  • 1997년 외환위기 이후 국내 부실기업의 해외매각을 빠른 속도로 진행하여 매각과정에서 협상력 부재로 인해 기업가치를 제대로 평가받지 못하였을 뿐만 아니라 계약조건 부분에 있어서도 협상성과는 매우 낮은 것으로 평가되고 있다. 또한, 부실한 계약조건으로 인해 계약이행이 종료되지 못하고 소송이나 중재와 같은 분쟁발생이 급격이 증가하고 있다. 이러한 문제인식 하에 본 논문은 부실기업 매각협상 사례중 국제중재와 관련된 한보철강 매각의 사례를 통해 매각시 국제중재를 통해 분쟁을 해결하는 과정을 상세하게 설명함으로써 향후 매각협상 과정뿐만 아니라 매각이후 분쟁이 실제로 발생한다면 이에 대한 정확한 대처와 중재 대처 전략을 수립할 수 있도록 하기 위함이다. 중재는 소송과 달리 단심제로서 중재기간이 상대적으로 짧다고 볼 수 있으나 단심제의 특성을 감안하여 최대한 유리한 증거와 증인확보 등 보다 더 적극적인 자세로 임해야 할 것이다. 본 사례연구에서 중요한 시사점은 국내 협상자들이 협상시 매각가격에만 중요성을 부여하며 기타 계약조건 특히, 준거법 및 관할권에 대해 소홀히 취급하는 경향이 있다는 점이다. 본 한보 중재에서도 승리의 결정적인 원인은 바로 계약서에 준거법을 한국법이라고 명시하였기 때문에 가능했던 것이다 이러한 점은 향후 국제협상시 중요하게 다루어져야 할 사항이라고 판단된다.

  • 지적 재산권 보호 중에서 디지털 상거래에서 가장 절실한 저작물 보호는 근래에 활발히 연구되고 있으며 법 과학 분야는 지문감식, 치아감정 DNA 등 많은 분야가 있다. 그러나 법과학 분야중 법적용 컴퓨팅(Forensic Computing)에 관한 응용은 아직 부족한 상태이다. 그중에도 디지털 저작물에 대하여 증거를 보전 하고자 많은 연구가 진행 되고 있지만 디지털 저작물에 관하여 네트워크를 통한 능동적 저작물 보호는 미약하다. 현재의 데이터 추출(Extraction), 발굴(Exploitation), 복구, 암호 해독, 패스워스 풀기(Defeat), 미러 이미징등의 방법 가지고 해결 못하는 경우와 인터넷 상에서 온라인으로 이루어지는 불법 복제에서 결정적 기여(smoking gun)를 찾아내려고 하는 것이 본 논문에서 해결 하고자 하는 부분이다. 오프라인일 경우도 가능하며 분석된 결과는 변호사/대리인, 법인, 보험회사, 법집행관등에게 온라인으로 제공한다. 진행 과정은 서버에서 파견시킨, 미션을 부여받은 에이전트가 저작물 불법 복제 상황을 트래킹 한 후, 네트워크를 통하여 정해진 시간별로 서버에 전달하면, 법 조항과 매핑시켜서 분석한 다음 서버의 지식베이스에 저장되어 사용자의 요구에 응하는 능동형 디지털 저작물 보호 관리 시스템이다.

  • In case of security of IoT-based areas in ICBM industry, the anxiety about safety goes to extremes in public and national safety area, so that the demand for security service related to disaster/safety management is increasing. Like this, as a security service for safety, CCTVs are installed/operated for the purpose of maintenance of public order and crime prevention. Especially, as the recorded images are presented as crucial evidences of crimes, they are rapidly increasing. However, as adverse effects of CCTVs, it is highly possible to unintentionally leak personal information in the process of performing the original purpose, or to violate someone's privacy in case when such technologies are abused. Therefore, it would be necessary to have researches on the multilaterally-combined mechanism for the protection of image privacy.

