  • 전 세계를 시장화하는 GATT 및 WTO 등 다자간 자유무역체제의 확산 및 특정 국가간의 자유무역협정(FTA) 등이 확대됨에 따라 방송 분야의 산업화와 세계화가 급속히 진전되고 있다. 산업적 논리에 입각한 방송환경의 변화는 방송의 산업적 위상을 높이는 결과를 가져왔으며, 방송은 21세기 최고 유망산업 가운데 하나인 문화산업의 핵심 분야로 주목받고 있어, 방송 상품은 국제무역에서 중요한 교역물의 하나가 되었다. 국제교역에 있어서 미국과 일본은 문화 산물도 일반 재화와 동일하게 취급하여 국제적인 자유무역의 틀 안에 두려고 하며, 반면 EU와 캐나다 등의 국가들은 문화 산물을 상품임과 동시에 공공재라는 입장을 취하여 자유무역에서 제외해야 한다는 문화적 예외를 주장하고 있다. 그러나 WTO의 DDA협상이 진행되고 있고 미국이 FTA를 급속히 확대해 나가고 있는 상황에서 다자간 자유무역협정의 틀 안에서 이루어지는 문화적 예외는 한시적 대응수단으로 근본적인 대안이 될 수 없다. 따라서 유네스코의 문화다양성 협약을 통해 국가의 문화정체성 확보를 위한 정책 등을 실행함으로써 문화에 대한 자주권을 국제법상 보장받도록 해야 하며 무역협정의 교역질서를 대체하는 새로운 문화교류의 질서를 조직하여야 한다.

The Influence of Origin Regulations on the FTA Utilization and Export Performance of Automobile Parts Companies

  • Purpose - This study examined the Rules of Origin (RoO) as a factor affecting free trade agreements' (FTA) utilization and analyzed the causal relationship and the effects of these factors on the export performance of automobile parts companies. Design/methodology - We analyzed and verified the impact of FTA utilization and the export performance of automobile parts companies by dividing the characteristics of the RoO into complexity and uncertainty. Following which, various statistical analyses were conducted on the interrelationships among these variables. Findings - This research analyzed the effect of the RoO factors of complexity and uncertainty on the use of FTA and the export performance of automobile parts companies. We found that these characteristics of RoO were generally related to and affected the FTA use and export performance of these companies. Based on this, this study's investigation into the characteristics of the RoO would then help companies in better utilizing the FTA, as well as providing suggestions on how to effectively respond to the application of the FTA in the future. Originality/value - Companies that want to utilize FTAs in international trade must follow the RoO. In the Regional Trade Agreement (RTA), the country-of-origin is a key factor, with the RoO being an important requirement for the application of preferential tariffs. These regulations are a requirement for receiving FTA preferential treatment; however, they also cause difficulties to companies in using the FTA.

다중 속성 협상과 상호 이익을 위한 중개 에이전트 시스템 (Mediator Agent System for Reciprocity and Negotiation using Multi-attributes)

  • 본 논문에서는 일반적인 상거래에서와는 다른 전자상거래 환경의 특성을 바탕으로 구매자와 판매자의 상거래에서 양자간 최대이익을 제공해 줄 수 있는 중개 에이전트 시스템을 제안하였다. 판매자와 구매자의 상거래를 통하여 얻을 수 있는 최적의 타협안은 어느 한쪽으로 이익이 치우치지 않고 양자간 이익의 합이 최대가 되는 제안으로 정의하였다. 중개 에이전트는 상품의 다중 속성을 고려하여 협상을 수행하며, 구매자와 판매자의 이익은 Multi Attribute Utility Theory(MAUT)를 이용하여 표현하였다. 중개 에이전트를 이용한 협상 과정은 협상에 참여한 구매자와 판매자의 협상 정보를 이용하여 정수계획법으로 모형화 하였다. 중개 에이전트 시스템과의 비교를 위하여 상호이익의 보장이라는 동일한 조건 하에서, 구매자와 판매자에이전트 사이의 상호작용을 이용한 협상 알고리즘의 하나인 trade-off mechanism을 적용하여 협상 시스템을 구현하였다. Trade-off mechanism에 의한 타협안의 경우 최적간을 보장하지 못하는 반면 중개 에이전트 시스템에 의한 타협안은 상대적으로 빠른 시간 내에 양자간 최대 이익을 제공하는 최적의 타협안을 보장해 주었다.

