  • 우리나라 경찰은 광복 이후 경찰제도가 국가경찰제도로 자리 잡아 오랜 기간 동안 중앙집권적 경찰제도로 운영되어 왔으며, 1991년 「경찰법」의 제정으로 경찰위원회가 설립되었다. 경찰위원회는 경찰행정과 관련된 주요 정책 등을 심의·의결하는 기능을 가진 합의제 행정기관이지만 본래의 경찰위원회 기능을 수행하지 못하고 단순 자문기관에 불과하다는 문제점이 있다. 이에 2020년 12월 「경찰법」 전부개정안이 통과되어 법이 개정됨에도 불구하고 국가경찰위원회의 운영과 구성에 있어 문제점이 여전히 존재하고 있다. 이에 본 연구에서는 국가경찰위원회의 문제점과 개선방안을 제안하고자 한다.

  • 경찰은 2015년 '범죄피해자 보호 원년'을 선포하고 전국 경찰서에 피해자전담경찰관을 배치하는 등 지속적인 보호조치를 실시하였고, 2018년에는 경찰법과 경찰관직무집행법의 경찰 임무와 경찰관 직무 범위에 '범죄피해자 보호'를 명시해서 범죄피해자 보호를 강화하고 있지만, 강력사건에 피해자전담경찰관이 현장 출동자와 동행하도록하는 등 현재보다 경찰의 범죄피해자 보호제도가 더 확충되어야 하며, 사건의 가해자에 대한 철저한 수사도 필요하다. 경찰은 범죄가 발생하지 않도록 예방하여야 하고, 범죄가 발생한 경우에는 수사 전과정에서 범죄피해자 보호중심으로 수사하여야 국민의 신뢰도 얻고 실체진실발견에도 도움이 될 것이다.

General Idea of Danger in Police Law (경찰법상 위험개념)

  • The exercise of police power for danger prevention gives top priority to the prevention of injury occurrence. However, the controversy over the concept of danger has hitherto focused on the limit establishment, namely which scope is to be a target of prevention in the danger prevention area of the Police Law. After all, the police's duty for maintaining public peace and order is forced to be peformed through individual measures for danger prevention, and the preventive police action, which aims at the prevention of danger against the protection interest in the Police Law, can be performed on the premise of a precise understanding of danger in order to carry out a legitimate preventive police action. In addition, it examines the legal meaning in each constitution element by dividing the minimum common components of danger into loss, sufficient probability and time accessibility, and the interpretation problem of danger as uncertainty concept.

  • In 19th May 2014, the government announced that KCG(Korea Coast Guard) is dissolved regarding responsibility for recently accident which is Sewol ferry disaster. But KCG, a central administrative agency is responsible for protecting maritime sovereignty of South Korea; the most basic and indispensable organization. Furthermore, The purpose of KCG is to provide the safety of the public and keeping of public order by prescribing matters necessary for the securement of maritime security, maintenance of public order and protection of marine resources & facilities. Therefore, In this article, I would like to suggest tentatively named FRAMEWORK ACT ON KOREA COAST GUARD's management plan which could reflect the scope of functions. It means we examine the current state of KCG, and would like to signpost for the most ideal way of legal system in Korea Coast Guard. Finally, this treatise is expected that this research can be a guideline contribute to improving Korea Coast Guard relevant laws even a little.

  • Korean police have been established as a national police system since the liberation of Korea and have been operated as a centralized police system for a long time, and a police committee was established under the enactment of the Police Act in 1991. However, the National Police Commission has a problem that it cannot perform the functions of the original National Police Commission because it is only a simple advisory body, not an institution that reviews and decides major policies related to police administration. As a result, despite the passage of a full amendment to the Police Act in 2020 and the revision of the Act to the Organization and Operation of the National Police and Local Police, operational and compositional problems still exist. Therefore, this study intends to propose the current state of operation and problems of the police committee system and measures for improvement.

