일본의 북극 정책 방향 - OPRF 북극 제언을 중심으로 -

  • 올 3월 일본 해양정책연구재단(Ocean Policy Research Foundation : OPRF)이 북극에 관한 추진 시책을 발표했다. 국제법, 안전보장, 과학조사, 조선, 해운, 기상관측 등 각 분야의 전문가들로 구성된 '일본 북극해 회의'가 지난 2년 동안의 연구를 통해 일본정부가 북극의 지속가능한 이용을 위해 추진해야 할 정책 방향을 제시한 것이다. 이번 보고서는 행정조직 선박 및 항로 지구환경 안전보장 자원개발 국제물류 국제협력 등 북극 전반을 다룬 일본의 종합적인 정책으로, 일본 해양정책연구재단은 이번 보고서에서 북극해를 전담할 전담조직 신설, 새로운 해상방위 대책 수립, 러시아와의 협력 강화 등 9가지 정책 방향을 제시했다.

  • In recent years, the major interest in international environmental laws has focused on the ways to secure observation of the laws. For the implementation and compliance of international marine environmental convention, the new sequence of developing convention has been sdopted. The main convention is adopted in a form of 'Framework Convention' and the details are expressed in the Annex and/or Guidelines of the convention for the purpose of conveniense of adoption and to secure the observation of the convention And the Annexes or Guidelines are amended, revised and newly adopted continuously. Therefore this study is to analyze the tendency of sequence for developing new convention, which will help understanding one particular international marine environmental convention as a whole.

  • National aircraft are subject to exceptions under the International Civil Aviation Convention. Each country must ensure the safety of civil aircraft through reasonable consideration (due regard). Accordingly, the Aviation Safety Act of Korea also includes an exception for national aircraft. However, Korea Coast Guard aircraft are legislated to be subject to the law on five provisions. As Korea Coast Guard aircraft operate under the application of these provisions of international and domestic laws, they will be required to control flight procedures from China's civil air traffic control when flying over provisional action zone, which is international waters in the West Sea. China's demand is a major limiting factor in protecting the safety of the people of Korea, which is the original mission of Korea Coast Guard aircraft, and through this study, countermeasures to solving these problems at the national level were suggested.

자율운항선박 운항을 위한 국내 해사관련법 검토 결과 요약

  • 해양산업 전반에 디지털라이제이션이 도입됨에 따라 새로운 기술이 선박, 항만에 가파르게 적용되고 있다. 하지만 현재의 규정 프레임워크는 선원이 중심이 되어 운영되는 선박을 기준으로 구성되어 있어 새로운 기술을 적용하는데 규정적 측면에서 제한 사항이 많다. 새로운 디지털기술을 적용하기 위해 국제해사기구의 해사안전위원회에서는 98차 회의에서 자율운항선박 운항을 위해 규정식별작업(RSE)을 진행하였고 최근 103차 회의에서 작업을 완료하였다. 이 작업을 통해 자율운항선박을 운항하기 위한 주요 이슈를 선별하고 향후 작업에서 논의하기로 하였다. 국제협약을 수용하는 체계를 갖는 우리나라의 해사 관련법은 국제해사기구의 이런 논의는 상당한 영향을 가져올 것으로 예상된다. 따라서 새로운 기술 및 운용 기술을 해사산업에 적용하기 위해서는 우리나라의 해사 관련법을 분석하여 주요 이슈 및 향후 작업계획수립이 요구된다.

The Present State of Domestic Acceptance of Various International Conventions for the Prevention of Marine Pollution (해양오염방지를 위한 각종 국제협약의 국내 수용 현황)

