Domestic construction industry accounts about 15% of Gross Domestic Product(GDP) and Korean government spends approximately 50 trillion won per year for public infrastructure projects. Effective management of public construction projects would result in cost saving and enhance financial stability of the government. In doing so, the government promoted a new budgeting system, Continual Budget Method(CBM) as a part of public project performance enhancement program published in 1999. This research mainly attempted to investigate and analyze the impact of new budgeting in term of cost and schedule performance. Based on the analysis result of n2 projects. The new budgeting system could save project cost by 9.83y. Due to the saving of indirect costs from reduction. Although limited government budget cannot allow all the projects to be excuted with the new budgeting system, the new budgeting system should be more-widely utilized in the public sector because of its proven benefits from this research.

Recently construction companies' capital condition has been aggravated due to low profit, fierce competition and market contraction. For this reason, the companies rely on public construction projects that protect construction fee by regulations. Despite these regulations, problems regarding progress payment are constantly happening. Also, insufficient analysis on interaction between contractors makes policy making difficult. Thus, in this study, interaction between contractors are quantitatively determined according to delay of application and payment based on current public construction regulations on construction stage. A system dynamics model is used, which analyzes the problems based on an interaction between contractors, and solutions for progress payment application and payment delay are suggested according to the research results.

Although Public Construction Works in Korea have been executed according to Government Contract Act, and nature of contract is very complicated. So it is difficult to define liability for the defects. Therefore the studies on the defective performance and contractor's defects liability were remained one of the non-cultivated virgin land. As a result, contract privy waive the right to claim or generally resolve the problems. Therefore domestic and overseas liability for the defects was investigated and liability for the defects, under and after construction, on the defective performance and defects, was analysed. With a literature research, contractor's defect liability was systematically analyzed, problems were defined and resolution of the problem were suggested item by item in this study.

This study aims to propose a set of improvement devices for construction dispute resolution clause of public improvement project in Korea. To do so, the study addresses the system and procedure of construction dispute resolution in domestic and overseas, and reviews precedent cases, specifically focused of a selective arbitration case. In public sector's initiated contracts, the absence of c)aim procedure clause is unable to response to the claims in timely manner, and the ambiguity of clause o( selective arbitration make it difficult to resolve a dispute by arbitration. Thus, in this study alternative dispute resolutions are explored as a way to resolve various construction disputes of public-initiated project in developed countries.

Construction uncertainties are frequently exposed to the claims. In most cases, an interpretation of the claims is based on the construction contract. Therefore, the key points of contract negotiation are how to fairly distribute the contract risks to the client and contractor. For these, a FIDIC that is considered as an international standard contract form would be a good reference to decide reasonable contract risk distribution. In order to find out any unreasonable and unfair contract clauses at the general conditions of contract applying generally to public construction project in Korea, this study surveys, analyses and evaluates the general conditions of contract based on a FIDIC, and then proposes a risk mitigation methodology to response those clauses' risk factors reasonably.

재정경제부는 지난 4월 28일 정부계약제도 개선안을 확정하고 29일부터 1천억원 이상 대형공사를 제외한 공공공사의 낙찰 하한율을 동전보다 2.8$\~$10$\%$ 상향조정토록 한 적격심사기준을 개정했다. 또 10억원 미만 소규모 시설공사는 시공실적을 평가하는 한편 기존업체와의 역차별을 해소하기 위해 시공실적에 가산점을 부여하게 된다.

기획재정부는 불공정하도급거래로 과징금을 부과받거나 하도급법을 상습적으로 위반한 자의 경우 공공공사 PQ입찰 시 최고 7점의 감점(종전 3점)을 부과하는 등 건설 하도급사 보호를 위해 계약예규를 개정했다. 이번 계약예규 개정은 대한설비건설협회가 건설산업 공생발전위원회와 동반성장위원회에 참여하면서 회원사의 권리보호를 위하여 건설공사 불공정하도급 거래 방지 제도개선을 지속적으로 추진한 결과이다.
