Study on the Improvement of Laws Related to the Electromagnetic Wave of Mobile Phones

  • Countries around the world have already taken direct and indirect measures to warn of the harmful effects of mobile phone electromagnetic waves. On the other hand, in the Republic of Korea the installation of Wi-Fi has been expandedwithout restrictions by location, and there is a widespread atmosphere of protesting human rights violations even if young students cannot use mobile phones, ignoring problems caused by the use of mobile phones. Human brain cells are increasingly exposed to electromagnetic waves of mobile phones as the penetration rate of smartphones grows.In order to solve the long-lasting question of whether electromagnetic waves from mobile phones will harm the human body, many studies are being conducted in various countries around the world, andthe recently published findingshave warned of the potential for harm. The labeling of electromagnetic waves alone is not sufficient to raise awareness about the dangers of electromagnetic waves. It is necessary that the Republic of Korea organize and operate a national electromagnetic wave research center in line with its status as an IT powerhouse, along with the revision of the Radio Wave Act, which directly warns the public about the hazards of mobile phone electromagnetic waves and can directly impose obligations on the mobile phone industry.

  • "UNIDROIT Principles 2004" focused on an enlargement rather than a revision. An additional Section or Chapter so to speak, which are about, the Authority of a Agents, Third Party Rights, Set-off, Assignment of Rights, Transfer of Obligations and Assignment of Contracts, and Limitation Periods have been added, while the only change of substance made to the 1994 Edition, apart from two paragraphs in the Preamble, and three new provisions in Chapter 1 and 2 which are necessary to adapt the Principles to the needs of electronic contracting. The Principles which have the nature of the restatement of international uniform laws (for example CISG) are continuous exercise. Therefore we should note whether in the future our concerns would be on a additional topics on a improvement of the current text by monitoring the reception of the "UNIDROIT Principles 2004" in practice, and the application by contracting parties. The purposes of the Principles may be classified into three ; the rules of law governing the contract, means of interpreting and supplementing international uniform law or domestic law, or models for national and international legislator. Among them, the function of governing law may be applied by the express choice by the parties or by the implied choice like "general principles of law" or "les mercatoria", and it may be applied in the absence of any choice of law by the parties. Among there importance functions, this writer would like to emphasize the function to supplementing international uniform law instruments. The reason is that the CISG which has been established as an international uniform sales act and to which our country would be a contracting State from March, 2005, needs a lot of gap-filling. For this purpose it is advisable the parties to insert following provisions in their contract. "This contract shall be governed by the CISG, supplemented when necessary by the UNIDROIT Principles 2004" Thus success in practice of the UNIDROIT Principles over the last then years has surpassed the most optimistic expectations. It is hoped that the 2004 Edition of the UNIDROIT Principles will be just as favorably received by legislators, business persons, lawyers, arbitrators and judges and become even better known and more widely used throughout the World.

Proposal of Urban Agricultural Park Management and Operation Plan Using the Public Service Design Process

  • Background and objective: With the revision of the Act on Urban Parks, Green Areas, Etc. in 2013, the "urban agricultural park" was newly established under the subcategory of "themed park," thereby establishing the institutional basis for the creation of urban agricultural parks. However, urban agricultural parks are still in the early stages of their introduction. There is a lack of research on direction setting and specific operation management that considers urban residents' needs and the city's physical infrastructure. Methods: We utilized the public service design process suggested by the Ministry of the Interior and Safety of the Republic of Korea in 2019 to identify problems and develop directions for urban agricultural parks. The process consisted of the following four steps: Understanding, Discovering people's needs, Defining real problems, and Developing ideas. Results: As four types of ideas for revitalizing urban agricultural parks, 'information users want to know,' 'user participation in design,' 'venue for local communities,' and 'urban agricultural parks as health and rest areas' were derived. This means that urban agricultural parks must provide the information users want; users must plan, decide, and implement such information by directly participating in the creation and efficient management and operation of urban agricultural parks; and urban agricultural parks must be used as a venue for local communities. Urban agricultural parks should also be spaces for health and relaxation. Conclusion: Urban agricultural parks should avoid the unified space and passive participation patterns of existing urban parks, and become real spaces for resident participation that can satisfy all the production, leisure, landscape, ecology, and psycho-social needs of the users of urban agricultural parks. Furthermore, it is necessary to introduce a more systematic and diverse operating system so that it can work to revitalize the local community and connect organically with the function of the city.

