Systematic Improvement for the Efficient Operation of the Private Security Field (민간경호경비 현장의 효율적 운영을 위한 제도적 개선방안)

  • 본 논문에서는 시큐리티 민간경호경비 현장의 현실적인 문제점을 도출하고 개선방안을 찾아내기 위한 조사를 위해 민간경호경비의 개념과 특성, 다양한 경비원의 고용형태를 알아보고, 경비업법상 민간경호경비현장의 효율적인 운영과 경비산업의 질적 향상을 위해서 민간경호 경비현장과 가장 직접적인 법률인 경비업법 내에서 정의하는 경비업, 집단민원현장의 개념, 경비업의 개정이유, 경비업허가, 배치 및 폐지신고, 경비원 교육의 내용을 연구할 것이다. 또한 현장에서의 기준성의 법적, 절차적 문제점 등을 관할하는 관할 경찰관의 경우 개인의 법적 해석 기준과 실정법에서 정하는 처벌의 해당요건에 따라 업무를 처리하고 있어 유관기관 협력체계가이루어지기 어려운 상황에 처해있다. 또한 관련된 선행연구를 통하여 각 학자들이 제시하고 있는 문제점과 이유, 개선방안의 타당성 등을 검토 하고, 나타난 문제점과 개선방안들이 현실성을 반영하고 있는지 기관, 학계, 협회 등 다양한 관점에서 이를 연구할 것이다.

Limit of interpreting 'security service' in current 「Security Services Industry Act」 and direction of legislating and revising private security industry (현행 「경비업법」상 경비개념과 경비업무 해석의 한계 및 민간보안산업 관련 입법의 제·개정 방향)

  • Security Act has been partially revised many times since it was revised to "Security Service Act". Main contents of such revision consist of the addition of security work such as protection or special security, responsibility enforcement of security company or security guard and systematic management of security service based on security work of previous security service act. But, it needs to be checked out that the fundamental matter about the concept of 'security' is directly related as double-edged sword in such flow of legal revision. That is because security service satisfies the multiple needs for security in the modern risky society and is based on the concept of active management whose goal is to forster and develop the function of actual security service comparing that current "Security Service Act" regulates the formal security service whose goal is permission of security service and systematic management based on article 2 as previous facilities and manned security that is guard duty-centered security service in another respect. So, this study pointed out the limit of interpreting security and security service in "Security Services Industry Act" in respect of providing private security service and drew the conclusion that the legislation and efforts are required for 'security for citizen' by reinterpreting the legislation and revision of private security service-related law as the normal regulation of "Security Services Industry Act" and the special law of "Private Security Services Industry Act".

  • Thus in order to have a better understanding about the KSA(Korean Security association) and to express opinions on its role and security, this paper introduces and discusses about All Japan Security Service Association(AJSSA), which is the prototype of the KSA. There are several positive aspects to consider the introduction of, when these two associations are compared: the traffic security, a supporting member, ex-high-ranking police executive directors practically run AJSSA. These are to enhance financial ability and to promote better relationship with police. KSA needs to improve such relationship and to diversify activities as well. In addition, not just dismissing their duty by giving them the license, AJSSA provides several educations to revitalize the related people so that they can deal in effective and productive services. In another words, JSA perceives it is indispensable to educate the relevant people in the business. In contrast, it is reality that KSA has not put much emphasis on educations. Concisely, the most prompt issue is it should be more beneficial to its members by strengthening itself. Not simply following the example of foreign cases, but putting diverse efforts, KSA can make it substantial and stabilize future private security market in a long term.

  • The objective of this study is to generally check the present situation of private security industry by analyzing the current situation of private security industry in Korea so as to find which policy base is reflected to amend law by analyzing the amendment process of private security law in order to suggest policy direction of private security industry in Korea. Viewing through amendment process of private security law, enhancing publicity and enterprise are not judged to form any definite policy base. They are merely interpreted to partially reflect enterprise under the strong base of publicity. Such policy base may cause overall stagnation of private security industry. For sound development of private security industry, it is required to get out of the existing policy direction so as to change policy base to the direction of enhancing enterprise of private security industry. The power of police for instruction and supervision should be largely transferred to Korea Security Association so as to cultivate autonomous purifying function of private security industry. Police should strive to develop policy in the level of joint production of security service.

