In this digital environment, license contracting and technical protection measure are being used by copyright holders as a means to restrict the rights of information users. The study reviewed the conflicting relationship between the copyright law and the contract law for digital resources the use of which is based on license contracting, and investigated the legal interpretations of the conflicting relationship between the two. And then based on the analysis of IF LA's position on copyright in the digital environment, the study suggested the expected role of librarians to cope with the technological overrides of copyright rules and to expand the rights of information users.

The private investigator service in Korea is to protect our legal market from personal right, creation of job, legal opening via OECD and FTA as well as the prevention of negative private investigation such as service center and private investigator operated without any control. Therefore, this study compares the civil research systems of advanced countries, reviews the legal process to introduce private investigator service as well as considers the previous studies to suggest the work sectors of private investigator service appropriate to Korea. As a result, it distinguished the private investigation work into corporate, finance, insurance, medical service, Cyber, traffic accidents, intellectual property right, lost and forensic science.

This paper tries to solve the problems which previous methods have the model using smart card for protecting digital contents. This study provides a contents distribution model to protect the rights of author, distributor, and user as well as user's information by using technologies such as cryptography, DRM(Digital Right Management), access control, etc. The proposed system is evaluated as the most safety model compared with previous methods because it not only solves the problems which the previous methods have, but also protects four type of risks such as use of contents which other mobile devices download, the attack on the key to decode the message, the attack on leaking the contents, and the internal attack such as an illegal reproduction.

The N Screen service has been focused because of the explosive growth of Smart media. However, between content producers and service providers have been causing the copyright issue while N-Screen service providing real-time channels. In this study, the current copyright issues are analyzed by examining at the right relationships associated with the right of communication to the public and private copy that caused by sling box which is activated N Screen.

민법상 인정하고 있는 부부재산제도는 부부별산제의 원칙 아래 부부재산계약을 따로 두고 있는 형태이다. 부부재산계약은 혼인신고를 하기 전 두 당사자가 재산관계에 대해 합의한 사항을 등기하면 제3자에 대해서도 효력이 있도록 하는 제도로, 부부별산제의 예외가 된다. 부부별산제(민법제830조)는 부부의 일방이 결혼 전부터 갖고 있던 재산과, 결혼 생활 도중 자신의 명의로 취득한 재산을 그 개인의 것으로 보고, 소유가 불분명한 경우만 공유로 추정하고 있다. 따라서 재산의 관리, 사용, 수익은 소유자가 하게 된다. 결국 부부의 공동으로 형성된 재산이라도 소유자가 모든 권리를 행사할 수 밖에 없어 명의를 갖지 못한 부부일방은 재산적인 침해를 받을 수 있는 등 형식적 평등에 불과하고 실질적인 부부의 경제적 평등을 보장받지 못하고 있는 실정이므로 양성평등과 가족법적 이념에도 어긋나는 제도라 볼 수 있다. 그리고 부부별산제가 제3자와 관계에 있어서 법적안정성을 확보할 수 있다는 장점은 있으나, 법적분쟁 시 일방배우자의 소유재산이더라도 상대방 배우자의 숨어있는 가사노동 지분에 대한 보호규정 등이 없어 문제가 제기되고 있다. 따라서 본 연구에서는 부부재산제도의 문제점을 파악해보고 이를 근거로 합리적인 개선방안을 제시하고자 한다.

2020년 7월 1일부터 공원일몰제가 시행되어 전국에 있는 미조성 공원이 지위를 상실하여 개인 사유지로서 개발이 가능하게 된다. 이는 애초에 개인에게 귀속된 토지를 공원으로 강제 지정하여 녹지를 유지하기 위함이었으나 개인의 재산권 침해 문제가 지속적으로 제기되어 왔고, 토지 소유자들의 권리를 인정하여 공원으로 지위를 해제하게 된 것이다. 서울시의 전체 공원 면적 $111.8km^2$중 $57.5km^2$가 미조성 공원이고 이 중 $55.1km^2$이 10년 이상 미집행 되어 2020년에 공원일몰제 시행 대상이다. 공원일몰제에 따른 난개발을 방지하기 위해 서울시는 토지 매입 예산을 책정하였으나 최근 과도한 부동산 가격 상승으로 인해 토지 보상비는 예산을 크게 웃돌 것으로 보인다. 때문에 서울시는 기존의 매입 기조를 수정해야만 한다. 따라서 본 연구에서 이에 대한 해결 방안으로 '수직 빌딩 숲(이하 빌딩숲)' 건축 보조금 지원을 제안하고자 한다. 빌딩숲은 토지 면적에 비해 높은 환경적인 효과를 보이며 기존 비용의 5%의 추가 비용으로 건축이 가능하다. 토지 가격과 녹지 유지의 필요한 정도를 위치에 따라 판단하고, 토지 매입 대신 건축 비용 보조를 통해서 환경적인 효과와 경제적인 효과를 동시에 도모할 수 있다. 따라서 이 연구는 특정 기준에 적절한 입지를 찾아 빌딩숲을 건축하는 것으로 공원일몰제의한 대안을 제시한다.

This study seeks to grasp the current status of and suggest improvements on records disclosure management. Data were collected through a literature review, surveys, and in-depth interviews with 7 record managers and 40 office staff in local governments. Existing records disclosures were also used as references for the discussion. With this, self-reliance efforts within local governments and active roles in central records management institutions were proposed.

Ethereum is an open software platform based on blockchain technology that enables the construction and distribution of distributed applications. Ethereum uses a fully distributed connection method in which all participating nodes participate in the network with equal authority and rights. Ethereum networks use Kademlia-based node discovery protocols to retrieve and store node information. Ethereum is striving to stabilize the entire network topology by implementing node discovery protocols, but systems for monitoring are insufficient. This paper develops a WireShark dissector that can receive packet information in the Ethereum node discovery process and provides network packet measurement results. It can be used as basic data for the research on network performance improvement and vulnerability by analyzing the Ethereum node discovery process.

Public institutions defining the legal scope of records management are a prerequisite to ensure the accountability and public's right to know. In this study, the requirements essential for determining the legal scope of the concept of public records were identified. For this, the concept of policies and the scope of public records which were prescribed by current laws such as the Public Records Management Act, Electronic Government Act, and Framework Act on Electronic Documents and Transactions were analyzed by this study. Furthermore, by examining both domestic and foreign cases on the legal competence of evidence of digitized records, institutional supplementary points were proposed.