An Analysis on the Issues of Records Disposal Freeze Program in South Korea (기록물 폐기중지 제도 도입을 위한 쟁점 분석)

  • The Records Disposal Freeze Program will be introduced in June 2020 with the revision of the Public Records Act of South Korea. In the study, the issues of the program were identified through the analysis of domestic cases and the programs of other countries, and the improvement plans on the issues were suggested. For the analysis of the programs, seven factors which should be presented to implement the program were derived from the notices of disposal freeze by National Archives of Australia. Based on the factors, the programs were analyzed; the programs of South Korea, the United States of America, United Kingdom, Australia and New Zealand. As a result of analysis and comparison of the programs, five issues of Korean program were derived. The experts interviews were conducted to understand the perception and the perspective on the program of records managers and archivists. The improvement plans for the program of South Korea were suggested based on the analysis and comparison of the programs of five countries and experts interviews.

Cost-Benefit Analysis on the Economic Effectiveness of Safety and Health Ledger (비용편익분석을 통한 안전보건대장의 경제적 효과성 분석)

  • The safety and health ledger system, which gives the responsibility of safety and health management for construction site workers to the construction project owner, was introduced as part of the overall revision of the Occupational Safety and Health Act. There is a need to explain the system's effectiveness in terms of economic feasibility to solve the execution problem of the system caused by low awareness and implementation rate. In this study, the economic effect of implementing the safety and health ledger system was analyzed using cost-benefit analysis based on the data discussed at the time of the introduction of the system. Results show that creating and managing the design safety and health ledger caused additional costs in implementing the system. As a result of comparing the cost of preparation and the direct and indirect benefits caused by the reduction of industrial accidents, the benefits were evaluated higher than the costs. Thus, it is thought that the safety and health ledger system reduces construction work accidents and generates economic effects.

A Study on Effective Floor Area for Wheelchair Users to Use Toilet (휠체어 사용자의 대변기 이용을 위한 화장실 유효바닥면적에 대한 연구)

  • Purpose: The purpose of this paper is to provide logical basis on enlargement of toilet floor space for the disabled by "ACT ON GUARANTEE OF PROMOTION OF CONVENIENCE OF PERSONS WITH DISABILITIES, THE AGED, PREGNANT WOMEN. ETC" Revised Enforcement regulation [Asterisk 1] (2018.2.10.) and to help with making plans, designs and establishing policies by conducting experimental study with the enhanced floor area regulations. Methods: We conduct Experimental study, field work and interview for this paper. In experimental study, verification of the effective floor area was proceeded by measuring activity space for people in manual wheelchair, electric wheel chair and electric scooter and also reviewed useable area with the space expanded 0.2m both width and depth. In filed work, conducted an observation what other things (ex. sanitary equipment, hand rail and so on) can also affect the active space as well as effective floor space. In the interview, other problems and requirements that were not revealed were experimental study and observation of field work. Results : it's expected to provide better access to toilets for the disabled with the law revision of effective floor area. But, with the usage increasement of enlarged wheel chair and electric wheel chair, expanding side areas of toilet is also highly likely to be required going forward. Implications : Additional research is required on locations of exists and internal arrangement that effect the usage of toilet. It should be led to Universal design by making additional investigation and verification of the users patterns.

