Way of Trust Restoration through Uplifting Police Integrity (경찰공무원 청렴성제고를 통한 신뢰도 회복방안)

  • Recently, Police integrity has been issued on the media, which cause discredit of police organization. Although high level of morality and integrity are required compared to other occupational groups due to their authority to exert legal force to the citizens and a variety of policies have been enforced by the National Police Agency for the purpose of uplifting the integrity of the officers, in reality, corruption had not yet been eradicated. At this point in time, this study attempted to draw implications for uplifting integrity by utilizing domestic and foreign preceding studies and statistical data related to police corruption and uplifting integrity. The inspection system through whistle-blowing was pointed out as a problem in the institutional framework that hinders uplifting integrity of the police officers and the perception in which police officers are regarded as potential criminals was also pointed out as a problem. Also, vague standards of disciplinary action in examining an offense of a police officer and lack of care for those who were disciplined in the past which affects loyalty to the organization were presented as problems. Based on such suggested concerns, policies for uplifting integrity and restoring citizens' trust in the policies officers were proposed. The proposed agenda were warning the police officers by presenting clear and specific category of corruptive behaviors, expressing the necessity of devising a system that prevents the officers from committing serious crimes by discovering problematic officers earlier through introduction of Early Warning System(EWS) of US and Australian police in order to break away from exposure-oriented inspection system, and reinforcing the testing of integrity in the new employment process.

  • 현대사회 환경의 변화와 개인생활의 복잡 다양화는 시민의 안전한 삶을 위협하는 요인들로 특히 범죄피해를 당하게 되면 피해당사자는 정신적 물질적으로 회복이 힘들고 피해의식과 두려운 기억에 의한 원만한 대인관계의 불가능이나 가족과 친지에게도 큰 상처를 남기게 된다. 경찰의 국민보호는 기본 임무이며, 주요 임무 중 하나인 수사도 국민보호의 차원에서 이루어지고 있는 활동임에도 이러한 경찰활동은 피해자의 신뢰와 협력 없이는 목적을 이룰 수 없으므로 이들 범죄피해자를 위하여 경찰에서도 적극적인 노력을 기울여야 한다. 본 연구에서는 경찰의 범죄피해자 보호 실태와 문제점의 주된 내용을 살펴보고, 그에 대한 대책을 살펴보도록 한다.

  • 국제투명성 기구가 발표한 우리나라 부패인식 지수는 2008년을 기점으로 매년 하락하는 추세를 보이고 있으며, 지난 2013년 55점(세계 46위, OECD 34개국 중 27위)를 나타내고 있다. 현대사회에서 공직자의 부패문제는 과거부터 꾸준히 제기되어온 해결과제라고 할 수 있으며, 최근 몇 년간의 문제만은 아니라는 것을 의미한다. 다산 정약용의 저서 "목민심서" 율기육조 중에서 제2조 청심에서 청렴은 수령의 기본임무이고, 모든 선의 근원이요 모든 덕의 근본이니, 청렴하지 않고서 수령 노릇을 할 수 있는 자는 없다고 하였다. 이는 공직사회의 청렴성을 중요시 하는 것으로 현대사회를 살아가는 공직자에게 귀감이 된다고 할 수 있을 것이다. 그러나 최근 경찰공무원의 청렴성이 대중매체의 도마에 끊임없이 회자되며, 이는 경찰조직구성원 전체에 대한 신뢰를 저하시키는 요인으로 작용되고 있다. 따라서 본 연구에서는 경찰부패와 청렴도 제고에 관련되는 선행연구를 검토하고, 경찰조직의 내 외적 환경에서의 청렴도 제고를 저해하고 있는 문제점을 도출하여, 이에 관한 개선방안을 제시하도록 하였다.

