최근 해킹 및 개인정보 유출로 인한 관공서 개인정보 취급에 대한 사회적 불신감 팽배, 신뢰도 저하 문제가 발생하고 있다. 개인정보보호법, 정보통신망법의 강화에도 불구하고, 업무에 활용된 명부 등이 저장된 위치를 기억하지 못하여 그대로 방치되고 있으며, 자료공유시스템 등 웹사이트를 통해 열람(접근)된 개인정보파일이 개인 PC내 임시파일로 PC의 하드디스크에 저장되어 있다. 개인정보보호법은 2011년 3월 29일 공포되었고, 9월 30일부터 전면 실시되었다. 본 논문에서는 PC의 개인정보를 검색하고 검색된 파일을 암호화, 파일숨김을 하여 파일을 안전하게 보관하게 하며, 사용기간이 지난 파일의 경우 완전삭제를 하여 PC에서 개인정보보호법에 대응 방안을 제시한다.

일본은 2003년 5월에 개인정보보호에 관한 법률을 제정하여 2005년 4월부터 시행되고 있으며, 특이사항으로는 각 자치단체별로 개인정보보호조례를 제정하여 시행하고 있다. 또한 중국에서도 우리나라와 비슷한 시기에 개인정보보호법 입법을 추진 중이나 아직까지는 통합적인 개인정보보호법은 제정되고 있지 않은 상태로 개인정보보호법(전문가의견안) 초안이 제출되어 있는 상황이다. 본고에서는 일본과 중국에서의 개인정보보호 관련 법제도 추진 현황에 대해서 분석하였으며, 국내 개인정보보호법과도 비교 분석하였다.

오늘날 개인정보를 둘러싼 문제는 세계적 관심으로 부상하고 있다. 정보처리 정보통신기술의 비약적인 발전으로 대량의 데이터 수집과 가공이 가능하고 소비생활의 개성화. 다양화에 대응하기 위한 기업들의 개인정보 수집 열기는 날로 뜨거워지고 있다. 우리나라도 국가 기간전산망 구축이전에 프라이버시보호법이 제정, 시행될 전망이다. 따라서 고속으로 변화하는 정보관리환경에 적절히 대응하고 건전한 정보화사회의 구현을 위한 개인정보보호법 제정을 위해 지난해 12월 9일 제정된 일본의 행정기관보유 전자계산처리에 관한 개인정보보호법을 소개한다.

The purpose of this study is to explore ways to resolve the conflicting issues that are currently applied in medical Act and medical privacy Act through the comparative Analysis of the Privacy Act and the Medical Information Protection Act foreign. the results run to establish the Public Health Act coming for the protection of health information is a characteristic of many countries, France in Europe, the United States and Canada had been running an independent medical information laws are enacted. Prescribes penalties of up to a fairly systematic method from the case records of patients would not have occurred in the management and implementation of the law and the protection of the author of the book focuses on the subject of medical records and physician records between patient confidentiality and privacy it can be seen that the method defined in. This indicates the need for the establishment of an independent medical information laws to protect all records relating to the patient systematically Korea also.

개인정보보호법이 2011년 3월 국회 법사위에서 통과되어 2011년 9월 30일 시행예정에 있다. 시행예정에 있는 개인정보 보호법은 기존 공공기관의 개인정보 보호에 관한 법률을 포함하게 된다. 기존의 개인정보보호 관련 법규 및 시행령은 크게 관리적 보호조치와 기술적 보호조치로 구분된다. 기술적 보호조치의 주요 기반기술은 개인정보보호시스템, 접근통제, 암호화, 출력매체, 접근 및 이용, 웹사이트 노출방지대책 등으로 분류할 수 있다. 본 연구에서는 개인정보보호 기술적 조치 사항의 주요기반기술에 대해 기술 및 솔루션, 시스템을 살펴보고 최근 웹 사이트 및 내부 업무시스템에서의 개인정보보호 시스템 특징을 연구하고 단계적 적용을 제안하였다. 본 연구를 통하여 2011년 9월 30일 시행되는 개인정보보호법에 대비하여 기술적 보호조치 단계를 제시함으로써 개인정보 담당자 및 정보보호 담당자에게 한정된 예산과 일정기간에 단계별로 개인정보보호 수준을 높이는 참조 모델로 활용될 수 있을 것으로 기대된다.

중국은 단일화된 개인정보보호법이 존재하지 않고, 네트워크 안전법, 형법 등에 포함된 개인정보보호 관련 조항에 근거하여 개인정보보호 정책을 수립·집행하여 왔다. 2020년 10월 중국은 개인정보보호법 초안을 공개하고 의견을 수렴하며, 입법 절차를 진행 중이다. 본고에서는 중국 개인정보보호법의 입법 취지, 주요 내용, 한국 기업에 미칠 영향 등을 살펴보고자 한다.

본 논문은 개인정보보호법의 벌칙조항 및 양벌규정을 기관 및 기업체의 CEO 및 최고경영자의 관점에서 제 70조에서 제75조의 벌칙조항을 구체적이고 간결하게 기술하였다. 이 논문의 주요 구성은 제정된 개인정보보호법에 관하여 먼저, 개인정보의 정의, 개인정보의 유형, 개인정보의 특성을 알아보았다. 또한 개인정보보호법에 대한 주요내용과 경영진의 주요 관심사인 개인정보보호법의 처벌조항과 양벌규정에 대해 연구하였다.

Personal Information Protection Act was first enacted in March, 2011, amended in September, 2011 and became effective. Nevertheless, the risk of interfering with personal information protection still remains, associated with collection, plagiarism, leakage, and even sales of personal information. The public libraries are not an exception. Accordingly, this study investigates the status of personal information protection in public libraries of Seoul and Gyeonggi province. Also, it tries to discover problems associated with the act and presents a model scheme to improve this situation. The scheme relates to (1) securing of a sufficient budget; (2) reinforcing professional education related to personal information; (3) developing detailed guidelines for public libraries.

The personal information protection act has been enacted from 2011 for the protection of public and private privacy. Since the application area of the law is so broad, there is a limit to covers everything in the financial field. As we enter the era of big data, the value of personal information is becoming ever more important. However, personal information protection laws in Korea have several issues. Furthermore, existing research are limited in their ability to facilitate a comprehensive understanding of measures to improve personal information protection laws. Accordingly, this study analyzes improvements to be made in the current personal information protection laws based on existing research. A total of 39 research articles discussing the problems of the personal information protection law were selected and analyzed by applying the meta - analysis technique. According to the results, the various issues such as the meaning and scope of personal information, the role and obligations of relevant parties, provision of personal information to third parties, and redundant and imbalanced regulations in special acts in each field. that exist in the current personal information protection laws were confirmed. This study contributes to the improvement of inconsistency between information protection laws and related special laws in each field in practice. Academically, it will contribute to understanding the problems of th law from the macro perspective and suggesting the integrated improvement ways of the law.
