A Study on the Improvement of Defect Management through Judicial Precedents of Landscape Construction Defect (조경공사 하자판례 분석을 통한 하자처리 개선방안 연구)

  • The purpose of this study was to analyze judicial precedents related on landscape construction defects(JPLCD) and suggested the improvement plan for dealing with it. The results are as the following: 1. Landscape construction defects litigations have been increased so far since 2000 and the duration of original trial was approximately 603 days, while appeal trials took up to 550 days. Therefore, the analysis revealed that settlement of disputes were lengthy and wasteful to consumers and constructors. 2. Judgement's cost accepted by the judge was only 53.6% of appraisal's cost appraised by appraiser, therefore it revealed appraiser overestimated the repair cost of landscape construction defects. 3. According to work classification categorized by Landscape Construction Standard Specification(2008) of the Korean Institute of Landscape Architecture, landscape planting amounted to 75% of JPLCD and plaintiff(consumers)'s prevailing rate of it reached 77% to be a serious burden to constructors. 4. According to JPLCD categorized by the type of dispute, defects caused by consumer's negligence for maintenance amounted to 29% and defendant(constructors)'s prevailing rate of it reached 64% to be the main responsibility of consumers. Further study will be required to make the judge standard of landscape construction defects through legal and technical research.

An Analysis of the Duration of the Construction Document Phase of Large Public Building Projects Delivered by the Total Solution Service from 2009 to 2014 (공공기관 발주 대형건축공사 실시설계 기간에 대한 분석 및 개선방안 -2009년부터 2014년까지 공공발주 맞춤형 서비스 프로젝트를 중심으로 -)

  • This paper analyzes the duration of the construction document (CD) phase of 42 large public building projects delivered by the total solution service of Public Procurement Services in Korea from 2009 to 2014. The quality of construction documents significantly affects the quality of construction and facility management. Thus, securing appropriate time for the CD phase during project planning is important for the quality of a project. Currently, the duration of the CD phase is planned based on the construction costs of a project following a notice of the Ministry of Land, Infrastructure and Transport. However, our analysis results showed that the correlation between the actual duration of the CD phase and construction costs is very weak. The actual CD phase takes 1.33-1.79 times longer than the planned duration. The practitioners who were interviewed, were already aware that the correlation between the duration of the CD phase and the construction costs is weak. They identified the complexity of the project, the extent of the design changes, project type, client characteristics, and others as more influential factors on the CD phase than the construction costs. To improve the quality of CDs, a new guideline for determining an adequate CD phase duration should be studied and developed.

  • The safety accident is one of the formidable issues in construction field, and in order to prevent safety accident, contractors perform safety education, safety control document, meeting with labors, and safety instruction in construction phase. However, safety accident is occurred continuously, it is needed to analyze which factors are affected to safety accident. day of the week, daily construction cost, and daily work task were selected as those factors. The result in this research represented that those factors were not considered as an critical one in safety accident. Because of approach limitation to safety accident, only two case studies were collected. If more safety accident cases are gathered in future study, it will clarify the cause of safety accident and will prevent safety accident.

분리발주 수주공사 현장탐방

  • 관악구 신림동에 위치한 관악우체국 청사 개축 기계설비공사는 정보통신부 조달사무소로부터 분리발주로 수주된 현장이다. 미작산업(주)(대표 배태석)와 (주)광운기전(대표 이광수)이 기계설비공사를 공동도급으로 시공하고 있으며 미작산업이 51%, 광운기전이 49%의 공사를 맡고 있는데 기계실 및 공조배관, 덕트. 위생배관 등 주요 공사는 광운기전이, 정화조, 자동제어, TAB, 연도 등 주로 외주제작은 미작산업이 시공하고 있다. 원래는 광운기전과 일성공업이 공동으로 수주받았으나 일성공업이 부도나는 바람에 일성공업의 보증업체인 미작산업으로 대체된 것이다. 공사금액은 13억9천 5백만원으로 지난 2003년 10월에 시작하여 오는 2006년 1월까지 완공예정이었으나 공사의 빠른 진행으로 6개월여를 앞당겨 오는 2005년 6월경 완공 예정이다.

The Rationalization through Comparative Analysis of Price Fluctuation Adjustment Method (물가변동 조정방법의 비교분석을 통한 합리화 방안)

  • There are index adjustment method and item adjustment method in estimation methods for price fluctuation rate of public constructions. A relevant regulation has put item adjustment method as a principle, but in most construction, contract sum adjustment has been made by index adjustment method. Hence, this study, by figuring out width and causes of the gap between index adjustment method and item adjustment method through direct comparative analysis, solved inequality caused by difference between them and suggested a rational way against irrationality of each method. For building operations of public housing construction, a detailed fluctuation rate by index adjustment method and item adjustment method of construction cost elements of the same construction, that is, direct material cost, direct labor cost and historical construction cost was estimated to analyze difference between two adjustments and establish its cause. Across the analysis, it was found that fluctuation rate by item adjustment method was estimated lower than that by index adjustment method and difference between methods for estimating fluctuation rate of quotation unit price and application of index unrelated to construction type and construction nature are main causes of the difference. This study has a significance in that, for smooth contract sum adjustment between contracting parties, it practically proved the real difference between adjustment methods by conducting comparative analysis of the difference in direct correspondence way.

