미국의 쉬운 언어정책의 제도화와 한국에의 시사점 (A Plain Language Policy Institutionalized in the U.S. and Implications for Korea)

  • 본 연구는 미국의 '쉬운 언어 정책'을 대상으로 정책의 제도화 과정에서의 법령과 추진체계를 분석하고 결론을 도출하여 한국의 쉬운 공공언어 프로젝트에 유의미한 시사점을 제시하는데 목적이 있다. 분석결과를 요약하면 다음과 같다. 첫째, 미국의 쉬운 언어 정책이 제도로 정착되기까지 행정부의 수반인 대통령의 지속적인 관심과 연방기관들의 솔선수범이 중요한 역할을 하였다. 둘째, 미국의 쉬운 언어 정책집행에 있어서 시대별로 마련된 법령들은 연방기관들의 의무적 준수를 끌어낼 수 있도록 기여했다. 셋째, 쉬운 언어 정책의 추진주체는 PLAIN(Plain Language Action and Information Network, 쉬운 언어 활동 정보 네트워크)이라는 행정부처가 아닌 연방공무원과 전문가로 이뤄진 커뮤니티이다. 넷째, 쉬운 언어정책은 공교롭게도 개혁성향의 민주당 출신 대통령들과 행정부로부터 전폭적인 지지와 지원을 받았다. 다섯째, 2000년대 이후 대부분의 연방부처와 기관들은 쉬운 언어 웹사이트를 운영하고 자체적으로 쉬운 언어 프로그램을 보유하고 있다. 결론적으로 현행 미국의 쉬운 언어 정책은 국민과 정부 간 명실상부한 의사소통을 향상시키는 메커니즘이자 신뢰사다리로서의 역할을 수행한다.

전자무역 플랫폼의 기본요건과 운영방안에 관한 연구 (A Study on the Basic Requirements and Operation Plan of E-trade Platform)

  • The rapid development of internet information technology has increased interest in e-Trade these days, but it is not activated greatly up to now. In order to promote e-Trade, it is essential to construct cooperative process such as connecting systems among trade related parties. Building e-Trade platform which is based on the infrastructure of the past trade automatic system is key point of promoting e-Trade. To do this, a study on the basic concept and specific components of e-Trade platform is needed absolutely. At this point of view, after this paper has examined domestic and foreign studies on the fundamental technologies about electronic commerce, it drew several key technologies that could be applied to e-Trade considering the current IT trend. Then it evaluates these technologies according to Technology Reference Model(TRM) of the National Computerization Agency. This will help us to show the operation strategy as well as the concept of future e-Trade platform and its composition. On the basis of the theoretical background, this paper classified NCA's technology model into 6 fields, which are application. data, platform, communication, security and management. Considering the key technologies, e-Trade platform has to be mutually connected and accept international standards such as XML. In the aspect of business side, trade relative agencies' business process as well as trading company's process has to be considered. Therefore, e-Trade platform can be classified into 3 parts which are service, infrastructure and connection. Infrastructure part is compared of circulating and managing system of electronic document, interface and service framework. Connecting service (application service) and additional service (application service) consist of service part. Connecting part is a linking mutual parts and can be divided into B2B service and B20 service. The organization operating this e-trade platform must have few responsibilities and requirements. It needs to positively accept existing infrastructure of trade automatic system and improving the system to complete e-trade platform. It also have to continuously develop new services and possess ability to operate the system for providing proper services to demanders. As a result, private sector that can play a role as TTP(Third Trust Party) is adequate for operating the system. In this case, revising law is necessary to support the responsibility and requirement of private sector.

멀티홉 클러스터 센서 네트워크 환경 기반에서 견고한 키 교환 (A Robust Pair-wise Key Agreement Scheme based on Multi-hop Clustering Sensor Network Environments)

