A critical review on informed consent in the revised Medical Law (개정 의료법상 설명의무에 관한 비판적 고찰)

  • The Supreme Court of Korea first admitted compensation for damages caused by breach of informed consent in 1979. From then on, specific details of informed consent are shaping up and developing through court precedents. The duty of informed consent of doctor is based on article 10 of the Constitution and medical contract, and is expressly prescribed Article 12 of Framework Act on Health and Medical Services and other acts and regulations. By the way, the regulations about duty of informed consent of doctor have been established in Medical Law revised on December 20, 2016, and the revised Medical Law will be implemented on June 21, 2017. According to the revised Medical Law, medical practices subject to description and consent are operation, blood transfusion and general anesthesia that threaten to cause serious harm to human life or to the body. When performing these medical activities, the written consent must be explained and agreed upon in advance. If a doctor violates the law, he will incur fines of less than 3 million won. Comparing and viewing the revised Medical Law and existing legal principles about the duty of informed consent, we can confirm that there is a substantial difference between the two parties. Accordingly, despite the implementation of the revised medical law, the existing legal principles are unlikely to be affected. However, from the perspective of legal uniformity and stability, it is undesirable that legal judgments on the same issues differ from each other. The revised Medical Law about informed consent needs to be reformed according to existing legal principles. And, as in the case of Germany, it is desirable to include the matters concerning informed consent in the civil code.

The Effect of Medical Interview Course in Korean Medical School (한의학교육에서의 의학면담 교육 효과)

  • Objectives: This article describes the effectiveness of, and student satisfaction with, the medical interview course. Methods: In the years 2010 and 2011, forty-two students took the medical interview course at the School of Korean Medicine, Pusan National University. The evaluation of the course was conducted using student questionnaires. Results: The students believed that learning medical interview skills was very helpful, and there was an increase in the number of students who thought they could improve their skills by learning the medical interview course contents. Also, they have come to feel that 'building a relationship' is the most important skill in the medical interview process. We used experiential teaching methods such as doctor-patient role-playing, and the students rated that method better than others. In addition, the students responded that the appropriate time to take a medical interview course is in the middle of a clinical practice. They also thought that the current credit value of the course was appropriate. Moreover, the students wanted to add some specific contents about specialized communication skills for Korean medical treatment. Conclusions: The medical interview course received a favorable evaluation from the students who finished the course. Among the course contents, they were most concerned with building the doctor-patient relationship. Also, they preferred experiential teaching methods more than didactic methods. The current timing and credit value of the medical interview class was evaluated as appropriate, and the students felt that communication skills specific to Korean medical treatment need to be taught. Therefore, we conclude the medical interview course is important and is worth considering as an independent course.

Proposal on Spplementation to Oriental Medical Policy for the Revitalization of Oriental Medical Therapy for Stomach Cancer (위암의 한방치료 활성화를 위한 한방의료정책 보완에 관한 제안)

  • Gastric cancer is common cancer generating about 20% incidence in Korea. But Oriental medical doctor (OMD) often can't measure therapy on gastric cancer positively because that the prognosis on it is not good. It is impossible the results on all of diseases not only gastric cancer always to have to be good. It is required to find out the causes of diseases and therapy method to conquest the diseases for the medical therapy. But because the results on medical therapy are not always good, it is necessary for the doctor who want to treat the diseases like gastric cancer having the prognosis to be death to protect himself, like as the legal system, a medical policy. And consequently, this protecting legal system lead the medical therapy principle or method on some special diseases to therapy completion on it. As a results of policy, medical therapy have to be developed. It is studied the literature referencing gastric cancer, experimental articles to insist the effects of Oriental medicine planet to gastric cancer and the clinical cases on gastric cancer to be treated as Oriental medicine therapy to have effects. Recently, there have been many other development in oriental medical therapy. This development can be grouped as two type. One type is clinical part and the other is experimental research part. Specially the experimental research and clinical research on gastric cancer in oriental medical therapy have been developed. So the present day is the time to make medical policy on liver cancer for OMD to measure oriental medical therapy and develop oriental medical theory. As a above results, we propose that the name of gastric cancer have to use in Korean medicine security clinical name (한방의료보험상병명) to make oriental medical policy.

