  • BOLERO project and TradeCard System are attracted public attention as new settlement method that is able to substitute for documentary letter of credit. BOLERO is the business processes and methods, together with the digital information system, which are provided by Bolero International for communicating Messages and Documents and facilitating business transactions. TradeCard aim to make international business-to-business e-Commerce easy, fast, inexpensive and secure while innovating current documentary compliance and financial settlement mechanisms. The main purpose of this paper is to search the possibility of paperless trade. Since, this paper examine the international legal feasibility of these systems and compare the strength and weakness.

  • This study aims to elucidate the major issues and problems of the North Korean woman defectors focusing on the Community settlement system of Korean society in the time of the historical change of the rapidly changing inter - Korean relations starting from the recent summit talks between North and South Korea. Analytical methods were conducted using literature and previous research data. The results of this study are summarized as follows. The necessity of legal and institutional support reflecting the characteristics of life of North Korean woman defectors and experience of defecting, the necessity of development and management of employment education and employment support program for stable settlement support, the necessity of an integrated support system of public - private cooperation governance structure The need for a tailored social adaptation program tailored to individual needs arises. The results of this study are important to suggest the direction of improvement of the actual system through studying the policy and system of the settlement of Korean society in advance of the unification era. In future research, the support system for the settlement of the South Korean society A variety of studies to identify the factors for role formation will be needed.

Effects of Gas Generation due to Biodegradation on Long-term Landfill Settlement (매립장의 생분해로 인한 가스발생이 장기 침하에 미치는 영향)

  • The conventional settlement prediction method is not appropriate to model landfill settlement because it is very complex phenomenon. Biodegradation needs to be considered for long-term settlement since landfills are comprised of various organic materials and soils. As organic materials are decomposed, they directly influences on settlement producing LFG(Landfill Gas). Therefore, mathematical settlement prediction model is proposed based on the generated gas volume. As one of stabilization methods, leachate recycling system is adopted to model tests. Two model tests; one is leachate recycled, the other is non-recycled, are componented with proposed model and analysed regarding gas generation and settlement. The proposed mathematical model requires correction coefficients of 1.4 and 1.7 for non-recycled model and recycled, respectively. The recycled model showed 22% increase of long-term settlement more than the non-recycled model.

  • This paper estimates the long-term settlement of Incheon unsanitary solid waste landfill, which is 20 years old. The unsanitary solid waste landfill was subjected to pre-loading system over a period of 1 year, and 300 settlement monitoring provided the long term settlement data. This landfill contains relatively small amount of organic component, and therefore the initial stage of settlement was very small. The existing settlement models were examineed by comparing the observed behaviors of this site, and also they were used to predict the long-term settlement. Power Creep Law (PCL) model showed good agreement with the measured settlement obtained from the initial stage of the measurement, but other models showed satisfactory agreements after $50{\sim}70$ days of measurement.

A Trend of Back Ground Surface Settlement of Braced Wall Depending on the Joint Dips in Rocks under the Soil Strata (복합지반 굴착 시 암반층 절리경사 각도별 흙막이 벽체 배후 지표침하의 경향)

  • The surface settlement of the back ground of a braced wall due to the ground excavation has the great influence on the safety of the surrounding area. But it is not easy to predict the settlement of the surrounding area due to proud excavation. Estimation of the settlement of the surface ground induced by the deformation of the braced wall is performed by FEM and empirical method (Peck, Clough etc). In this research, surface settlement of the back ground braced wall depending on the joint dips in rocks during excavating the composit ground was measured at the large scale model test (standard: $0.3m{\times}0.3m{\times}0.5m$). The scale of model test was 1/14.5 and the ground was excavated in ten steps. Earth pressure on the braced wall and ground surface settlement on the back ground of a braced wall were investigated. The surface settlement during the excavation depended on the joint dips in rocks on of the ratio of rock layer. Maximum earth pressure and maximum surface settlement were masured at the same excavation step. In accordance with the increase of the rock layer dips and rock layer ratio, the ground surface settlement increased. The maximum ground surface settlement was 17 times larger at 60 degree joint dips in rocks than that of the horizontal ground conditions. And the position of the maximum surface settlement by empirical method was calculated at the point, which was 17%~33% of excavation depth. In accordance with the increase of the rock layer dips and rock layer ratio, the ground maximum surface settlement increased. The ground surface settlement of composite ground is smaller than that of the empirical.

  • A traditional settlement, in a long history establishment, is appeared to be configured of the people and their life in the areas. This is, a positive aspects, compared to most of the city in these day which is monotonous aspects. The purpose of this research deals what is the formation process and spatial character in urban settlement of Naju city, and how to applicate in a modern city context. For the research goals, it analyse an old Naju Castle area, transformation of the land use through the cadastral survey, and spatial character through step by step in chronical approach. The process of change can be seen in the devide pattern in a lot, formation and extension of a private road, and formation and change of the road; This shows how to changes traditional settlement in a old urban areas of Naju city. A now road system in old area, as a conflict, push the change of the spatial organization, and the balance of the identity of a traditional settlement and a new change as a convenient needs, it is a key point to get ideal settlement.

