협상의 장애요인과 노사분쟁 (Negotiation Barriers and Labor Disputes)

  • 한국은 거의 모든 부문이 분쟁으로 시달리고 있지만 특히 노사관계 부문은 분쟁 발생의 빈도가 높고 분쟁 해결의 양상이 과격하다. 그러나 분쟁의 발생과 해결에 대한 연구가 부족하며 특히 분쟁 해결의 장애요인에 대한 연구는 찾아보기 어렵다. 본 논문은 분쟁을 해결하기 위해서 협상을 하게 될 때 장애요인을 조사하고 전형적인 노사분쟁의 사례에 적용하여 정책적인 시사점을 제시한다. 협상 당사자의 심리적 문제, 협상 이슈에 대한 정보의 비대칭성 문제 그리고 당사자와 이슈에 관련된 제도적 문제가 어떻게 협상의 장애물로 작용하는지 살펴보고 각각의 경우에 대해서 노사 당사자가 협상의 장애물을 극복할 수 있는 방안을 찾는다.

  • In Korea-U.S.A. FTA Negotiation, U.S.A. request to eliminate barriers of tariffs and non-tariff in trade of cosmetics. Korea applies tariffs of 8% on most cosmetics and personal care products. There are some non-tariffs barriers in cosmetics trade between Korea and U.S.A., for example, transparency on restriction and regulatory, cosmeceuticals, import clearance review, quality control testing, ingredient labelling. Tariffs of 8% on most cosmetics should be eliminated, a proviso of complementary measures on sanitation of Korean people about imported cosmetics. This is a meaning of reformation of prior management(tariffs) by strong ex post management in cosmetics trade. It is important that Korea should construct system of ex post management, for instance, construction of data base on manufacturer, importer, bland name of cosmetics and all ingredients of cosmetics. This is concerned with labelling of cosmetics and cosmeceutical and publication of Korean edition of INCI(International Nomenclature of Cosmetic Ingredient).

Non-native/Non-native Interactions: Meaning Negotiation by EFL College Students

  • The purpose of this paper was to examine various aspects of meaning negotiation process in online chatting. Korean college students were asked to engage in chatting on the Internet over the course of a semester-long period, and chatting transcripts were analyzed in terms of sources of communication breakdown, signals to indicate communication breakdown, strategies to overcome communication breakdown, and ways of closing meaning negotiation. According to the findings of the study, lack of background knowledge and incoherent string of sentences in text were two major barriers creating communication problems. Subjects were able to use signals to indicate their communication difficulties, and overcome them by using different strategies. In doing so, however, they were found to suffer a narrow range of signals and strategies, which showed their limited communicative ability in the management of interaction, and indicated a clear, strong need for an extension of discourse and strategic competences of Korean students for more effective and smoother transition of message in everyday interaction.

남자대학생의 성 경험 유무에 따라 콘돔사용 의도에 영향을 미치는 예측요인 (Predictors of Condom Use Intentions according to Experience of Sexual Intercourse in Male College Students)

  • Purpose: To promote condom use for young men, there is necessary to meet their varying needs for condom. The purpose of this study was to examine what predicts condom use intention according to experience of sexual intercourse among Korean male college students. The conceptual framework for the study was the theory of planned behavior and the health belief model. Methods: A cross-sectional descriptive design was used with self-report questionnaires, which were completed by 399 subjects. Logistic regression analysis was done to examine predictors of condom use intentions according to experience of sexual intercourse. Results: The susceptibility to sexual transmitted diseases/ Acquired Immune Deficiency Syndrome (STDs/AIDS) and pregnancy and benefits from condom use were significant predictors of condom use intentions in the non-experienced group. The significant predictors of condom use intention for the experienced group were barriers to condom use and condom use self-efficacy. Conclusion: These findings suggest that sex education program should be developed to overcome barriers to condom use, enhance condom use self-efficacy, and maximize the benefits from condom use as well as increase the perceived susceptibility to STDs/AIDS and pregnancy. To enhance condom use self- efficacy, practicing and increasing ability in interactive negotiation to use condom should be included.

