punishment sanctions. But the best way is autonomous control by members of the medical area. Penalties in criminal law must make an enterance at the last, and administrative regulation should be timely intervene in specific situations through diversification. In conclusion, state interventions should be farthest in order to proceed to autonomous control of medical area.

위평충제치료소아소화성궤양98례임상관찰여수방보고(胃平沖劑治療小兒消化性潰瘍98例臨床觀察與隨訪報告) -위평충제(胃平沖劑)로 소아 소화성궤양 환자 98예(例)에 대한 임상치료 및 추적관찰 결과에 대한 연구-

  • 소아의 소화성궤양은 소아 소화계질환 중에서 발병율이 점차 늘어나고 있는 추세에 있다. 최근 소아과에서 내시경의 활용이 활발해지면서 장기적으로 반복하여 위완통(胃脘痛), 변혈 (便血)및 구혈(嘔血)이 나타나는 경우 궤양성질환의 가능성이 높은 것으로 밝혀지고 있다. 본원에서는 유명한 중의사 왕붕비(王鵬飛) 교수의 비완통(脾脘痛) 치험방을 토대로 많은 임상을 거쳐 위평충제(胃平沖劑)를 개발하여 1992년6월부터 1997년12월까지 위내시경 검사를 통하여 위궤양으로 진단된 98명의 소아환자에게 투여하여 관찰한 바 만족스러운 효과가 나타나 이를 보고한다. 위평충제(胃平衝劑)의 처방구성은 자초(紫草), 청대(靑黛), 곽향(藿香), 유향(乳香), 회향(茴香), 정향(丁香), 황련(黃連), 적석지(赤石脂), 황정(黃精) 등이다. 한의학적 이론에 따르면 불규칙하고 자극성이 강한 음식섭취 습관은 비위(脾胃)를 손상시켜 중주(中州)를 옹체(壅滯)시키므로 기(氣)의 원활한 소통이 이루어지지 않으면 부통즉통(不通卽痛)의 기전으로 발전한다. 또한 근래 소아들이 각종 정신적인 압박으로 스트레스가 쌓이면서 간기울결(肝氣鬱結)을 초래하여 울화(鬱火)로 인하여 혈락(血絡)이 손상되면서 출혈증상이 나타난다. 왕교수의 견해에 따르면 체내에 어혈이 제거되지 않으면 기혈(氣血)의 순환이 더욱 악화되어 어적(瘀積)이나 궤양 또는 경새(梗塞) 등을 일으키게 된다고 하였다. 따라서 위평충제(胃平沖劑)는 활혈화어(活血化瘀), 청열해독(淸熱解毒)과 더불어 익기양위(益氣養胃), 거어지통(祛瘀止痛)의 효능이 있는 약물들로 구성되었다. 동물실험에서 위평충제(胃平衝劑)는 궤양표면을 보호하고 치유하며 재발을 방지하는 효과가 있는 것으로 확인되었고, 위액의 분비, 위단백질효소의 활성에 대한 억제 및 진통효과도 있는 것으로 입증되었다.행하여 사용하는 것이 바람직하며, 단순한 중약 투여는 일부 양약에 의한 소아성장에 미치는 영향을 피할 수 있어 더 많은 임상연구가 이어져야 한다.(當歸) 목단피(牧丹皮) 울김(鬱金) 정력자(?歷子) 세신(細辛) 오미자(五味子) 구기자(枸杞子) 산수황육(山茱黃肉) 황기(黃?) 감초(甘草) 등을 기본적으로 사용한다. 비신양허형(脾腎陽虛型)은 온보비신(溫補脾腎) 화어척담(化瘀滌痰)을 원칙으로 하며, 처방에는 구마황( 灸麻黃) 세신(細辛) 오미자(五味子) 당귀(當歸) 단삼(丹蔘) 울김(鬱金) 정력자(?歷子) 반하(半夏) 보골지(補骨脂) 선령비(仙靈脾) 태자삼(太子蔘) 황기(黃?) 감초(甘草) 등을 기본적으로 사용한다. 치험(治驗): (1) 천식의 실증(實證)은 치료를 한 뒤 완화단계에 접어들면서 허증(虛證)으로 전화되는데, 허천(虛喘)도 역시 천식이니 만큼 단순히 보법(補法)만 사용하여서는 안된다. 시종일관 천식치료에는 척담화어(滌痰化瘀)의 원칙을 지켜야 한다. 폐내(肺內)의 담어(痰瘀)가 철저하게 제거되어야 폐(肺)의 순환기능을 개선시켜 기도(氣道)의 염증을 신속히 흡수하고 치유할 수 있다. 이와 같은 치료과정은 약 3-6개월이 필요하다. 완화단계의 기간이 길어질수록 완치될 확률도 높아진다. (2) 급성기 천식은 폐(肺)를 다스려야 한다. 폐(肺)를 다스리는 방법에는 선폐(宣肺), 청폐(淸肺), 온폐(溫肺), 윤폐(潤肺) 및 척담거어(滌痰祛瘀) 등이 있다. (3) 증상이 완화되면 신(腎)을 다스린다. 천식은 신허(腎虛)가 근본적인 원인이므로 완화단계에서 심지어 발작기에도 보신제(補腎劑)를 추가하여 사용하면 배의 효과를 얻을 수 있다.   • Since the recent restoration of the Sungnyemun gate (South gate of Seoul) which was burnt down in 2008, there were dispute about the application of traditional technique for the conservation of cultural heritage. In this research, the definition of traditional technique for cultural heritage conservation is thought and mentioned. In general, the understanding of traditional technique is based on the idea of 'tradition'. Tradition is not defined as a 'eternal doctrine existence', but a 'development of succession' and a 'living existence'. Thus 'traditional performance and craft as intangible cultural heritage' is defined as 'intangible' which also makes it difficult to define the 'original form/state' from 'the conservation of the original form' which is a major principle of cultural heritage. In case of Korea, if the 'traditional technique as intangible cultural heritage' is put into application to cultural heritage conservation, the unclear definition will cause many problems in the restoration/conservation site. This is because the site will apply this technique without any discussion of the range and limitation of 'traditional technique'. This means there will be the lack of discussion for the conservation of the cultural heritage which will not have a strict criteria for the allowable range of usage for the 'traditional material' using the vaguely defined 'traditional technique'. In this study, these application issues of the traditional technique were also considerecl, comparing the development of international wnservation principles. As a result, the conservation of 'traditional technique as intangible cultural heritage' is important, but the 'technique left inside the tangible cultural heritage' which is the 'material which is carrying the technique when it was firstly built' has more importance to preserve and need to be in the major considerations.

