  • It is well known that in the knowledge-based economy a firm's intellectual property including patent is crucial for its competitive advantage. In industrial economy, tangible assets such as land and equipment have been of critical importance for a firm's competitiveness. However, as the paradigm shift to the knowledge-base economy is being accelerated, intangible assets such as intellectual property are considered to be more influential for a firm to be competitive. The valuation of intangible asset is as necessary as that of tangible asset. In particular, reasonably accurate valuation of patent which represents a firm's technological competitiveness seems to be of great importance since (1) it is essential for a firm's patent strategy development, (2) it can activate the technology market, and (3) it is necessary to evaluate a patent's technological contribution when multiple patents are used to develop and commercialize an innovative product. Unlike that of tangible asset, the valuation of intangible asset is very difficult. In order to figure out a value of patent it is necessary to use a number of appropriate valuation factors. In this paper, we surveyed various valuation factors presented by previous researches and several technology valuation organizations to find a set of common valuation factors considered to be of more importance.

  • The innovation is an important element controlling national economic growth and the competitive power reinforcement of the company. The developed nations concentrate interest on upbringing and investment in knowledge intensive industry and advanced technology base industry for national competitive power reinforcement. I support in particular it as Korean representative industry in the case of the advanced technology base industry positively in the government. Though a patent can become the important competition predominance element of the company by such an advanced technology base industry, this and the proof study in the country to be concerned with are the facts that are not enough now. As for the article of the book, what kind of difference there is in importance by IT and BT industry distinction comment on current events value factors of the patent valuation; of the study is aimed. I derived an importance factor among factors shown in the valuation model of the patent valuation organization and an existing precedent study for comparison analysis in the study and used it. In addition, it was analysis hello it utilized AHP technique, and what kind of difference patent value evaluation important factors showed by IT and BT industry distinction.   • Since technological innovation is such an important factor that it can determine a company's economic growth and competitive enhancement, all the companies make lots of investments and efforts for technological innovation. As outcomes of technological innovation, there are patents, trademark and copyrights, etc. and they are mostly approved as a legal right called 'Intellectual Property Right'. To activate such an intellectual property right, financing techniques are needed for enterprises to raise funds through collaterals, such as technological and intellectual patents. In reality, however, any IP-related financial system is not really activated due to the lack of surety-related regulations in Korea. Thus, on the premise that it is important to carry out an objective and reliable valuation on IP as a collateral for the activation of IP finance, this study intends to investigate various different methods of patent valuation needed for IP finance.

  • The valuation of patented technology has been recently emphasized, and the patent citation is known as an important factor. This study performed a generalized linear model to find variables that effect the patent citation. We classified 13 variables as morphological, technological and conceptual factors and used them to find out effective variables in 14 medical devices classification. Through the empirical study, we found seven effective variables (assignee nationality, assignee character, the number of inventors, the number of application countries, the number of IPC, the number of references, the strength of bibliographic coupling). In order to apply to Korean industry, this study has significance that provides basic research to citation analysis model.

Regression Models for Determining the Patent Royalty Rates using Infringement Damage Awards and Inter-Partes Review Cases (손해배상액과 무효심판 판례를 이용한 특허 로열티율 산정 회귀모형)

  • This study suggested quantitative models to calculate a royalty rate as an important input factor of the relief from royalty method which has the characteristics of income approach method and market approach method that are generally used in the valuation of intangible assets. This study built a royalty rate regression model by referring to the patent infringement damages cases based on royalties, i.e., by using the royalty rates as a dependent variable and the patent indexes of the corresponding patent right as independent variables. Then, a logistic regression model was constructed by referring to inter-partes review cases of patent rights, i.e. by using not-unpatentable results as a dependent variable and the patent indexes of the corresponding patent right as independent variables. A final royalty rate was calculated by matching the royalty rate from the royalty rate regression model with a not-unpatentable probability from the logistic regression model. The suggested royalty rate was compared with the royalty rate obtained by the traditional methods to check its reliability.