한.중 FTA의 무역기술장벽 대응방안에 관한 연구 (A Study on Countermeasures for Technical Barriers of Trade in Korea-China FTA)

  • 본 논문은 현재 협상 중인 한 중 FTA관련하여 예상되는 무역의 기술장벽의 현안을 도출하고 그 문제점과 대응방안에 대하여 중점적으로 고찰해 보았다. 우선 FTA 무역 기술장벽의 이론적 배경인 의의와 유형을 살펴보았고, WTO의 주요 협정 내용 및 한국과 중국의 FTA 기술부문의 동향에 대해서도 알아보았다. 중국과의 무역의 기술장벽에서 쟁점이 될 수 있는 현안을 통보문 건수가 많은 "사람의 건강과 또는 안전의 보호", "환경보호" 및 "국제표준과의 조화", "투명성" 등으로 도출하였다. 대응방안으로는 중국의 배타적 기술규정에 대해 정부 차원에서 철회할 수 있도록 해야 하며 한국기업은 높은 수준의 환경규제에 충족하는 제품을 개발해야 하고 정부에서도 이러한 기업들에게 재정지원, 세제혜택 및 금융지원 등의 장려책을 실시해야 한다. 국제표준 활동의 역량강화와 전문인력의 확보가 중요하다 하겠다. 또한 한 중 정보 전달의 속도를 높이고 투명성을 제고하기 위하여 상호 직접적인 통보망을 설치하면 효율적이다. 중국의 지역통보자문센터와 유기적이고 협력적인 교류가 필요하며 기술규제의 재 개정 및 새로운 기술규제의 의견 수렴기간을 다양하게 해야 한다.

한·중 배출권거래제 연계를 위한 설계요소 및 장애요인 분석 (Analysis of Design Elements and Barriers to Link the Emission Trading Systems between the Republic of Korea and China)

  • The Republic of Korea (ROK) has made many efforts to reduce greenhouse gases through a legal framework, making obligations to reach domestic and overseas targets via the Paris Convention in 2015. China recently launched a nation-wide emission trading system (ETS) and has considered extending this ETS to include the ROK. This study examines the possibility of linking the ETS between ROK and China by considering the institutional design elements of the ETS. Additionally, this study provides policy implications to reach Korea's overseas reduction target. For the research methodology, the design elements of both the ROK and China policies were analyzed by categorizing their standard design elements based on the International Carbon Action Partnership. This paper focuses on four main barriers (cap type, borrowing, offset and price ceiling) based on their environmental benefits and analyzes the challenges to combining the design elements between the ROK and China systems. The two ETS commonly share the same cap types, and there is similar institutional progress regarding the offset and price ceiling. In addition to this, note that China has a borrowing system that is opposite to the borrowing system in ROK. According to these findings, there are major challenges to linking the ROK and China systems due to differences in the major design elements. Thus, it is necessary to modify the Korean domestic borrowing system and understand the Chinese institutional processes related to environmental negotiation to achieve further cooperation.

  • 이 논문은 WTO 서비스 협상에 대비하여 우리나라의 방송규제 정비의 필요성을 논의한 정책 연구이다. 커뮤니케이션의 세계화 추세가 진척됨에 따라, 그리고 세계 경제가 정보산업에 의지하는 비중이 커감에 따라, 미디어 정책이 WTO등 세계경제기구의 관심과 논의의 범주에 들게 되었다. 이 같은 변화는 오랫동안 방송영상산업을 문화로 규정, 국가의 정책적 개입을 인정해온 관행에 일대 변혁를 요구하는 것이어서 국제사회에서 큰 파장을 불러일으키고 있다. 방송정책이 문화와 정체성 유지를 위한 개별국가의 고유권한인지, 아니면 시장론자의 견해대로 자유로운 시장유통을 저해하는 무역장벽인지의 문제는 단순한 이론적인 논쟁에 그치지 않는다. 여기에는 각국의 문화적, 경제적 이익의 추구가 관여되어 있으며, 각국의 이해관계는 미국 대 프랑스, WTO 대 UNESCO를 최정점으로 하여 세계 영상산업 지적도 상의 각국의 위상에 따라 다양하게 나타난다. 우리나라는 입지 조건적으로 국가지원 모델을 채택하고 있는 나라와 입장을 같이 하나, 대미관계 때문에 WTO 협상 논의에서 전적으로 자유로울 수 없다. 한국의 전략적 선택을 위해 우리나라의 방송 규제의 제문제를 여타 OECD 국가의 방송규제와 비교, 분석하였다.