  • 본 연구는 객관적인 생리 신호로부터 인간의 감성을 추론할 수 있는 감성 평가 전문가 시스템을 개발하기 위한 첫 번째 단계로, 측정된 생리 신호를 이용하여 인간의 긴장도를 판단하는 알고리즘의 개발이 목표이다. 감성 평가에 관련된 애매함을 수리적으로 취급하기 위해 퍼지 이론을 적용하여 임의의 감성 영역에 속하는 정도를 소속 함수로 정량화 함으로써 감성 평가를 가능하게 하고자 하였다 소속 함수의 결정은 상상을 통해 유발된 긴장/이완의 생리 신호 데이터 베이스 결과를 사용하였다. 그리고 두 가지 이상의 생리 신호 측정 결과와 각 생리 신호의 소속 함수로부터 하나의 최종 결과 (긴장도)를 유추하기 위해서 Dempster-Shafer 증거합 법칙을 적용하였고, 이를 통해 최종적인 긴장도를 도출할 수 있도록 하였다.

Analysis on Scale Effects to Hydraulic Conductivities in Crystalline Rock (결정질암체의 수리전도도에 대한 규모종속에 관한 분석)

  • Hydrogeologic characteristics of crystalline rock including discontinuities is defined by the hydraulic data from the in situ test and by analytical method. Methodology and procedure of the in situ test are used in accordance with test purpose, site condition and characteristics of host rock Hydraulic conductivities in crystalline rock including discontinuifies such as fractured zone and joint, are defined by packer test and slug test. The results indicate Hvorslev' s theory of ground water flow in NX borehole, that the shorter of test interval is, the higher hydraulic conductivity is. This is an indicafion of the fact that the hydraulic rneasured were governed by scale effect of test interval, even at same borehole. According to the result of packer tests in two boreholes, it is understood that hydraulic conductivifies show variations according to the effect of as order of tests. In the comparison of hydraulic conductivifies from both of open borehole tests, the results are relatively well correrated in values. The hydraulic conductivity in the test intervals induding hydrogeologically significant discontinuity shows relatively higher value of hydraulic conductivity in vertical distribution of full depth.

Investigation of Science Gifted Students' Value-Judgement and Decision Making Writing on Space Exploration Enterprise (과학영재들의 우주개발사업에 대한 가치판단과 의사결정 글쓰기 분석)

  • The purpose of this study was to explore the science gifted students' value-judgments and decision making writing on the space exploration enterprise. Sixty-four first graders of a gifted science school took the seminar-style decision making instruction for 10 hours in one month. After having the seminar-style decision making instruction, we have analyzed science gifted students' value-judgments and decision making process utilizing questionnaires and their writings. As a result, gifted students were aware of both sides of the space exploration enterprise, benefits and risks, and showed different decision making depending on their priorities of evidence interpretation. Although the majority of gifted students were very well aware of the importance of space exploration enterprise, they would still need to know the background information of space exploration enterprise. Based on this study, implications of SSI education and future research about space exploration enterprise were discussed in the result.

Hydrous Minerals (Phlogopite and Amphibole) from Basaltic Rocks, Jeju Island: Evidences for Modal Metasomatism (제주도 현무암에 산출되는 함수광물(금운모와 각섬석): 모달교대작용의 증거)

  • Phlogopite and kaersutite, showing distinctively different textural characteristics compared to the common phenocrysts, are observed in alkali basalt from Jeju Island. They occur as large crystals (2-10 mm) in host basalts, whereas fine-grained phlogopite and kaersutite occur in ultramafic mantle xenoliths and mafic gabbroic xenoliths, respectively, as an interstitial and microvein phases, or in corona textures (<1 mm). This textural characteristics of fine-grained grains clearly indicates secondary in origin. Phlogopite contains high $TiO_2$(4.1-6.9 wt%) and F(2.8-4.6 wt%) and relatively high mg#[=100Mg/(Mg+$Fe^t$) in mols, where $Fe^t$ is total iron](88-80), whereas kaersutite has high $TiO_2$(5.6-6.11 wt%) and much lower mg#s(68-64). Our textural observations and the geochemical character of these hydrous minerals suggest that they were unrelated to each other and mica formation happened early in the upper mantle before the mantle xenoliths had been trapped. In contrast, kaersutite formation has happened later, probably during the late stage of crystallization as intracrustal processes. The presence of phlogopite and kaersutitic amphibole is a direct evidence for K-, Ti-, F- and $H_2O$-bearing fluid/melt percolation in the lithosphere beneath Jeju Island, indicating that they are product of interaction between host rock/peridotite/fluid-melt. Thus, the upper mantle/lower crust beneath Jeju Island are metasomatized to various extents, characterized by a change in major metasomatic hydrous minerals from phlogopite to amphibole with decreasing depth.