  • Braced excavation systems are commonly required to ensure stability in construction of basements for shopping malls, underground transportation and other habitation facilities. For excavations in deposits of soft clays or residual soils, stiff retaining wall systems such as diaphragm walls are commonly adopted to restrain the ground movements and wall deflections in order to prevent damage to surrounding buildings and utilities. The ground surface settlement behind the excavation is closely associated with the magnitude of basal heave and the wall deflections and is also greatly influenced by the possible groundwater drawdown caused by potential wall leakage, flow from beneath the wall, flow from perched water and along the wall interface or poor panel connections due to the less satisfactory quality. This paper numerically investigates the influences of excavation geometries, the system stiffness, the soil properties and the groundwater drawdown on ground surface settlement and develops a simplified maximum surface settlement Logarithm Regression model for the maximum ground surface settlement estimation. The settlements estimated by this model compare favorably with a number of published and instrumented records.

  • Ground settlements induced by tunnel excavation cause the foundations of the neighboring building structures to deform. An expert system called NESASS( Neural network Expert System for Adjacent Structure Safety analysis) was developed to analyze the structural safety of such building structures. NESASS predicts the trend of ground settlements resulting from tunnel excavation and carries out a safety analysis for building structures on the basis of the predicted ground settlements. Using neural network technique. the NESASS learns the database consisting of the measured ground settlements collected from numerous actual fields and infers a settlement trend at the field of interest. The NESASS calculates the magnitudes of angular distortion, deflection ratio, and differential settlement of the structure. and in turn, determines the safety of the structure. In addition, the NESASS predicts the patterns of cracks to be formed in the structure, using Dulacska model for crack evaluation. In this study, the ground settlements measured from Seoul subway construction sites were collected and classified with respect to the major factors influencing ground settlement. Subsequently, a database of ground settlement due to tunnel excavation was built. A parametric study was performed to select the optimal neural network model for the database. A comparison of the ground settlement predicted by the NESASS with the measured ones indicates that the NESASS leads to reasonable predictions. The results of confidence evaluation for safety evaluation system of the NESASS are presented in this paper.

  • As the Internet settles down as a general means, every year the domestic e-commerce transaction using the internet rapidly increases in its scale, and the conflicts occurred from the e-commerce largely grow as well. However, it is true that the clear settlement means to work out such conflicts is not established yet. Considering the feature of e-commerce, it would be better to resolve them by ADR rather than by lawsuits in the court, and in addition to it, the ODR system having sweetness as its advantage will be the optimized model. But to make the ODR settled down, there are many assignments to be improved in many aspects afterwards. In case of our country also, since the ODR system is still its early developing step, it is not activized yet due to its weak technical, lawful environments. Thus, currently, it is unavoidable to operate the dispute mediation system, carrying out a system by the existing Off-line together, and thereby, as we replace the parts worked out by the Off-line with by the On-line, we must try to develop it into a quick, cheap, and reliable dispute settlement system.

Settlement Promotion of Commercial Disputes through the Arbitration Agreement (중재협정을 통한 상사분쟁의 해결촉진)

  • It is well recognized that the availability of prompt, effective and economical means of dispute resolution is an important element in the orderly growth and encouragement of international trade and investment. Increasingly, arbitration, instead of litigation in national courts, has become the preferred means of resolving private international commercial disputes. Under the situation, it will be important thing for arbitral institutions to reach an agreement to promote the dispute settlement of the commercial disputes, for which efforts have been made between the Korean Commercial Arbitral Board(KCAB) and principal arbitration institutions of the foreign countries. Since 1973, the KCAB has entered into many arbitration agreements with well-known foreign institutions of arbitration. If the place of arbitration is not so designated by the parties, it, as a general rule, shall be the country of the respondent(s) under the Korea-Japanese Arbitration Agreement. On the other hand, the U.S.-Korean Commercial Arbitration Agreement maintains 'Joint Arbitration Committee which finally decide the place of arbitration. In 1996, the Korea-Austria Agreement of Cooperation was concluded for the prompt and equitable settlement on an amicable basis of commercial disputes. Under this Agreement, arbitral institutions between Korea and Austria agreed to act as an appointing authority in accordance with the UNCITRAL Arbitration Rules. It is also very important for Korea and China including North Korea to cooperate each other for the settlement of the commercial disputes within the Pan Yellow Sea Economic Bloc(PYSEB). The PYSEB is quickly becoming a distinctive and crucial region in the world sharing geographical proximity, many common historical experiences, and similar cultural norms and values although they have disparities in stages of development, trade and economic policies, and financial and legal frameworks. Finally, it should be considered to establish a central common system for settlement promotion of the commercial disputes within the PYSEB through the arbitration agreement. Such a dispute resolution system was already introduced and established within the area of the NAFTA, and it is called the Commercial Arbitration and Mediation Center for the Americas(CAMCA).