  • 2023년 우리나라에 발생한 재난은 남부지방의 가뭄, 태풍 카눈에 의한 폭우, 7월~9월 폭염 등의 자연재난과 4월 5일 분당 정자교 붕괴, 4월 29일 검단신도시 붕괴사고, 7월 13일 대구 염색산업단지 황산 누출 등의 사회재난이 발생하였다. 이전 2022년에는 022년 10월 29일, 서울 이태원역 부근에 대규모 인파가 한번에 몰리며 압사사고가 발생하여 159명이 목숨을 잃고 196명의 부상자가 발생하였다. 이처럼 다양한 형태로 발생하는 재난에 대하여 우리나라는 「헌법」과 「재난 및 안전관리 기본법」에서 재난으로부터 국민의 생명·신체 및 재산과 국가의 피해를 줄이기 위해 노력하여야 한다고 명시하고 있다. 재난은 다양한 특성을 지니고 있으며, 학자들의 일반적 견해는 누적성, 불확실성, 복잡성, 인지성 등의 특성을 들고 있다(재난관리론, 2020). 특히, 사회재난은 발생위치, 시점, 피해, 규모를 예측하기가 상대적으로 매우 어렵기에(장대원 외, 2019) 불확실성의 특성을 강하게 보여주고 있다. 이러한 사회재난의 특성은 자연재난과 비교하여 사람들에게 물리적·심리적 영향을 크게 미칠 뿐만 아니라 단기간에 회복하기 어려운 특성을 지닌다(신재헌 외, 2020). 이에 대하여 많은 국민들은 심각한 사회재난이 발생할 때마다 정부차원의 적극적 재난관리 및 통제능력 향상을 요구하고 있으나, 사회재난 특성 상 특정 기관 중심으로 대응하기에는 많은 어려움이 있다(신재헌 외, 2020). 우리나라 경찰은 2021년 7월부터 자치경찰제도를 실시하며 국민의 생명·신체 및 재산의 보호, 범죄예방, 수사 및 질서유지업무 이외에 국민들의 봉사·서비스 행정 요구의 증대로 인한 적극적·능동적 경찰활동으로 변화하게 되었다(조호대, 2014). 이에 따라 경찰은 경찰의 재난관리체계를 확립하고, 경찰의 재난관리에 관한 사항을 규정함을 목적으로 2012년 「경찰 재난관리규칙」을 제정하였다. 이에 본 연구에서는 경찰의 재난 발생 시 역할이 무엇이며, 특히 사회재난 시 경찰의 적극적 대응 방안은 무엇인가에 대하여 살펴보고자 한다.

Comparative Study of Security Services Industry Act and Police Assigned to Special Guard Act - Focused on special guards and police assigned to special guard duty - (경비업법과 청원경찰법의 비교 연구 특수경비원과 청원경찰을 중심으로)

  • Police Assigned to Special Guard Act was legislated in 1962 to solve issues regarding the protection of various staple industrial installations, and in 2001, the Security Services Industry Act was revised to establish an effective security system for important national facilities. Thereby the Special Guards System was instituted. The current law has two parts, with the Police Assigned to Special Guard System and Special Guards System, and many scholars have actively discussed the appropriateness of the integration of both systems to solve problems caused by a bimodal system. However, in spite of these discussions taking place in the academic world, the idea of unification lost its power when the guarantee of status regulation was established for the police assigned to special guard. Strictly speaking, police assigned to special guard is a self-guard, and a special guard is a contractual guard. So, both of them have pros and cons. Thus, it would be desirable to give a legal, constitutional guarantee for both systems by strengthening each of them and making up for the weakness of each of them rather than trying to unify police assigned to special guard and special guard. To begin this process, we need to revise unreasonable legal provisions of Security Services Industry Act and Police Assigned to Special Guard Act as below. First, since the actual responsibilities of special guards and police assigned to special guard duty are the same, we need to make the facilities which they use equal. Second, legal provisions need to be revised so that a special guard may perform the duties of a police officer, according to the Act on the Performance of Duties by Police Officers, within the facility that needs to be secured in order to prevent any vacancy in the guarding of an important national facility. Third, disqualifications for the special guards need to be revised to be the same as the disqualifications for the police assigned to special guard duty. Fourth, it is reasonable to unify the training institution for special guards and for police assigned to special guard duty, and it should be the training institution for police. On-the-job education for a security guard needs to be altered to more than 4 hours every month just like the one for police assigned to special guard duty. Fifth, for a special guard, it is not right to limit the conditions in their using weapons to 'use of weapon or explosives' only. If one possesses 'dangerous objects such as weapon, deadly weapon, and so on' and resists, a special guard should be able to use their weapon against that person. Thus, this legal provision should be revised. Sixth, penalty, range of fines, and so on for police assigned to special guard duty need to be revised to be the same as the ones for a special guard. If we revise these legal provisions, we can correct the unreasonable parts of Security Services Industry Act and Police Assigned to Special Guard Act without unifying them. Through these revisions, special guards and police assigned to special guard duty may develop the civilian guard industry wholesomely under the law, and the civilians would have a wider range of options to choose from to receive high quality security service.

