  • The development of information & telecommunication technology and internet-based electronic commerce helps to create a new economic environment. Such an economic environment requires the companies to change themselves, while providing unlimited potential and opportunities to them. Thus, in order to help the companies engaged in a fair and free competition in the electronic market, a fair competition policy needs to be designed and operated. The electronic commerce has not only promote the competition but also impede it. The electronic commerces tend to violate the fair trade than the conventional commerces in terms of differentiation, monopoly, conference, limited competition and intellectual property rights, schumpeterian competition, Alliance competition. With such basic concepts in mind, this study was aimed at reviewing the economic effects of the electronic commerce in the market and addressing the problems involving the application of the fair trade code to the electronic commerce, and thereby, suggesting the insights into our fair competition policy and reform measures.

The Role of Compensation in Natural Resource Conflicts (자연자원분쟁에서 보상의 역할에 대한 연구)

  • When landowners have private information about land value, compensation based on conservation value at the time of regulatory takings of land is impractical even though it generates an efficient outcome. No compensation rule to a landowner not only yields an inefficient outcome but also provides an ex ante pervasive incentive for the landowner to invest in lowering conservation value. An alternative rule of compensation based on the market value of the land provides ex ante incentives for landowner either to reduce conservation value or to increase it. Under the market value compensation rule, placing the burden of proof on landowner gives higher probability of conservation than placing it on regulator. Whether it is better to allure landowners to conserve by paying compensation with market value and placing the burden of proof on landowner through changes in the regulatory regime however depends on the magnitude of inefficiency, equity consideration and dynamic nature of property rights on environmental goods.

  • Because of the rapid growth of Internet and multimedia applications, how to protect IPR (intellectual property rights) has become a critical issue. Is one of the ways to overcome the problem of the protection of IPR. Digital watermarking call be applied to multimedia data, such as digital images, digital video, and digital audio. In this paper, we propose a digital watermarking technique for digital images to authenticate an owner or an image by embedding visually recognizable patterns, such as logos, signatures, or stamps into images In BDCT (block discrete cosine transform) frequency domain. The proposed method sorts the components of an original image twice. At the same time, the method, also, rearranges the components of a watermark twice in order to be more robust, and finally embeds the watermark into the image. From the experimental results, the conjunction of three similarity measurements shows that our proposed method is robust to image cropping, image filtering, and JPEG (the Joint Photographic Experts Group) both subjectively and objectively.

  • Since NFTs can be used like certificates due to the nature of blockchain, their use in various digital asset trading markets is expanding. This is because NFTs are expected to be actively used as a core technology of the metaverse virtual economy as non-transferable NFTs are developed. However, concerns about NFT security threats are also growing. Therefore, the purpose of this study is to investigate and analyze NFT-related infringement cases and to clearly understand the current security status and risks. As a research method, we determined NFT security areas based on previous studies and analyzed infringement cases and threat types for each area. The analysis results were systematically mapped in the form of domain, case, and threat, and the meaning of the comprehensive results was presented. As a result of the research, we want to help researchers clearly understand the current state of NFT security and seek the right research direction.

  • This paper explores the determinants of the economic value of patents using a survival time analysis. The analysis is based on renewal information of about 250,000 patents filed from 1984 to 2005 in the Korea Intellectual Property Office. A patent right is valid only when its owner pays yearly maintenance fees. Failure to pay causes patent rights to be lapsed. We use the fact that more valued patents live longer and the lengths of their renewals can be closely related to their value. The value can be affected not only by its own technological aspects such as quality and breadth, but also by characteristics of its owners such as innovativeness and age. This paper presents patent-specific and firm-specific characteristics which influence patent value. The result of analysis implies that patent value depends on both the technological contents of the patent and general capabilities of a firm.

A Strategic Effect of Bundling on Product Distribution

  • Purpose - This study examines a bundling effect on production and distribution in a patent-protected industry. Despite the heavy use of bundling strategies in the information and technology industry, literature has paid scant attention to bundling of intellectual property rights. This study examines a theoretical exploration of the bundling effect on licensing behavior. Research design, data, and methodology - To address this behavior, we build a simplified model consisting of three stages: 1) bundling decision, 2) licensing agreement, and 3) competition. The subgame perfect Nash equilibrium is applied to the model. Results - A single-patent holder with superior technology grants its own license to the multiple-patent firm, thereby leaving the market. Anticipating the single right holder's licensing strategy, the multiple-patent firm offers a bundle, making the single-right holder's bargaining position weaker. Conclusions - Bundling is an effective business strategy, resulting in multiple products for a firm as it faces other firms with single-product lines in each market. Taking advantage of the multi-patent or multi-product lines, the firm utilizes the bundling strategy obtaining better technology from the standalone single-patent firms.

  • Recently, increasing security threats are not only interfering with business continuity of companies but they are al so causing serious problems on social and national levels. As violation of intellectual property rights increases due to growing competition between different companies and countries, companies are now required to follow various IT compliance regulations, under relevant legal obligations. This study proposed a model of convergence security compliance management by using machine learning, in order to help companies actively utilize IT compliance.

  • This paper suggests how to systemize administrative metadata required for managing intellectual property rights and their applications, which has been newly requested in digital library environment. For this purpose, firstly, the types of metadata required in digital libraries were identified. Secondly, this paper detected problems in MARC that digital libraries have been using as the tool for information organization. Finally, the structures of administrative metadata required by copyright laws were analyzed. On the basis of the researches above, this paper proposed how to systemize and operate administrative metadata that interlocks MARC, Dublin Core and administrative system of copyright trust agencies.

  • The acceptance of unsolicited proposals (a private-initiated process) has been viewed by several governments as a means of encouraging innovative initiatives. However, the ramifications of this mechanism are still poorly understood. This paper analyzes a framework used by the Taiwanese government to evaluate unsolicited proposals. Taiwan's experience demonstrates the need for an improved framework in which key issues such as building consensus, maintaining a transparent procurement process, ensuring sufficient competition, and protecting intellectual property rights shall be addressed. In addition, the case study suggests that the roles of participants, the relationships and interfaces of activities, information flows, and decision making points should all be well defined. Some fundamental differences between solicited and unsolicited proposals are also discussed.

  • When Digital Contents goes through production${\cdot}$delivery${\cdot}$consumption, MPEG(Moving Picture Expers Group)-21 IPMP(Intellectual Property Management and Protection) defines standard which have defined by FCD(Final Committee Draft) level to keep the Digital Contents in safety. And development of system which applied to latest standard to protect and manage the broadcasting contents is required. Currently, the system to protect and manage the broadcast contents consists of fourth organizations which means production server, tool server, license server, consumption server. In this paper, we made production server to parse REL(Right Expression Language) document that has right information for content from license server, and create metadata based on MPEG-21 IPMP about the content that applied to watermark. then, after it do remuxing, transmit the protected data to consumption server.