A Study of Literature Review on Needling Sensation and the Flow of the Needling Sensation (침감(鍼感) 및 침향(鍼響)에 대한 문헌적(文獻的) 고찰(考察))

  • Objective : To study needling sensation and the flow of the needling sensation the ancient and the present literatures were reviewed. Results : 1. The needling sensation was getting the Qi and a normal reaction of acupuncture. 2. The flow of the needling sensation was promoted the Qi and normalized the flow of the Qi 3. The needling sensation of a patient expressed soreness, distension, heaviness, numbness, tingling, flushing, fervor, chill, itching, and so forth. 4. The needling sensation of a patient expressed simple or complex syndrome. 5. The needling sensation of a doctor expressed objectively more than the needling sensation of a patient in the hand feeling of a doctor. 6. The doctor was compared good needling sensation and bad needling sensation. 7. The needling sensation and the flow of the needling sensation were processed continuously. 8. The needling sensation and the flow of the needling sensation were connected with a nervous system and expressed variously in the anatomical structure and hand acupuncture tenchnique.

  • To become an effective and successful consultation-liasion psychiatrist the psychiatrist should consider two aspects of consultation before he/she meets his/her patients. First the psychiatrist should understand the internal need and psychological state of patients who visited their physician before being refered to a psychiatrist So psychiatrists should be careful in the evaluation of the patient's intention whether they are willing to accept the psychiatric treatment approach or not Second the psychiatrist should understand the situation and the physician's internal need in the consultation. Psychiatrists should recognize whether there are any factors which interfere with the mutual understanding and cooperation between physicians and psychiatrist.

  • Just in case a patient's state couldn't get better or get even worse after medical practices, it is difficult for the patient's side to accept the result and it tends to think that its damage is caused by his doctor's malpractice. Medical practices of a doctor require highly advanced attention duty as a medical expert, because they are targeted at a human body of the best benefit and protection of the law. However, it is hard to prove the malpractice on the patient's side in medical dispute. Therefore, to solve a medical dispute quickly and fairly before the medical suit Korea Consumer Agency (KCA) has done a medical dispute adjustment business since 1999. For the past 5 years (2006~2010), the medical team of KCA had managed 4,171 cases as an injury relief, but it had dealt with them focusing on an injury relief business only after the occurrence of a medical accident. Afterwards, it is necessary to expand the range of its services in purpose of preventing the injury of consumers. If we can solve the problems -the clear statements about the cease of extinctive prescription in the fundamentals of comsumer act, the presence of parties directly concerned at comsumer dispute adjustment committee, and the effect of an agreement, etc. -, which have been founded in medical injury relief service of KCA and the management and procedures of the comsumer dispute adjustment committee of KCA and if we can also give KCA more workers and the proper budget of the government, we can expect KCA to become a more useful agency.

A study of Medicine in the Period of the Three Kingdoms (三國) (삼국시대(三國時代) 의학(醫學)에 관(關)한 문헌적(文獻的) 고찰(考察))

