The Rationalization through Comparative Analysis of Price Fluctuation Adjustment Method (물가변동 조정방법의 비교분석을 통한 합리화 방안)

  • There are index adjustment method and item adjustment method in estimation methods for price fluctuation rate of public constructions. A relevant regulation has put item adjustment method as a principle, but in most construction, contract sum adjustment has been made by index adjustment method. Hence, this study, by figuring out width and causes of the gap between index adjustment method and item adjustment method through direct comparative analysis, solved inequality caused by difference between them and suggested a rational way against irrationality of each method. For building operations of public housing construction, a detailed fluctuation rate by index adjustment method and item adjustment method of construction cost elements of the same construction, that is, direct material cost, direct labor cost and historical construction cost was estimated to analyze difference between two adjustments and establish its cause. Across the analysis, it was found that fluctuation rate by item adjustment method was estimated lower than that by index adjustment method and difference between methods for estimating fluctuation rate of quotation unit price and application of index unrelated to construction type and construction nature are main causes of the difference. This study has a significance in that, for smooth contract sum adjustment between contracting parties, it practically proved the real difference between adjustment methods by conducting comparative analysis of the difference in direct correspondence way.

  • The business market of architecture has got a system that controls a deposit according to the price function. This system is written on a law of contract about countries. So the main body of construction has to make a reasonable contract. This study is written about a rate of numerical index on controling a deposit. We tried to fine problems and solutions of labor expenses, instrument costs and material costs which is so big and changable on the construction market Labor expenses are expressed according to the rate of construction scale between direct and indirect cost that applies ability of works. Instrument costs are expressed according to an output method of a unit price annually and a weight allowance of local instrument conditions and use frequence. The last material costs expressed according to a local weight allowance make a decision of the material cost index. They applies locally relative index more than absolute one on what uses the price rate of producers and importations. This solutions are not enough to apply to the real market, so it needs to exam and to be on the market after a feasibility study.

  • The loss of potential opportunity profit which is consisting in the partial markups of the corporation would taking placed in related with the time-delay deeply, has customarily disregarded in contract adjustment under the principles of denial of cost accounting method, declined conjecture in the point of benefits and protection of the law in scope of compensation and the restricted conditions of constant contract. It is being resulted from that the policies of the general principles of accounting standards which is subjected to ask an objective data and evidence, and the denial system as a debt derived from imperfect legal theory applied by current law. Therefore, it is necessitated to find if any irrationality in the positive system is and further to draw an improved reasonable measures to adopt by review of constant system preparing tile reasonableness with the method of suitable quantification devices provided that any time-delay is induced by the party.

건설정책 - 하도급계약 '구두발주' 관행 없앤다!

  • 공정거래위원회(위원장 김동수)가 하도급거래에서 서면발급 및 보존관행을 정착시키기 위해 "바람직한 서면발급 및 보존에 관한 가이드라인"을 제정해 1월 1일부터 시행에 들어갔다. 가이드라인에는 ${\bigtriangleup}$하도급계약서(추가 변경계약서 포함) ${\bigtriangleup}$하도급계약 확인서면 ${\bigtriangleup}$목적물 등 수령증명서 ${\bigtriangleup}$검사결과 통지서 ${\bigtriangleup}$감액서면 ${\bigtriangleup}$기술자료 제공 요구서 ${\bigtriangleup}$계약변경 내역 통지서 등 7건은 의무발급을, ${\bigtriangleup}$목적물 등의 검사결과 및 검사 종료일 ${\bigtriangleup}$하도급대금의 지급일 지급금액 및 지급수단 ${\bigtriangleup}$설계 변경 등에 따라 하도급대금을 조정했을 때 사유 ${\bigtriangleup}$원재료 등의 가격변동 등에 따라 수급사업자가 하도급 대금 조정을 신청한 경우 협의내용 및 조정사유 등 7건은 보존 서면으로 명시했다. 이번 가이드라인은 동반성장협약 평가 항목에도 반영될 예정이다. 또한 공정거래위원회는 하도급법상 서면발급 또는 보존의무를 위반해 경고조치를 받을 때에는 교육이수를 권고하는 한편, 서면 미발급 등 혐의가 반복될 때에는 최고경영자(CEO)가 교육(3개월에 3시간)을 이수토록 규정했다. 특히 서면실태조사에서 서면 미발급 미보존 혐의가 장기간 상습적으로 이뤄졌다는 사실이 확인되면 직권조사를 거쳐 엄중할 방침이다.

지방계약법 시행령 개정

  • 행정자치부가 지난 9월 20일 지방계약법 시행령 개정안을 공포하고 이날부터 시행에 들어갔다. 개정된 시행령은 당초 행자부가 분리발주를 억제하기 위하여 지방계약법 제77조를 개정하여 '공사의 분할 및 분리발주 시에는 행정자치부 장관 등 상급기관에 보고'토록 입법예고 되었으나, 우리협회는 분리발주 활성화를 위하여 '기계설비공사 분리발주 근거 조항인 단서3호는 제외'토록 추진함에 따라 우리 협회의 의견이 반영된 시행령이 개정되었다. 또한 하도급관리계획을 불이행한 원도급업체는 앞으로 부정당업자로 제재받아 입찰참가자격이 최소 1개월에서 최고 6개월 미만까지 제한된다. 이밖에 물가변동과 관련하여 단품슬라이딩제를 도입해 특정자재의 가격이 15% 이상 등락할 경우 계약금액을 조정할 수 있게 했다. 이중 지방계약법 시행령 제 77조 개정 내용의 의의 및 우리 설비건설업과 신.구조문 대비표는 다음과 같다.

  • Delay schedule coming about duration extension is happening essentially because public construction project consist of many sub contractor. The method which can calculate delay day is suggested by many studies in case of happing delay schedule, but It is difficult to apply to real construction project because there is no mention about the control of The law of contract according to delay schedule. The law of Contract which is cost of account has more uncertain problem than FIDIC condition of contract. This study suggests method which can make extension of duration procedure clear in case of happing the reason of design change related with activity duration during carrying on construction, and a submission process of the reason of duration extension and modify schedule making way about section which is basis of calculating contract amount clear.

  • This study is the results to survey on the problems and improvable Policies for current escalation system in construction contracts, through a Delphi survey to experts. From the survey results, it is desirable to decide the fluctuation rate of construction cost, which is the requirement of escalation clause, on the basis of inflation rate or construction cost index. The desirable price fluctuation rate is proposed as a $3\%$ level. However, it is difficult for construction companies to cope with the sudden increase of material price in advance, arising from short-term shock factors such as exchange rate and international raw material's price. Accordingly escalation system for specified materials, as an exceptional mode, should be introduced. As a method to calculate the fluctuation rate, ARCA(adjustment rate for the categories of articles) is more desirable than ARI(adjustment rate for an index), because the ARCA can be more reflected the characteristics of each construction work.To rationalize the ARI method, it is needed to announce the wage index, material index and machinery expense index via detailed classification by construction types. Also, it is desirable to prescribe the bidding date as a starting date of the price change, rather than contact signing date. considering the price change can happen since the biddiilg stage.

  • The purposes of this study is to survey unfair aspect of specific provisions in the construction contract. The research method of this stud)'includes judicial precedents and a questionnaier survey. The result of thus study are as follows: 1) unfair payment condition gives increase to faulty construction. 2) shift of the responsibility gives increase to delay, 3) adjusted contract sum gives increase inappropriate compensation to contractor.