Is the RCEP a Cornerstone or Just Collaboration? Regional General Equilibrium Model Based on GAMS

  • Purpose - This paper investigates the potential effect of the Regional Comprehensive Economic Partnership (RCEP) on trade liberalization among member countries in order to answer key questions in our research on whether the RCEP will be a cornerstone or just collaboration. Furthermore, it aims to measure the likely magnitude of the economic impact it has on its members. Design/methodology - Toward achieving research objectives, we developed a regional CGE model based on the GTAP 9 database. Findings - The simulation results show Korea, Australia, India, and Japan ranked the top countries with an average growth in GDP of 0.38 %, 0.36%, 0.29%, and 0.23%, respectively. Moreover, China and New Zealand followed with a percentage of 0.12% each. The lower economic performing group is the ASEAN group due to a contraction in GDP by 0.13%. Accordingly, there was a positive impact of the RCEP agreement on all member states, as empirically demonstrated. Furthermore, Korea is one of the countries that will benefit most from joining this agreement. Finally, this agreement is important; it has many economic benefits to member states, but it is not a cornerstone. Originality/value - The examination of the quantitative effects of tariff removal among the RCEP's countries is its value. We will address all member countries of the convention simultaneously using a regional CGE model GAMS language, where we employed a Mathematical Programming System for General Equilibrium (MPSGE) to establish a Regional CGE model. This study is directed to policymakers looking at evaluating RCEP agreement.

국제교역에 있어 환경보호를 위한 규제조치의 내용 분석 (Analysis of regulatory action for environmental protection in International Commerce)

  • The Purpose of this study is to research the problems of trade restriction for an environment protection. Environmental regulation relate to trade are Convention on International Trade in Endangered Species of Wild Fauna & Flora, Montreal Protocol on Substances that Deplete the Ozone Layer, Kyoto Protocol to the UN Framework Convention on Climate Change, Basel Convention on the Control of Transboundary Movements of Hazardous Wastes & Their Disposal, Cartagena Protocol on Biosafty and WTO Agreement. Regulatory action for environmental protection has economics instrument, command & control, liablity, damage compensation, voluntary agreement. In the case of our country, impact of regulatory action for environmental protection is low. Because is recognized position of developing country yet. For in the balance rules of trade and enviroment, First must satisfy WTO's basic principles and principle of quantitative restrictions prohibition, Second, operation of protection action must reasonable and objective standards Third, must satisfy GATT article 20 (b) clause and (g) protestation each essential factor To grow for environment advanced country, we should do i) using of FTA ii) international cooperation strengthening for developing country position iii) construction of environment information network

  • In a rapidly changing environment of international trade, the purpose of this study is to examine economic benefits and losses of each country involved in the negotiation on the Free Trade Agreement (FTA) in Northeast Asia and to prepare strategies for the negotiation in the FTA between Korea and China. Previous researches on FTA have been made mainly from the macroeconomic perspective. The approach in this study is a combination of regulatory, reviewing regulations, and economic making quantitative analysis of the economic effects of FTA, which are the basic background of FTA. In economic analysis, I estimated the macroscopic economic effects of FTA by examining the effects of FTA on the trade balance, GDP and production of focal countries through the Computable General Equilibrium(CGE) model using GTAP data set.