Extending the Scope of License Restrictions for Medical Personnel and Limiting Fundamental Rights - Focusing on the Revision of the Medical Law - (의료인의 면허제한 범위 확대와 기본권 제한 -의료법 개정안을 중심으로-)

  • Reasons for disqualification to restrict a medical person's license should be considered in functional and moral terms. In this sense, the grounds for disqualification of medical personnel should be expanded to include all crimes that have been declared to be "imprisonment without labor or greater punishment" by a court. Because a sentence of "imprisonment without labor or greater punishment" means that it is highly reprehensible and undermines the trust of the state as well as the trust in medical personnel. Therefore, the expansion of the scope of license restrictions for medical personnel cannot be regarded as a violation of "the Less Restrictive Alternative" rule. However, it is necessary to reflect the specificity of medical services in the license restrictions of medical personnel. This is because not all diseases can be treated with current medical services. In addition, unpredictable situations can occur at any time during medical practice. Consequently, the negligence that occurs during medical practice should be carefully examined from a functional perspective of the medical personnel. And it should be treated differently from ordinary crimes. To this end, an independent license review organization should be established to establish expertise in license management.

Outlook for a New International Agreement on Climate Change Adaptation: How to Approach (기후변화 적응의 신기후체제 합의: 전망을 위한 접근방법)

  • The purpose of this study is to analyze the major issues discussed among Parties and provide a framework for predicting the agreements on those issues, prior to the final negotiation on a new legally-binding agreement on climate change adaptation in the United Nations Framework Convention on Climate Change (UNFCCC). The analyses of documents, adaptation actions, and work of the Ad Hoc Working Group on the Durban Platform for Enhanced Action (ADP) under the UNFCCC informed that the adaptation issue has primarily been focused on the support of developed country Parties for the adaptation of developing country Parties following the principle of the Convention, Common but Differentiated Responsibilities and Respective Capabilities (CBDR-RC). Three-year work of the ADP acknowledged the major issues on adaptation in the new climate agreement, which would be categorized as long-term and global aspects, commitments/contributions/actions, monitoring and evaluation, institutional arrangements, and loss and damage. A final agreement on each issue could be predicted by setting a zone of possible agreement in-between the two extremes of developing and developed country Parties and considering three major elements affecting the Parties' positions, national priority, adaptation action, and social expectation, which are proposed in this study. The three major elements should be considered in a balanced manner by Parties to draw a durable agreement that will enhance global adaptation actions from a long-term perspective. That is, the agreement needs to reflect adaptation actions occurring outside the Convention as well as social expectations for adaptation. It is expected that the new agreement on climate change adaptation, from a long-term and global perspective, would be an opportunity to reduce vulnerability and build resilience to climate change by incorporating global expectations.

Planting Design Strategies and Green Space Planning to Mitigate Respirable Particulate Matters - Case Studies in Beijing, China - (미세먼지 저감을 위한 식재기법 및 도시 녹지계획 방향 - 중국 베이징시 사례를 중심으로 -)

  • The purpose of the research is to analyze the recent cases of green space planning and planting design in Beijing, one of the cities having the worst particulate matters (PM) pollution. This study comprehensively reviewed Chinese academic literature addressing green space planning to reduce PM pollution. In addition, we conducted field observations and interviews with public officials from Beijing Municipal Bureau of Landscape Design in charge of planning and management of green spaces in Beijing. After the extensive review of literature we derived tree planting principles to mitigate the impact of PM from urban road system, residential area, and industrial district. Using the principles we evaluated the three recent cases of planting design to mitigate PM: Beijing Fuxing Road, Fu Run Residential Area and Beijing Beiqi Multipurpose Vehicle Factory. We conclude that green space planning and trees planting are not effective in mitigating negative impact of PM pollution because of inadequate selection of trees and inconsiderate planting composition. We proposed to replace the tree species with the ones capable of reducing the spread of PM, and reorganize planting compositions that consider the directions and characteristics of urban wind flow. This study suggests desirable types of tree species and planting compositions for road, residential and industrial districts, and we expect that it provides helpful guidelines for making planting design and species selection to mitigate the impact of PM in urban landscape.