  • The primary objective of pulp treatment is to maintain the integrity and health of the oral tissues. The most important and difficult aspect of pulp therapy is determining the health of the pulp, or its stage of inflammation, so that a decision can be made regarding the best form of treatment. Immature permanent teeth are good candidates for many pulp healing procedures, due to their rich blood supply, which is believed to enhance the pulp's ability to react successfully to various insults. Healing was considered to have taken place when the tooth fulfilled the following criteria: 1. Abscence of clinical symtoms 2. Radiographic evidence of dentin bridge formation 3. No intrapulpal or periapical pathosis was evident radiographically 4. Continued root development and closure of the apex in immature teeth 5. Normal dentin apposition in mature teeth 6. Positive response to electrical pulp test This presents a report of cases in which immature permanent teeth, pulp-exposed by caries or trauma, was treated successfully by partial pulpotomy.

Study on the EDA based Statistics Attributes Discovery and Utilization for the Maritime Safety Statistics Items Diversification (해상안전 통계 항목 다양화를 위한 EDA 기반 통계 속성 도출 및 활용에 관한 연구)

  • Evidence-based policymaking and assessments for scientific administration have increased the importance of statistics (data) utilization. Statistics can explain specific phenomena by providing numerical values and are a public resource for national decision making. Due to these inherent attributes, statistics are utilized as baseline and base data for government policy determinations and the analysis of various phenomena. However, compared to the importance, the role of statistics is limited, and statistics are often used as simple abstracts, produced mainly for suppliers, not for consumers' perspectives to create value. This study explores the statistical data and other attributes that can be utilized for policies or research to address the problems mentioned above. The baseline statistical data used in this study is from the Maritime Distress Accident Statistical Yearbook published by the South Korean Coast Guard, and other additional attributes are from text analyses of vessel casualty situation reports from the South Korean Maritime Police. Collecting 56 attributes drawn from the text analysis and executing an EDA resulted in 88 attribute unions: 18 attribute unions had a satisfactory significance probability (p-value < .05) and a strong correlation coefficient above 0.7, and 70 attribute unions had a middle correlation. (over 0.4 and under 0.7). Additionally, to utilize the extra attributes discovered from the EDA politically, a keyword analysis for each detailed strategy of the disaster Preparation basic plan was executed, the utilization availability of the attributes was obtained using a matching process of keywords, and the EDA deducted attributes were examined.

Review in terms of the earthen wall stamped technique in the Three Kingdoms period (삼국시대 토성 판축기법 용어 검토)

  • In this article, I have summarized and reviewed the concepts and terms surrounding the stamped construction technique, focusing on earthen walls in the Three Kingdoms period. This is because confusion is caused by defining the nature of the earthen walls by using various concepts and terms for each researcher regarding the substance and construction method of the earthen walls. The stamped earth method is a representative ancient civil engineering or construction technique in which a frame is made of plates to form a fortress wall, a fence, and the base of a building, and then soil or sand is poured into it layer by layer and then stamped with a bat to make it solid. Therefore, in order to prove that the earthen wall was built by the stamped earth method, evidence such as a narrow plate, a column for fixing it, long horizontal and vertical wood pieces to support the narrow plate, and traces of pounding the soil must be detected. However, in Korea, there are very few cases where such evidence has been fully excavated, so it is necessary to agree on how strictly the standards for the stamped earth method will be applied. The terms related to the stamped technique mobilized for the construction of the earthen walls were explained with actual examples by dividing the terms related to the concept into terms related to the principle and unit of the stamped plate, and the specific stamped technology. In particular, in Pungnabtoseong Earthen wall, a variety of typical and diverse methods of building the ancient stamped earthen wall were identified so that decisive data could be secured to understand the principles and techniques of the stamped earthen wall. In the future, a more general understanding of the stamped technique will be possible only when more evidence related to it is found in relics other than Pungnabtoseong Earthen wall.
