국내 주거의 주종인 아파트의 구조형식은 벽식 철근콘크리트조로 경제성 때문에 대부분 고층으로 지어지고 있다. 철근 콘크리트구조 건물을 구체공사비중 상당부분이 거푸집공사에 투입되고 있다. 구체공사의 공기(工期)는 층당 소요일수로 산정할 수 있는데 공사비 절감 및 공기단축을 통한 시공효율상의 향상을 위해서는 지주시스템의 효율적인 전용(轉用)이 필수적이라 할 수 있다. 본 연구에서는 벽식구조 아파트의 현장조사를 토대로, 현재 사용되고 있는 지주시스템 및 바닥슬래브에 대한 응력해석을 수행하고, 이를 분석하여 공기단축의 가능성을 검토하였다.

In order to reduce the construction cost and period without degrading the quality, construction companies are making a lot of efforts to prefabricate and mechanize the construction process, and introducing and utilizing various techniques of construction time management in the process of construction. However, due to the various factors (such as weather conditions, labor factors, supply of equipment and materials, safety accident, etc) in the process of construction, construction projects are not frequently completed within the scheduled Period. This research is to examine the current status of construction time management and factors causing delay in construction with regard to the concrete work (such as form work, steel reinforcement, and concrete work) in building apartments.

최근 환경문제에 대한 일반인의 관심고조와 함께 3D 기피현상에 따른 철근공, 거푸집공 등의 기능노동자의 부족, 고령화, 외국인노동자 고용 현상과 낮은 노동생산성은 건설업계의 심각한 현안이다. 과거에는 재료비의 비중이 높았으므로 재료의 낭비를 줄이기 위한 합리화가 추진되었다. 그러나 현재는 노무비 비율의 급격한 증대로 인하여 공기단축이나 합리화, 시스템화를 통해서 경쟁에서 생존해 나가고 있다. 건축공사 중 특히 철근 콘크리트공사는 기술의 발전이 느리고, 시공 방법도 과거의 공법을 그대로 유지하고 있는 실정이다. 건축공사비 중 구체공사의 비율은 30% 정도이고, 그 비용 중 인건비가 50% 정도를 차지하고 있기 때문에 철근 콘크리트 공사는 아직도 기술 집약적인 산업이 아닌 노동 집약적 산업으로 간주되는 결과를 초래하고 있다.(중략)

민간건설공사 대금 지급보증제 도입과 불공정 특약 규정 무효 등을 주요 내용으로 하는 개정된 건설산업기본법이 지난 8월 6일 개정되어 내년 2월 7일부터 시행된다. 개정된 법률에서 계약금액 및 기간 변경 불인정, 계약체결 전 예측이 어렵거나 구체적으로 정하지 않는 내용의 책임 전가 등 건설공사 도급계약 내용 중 계약당사자 간 현저하게 불공정하고 불평등한 특약은 효력을 잃는다. 또한 민간건설공사에서 수급인은 계약이행보증에 대응하여 발주자에게 공사대금지급보증 또는 담보제공 요구를 할 수 있게 되며, 계약당사자가 대등한 입장에서 공정하게 계약을 체결하도록 표준계약서 사용이 권장된다.

건설산업기본법 시행령 시행규칙이 개정, 2008년 12월 31일 공포되었다. 이번에 개정된 건산법 시행령은 ${\bullet}$원도급자의 공사금액 조종사유 통보 내용과 절차 구체화 ${\bullet}$소규모 공사의 건설기술자 중복배치 허용 현장 수 확대, 건산법 시행규칙은 ${\bullet}$건설공사 하도급계약통보서 및 건설공사대장에 4대 보험료 등의 내용 명시 ${\bullet}$건설업 양도 공고절차 간소화 등의 내용이 개정되었다. 개정된 건산법 시행령은 오는 7월 1일부터, 시행규칙은 오는 4월 1일로부터 시행된다.

Activity-based productivity data can be used as an significant reference in many areas of project management such as performance evaluation and project planning. However, the existence of various factors influencing construction productivity makes it difficult to collect and analyze the productivity data. In the most of the domestic construction sites, there is no systematic method to collect and analyze the productivity data along with information on influencing factors; it is common to heavily rely on experience and intuition of field managers when dealing with construction productivity data. Therefore it is necessary to develop a management system for collecting and utilizing the productivity data as well as the factors influencing construction productivity. The main objective of this research is to define the construction productivity and its influencing factors at the activity level. In addition, methodologies on how to analyze the productivity data and to estimate productivity of future projects are proposed.

국토부는 하수급인의 계약상 이익을 부당하게 제한하는 특약유형을 구체화하고 하도급대금 직접지급 공공기관의 범위 확대 등의 내용을 담은 건설산업기본법 시행령 개정안을 지난 5월 27일 공포하고, 6월 30일부터 시행에 들어갔다. 다만, 건설근로자 퇴직공제 가입대상 공사범위 확대 관련 조항은 9월 30일부터 시행에 들어간다. 개정된 시행령은 하수급인의 계약상 이익을 부당하게 제한하는 특약유형을 보험료 미지급, 하자담보책임 전가, 하도급대금 조정 미반영 등으로 구체화 했으며 하도급대금 직접지급 공공기관의 범위를 공기업, 한국농어촌공사, 한국철도시설공단, 지방직영기업, 지방공사 및 지방공단 등으로 확대했다.

지방자치단체의 계약업무에 기초가 되는 지방계약법 시행령이 지난 11월 24일 공포되어 시행에 들어갔다. 이번 지방계약법 개정은 지난 해 12월 30일 개정된 국가계약법 시행령 제68조와 동일하게 제77조를 신설하여 '하자책임 구분이 용이하고 공정관리에 지장이 없는 공사에 대하여 기계설비공사와 같은 '설계서가 별도로 작성되는 공사로 명시함으로써 공공공사의 분리발주 활성화를 유도하는 내용을 담고 있다. 이로써 지방계약법에도 분리발주 허용 대상을 구체화 하고 발주기관의 장이 공사의 예산편성과 기본설계 등 사업의 계획단계부터 분리발주의 가능 여부 검토 조항이 명문화 됨으로써 지자체 분리발주가 더욱 활성화 될 것으로 예상된다. 이에 앞서 대한설비건설협회는 분리발주 법제화를 정부, 국회, 제18대 대선후보 등에 지속적으로 건의한 결과 박근혜 정부가 공공공사의 분리발주 법제화가 포함된 40대 중점 국정과제를 확정하고 공공공사의 분리발주 허용 대상과 활성화 조문이 포함된 국가계약법 시행령 제68조를 지난해 12월 30일 개정, 시행에 들어간 바 있다.

Construction contract have great possibility of dispute between contract parties because of long term performance of contract, various participation of the person concerned, effect according to external environment, etc. It is needed correct comprehension and construction management because good reason of claims depends upon contract document or clauses of the related laws and regulations in cases. The purpose of this study is to suggest desirable Interpretation principle for the harmonious management of the construction work in the cases or arbitration adjudication.
