  • The Maritime Commercial Part, which based on the CMI Conventions before 1950s, of the Korea Commercial Code has some critical issues to be improper to the morden internaitonal sea trade. This paper, therefore, has proposed a legislative policy and draft articles in order to make a reasonable and proper shipping law.

  • This research traces the history of legislative matters regarding the enactment and revision of laws and regulations related to the outdoor landscape in apartment complex. The years before 1976 can be classified as 'a period of darkness' for the landscape in apartment complex due to absence of landscape legislation. From the year of 1977 when the landscape planting and mere necessities were carried out according to the local administration's building standard to the year of 1990 can be classified as 'a period of quickening'. The year of after 1991 when the enactment of the code#32 called "the green space in site" in the "Korea Building Code" and the "Korea Housing Standard & Regulation" was made, and various construction regulations and provisions were revised in order to improve the scantiness of the apartment complex and its environment should be called 'a period of development'.

한국형 코드아담제도 도입을 위한 입법모델 연구 (Missing Children Policy in Korea: A Legislative Model for Korean Code Adam Alert)

  • 실종아동의 발생 시 가장 중요한 것은 초기수색을 통해 조속히 실종된 아동을 찾는 것이다. 1981년 미국에서 발생한 아담 월시 실종사건을 계기로 미국에서는 코드아담법을 제정, 모든 연방건물에서 실종아동 발생시 코드아담경보를 발령토록 하고 있고, 월마트를 비롯하여 다중이용 민간시설에서는 자발적으로 여기에 동참하고 있다. 우리나라에서도 최근 이러한 코드아담법의 도입이 논의되고 있으나 아직 선행연구가 전무한 상황에서 본 연구는 한국형 코드아담법의 입법모델을 제시하였다. 동 모델에 따라 대규모 점포나 놀이시설 등을 포함한 대규모 다중이용에서 의무적으로 '실종아동등의 예방 및 조기발견계획'을 수립 시행하도록 하고, 이를 위반할 경우 행정질서벌로서 과태료를 부과하고 명단을 공표하는 방식의 제재수단을 마련하도록 하는 것과, 자율적 참여를 유도하기 위해 인증제를 통해 실종아동예방 안전시설에서 인증로고를 상업적으로 이용할 수 있도록 하는 것을 제안한다.

  • Since 1979, the People's Republic of China has been opeining their marke tprogressively toward all over the world for developing its own domestic economy and international trade. China also has paid a great attention to the international maritime transport due to the fact that its volume of international trade has increased continuoulsy. Under such circumstance, the Chinese Maritime Code was issued in 1992 in which the regulation with regard to carrier's liability occupied an important position. The author, therefore, selected this issue for demonstration of the legal proinciples about carrier's liability which is provided in the Chinese Maritime Code. The study on the issue is under guidance of related international conventions. On the basis of the above, the differences between the Code and relevant conventions have been pointed out in order to make the people in the field of shipping understood for legal system with regard to carrier's liability in China which is a great potential partner of Korea in shipping and trade.

The Role of the Green Building Code in Achieving Sustainable Green Built Environment: the Philippines

  • The continuing trend of built environment set forth by the rise of modernization and industrialization has led every country in achieving their respective economic development. Along side this trend is an issue that needs to be addressed - the environmental impacts of the built industry. Construction and maintenance of buildings are said to consume 40% of the world's energy, 65% of electricity, and 40% of raw materials, creating drastic pollutants harmful not only to the environment but also to human. Figures have been released and analyzed proving the contributions of built environment with environmental depreciation. Said figures earned concerns not just from different private and non-profit organizations but also the governments of every country, thus, steps towards sustainable development are being implemented. As a response, the "green" was added in the built environment. Later on, the now emerging concept of "National Green Building Code" found its role in the policy of various states in protecting the people in accord with the nature. This paper appreciates the initiatives of various countries and non-profit organizations in their drive to pursue sustainable green built environment in general, and specifically proposes an establishment of an "incentives grant framework" as an additional legislative policy to be included in the draft of the National Green Building Code of the Philippines.

THE SILK TRADE FROM ILKHANIDS TO AQQOYUNLU

  • The initial phase of the Mongol invasion resulted in the establishment of relative political stability in the vast expanses of Eurasia, which came under the control of a single political entity - the Mongol realm. This contributed to a fairly rapid restoration of the commercial links and trade routes between the East and the West. During this period, Chinese silk again became available in large quantities in the Western markets. At the same time, the beginning of silk production and manufacturing of silk fabrics in Italy and the fashion flash for these goods in Western countries affected trade between Europe and the Muslim world. The centers of silk production in the Ilkhanid Empire were some provinces of Azerbaijan and Persia, where from it was exported in large numbers along the trade routes of Anatolia and Syria to the Mediterranean ports and further to the west. There are numerous testimonies of European travelers, and Muslim authors related the international silk trade in 13th-15th centuries, ie in the era from the Mongol Ilkhanid Empire till the reign of the Turkman Aqqoyunlu dynasty. One of the most informative documentary sources on this issue are the legislative codes (kanuname) of sultan Uzun Hasan from the Aqqoyunlu dynasty regarding the eastern provinces of the Asia Minor. This article presents and analyzes the information from these documents concerning the whole range of goods related to silk and silk fabrics trade in the period under the consideration.