  • 본 논문에서는 신뢰하는 제 3기관(혹은 장치)(TTP)이 없고 사전에 키가 분배되지 않는 멀티 홉 클러스터 센서 네트워크 환경에서 안전하게 암호화된 키를 교환하는 알고리즘을 제안한다. 기존의 연구는 TTP가 존재하거나 노드간 키가 이미 분배되었다는 가정하에서 진행되었다. 그러나, 기존의 방법들은 기반 구조가 없는 USN 환경에서는 가능하지 않다. 기존 연구 중 일부는 난수를 이용한 Diffie-Hellman 알고리즘을 이용하여 문제를 해결하고자 하였으나 재생 공격과 중간자 공격에 취약한 것으로 나타났다. 기존의 Diffie-Hellman 알고리즘에서 취약한 문제로 드러난 노드 간 인증 문제는 ��TESLA를 사용한 수정된 Diffie-Hellman 알고리즘으로 해결한다. 본 논문에서는 수정된 Diffie-Hellman 알고리즘에 타임 스탬프를 사용한 일회용 패스워드(OTP)를 추가하여 안전하면서, 가볍고, 강인한 키 교환 알고리즘을 제안한다. 마지막으로 인증, 기밀성, 무결성, 부인방지, 후방향 안전성 및 전방향 안전성에 대해서 안전하다는 것을 검증한다.

독립보증상의 수익자에 의한 부당청구(unfair calling)에 관한 연구 (A Study on the Unfair Calling under the Independent Guarantee)

  • In International trade the buyer and seller are normally separated from on another not only by distance but also by differences in language and culture. It is rarely possible for the performance of obligations to be simultaneous and the performance of contracts therefore calls for trust in a situation in which the parties are unlikely to feel able to trust each other unless they have a longstanding and successful relationship. Thus the seller under an international contract of sale will not wish to surrender documents of title to goods to the buyer until he has at least an assurance of payment, and no buyer will wish to pay for goods until he has received them. A gap of distrust thus exists which is often bridged by the undertaking of an intermediary known and trusted by both parties who will undertake on his own liability to pay the seller the contract price in return for the documents of title and then pass the documents to the buyer in return for the reimbursement. This is a common explanation of the theory behind the documentary letter of credit in which the undertaking of a bank of international repute serves as a "guarantee" to each party that the other will perform his obligations. The independence principle, also referred to as the "autonomy principle", is at the core of letter of credit or bank guarantee law. This principle provides that the letter of credit or bank guarantee is independent of the underlying contractual commitment - that is, the transaction that the credit is intented to secure - between the applicant and the beneficiary ; the credit is also independent of the relationship between the bank and its customer, the applicant. The most important exception to the independence principle is the doctrine of fraud in the transaction. A strict interpretation of the rule that the guarantee is independent of the underlying transaction would lead to the conclusion that neither fraud nor manifest abuse of rights by the beneficiary would constitute an objection to payment. There is one major problem related to "Independent guarantees", namely abusive or unfair callings. The beneficiary may make an unfair calling under the guarantee. The countermeasure of beneficiary's unfair calling divided three cases. First, advance countermeasure namely by contract. In other words, when the formation of the contract, the parties must insert the Force Majeure Clause, Arbitration Clause to Contract, and clear statement to the condition for demand calling. Second, post countermeasure namely by court. Many countries, including the United States, authorize the courts to grant an order enjoining the issuer from paying or enjoining the beneficiary from receiving payment under the guaranty letter. Third, Export Insurance. For example, the Export Credit Guarantees Department is prepared, subject to certain conditions, to cover the risk of unfair calling. Of course, KEIC in Korea is cover the risk of the all things for guarantees. On international projects, contractor performance is usually guaranteed by either a standby letters of credit or Independent guarantee. These instruments will be care the parties.

이동통신 환경에서 임시 익명 아이디를 이용한 위치 불추적 서비스와 지불 프로토콜에 관한 연구 (A Study on Location Untraceability Service and Payment Protocol using Temporary Pseudonym in Mobile Communication Environments)