  • Domestic laws such as Korea Marine Pollution Prevention Law (KMPPL) which has been mae and amended according to the conclusions and amendments of various international conventions for the prevention a marine pollution such as MARPOL 73/78 were reviewed and compared with the major contents of the relevant international conventions. Alternative measures for legislating new laws or amending existing laws such as KMPPL for the acceptance of major contents of existing international conventions were proposed. Annex VI of MARPOL 73/78 into which the regulations for the prevention of air pollution from ship have been adopted has been recently accepted in KMPPL which should be applied to ships which are the moving sources of air pollution at sea rather tlnn in Korea Air Environment Conservation Law which should be applied to automobiles and industrial installations in land. The major contents of LC 72/95 have been accepted in KMPPL However, a few of substances requiring special care in Annex II of 72LC, a few of items in characteristics and composition for the matter in relation to criteria governing the issue of permits for the dumping of matter at sea in Annex III of 72LC, and a few of items in wastes or other matter that may be considered for dumping in Annex I of 96 Protocol have not been accepted in KMPPL yet. The major contents of OPRC 90 have been accepted in KMPPL. However, oil pollution emergency plans for sea ports and oil handling facilities, and national contingency plan for preparedness and response have not been accepted in KMPPL yet. The waste oil related articles if Basel Convention, which shall regulate and prohibit transboundary movement of hazardous waste, should be accepted in KMPPL in order to prevent the transfer if scrap-purpose tanker ships containing oil/water mixtures and chemicals remained on beard from advanced countries to developing and/or underdeveloped countries. International Convention for the Control if Harmful Anti-Fouling Systems on the Ships should be accepted in KMPPL rather tlnn in Korea Noxious Chemicals Management Law. International Convention for Ship's Ballast Water/Sediment Management should be accepted in KMPPL or by a new law in order to prevent domestic marine ecosystem and costal environment from the invasion of harmful exotic species through the discharge of ship's ballast water.

  • The right of hot pursuit is an exception to the general rule that a ship on the high seas is subject to the jurisdiction of the state whose flag she flies. The right of hot pursuit is provided in the United Nations Convention on the Law of the Sea. This paper discusses the requirements for the right of hot pursuit. The use of force should be avoided during hot pursuit. When force is unavoidable, it should not be used beyond what is reasomable and necessary in the circumstances.

  • 최근들어 선주책임과 관련한 국제사회에서의 논의가 심상치 않다. 해상안전 및 해양환경보전이라는 미명하에 선주책임을 대폭 상향 시키려는 의도가 다분하기 때문이다. 2008년 4월 8일 홍콩에서 아시아선주들이 회합을 갖고, 이러한 현황에 대해 심도 있게 논의하고 선주책임을 강화하려는 국제협약의 제정 및 개정 움직임에 적극 대응해 나가기로 했다. 다음은 선주책임을 대폭 강화하려는 국제협약의 제 개정 움직임을 요약하여 정리한 것이다.

  • 전 세계적으로 자율운항선박 및 유관 기술개발이 현재 진행되고 있으며, 기술개발과 상용화를 위해서는 법·제도적 규정 마련이 함께 진행되어야 한다. 국제해사기구(IMO)에서는 2017년부터 자율운항선박의 운용에 관한 규정 검토 작업에 착수하였으며 일본, 중국, 노르웨이 등의 국가에서는 자율운항선박의 운항 및 기술개발을 위해 자율운항선박의 운항에 대한 가이드라인을 제정하고 기존 법률의 정비방안을 발표하는 등 자율운항선박 기술개발과 함께 법·제도 규정마련에 박차를 가하고 있다. 현재 국내에서는 자율운항선박과 관련하여 자율운항선박기술의 개발 및 실증을 하기 위한 법적 근거가 없다. Methodology of Strength Analysis of Socket for AL Handrail in Offshore Platform (해양플랫폼 알루미늄 핸드레일 적용을 위한 소켓 구조강도 평가법)

  • The aluminum handrails used for promoting structural strength and weight reduction of the topside in an offshore platform are designed according to international standards (ISO, NORSOK, and Austria Standard), and consider the most conservative load combinations. Existing aluminum handrails are bolted to a socket when installed on the topside of a platform, and the amount of deflection of the handrail is largely influenced by the socket design. However, the importance of socket design has been overlooked, and furthermore, separate evaluation procedures or guidance for socket design are ambiguous. Therefore, a series analysis was performed for estimating the structural strength of aluminum handrails to obtain the governing parameters that minimize their deflection against loads. Experimental verification was performed to validate the structural safety of the new model, and we confirmed that all were satisfied within allowable deflection according to international standards. The developed model could be used in several areas in the future as it is lighter and more productive compared to existing models from overseas makers.
