$F{\ddot{u}}r$ den Schadensersatzhaftung des Arztes, sog. die Arzthaftung, ist es vornehmlich vorauszusetzen: die $Sch{\ddot{a}}digungsbehandlung$ des Arztes, die Rechtswidrigkeit und das Verschulden. Zur Problematik der $Fahrl{\ddot{a}}ssigkeit$ in der Stufe des Verschuldens handelt sich es in dieser Beitrag um die Kritisierung der Rechtsprechung. $F{\ddot{u}}r$ die Entscheidung des Verschulden im medizinischen Fehler kommt es darauf an, ob die Sorgfaltspflicht des Arztes verletzt wird. $Daf{\ddot{u}}r$ wird der medizinische Standard rekurriert, den die Rechtsprechung nicht aus materieller, sondern aus normativer Sicht begreift. Erstaunlich $un{\ddot{u}}bereinstimmend$ mit deren Leitsatz wird der medizinische Standard als $Ma{\ss}stab$ der Sorgfaltspflicht materiell - zutreffend nur im Ergebnis - behandelt. Die Sorgfaltspflicht in der Medizin bedeutet nicht die natur-wissenschaftliche Erkenntnisse, sondern eine "Best-$M{\ddot{u}}ssen$" Pflicht. Demnach ist der Standpunkt der Rechtsprechung, wonach den med. Standard normativ bewertet und die Sorgfaltspflicht darduch wieder normativ entscheidet, nicht anders als eine $w{\ddot{o}}rtliche$ Wiederholung. With the results of correlation analysis, it was possible to predict the fruit weight through the observation of soluble solid contents and flesh firmness, because both factors were closely correlated to fruit weight in all treatments. Moreover, these factors were confirmed to be useful indicators of forecasting consumer preference in the sensory evaluation. Research on autonomous vehicles is being actively conducted. As autonomous vehicles emerge, there will be a transitional period in which traditional and autonomous vehicles coexist, potentially leading to a higher accident rate. Currently, when a traffic accident occurs, the fault ratio is determined according to the criteria set by the General Insurance Association of Korea. However, the time required to investigate the type of accident is substantial. Additionally, there is an increasing trend in fault ratio disputes, with requests for reconsideration even after the fault ratio has been determined. To reduce these temporal and material costs, we propose a deep learning model that automatically determines fault ratios. In this study, we aimed to determine fault ratios based on accident video through a image classification model based on ResNet-18 and video action recognition using TSN. If this model commercialized, could significantly reduce the time required to measure fault ratios. Moreover, it provides an objective metric for fault ratios that can be offered to the parties involved, potentially alleviating fault ratio disputes.

Among the major rulings handed down in 2020, there were cases involving anaphylaxis, which is timely as a side effect of coronavirus and flu vaccine. And as a rare case, a ruling was handed down that if medical treatment was done so unfaithfully beyond the limit of patience of ordinary people, it can be an independent illegal act and a cause of compensation for emotional distress. The present work refers to the standards by which the due diligence and responsibility of the individual persons are to be determined and delimited. In this context, it has been proven that objective theory as a measure of due diligence is appropriate. From a moral point of view, when assessing due diligence, it makes sense to impose greater individual or higher performance demands on the perpetrator, but law and order require that due diligence should result from socially relevant human behavior. This experiment was carried out to investigate the replaceability of chemical fertilizer by SCB liquid fertilizer (SCB) in pear orchard for 5 years. The effects on the mineral content of leaf, fruit quality, yield and soil chemical properties are as follows: The mineral content of leaf showed no difference between the treatments; two SCB liquid fertilizer treatments based on the N (SCB-N) and K (SCB-K) content, and control (chemical fertilizer application). There were no significant differences in yield, titratable acidity and weight of the fruit although the figure of fruit weight was high in SCB-N treatment. Soluble solids content was higher in the SCB treatments than the control. Soil chemical properties such as the content of soil organic matter, available soil phosphate and exchangeable cation were not different, although soil pH was higher in SCB treatments. In conclusion, it is suggest that the use of chemical fertilizer in pear orchard could be replaced by the application of SCB liquid fertilizer because of the same effect on the growth of pear tree and soil chemical properties.