  • 지금까지 많은 연구사들이 이동통신 환경과 관련하여 프라이버시 측면에서 모바일 이용자들의 현 위치와 행적의 노출에 대한 문제를 다루어 왔다[1,2,3.4,5,6,7,8]. 그 중에서도 Kesdogan과 Pfitzmann[3,6]은 이 문제를 해결하기 위해 TP(Temporary Pseudonym)라는 임시 익명 아이디를 이용한 효율적인 방법을 제안하였다. 그 후 Kesdogan 등은 [8]에서 이 방법을 더욱 개선하여 네트워크 제공자 측의 각종 공격 유형들과 이들로부터 모바일 이용자들을 보호할 수 있는 방법을 제안한 바 있다. 그러나 그들이 제안한 공격 유형들 가운데 특히, 네트워크 제공자의 능동적인 공격에 대비한 방법은. 새로운 또 하나의 장비(이를 Reachability Manager라 부른다)를 시스템에 부착하는 방법으로, 실질적이라기 보다는 대안에 가까우며 그 방법에 대한 기술이 구체적이지가 않다. 게다가 이것은 또 다른 비용과 부담을 요구한다. 따라서 본 논문에서는 이러한 추가적인 장비가 없이 기존의 환경에서 네트워크 제공자의 능동적인 공격에 대비하는 실질적인 방법을 제안한다 제안한 방법의 기본 아이디어는 모바일 이용자, 그리고 이용자와 네트워크 제공자가 신뢰하는 제 3자(이를 Trust Device라 부른다) 이 둘만이 알고 있는 비밀 정보를 네트워크 제공자를 통해 교환함으로써 내부 이용자인 네트워크 제공자 측의 부정을 방지하는데 있다. 아울러 제안한 방법을 응용한 새로운 지불 프로토콜을 소개하고자 한다.

Reflections on the Possibility of Replacing the Registration System with a Blockchain System

  • 전자등기 및 블록체인시스템을 도입한 등기시스템 하에서 해당 전자정보로서의 부동산등기의 공신력을 확보하려면 이들 범죄 및 법률분쟁을 방지하는 방안으로 거래자의 신분증명 및 부동산등기 기재내용의 투명성을 마련하는 방법에 또한 블록체인 시스템을 이용하여 기록되는 방법으로 진행되어야 한다. 그 방안으로 거래자의 신분증명에 관한 신뢰성을 높이는 방법과 부동산등기부의 기재단계에서 등기관의 실질적 심사권을 인정하고 물권 등 권리사항의 기재시 공증단계를 거치는 등의 공신력 제고 방안을 검토하고 이 단계에서도 블록체인 시스템을 도입하여 무결성 및 신뢰성을 확보하는 방법을 고려해 봄직하다. 현행 부동산 등기 등 공부시스템이 블록체인 시스템으로 전환되기 전 단계에서 부동산 등기 기재사항의 명확성과 투명성, 실제 부동산과의 정합성이 갖추어져야 최종적으로는 부동산 공부에 관한 공신력이 인정될 수 있고 이로써 향후 블록체인시스템을 도입한 부동산공부시스템에 대하여 거래당사자의 신뢰를 담보하고 부동산 거래시장에서 부동산 공부에 대한 투명성과 무결성바탕으로 이를 신뢰한 당사자 간에 최종적으로는 스마트계약의 형태로 부동산거래가 이루어지는 목표에 가까워질 수 있게 될 것이다.

2011년 주요 의료 판결 분석 (Review of 2011 Major Medical Decisions)

  • According to the review and analysis of medical cases that are assigned to the Supreme Court and all local High Court in 2011 and that are presented in the media, it was found that the following categories were taken seriously, medical and pharmaceutical product liability, the third principle of trust between medical institutions, negligence and causation estimation, responsibility limit, the meaning of medical records and related judgment of disturbed substantiation, Oriental doctors' duties to explain the procedures, IMS events, whether one can claim for each medical care operated by non-physician health care institutions to the nonmedical domain in the National Health Insurance Corporation, and the basis of norms for each claim. In the cases related to medical pharmaceutical product liability, Supreme Court alleviated burden of proof for accidents with medical and pharmaceutical products prior to the practice of Product Liability Law and onset the point of negative prescription as the time of damage strikes to condition feasibility of the specific situation. In the cases related to the 3rd principle of trust between medical institutions, the Supreme Court refused to sentence the doctor who has trusted the judgment of the same third-party doctors the violations of the care duty. With respect to proof of a causal relationship and damages in a medical negligence case, the Supreme Court decided that it is unjust to deny negligence by the materials of causal relationship rejecting the original verdict and clarified that the causal relationship shall not deny the reasons to limit doctors' responsibilities. In order not put burden on patients with disadvantages in which medical records and the description of the practice or the most fundamental and important evidence to prove negligence and causation are being neglected, the Supreme Court admitted in the hospital's responsibility for the case of the neonate death of suffocation without properly listed fetal heart rate and uterine contraction monitor. On the other hand, the Seoul Western District Court has admitted alimony for altering and forging medical records. With respect to doctors' obligations to description, the Supreme Court decided that it is necessary to explain the foreseen risks by the combination of oriental and western medicines emphasizing the right of patient's self-determination. However, questions have arisen whether it is realistically feasible or not. In a case of an unlicensed doctor performing intramuscular stimulation treatment (IMS), the Supreme Court put off its decision if it was an unlicensed medical practice as to put limitation of eastern and western medical practices, but it declared that IMS practice was an acupuncture treatment therefore the plaintiff's conduct being an illegal act. In the future, clear judgment on this matter should be made. With respect to the claim of bills from non-physical health care institutions, the Supreme Court decided to void it for the implementation of the arrangement is contrary to the commitments made in the medical law and therefore, it is invalid to claim. In addition, contrast to the private healthcare professionals, who are subject to redemption according to the National Healthcare Insurance Law, the Seoul High Court explicitly confirmed that the non-professionals who receive the tort operating profit must return the unjust enrichment and have the liability for damages. As mentioned above, a relatively wide range of topics were discussed in medical field of 2011. In Korea's health care environment undergoing complex changes day by day, it is expected to see more diverse and in-depth discussions striding out to the development in the field of health care.