도하개발아젠다 전경협상과 환경통상정책 과제 (Trade and environment issue in Doha Development Agenda and its policy implication)

  • The Ministerial Declaration of the 4th WTO Ministerial Meeting at Doha in November 2001 announced the launch of the New Round and a completion date of January 1st, 2005. It agreed to eventually negotiate trade and environment linkage issues, such as the relationship between the WTO rules and Multilateral Environment Agreements and the reduction or elimination of tariff and non-tariff barriers to environmental goods and services. The Committee on Trade and Environment was instructed to pursue work on all items on its agenda within the current terms of reference and to give particular attention to the effects of environmental measures on market access, relevant provisions of the TRTPS Agreement, and labelling requirements for environmental purposes. This means that far the first time, the members of the WTO will discuss and negotiate trade and environment linkage in the framework of multilateral trade negotiation. Korea, from the standpoint of a smaller open economy heavily dependent on international trade, is obliged to overcome the challenges imposed by the environment agenda in the Doha declaration. This study examined the linkage among environment, economic growth and international trade in order to review the possible trade and environment policy implications in Korea. Mutual supportiveness of trade and environment depends much on the effectiveness of trade and environment policy coordination. In this regard, we conclude that the Korean government should provide an appropriate institutional framework to promote closer cooperation among policy makers engaged in negotiations. Trade and environment policy review and environmental impact assessment of trade negotiation should be considered as a work programme of this institutional policy coordination framework.

한국의 FTA 추진 정책과 한.중 FTA에 대한 시사점 (The Korean FTA Drive Policy and Suggestion of Korea. China FTA)

  • 한국 정부는 2003년 FTA 추진 로드맹에서 밝힌 '동시다발적이고 높은 수준의 포괄적인 FTA 추진 전략'에 따라서 칠레, 싱가포르, EU, MERCOSUR, ASEAN 등 세계 22개국과 FTA가 이미 발효되었거나 FTA 협상이 진행 또는 추진되고 있다 한 중 FTA 협상에서는 무엇보다 관세인하 전략의 추진과 함께 중국의 수입을 제한하고 있는 각종 비관세장벽의 철폐 노력이 필요하다. 동시에 중국 내 한국 기업의 경영환경을 개선시키는 노력과 함께 농산물뿐만 아니라 제조업 분야에서도 전방위적인 수입확대가 예상되므로 한 중 FTA 원산지 기준을 강화하는 등 중국을 경유한 우회수출 방지를 위한 노력도 매우 중요한 과제가 된다.

한국기업의 해외정부조달분야 수출증대방안에 관한 연구 (A Study on Export Promotion Strategy to Foreign Government Procurement Markets for Korean Firms)

  • Recently, the world government procurement market has been greatly opened thanks to the WTO Government Procurement Agreement and FTA etc..In spite of that, many companies trying to export their products into overseas procurement market have been still facing many kinds of invisible barriers and practices for restricting the market access. With the survey results, this study aims to suggest strategic and political implications for the exporting companies in the procurement area for preparing the marketing strategy and introducing the export assistance regime and developing the negotiation position in the concerned FTA. This study has showed some kinds of important implications for the export promotion in the area. Firstly, the companies have to try to increase their products competitiveness, to strength efforts for bids information gathering, to use special program for the foreign companies in some countries. Secondly, the Korean Government also has to try to establish a realistic system for gathering many information about the foreign government procurement market, to assist the companies's export marketing, to introduce the global standards for adapting international technical specifications, and to conclude the FTA agreement with the concerned developing countries in the procurement area etc..