  • This study is concerned on how much effect to activate private security officers from the attitude of CEO in private security companies. Of course the philosophy of CEO at the work is much important element on the company activity. And in small-medium size private security company the effect of CEO is tremendous because most of decision making comes from CEO and company is operated. The result of the analysis of the survey on the CEO in private security business is as belows. a) Most of them are not satisfied and negative from current situation of private security industry because too many companies are scattered and the expected social understanding is too low even though the company was established by their own decision due to it was fit to their aptitude. b) The job position is estimated not high by socio-economical perspective, which would be improved to get higher because this industry is very future business. c) Most of members of the korea security association are in negative on the policy of the korea security association but to enhance of the activity all the members should be in union. d) Must make and settle down a channel to communicate and cooperate each other between public and private sector of security business.

  • 「Security Services Industry Act」made in 1976 for the purpose of contributing to the good operation of services industry by establishing the requirements for promotion, development and systematic management of services industry has been since 26 times of overall revisions. Period division of private security through overall revision of 「Security Services Industry Act」 can be roughly divided into three periods. The first is a settlement period. It is a period when the present five business areas were completed rom 1976 to 2001. Beginning with facility and escort security in 1996, five types of jobs have been prepared. so far by adding personal protection in 1996, and machine and special security in 2001. The second is a quantitative growth period. It is a period when quantitative development is made on the institutional basis. As various culture, sports and arts events are increasing based on the demand of security services due to an increase in the people's sense of security, quantitative development was made, which additionally influenced the downward trend of capital and the possibility of having two jobs through revisions. The third is a qualitative growth period. From 2013 to the present is a period when quantitative growth has slowed and qualitative growth has been made. After the period of quantitative growth, the growth slowed down. However, by raising the criteria for permission of services industry through creation of a rule for the group civil petition, by raising capital, by institutionally compensating for diverse punishment regulations, by realizing the training hours for new security guards, by permitting private education, etc, the reliability and professionality of a security guard job has been to be recovered.

  • The purpose of this paper is to study ways to improve the welfare of private security guards. For this reason, it was analyzed the actual situation of the private security guards' wage and welfare system. As a result of the analysis, the most important factors that affect the wages and welfare system of private security guards was such as contracting costs, the minimum wage level, professional duties. In particular, a private security guards have been recognized as the most low-level professionalism sorted by the simple laborers standard classification. Wages of guards in accordance with this recognition is only about 47% of major company on average, about 80% of the small business average. If the proposed future improvements include: First, we need to improve the professionalism of a private security. Second, It is established a mutual-aid project about private security guards. Third, It shall regulate the wage of private security guards on Private Security Industry Act. Fourth, we should adopt a selective welfare system.

  • 최근 국민소득의 성장과 안전한 삶의 질에 대한 요구는 보다 높은 건설 현장이나 공사장, 도로, 그리고 각종 행사장에서의 안전 관리를 요구하고 있으나 현실은 이에 미치지 못하고 있다. 본 연구에서는 일본에서 시행되고 있는 교통유도경비 제도를 우리의 실태와 분석하여, 방안으로, 경비업과 관과의 상호협력체계마련과 민간자격제도 도입, 그리고, 교육프로그램 개발과 교육의 표준화, 법적지위의 확보에 대한 대안을 제시하였다.

  • 해양에서 각국의 사경비제도를 비교 분석하고 육상에서 사경비(私警備) 현황을 조사하였다. 미래의 해양치안수요의 증가에 대비하여 공경비(公警備)를 유기적으로 보조하고 수요자의 욕구에 맞춤형 서비스를 제공하는 해양에서 사경비제도 도입방안을 모색하였다. 향후 우리 나라의 해상치안환경에 부합하는 해양 사경비 경비모델을 설계해나가고자 한다.

  • The system of civil security service is analyzed and reviewed in order to induce it to maritime security domain. A system of civil maritime guarder who provides security service and cooperates with coast guard at sea is proposed. It is expected not only that some expecters on the field of maritime security service are built up but that the Qualities of security services are improved in considering characteristics of sea control and coast guard.