서비스 실패요인이 보복행위에 미치는 영향과 관계품질의 조절효과 (The Effect of Service Failure on the Desire for Betrayal and Retaliatory Behavior - Based on the Moderating Role of the Customer-Service Firm Relationship Quality)

  • 과거 기업은 고객만족을 통해 고객의 충성도를 구축해 지속적인 이윤을 창출하는데 주로 초점을 맞추었다. 그러나 고객들은 기업에게 긍정적 영향만을 주지 않으며 때로는 기업을 위험에 빠뜨리기도 하고 곤란에 처하게 하기도 한다. 서비스 실패를 경험한 고객에게 기업이 적절한 서비스 회복조치를 취하지 못했을 때 그들은 배신감과 분노 같은 강한 부정적 정서를 느끼며 이러한 부정적 정서는 기업의 성과에 상당한 부정적 영향을 미칠 수 있는 공격적 행동이나 보복행동을 유발 할 수 있다. 고객이 느끼는 이러한 부정적 정서는 기업과 오랜 거래관계를 유지하고 그 기업에 대해 애착을 가진 충성고객에게 더 강하게 발생될 수 있다. 강한 배신감을 느낀 충성고객은 단순히 경쟁기업으로 브랜드 전환을 하는데 머무는 것이 아니라 온라인 부정적 구전, 불매운동, 언론매체를 통한 호소 등의 강력한 보복행동을 수행한다. 본 연구는 서비스 실패요인으로 발생되는 배신감이라는 감정이 보복욕구를 통해 보복행위까지 가는 인과관계에 대해 알아보고, 기업 간의 충성도가 각기 다른 고객들을 분류하여 그 차이를 살펴보았다. 실증분석 결과 각각의 공정성 훼손은 모두 지각된 배신감에 유의한 영향을 미치는 것으로 나타났다. 특히 고객들은 분배 공정성 훼손으로 인한 서비스 실패를 경험하였을 경우 가장 높게 배신감을 지각했으며 절차공정성 훼손으로 인한 서비스 실패를 경험하였을 경우 배신감을 가장 낮게 느끼게 하는 것으로 나타났다. 또한 지각된 배신감은 보복욕구에 유의한 영향을 미치며 이후 부정구전과 보복적인 불평행동, 제3단체를 통한 불만 홍보와 같은 보복행위 모두에 유의한 영향을 미치는 것으로 나타났다. 따라서 공정성 훼손은 지각된 배신감과 보복욕구와 같은 매개변수를 통하여 보복행위에 영향을 미치는 것으로 볼 수 있다. 마지막으로 공정성 훼손과 지각된 배신감과의 관계에서 과거 해당기업과 고객 간의 관계의 친밀도를 나타내는 관계품질의 조절변수 역할을 검증한 결과 관계품질은 조절변수로서 역할을 하는 것으로 나타났다. 본 연구는 서비스 실패 요인이 보복행위에 미치는 영향을 단순 인과관계로 보지 않고 기업과 고객 간의 관계품질의 조절효과를 고려하여 연구를 하였다는 데 그 의의가 있다.