  • The Korean economic crisis hit badly the local construction industry, especially during the year of the 1998 when the country took the IMF bailout proframme. Under the poor business environment, such as reduction of construction investment, financial difficulty from high interest rate, and increasing bankruptcies, restructuring measures were repuired for survival of the industry. It is obvious the restructuring process is essential for the future business success. regardless of the financial crisis. With this background, this research aims the contribute to improved construction management structure and strengthened international competitiveness of the industry through the cost reduction and productivity enhancement, by analysising and proposing and optimal level of the manpower structure of construction management organization With the subject of 24 construction fields of apartment houses in the capital region as of January 1, 1999, constructed by OO company having leaded the construction industry of the country so far now, the researcher performed the on the spot survey regarding the organization/manpower structure and construction contract amount.

2006년 하반기 건설공사 실적공사비 적용 공종 및 단가

  • 정부등 공공기관에서 시행하는 건설공사 예정가격 작성시 적용되는 2006년 하반기 실적공사비 적용대상 공종 및 단가 931개(기계설비 216, 건축 335, 토목 350)가 지난 8월 14일 공표되었다. 실적공사비 단가는 재료비, 노무비, 직접공사 경비가 포함된 공종별 단가를 계약단가에서 추출하여 유사공사의 예정가격 산정에 활용하는 방식으로 공공건설공사의 예정가격 작성시 적용되고 있다. 또한 실적공사비 단가는 공공건설공사의 설계조건이 유사한 공종을 대상으로 계약단가가 설계단가 대비 ±25% 범위 내의 단가로 2006년 하반기 실적단가 설계가 대비 평균 낙찰률이 70% 수준이다. 대부분의 공공기관에서 예정가격 작성시 적용하고 있는 실적공사비 단가는 종전의 표준품셈에 의한 예정가격 작성시보다 공사예정가격이 낮게 산정되고 있다. 따라서 설비건설업계도 이를 감안하여 반드시 적정공사비를 확보할 수 있는 금액으로 입찰에 참가해야 한다.

  • 본 논문에서는 국가 경제성장률과 국내 전기공사실적 증가률에 대한 상관관계를 비교분석하였으며, 연간 전기공사 실적에 대한 항목별 구성비율 중 노무비가 차지하는 비율을 분석하였다. "국가를 당사자로 하는 계약에 관한 법률 시행령 및 시행규칙"과 회계예규인 "예정가격 작성기준"에 근거하여 원가계산에 의한 전기공사 예정가격 산정의 기초자료로 활용되는 전기부문 표준품셈 체계개편이 전기공사업에 미치는 영향을 최근 발주된 대형공사에 체계개편 전과 체계개편 후 공사금액을 비교하여 종합적으로 분석하였다.

Improvement on the Managerial Method of Price Fluctuation System (물가변동제도 운영방식 개선방안)

  • There are several causes to recalculate the contract amount in public construction projects. Among them, the escalation clause was introduced in 1969 and now the condition to recalculate the cost is effective after 90 days from the date of contract and the rate of fluctuation should be more than 3% from the date of bidding. The two calculation methods for the rate of fluctuation are item-adjustment and index-adjustment. According to the results of investigation into 4 public institutions and 163 projects, all of them have used the method of index-adjustment and the rate of projects that spend over 6 months obtaining the approval of contract amount adjustment is more than 90%. The reason for spending lots of time is caused by problems of the calculation method on the price fluctuation rate. Therefore, it is necessary that the calculation method should be diversified to cope with the problems and a option of the builder should be expanded as well. Furthermore, if the way to apply correction factors to construction price index and average index based on the producer and consumer price index made by the bank of Korea is added, then the duration will be reduced without additional expenses. This study proposed the diversification of the calculation method using price fluctuation rate and builders' expanded options as improvement on the managerial method of Price Fluctuation System for the prompt and efficient contract amount adjustment.

  • Article 64 of the Enforcement Decree of the National Contract Act The requirement of the pre-amendment statute related to the adjustment of the contract price was 5% or more of the price fluctuation rate from the date of the contract. However, the meeting requirement was changed from 5% or more to 3% or more from the date of signing of the Presidential Decree No. 19035 to 2005. 9. 8. The method of adjusting the contract amount was also changed to determine the contractor's desired adjustment method at the time of contract. Alleviating these requirements and revising the empowerment of contract partners is intended to prevent difficulties in achieving smooth objectives by applying to public construction contractors without unfairly benefiting or unfavorable to contract partners. Even if the standards are relaxed and the rights are secured as described above, if the existing provisions for the adjustment of price fluctuation are applied, unlike the original purpose of the government system, the Korea Bank's price economic statistics classification method and the contract construction classification criteria applied in public construction work Due to the inconsistency, it can be seen that the amount of adjustment for price fluctuation by construction type is excessive and underestimated. Therefore, the purpose of this study is to analyze problems through cases and to make appropriate construction cost adjustment through improvement measures.