  • Recently, there has been fierce argument between oriental and western doctors in the medical field. The use of medical devices has particularly come to the fore lately. Appropriate medical devices are required to diagnose and treat patients' conditions or illnesses accurately. At issue recently in medical device sector are diagnostic instruments using radiation, magnetic resonance imaging, ultrasound, IPL(Intense Pulse Light), and instruments used for tonometry. Relating to this issue, Association of Korean Oriental Medicine and The Association of Korean Medicine are sharply opposed. It is predicted that more accusations of this kind will be seen in the future. As oriental medicine contends, ultrasonic imaging itself seems to cause no harm to humans and its use may have an advantage for national health. The use of western diagnostic equipment can expand the diagnostic range of oriental doctors. However, unless new legislation is made, it is against the law for oriental doctors to use this equipment. Both law and medical science require grounds and predictability on the correctness of a decision and all of its consequences. Additionally, oriental medicine's use of ultrasounds and other medical devices should be established by standards and grounds which make same the diagnosis with repetition. Therefore, the scope of oriental medicine can be expanded following a revision of the Oriental Medicine Promotion Act and it is estimated that the state of national health will be greatly improved by the mutual respect of both sides of the health profession.

A Study on the Functional Area Composition and Correlation Factors of Elderly Care Floor in Nursing Home (노인요양시설 요양층의 기능별 면적구성과 상관요인에 관한 연구)

  • Nursing Homes do not have a defined standard in the space area nor does it have a detailed standard facility requirement by law. This can possibly lead to the deterioration of the facility and the system. This directly affects the medical treatment space area within the nursing home. The medical treatment area provides medical treatment to seniors and this is where the seniors get most of their daily services. Therefore, this is research is about the study of the space area of the medical center and the ratio trend of the space area for the medical treatment facility located in senior nursing homes. Ten facilities have been selected in this study to analyze the correlation factors between space area and its trends. The analysis performed includes the conditions relating to the area and what affects the center. We have followed up with a proposal for improvement of the facility and area configuration for the medical treatment facility. Based on the analysis, the following conclusion can be made: First, the senior welfare centers are mostly used as a residence purpose followed a temporary stay of residence facility for the seniors. Second, research indicates that the bigger the facility, nursing and public functions took a larger portion of the space area compared to other services within the senior welfare centers. Third, the study shows the management space area took up about 1%~6% of the entire medical center within the nursing home which is a narrow space area because of the integrated management. Fourth, analysis based on the trend in the time-series indicate after the adoption of the system, there is a continued decline in the space area of nursing, management and public areas. Lastly, since before and after 2008, the space area composition of the nursing facility shows a continuous decline in our study. We can safely conclude that the revised senior welfare act's construction plan has an effect in the facility and is effectively working to meet its requirement. Therefore, the revision of the law is required to reflect the social needs of the residents.

A Review on Recent Debate on Proposals of Amendment of the Article of Prohibition of Inhouse-Contract for Harmful Work in the Industrial Safety and Health Act (유해작업 사내도급 금지와 관련된 논란 및 개정방안에 관한 고찰)

  • Objectives: The purpose of this study is to review the debate on the Article 28(Prohibition of Inhouse-Contract for Harmful Work) of the Industrial Safety and Health Law. Methods: Literatures and recent debate for prohibition and permission of inhouse-contract for harmful work were reviewed. Proposals of revision for the Article 28 of the Industrial Safety and Health Law were also reviewed. Results: It was not found reasonable to revise the Article 28 based on increased fatal accidents or diseases in the electroplating work and heavy metals handling works that are currently listed in the Presidential Decree under the law as the harmful works. Regulation types of prohibition or authorization for any harmful work shall have inherently poor coverage since the scope of application is extremely limited. Contractors for maintenance and repair of chemical facilities may not be included in the scope of application if the harmful works are defined as chemical handling works. If harmful works are prohibited, the contractor workers may loose their jobs. Therefore, it is necessary to consider balancing job security and occupational safety and health safety. Conclusions: Various limitations were found in the Article 28 and the proposals to revise it. Currently in-house subcontracting is widely spread in the workplace. Therefore, it may be inappropriate to set one or two Article such as the Article 28 and 29 to protect in-house subcontract workers from injury and illness. It is believed that it needs fundamental redirection and new approach with new paradigm to impose occupational safety and health duty to prime contractors.