A Study on limit of Policeman's Exertion in Police Questioning (불심검문시 경찰관의 유형력행사의 한계)

  • Police questioning is police measure for acquiring information or inquiring an identification without questionee's will in order to accomplish the goal under the Police Act. However, like spear and shield, it has its own inherent limits between both sides of public power and human right and has stirred an hot issue in our society for longtime. The core problem is whether policeman can force a questionee stop when the questionee refuses policeman's stop requirement, the first step for police questioning. Some opinions argue that police questioning has somewhat effects on crime prevention and suspect arrest but people still have inconvenience and refusal from experiences of reckless police questioning in the past. Because of this, the police needs to recover people's trust on police questioning. In order to do so, in case of police questioning, human right should be superior to crime prevention or suspect arrest. This is the time's call. So when there is a police questioning, policeman's exertion of it on the questionee who refuse it should be conducted under strict conditions.

The Subjectivity Perceptions of the Image of the Police (경찰 이미지 제고에 대한 주관적 인식유형)

  • The purpose of this study is to understand the types and features of subjectivity perceptions of the police by applying Q methodology that draw upon schematic model in subjectivity study. A survey was carried out among police officers in Gangwon province, South Korea, to classify the 61 selected Q-statements into a normal distribution using a 11 point scale. The collected data was analyzed using QUANL program, and principal component factor analysis using varimax rotation was used to identify the types of perceived image of the police. Type I can be categorized by a strong concern for the education & manpower management, Type II can be categorized by advocating for duty observance, Type III can be categorized by the pursuit of publicized police image and Type IV can be categorized by the suggestions for legal improvement. The use of Q methodology provides insights into the image of the police that would not be available through traditional methodologies and offers a foundation for essential efforts to address and overcome concerns about the image of the police.

Influencing Factors of Attitude toward Secondary Victimization in Sexual Assault Cases by the Police Officers (수사경찰의 성범죄에 대한 2차피해 인식요인 탐색)

  • Police officers in charge of investigating sexual assault cases are likely to have suspicions in the process of investigation to find out the truth about the case, which leads to secondary victimization to the victims, and these concerns are often unveiled as social problems. This study suggested the research question that what the causes of secondary victimization derived from the police officers in charge of sexual assault investigation are. The purpose of this study was to contribute to the restoration of the trust of the police by preventing or minimizing the secondary victimization of sexual assault cases in the investigation process. Among the personal characteristics of police officers, rape myth, tolerance n violence and hostile gender discrimination influenced suspicion and prejudice, and rape myth and hostile gender discrimination affected the lack of sensitivity. Among the workplace-related characteristics, the duration of employment and experience in sexual assault cases affects the lack of sensitivity. In addition to the revision of the law and the improvement of the system of sexual assault, the prejudice against the sexual assault inherent in the attitudes and behaviors of the police officers in charge of the sexual assault cases should be improved.

A Study on the Empirical Basis of Prejudice towards the Credibility of Persons under Investigation (수사관 편견의 실증적 근거에 관한 연구 - 교통사고 피조사자의 인구사회학적 특성에 따른 수사관의 편견을 중심으로 -)

  • Police officers have an obligation to their profession to continuously strive for fairness for all the people they serve. However, some police officers are believed to have developed prejudicial attitudes towards some groups of the society and exercised police power unfairly against them. Especially, when the actions of the police are prejudicial during criminal investigation, this can affect outcomes of the investigation. Therefore, the police need to tackle this problem effectively. In order to develop a preventive strategy, the police must have a clear understanding of prejudice. However, there has been little research on this topic in Korea. Thus, this study attempted to fill the gap. The purpose of the current study was to examine if prejudice of police officers are statistically valid. In order to answer this research question, the present study utilized the results of 173 polygraph examinations that had been employed to investigate traffic accidents in a provincial police agency in 2006. From the polygraph examination reports, information relating to the subjects could be identified and this information was analyzed, using a logistic regression. The results of the logistic regression revealed that most of the variables relating to the subjects did not affect the credibility of the subjects' statements. This means the police officers' belief that some groups of people make false statements more often than others during criminal investigation is an unfounded prejudice.
