The Protection Offered by "Umbrella Clauses" in Korean Investment Treaties

  • Korea is, after China, the Asian country with the largest number of concluded investment treaties. One of the protections that Korean investment treaties frequently afford to foreign investors and their investment is the so-called "umbrella clause," which requires the host state of the investment to observe the commitments that it has undertaken toward the foreign investor or its investment. This is a potentially very powerful protection. Umbrella clauses, however, have proven to be amongst the most controversial provisions in investment treaties, giving rise to diverging interpretations by tribunals and commentators that are still not reconciled today.

  • Due to recent extreme weather, the information of the reliability for the nation's major social overhead capital (SOC) is emerging as a major issue. So the real-time monitoring of the underground state has become a very important. This paper is about a open USN platform for the underground information collection. Various sensors to collect information for the underground is used. The interface and the power of each sensor may vary. In order to solve the interface and power problem, this paper refer to the open interface, the network required for an open platform and the energy problem.

Shanghai Residents' Cognition, Attitudes and Expressions towards Significant Political Events -A Case Study of the 2013 "Two Sessions" of China

  • China's "two sessions," namely, the National People's Congress (NPC) and the Chinese People's Political Consultative Conference (CPPCC), has significant meaning to the political life of the nation. It collects opinions and advice from different groups of people annually. "Two sessions" 2013 was especially eye-catching, because new state leaders were elected at the meetings. Using CATI (Computer Assisted Telephone Interviewing) system, the Media and Public Opinion Center of Fudan University (FMORC) conducted surveys of China's "two sessions" every year from 2007 to 2013. In 2013, the influence of new media on public opinion has become increasingly significant. Microblog and WeChat have become two types of important media for Shanghai residents to express their opinions and take part in China's "two sessions." Based on the empirical findings, this paper examines Shanghai Residents' cognition, attitudes and expressions towards "two sessions" 2013 and analyzes how new media affect the public opinions on significant political events.

  • Purpose - The purpose of this paper is to examine IKEA in the context of corporate social responsibility to determine the reasons, if any, as to why IKEA has had more success in the implementation of its CSR policies and Code of Conduct where many other multinational companies seem to have failed. Research Design and Methodology - This is a case study, an analytical approach, which focuses on exploring and analyzing the CSR policies to measure IKEA's ethical behavior in a business environment. Results - IKEA stands out as a multinational company whose CSR policies are ingrained into the business itself as a part of its ethical operations, rather than a marketing event. Conclusion - Beyond profit, IKEA actively works together with its suppliers and the nation states to eradicate the harmful social causes of the various challenges it faces in the global business environment.

  • A digital map is provided with 2 dimensions of tile based, a user is hard for decision-marking directly. In this study, we analyzed the present situation and characteristics of a digital map about a developed nation such as United States, England, Canada. As a result, American National Map and British Master Map are keeping continuity and up-to-date, included UFID, ISO, OGC referred to an international standard, and a digital map was made.

데모그라피의 역사적 배경과 한국인구의 지역적 편향분포의 지니 계수적 해석

  • Now we have faced to two fundamental population problems: The one is over-population problem in proportion to the nation's total area, 99,434 $km^2$, and the other is unbalanced population distributions in the provincial districts of administration (16th local governments). For example, the population density of Seoul city is 16,335 persons, and the nations population density of South Korea is 464 persons for 1 km$^2$. At the first part of this study, we introduced the origins and historical back grounds of Formal Demorgraphy. And the second part, we suggest some useful indicators of urbanization of rural populations in terms of Gini's Coefficients of Concentration. As the result, we can show that the ecological Gini's Coefficients of Concentration, during the periods covered by this study, have been increasing extraordinary: 0.349, 0.433, 0.532, 0.581, 0.633 and 0.626 in 1970, 1980, 1985, 1990, 1995, 2000 A.D. respectively. However, the trend of urbanization (concentration of population) of Korean population has been the relative equilibrium state of 0.63 from 1995 to 2000 A.D.

  • Teaching of fractions is very challengeable for elementary and middle school teachers. Many teachers feel uncomfortable teaching the subject. How shall we introduce the concept of fractions? Shall we focus more on concept development or computational procedures and skills? What methodology can be used in teaching those important topics? These are the kind of questions many teachers and researchers try to answer. In this article, the authors are to look at this issue from a cross nation perspective, by examining how the Chinese mathematics curriculum and the Chinese teachers deal with this subject.

  • The United States of America is privileged in that social stratification is not directly linked to the division of powers. Nonetheless, America endured the devastating Civil War only to consolidate her national identity when a nation was not defined. In fact, state governments preexisted as a sovereign long before the federal government came into existence as a national government. As a consequence, intergovernmental relations have persistently been contested long after the Civil War ended. In contrast, the European Union was founded on the political will to establish regional integration such that her member states would never repeat the bloodshed in catastrophic wars. Since the principle of subsidiarity precipitated political endeavor in regional integration, the EU developed into a bifurcated system of transnational and international organizations. In this paper, I evaluate the US and the EU by applying the perspective of federalism in which separation and integration are perennially at tension.

Investigating the Construction Industry from Key Performance Measurements

  • The construction industry is an integral part of any nation's economy, whether measured by dollar volume or workforce size. In spite of its strong influence, there has been very little specifically aimed at evaluating the current industry performance. This research investigates the macroeconomic performance of the construction industry by accounting for crucial performance affecting factors such as labor productivity and gross margin. A clustering analysis, followed by a series of statistical analyses, yielded a notable finding that labor productivity is the most important factor that affects industry's profitability. The results of the analysis also revealed that the states with the strongest labor productivity show the highest level of profitability in terms of gross margin. This study should be of value to decision-makers when plotting a roadmap for future growth and rendering a strategic business decision.

DEVELOPMENT OF STATE-LEVEL APPRAISAL INDICATORS OF SUSTAINABLE CONSTRUCTION IN TAIWAN

  • In this study we examine Taiwan's overall performance in accordance with sustainable construction by developing an appraisal indicator framework. The framework consists of five layers, from bottom to top: the indicator; the indicator category; the core cluster; the theme; and the overall performance. The procedure for the development of a sustainable construction indicator system is outlined. Finally, a framework consists of 3 themes, 10 core clusters, and 33 indicator categories are established. Following the established framework, 67 proper indicators are selected for each category in the framework, and data of the 53 indicators are collected respectively from a nation's statistical databank in Taiwan. Sustainable construction index aggregated step-by-step from the indicators, the indicator categories, the core clusters and the themes is computed to assess Taiwan's progress in sustainable construction. The preliminary results and the discussion are reported.