한.중 FTA체결이 광주.전남지역에 미치는 영향에 관한 소고 (The economic effects of a Korea.China FTA on Gwangju-Jeonnam Region - Mainly Agricultural and Marine Products -)

  • The economic development system of Korea is based on export-oriented strategy and the free trade agreement. So Korea is trying to conclude the free trade agreement with China, Japan, and EU. The reason is that Korea will have more chances to develop there economy scale and trade surplus, but it will give the worst economic situation. The research showed that the effects of FTA on Korea's GDP will be much greater than China's and Korea's trade surplus with China will expand in the manufacturing sector, but agricultural and marine products are layed in opposite situation. Especially comparing with other Provincial, Gwangju Jeonnam has a relative importance portion of agricultural and marine products. So, Gwangju Jeonnam have to prepare the effects of agricultural and marine products under the Korea China FTA.

  • As the development of information and globalization of world economy enters new condition, the stake of every nation's makes more complwx, and multilateral negotiation lead by WTO is seriously delayed. But the number of agreement about FTA increase exponentially. In this study we aim to consider whether Korean FTA affects the relation of the trade of Korea and Japan or not, especially Automobile industry. The composition of this paper is as follows. Chap. 1 is Introduction. In Chap. 2, we consider the change of the Trade Policy of Korea focusing in FTA. In Chap. 3, we consider how Korean FTA affect the structure of Japan's Trade, especially the automobile industry of Korea and Japan. In Chap. 4, we have conclusion. As the conclusion, the impact to the automobile industry of Korea and Japan is that Korean FTA works to Korean automobile industry advantageously in micro level, but in macro level, the competition of world automobile industry move into a next generation technology market.

관세평가협정과 관세법상 하자보증비용에 관한 연구 (A Legal Review on the Warranty Charges Clauses of the WTO Customs Valuation Agreement and the Korean Customs Act)

  • Recently, Korean customs authorities have attempted to impose customs duties on the warranty charges paid by Korean subsidiaries ("the taxpayers") of multinational corporations to their overseas headquarters, or their affiliates, as indirect payment of the price actually paid or payable for imported goods and services, and the taxpayers' complaints have been steadily increasing. The key issue of Korean Supreme Court decision, 2018Du56619, revolves around opposing interpretations of the Korea Customs Act and the WTO's Customs Valuation Agreement in determining who is responsible for paying duties levied on warranty charges. The Supreme Court's ruling was consistent with its previous interpretations of the WTO agreement on customs valuations. The Supreme Court ruled in favor of the plaintiff, a Korean subsidiary, stating that the overseas corporate headquarters' payments of warranty charges to Korean dealers are made on behalf of the Korean subsidiary, which is ultimately responsible for covering warranty charges. Thus, the Korean subsidiary's settlement of the warranty charges to their Korean dealers through the overseas headquarters is effectively the same as a direct payment to the dealers. Therefore, the Korean subsidiary performed warranty services on its liability and account. As such, the court ruled that warranty charges should not include tariffs on the indirect payment for warranty services in such cases. This paper presents the comparative legal implications for the warranty charge clauses in the WTO agreement and the Korean Customs Act and analyzes the Supreme Court's decisions.

선화주 균형발전을 위한 해운법 및 독점규제법의 개정방향에 관한 연구 (A Study on the Direction for Revision of Korea Shipping Act and Monopoly Regulation and Fair Trade Act)

  • Korea Shipping Act admits shipping conferences' joint actions like rate agreement, sailing agreement in some degree for development of shipping transport industries for decades. Meanwhile, EU has prohibited all kinds of shipping conferences' joint actions since October 2008, and many advanced countries also have similar position on shipping conference. The balance development between shippers and ship owners is very important in terms of national economic growth. So it is appropriate time to revise related laws such as Shipping Act and Monopoly Regulation and Fair Trade Act. First, It is direction for revision of Korean Shipping Act. The act has to define precisely the criteria of "unfairness" in case of admitting of shipping conferences' joint actions. Shipping conferences have a conference with shipper or shipper's delegation substantially on freight and transport conditions and so on. Second, It is direction for revision of Monopoly Regulation and Fair Trade Act. The fair trade commission has to perform fair roles between shippers and ship owners. The judgement of fairness has to confirm according to the spirit of not Korea Shipping Act but Korea Monopoly Regulation and Fair Trade Act itself.