  • 최근 해양자원 및 산업개발, 해양관광산업 등의 발달로 바다에 대한 관심은 더욱 증가하고 있으며 국가 간 경쟁도 나날이 치열해지고 있어, 바다를 무대로 활동하는 해양경찰의 중요성은 더욱 커지고 있다. 해양경찰의 가장 중요한 임무는 해양에서 국민의 소중한 생명과 재산을 보호하는 것이다. 이를 위해서는 경비함정을 안전하게 운항하는 것이 가장 중요하다. 경비함정을 안전하게 운항하기 위해서는 선박운용에 필수인 항해기초 항해학, 연안항법, 전파 및 레이다 항법, 항해계기, 해상기상, CORLEG(항법), 함정운용, 함정조종론, 해사일반(함정의 감항성), 해사영어(SMCP), VTS 교육과 SHS를 활용한 함정운항 심화 교육인 선위측정(GPS 및 레이다이용), CBT 실습(항해장비 운용법, 조함 명령법), 시뮬레이션 MOCK-UP 실습(상황별 항해실습, 자기주도실습, 함정운용술 고도화)과 더불어 함정의 비상상황에 대비한 교육 및 다양하고 심도 있는 항해 전문화 교육이 필요하다.

A Study on the Appropriate Management of Maritime Police Authority in Korea Coast Guard: Focusing on the Japan Coast Guard (해양경비안전본부의 해양경찰권 적정 운영방안에 관한 연구: -일본 해상보안청과의 비교를 중심으로-)

  • Regarding the [Government Organization Act; which is legislated on 19th November, 2014] Korea Coast Guard(KCG) has been re-organized and belong from Korea Coast Guard shall be established under the Minister of Oceans and Fisheries to Ministry of Public Safety and Security. Furthermore, National Police Agency(NPA) Commissioner has the right for administer duties concerning investigation and information by succession from Korea Coast Guard Commissioner. That means that main rule has been moved from prior KCG to Ministry of Public Safety and Security(MPSS) and NPA currently which is dual structure. Meanwhile, This kind of organization change has been effective to investigative agency which exert KCG's call of duty and causes needs of variety problems. In other words, There are quite huge changes such as KCG's reduction of their work, call of duty and re-organization regarding revised government organization act. However this change - including re-organization by government, was not able to take current MPSS's special features such as organization specialty and legal rights. It means, the current change has not been taken present law system CRIMINAL PROCEDURE LAW and there was no preparation to stable maritime police authority action as well. To sum up, this revised GOVERNMENT ORGANIZATION ACT is supposed to provide total, quick security service by establishing strong disasters and safety control tower. However they only contains few area such as organization revision regarding 'Sewol Ferry Disaster', they was not able to contain the other parts of Society. Therefore, in this article I would like to check the part of re-evaluation of current change made by KCC's organization revision. It is supposed to provide better legal stability by making clear of work area by government agencies who acts maritime police authority.