심리적 계약 위반이 OS이용자의 배신 행동에 미치는 영향: 윈도우 XP 기술적 지원서비스 중단 사례 (The Effects of Psychological Contract Violation on OS User's Betrayal Behaviors: Window XP Technical Support Ending Case)

  • Technical support of Window XP ended in March, 8, 2014, and it makes OS(Operating System) users fall in a state of confusion. Sudden decision making of OS upgrade and replacement is not a simple problem. Firms need to change the long term capacity plan in enterprise IS management, but they are pressed for time and cost to complete it. Individuals can not help selecting the second best plan, because the following OSs of Window XP are below expectations in performances, new PC sales as the opportunities of OS upgrade decrease, and the potential risk of OS technical support ending had not announced to OS users at the point of purchase. Microsoft as the OS vendors had not presented precaution or remedy for this confusion. Rather, Microsoft announced that the technical support of the other following OSs of Wndow XP such as Window 7 would ended in two years. This conflict between OS vendor and OS users could not happen in one time, but could recur in recent future. Although studies on the ways of OS user protection policy would be needed to escape from this conflict, few prior studies had conducted this issue. This study had challenge to cautiously investigate in such OS user's reactions as the confirmation with OS user's expectation in the point of purchase, three types of justice perception on the treatment of OS vendor, psychological contract violation, satisfaction and the other betrayal behavioral intention in the case of Window XP technical support ending. By adopting the justice perception on this research, and by empirically validating the impact on OS user's reactions, I could suggest the direction of establishing OS user protection policy of OS vendor. Based on the expectation-confirmation theory, the theory of justice, literatures about psychological contract violation, and studies about consumer betrayal behaviors in the perspective of Herzberg(1968)'s dual factor theory, I developed the research model and hypothesis. Expectation-confirmation theory explain that consumers had expectation on the performance of product in the point of sale, and they could satisfied with their purchase behaviors, when the expectation could have confirmed in the point of consumption. The theory of justice in social exchange argues that treatee could be willing to accept the treatment by treater when the three types of justice as distributive, procedural, and interactional justice could be established in treatment. Literatures about psychological contract violation in human behaviors explains that contracter in a side could have the implied contract (also called 'psychological contract') which the contracter in the other side would sincerely execute the contract, and that they are willing to do vengeance behaviors when their contract had unfairly been broken. When the psychological contract of consumers had been broken, consumers feel distrust with the vendors and are willing to decrease such beneficial attitude and behavior as satisfaction, loyalty and repurchase intention. At the same time, consumers feel betrayal and are willing to increase such retributive attitude and behavior as negative word-of-mouth, complain to the vendors, complain to the third parties for consumer protection. We conducted a scenario survey in order to validate our research model at March, 2013, when is the point of news released firstly and when is the point of one year before the acture Window XP technical support ending. We collected the valid data from 238 voluntary participants who are the OS users but had not yet exposed the news of Window OSs technical support ending schedule. The subject had been allocated into two groups and one of two groups had been exposed this news. The data had been analyzed by the MANOVA and PLS. MANOVA results indicate that the OSs technical support ending could significantly decrease all three types of justice perception. PLS results indicated that it could significantly increase psychological contract violation and that this increased psychological contract violation could significantly reduce the trust and increase the perceived betrayal. Then, it could significantly reduce satisfaction, loyalty, and repurchase intention, and it also could significantly increase negative word-of-month intention, complain to the vendor intention, and complain to the third party intention. All hypothesis had been significantly approved. Consequently, OS users feel that the OSs technical support ending is not natural value added service ending, but the violation of the core OS purchase contract, that it could be the posteriori prohibition of OS user's OS usage right, and that it could induce the psychological contract violation of OS users. This study would contributions to introduce the psychological contract violation of the OS users from the OSs technical support ending in IS field, to introduce three types of justice as the antecedents of psychological contract violation, and to empirically validate the impact of psychological contract violation both on the beneficial and retributive behavioral intentions of OS users. For practice, the results of this study could contribute to make more comprehensive OS user protection policy and consumer relationship management practices of OS vendor.