  • I have felt seriously a desire to study and analyse the medicine of the period of the Three Kingdoms when I thought and studied the ancient medical history. Therefore in Chapter II I inquired into the background of Politico-social and the currency of thought. In the Chapter III inquired into the system of Medical politics in the period of the Three Kingdoms. In the Chapter IV inquired into the general view of the period of the Three Kingdoms. In the Chapter V inquired into the writings of Medicine and Doctors. From this study, I reached at following-conclusions. 1. The Three Kingdoms are politically opposed to each other, but socialo culturaly cooperated, connected each other to import the technique and thought which developed in China, so generally their system and life pattern are alike. 2. On the system of medical politcics Goguryeo(高句麗) had the system of court phisician, Baek jeo(百濟) had medical doctor and collector in the Ministry of Drug which took charge of teaching and medical treatment and specially had spellchanting doctor who treat epidermic and psychological diease untreated with herb and acupuncture, Shilla(新羅) had the system of Yak chun which was charge of teaching and treatment, and had the Chimbang(針房) which assist doctor in the system of Yagchun(藥典制度). 3. The medical interchange with China made the Three Kingdoms to import the medical books. So the theory of medicine was systematized and the art of treatment developed. In the aspect of Herb the Three Kingdoms and China actively exchange their own district product. 4. The medicine of Three Kingdoms accommodated Yin Yang Ohang theory(陰陽五行說), the theory of body compose with four element(四大 : 地水火風) and the theory of life cultivation and breathing(導引養生說) with Therefore in many aspect of oriental medicine basic theory and treatment would improved. 5. The epidermic diease occurred in period of Three Kingdoms, is represented Yeok(疫), that is after all Ohn Diease(溫病), and epidermic diease, is relfected by earthquake, heavy rain, terrible droughty and eclipse of sun. The treatment of this diease did not developed in that time, we presume that there are many persons killed. 6. As the record of five starr(五星), comet(彗星) and eclipse of sun was showed, the astronomy of oriental medicine in the Three Kingdoms was high level and it became the mothers womb of Korean astronomy. 7. The medicine of the Three Kingdoms, concreted with Chinese medicine and their own ancient one, was reflect on Japanese medicine to improve the medical theory and treatment. 8. The Three Kingdoms peculiarly published Korea Nosabang(高麗老師方) Baekjyeo Shinjipbang(百濟新集方), so this independent medicine reflected on the development of natural hurb(鄕約) of the period of Korea(高麗).

Famous medical doctor Yoo Itae's Study in the Chosun Dynasty (조선의 명의(名醫) 유이태(劉以泰.劉爾泰) 연구)

  • Objective : Two famous medical doctors, Yoo Itae(以泰, 爾泰) and Riu Euitae(義泰), have been well known in academic world and public in Sancheong-gun. Yoo Itae is the progenitor of Majinhak which is the therapy for measles, he wrote a "Majinpyun" as the first book of therapy for measles in Chosun. Riu Euitae, meanwhile, is a fictional medical doctor and a teacher of Heo Jun who became real without confirmation of historical truths by Roh Jeongwoo who heard about a name, Yoo Itae. Roh's assertion was quoted in the report of literatures, papers, novel, and telecast without verification. His assertion is exposed in novel and media and it has seriously distorted the history. The purpose of this study is to rectify the historical distortion. Methods : Various references study was performed. Confirmed a family tree, birth and death year, birthplace, sepulture, words on a tombstone, writing, collections of works anthology and the existence of keepsake. Investigated records of royal family, Sancheong-gun papers, Sancheong Hyanggyo papers, Dongyuhagan, Chosun Hanryuseungram and the record of Sawoo Munjip(anthology). Analyzed Roh Jungwoo's conversation that tells Riu Euitae is a teacher of Heo Jun and contents of an encyclopedia. Listened to testimony of descendants and assertions of historian in rural area. Verified voice recording on books taken from at birthplace and the space of activity. Results : Yoo Itae is well shown in various records and medical writing books, whereas Riu Euitae does not. Riu Euitae is not a real person in the history. Roh Jeongwoo who asserts Riu Euitae is a teacher of Heo Jun admits his mistake. But, the encyclopedia record describing Riu Euitae is a teacher of Heo Jun, government official at Sancheong district office, historians in rural area, historians in rural area who made a family shrine, gravestone, a statue, memorial, historic site of Riu Euitae on Jinju Rui could not suggest any evidences for the existence of Riu Euitae and for record Riu Euitae is a teacher of Heo Jun. Conclusion : Riu Euitae is neither a real person in the history nor a teacher of Heo Jun. Riu Euitae came from pronunciation confusion between 'I' and 'Eui' in Kyungsang province. Riu Euitae is Yoo Itae on Geochang Yoo who was a medical doctor of King, Sukjeong and wrote medical books including , , .