The Main Contents and Task in Future for the Air Transport Law Established Newly in the Korean Revised Commercial Law

  • As the Reublic of Korea revised the Commercial Code including 40 articles of air transport enacted newly on May 23, 2011, so Korea became first legislative examples in the Commercial Code of the developed and developing countries. I would like to explain briefly the main contents of my paper such as (1) history of enacting newly Part VI (air transport) in the Korea's revised commercial law, (2) legal background enacting newly Part VI (air transport) in the Korea's revised commercial law and the problems on the conditions of air transport, (3) every countries' legislative examples on the civil liability of aircraft's operator, (4) unlawful Interference Convention and general risk convention of 2009, (5) main contents and prospects of the revised Commercial Code for the liability of aircraft's operator etc as the followings. Meanwhile as the Aviation Act, Commercial Code and Civil Code in Korea and Japan did not regulated at all the legal basis of solution on the disputes between victims and offender for the amount of compensation for damage due to personal or property damage caused by aircraft accidents in Korea and Japan, so it has been raised many legal problems such as protection of victims, standard of decision in trial in the event of aircraft accident's lawsuit case. But the Korean Revised Commercial Code including Part VI, air transport regulations was passed by the majority resolution of the Korean National Assembly on April 29, 2011 and then the South Korean government proclaimed it on May 23 same year. The Revised Commercial Code enforced into tothe territory of the South Korea from November 24, 2011 after six month of the proclaimed date by the Korean Government. Thus, though Korean Commercial Code regulated concretely and respectively the legal relations on the liability of compensation for damage in the contract of transport by land in it's Part II (commercial activities) and in the contract of transport by sea in its Part V (marine commerce), but the Amended Commercial Act regulated newly 40 articles in it's Part VI (air transport) relating to the air carrier's contract liability on the compensation for damage caused by aircraft accidents in the air passengers and goods transport and aircraft operator's tort liability on compensation for damage caused by the sudden falling or collision of aircraft to third parties on the surface and so it was equipped with reasonable and unified system among the transport by land, marine and air. The ICAO adopted two new air law conventions setting out international compensation and liability rules for damage caused by aircraft to third parties at a diplomatic conference hosted by it from April 20 to May 2, 2009. The fight against the effects of terrorism and the improvement of the status of victims in the event of damage to third parties that may result either from acts of unlawful interference involving aircraft or caused by ordinary operation of aircraft, forms the cornerstone of the two conventions. One legal instrument adopted by the Conference is "the Convention on Compensation for Damage to Third Parties, Resulting from Acts of Unlawful Interference Involving Aircraft" (Unlawful Interference Convention). The other instrument, "the Convention on Compensation for Damage Caused by Aircraft to Third Parties" (General Risk Convention), modernizes the current legal framework provided for under the 1952 Rome Convention and related Protocol of 1978. It is desirable for us to ratify quickly the abovementioned two conventions such as Unlawful Interference Convention and General Risk Convention in order to settle reasonably and justly as well as the protection of the South Korean peoples.

'낙태죄' 헌법재판소 헌법불합치 결정의 취지와 법률개정 방향 - 헌법재판소 2019. 4. 11. 선고 2017헌바127 전원재판부 결정에 따라 - (A Review on Constitutional Discordance Adjudication of the Constitutional Court to Total Ban on Abortion)

  • 헌법재판소가 2012년 8월 23일 낙태죄 규정을 합헌으로 결정한 이후에도 낙태죄 폐지에 대한 논란은 지속되어 왔다. 낙태죄의 존폐논란은 최근에만 일어난 일이 아니라 이미 형법제정 당시부터 있었던 것으로, 대한민국의 근대입법과정과 역사를 같이 한다. 당시 형법제정과정에서 낙태죄의 전면삭제를 주장하면서 수정안을 제출했던 의원들은 사회·경제적 적응사유를 핵심적인 제안이유로 제시하기도 하였다. 이후 개발독재기에도 낙태죄의 폐지가 논의되었으나, 이는 여성의 인권을 보장하기 위한 것이 아니라, 박정희 독재정권의 '산아제한', '가족계획'이라는 국책사업과 관련이 있었다. 이후 인공임신중절을 제한적으로나마 허용하는 「모자보건법」의 제정은 유신으로 국회가 해산된 후 입법권을 대신하게 된 비상국무회의에서 1973년 2월 8일 이루어졌고, 1973년 5월 10일부터 시행되었다. 그나마 일부라도 낙태의 합법화를 포함하는 「모자보건법」이 가능했던 배경은 당시 유신독재가 어떠한 이견도 허락하지 않았기 때문에, 종교계에서도 반대 의견을 표명하기 어려웠기 때문일 것으로 보인다. 이렇게 제정된 「모자보건법」은 지금까지 약간의 수정만을 거치며 그대로 유지되어왔다. 낙태죄 존폐론의 논거들도 형법제정 당시와 큰 차이 없이 그대로 평행선을 달려왔다고 볼 수 있다. 2012년 8월 23일 헌법재판소의 결정에서도 합헌의견과 위헌의견이 4:4로 팽팽하게 맞섰었다. 다만 헌법재판소의 위헌결정을 위한 정족수를 채우지 못하여 합헌으로 결정하였다. 이 낙태죄 폐지 논쟁은 이번 헌법재판소의 헌법불합치 결정으로 일단락되었고, 국회는 새로운 입법이라는 과제를 부담한다. 즉 국회는 적어도 2020년 12월 31일까지 개선입법을 이행하여야 하고, 그때까지 개선입법이 이루어지지 않으면 낙태죄조항들(「형법」 제269조제1항, 제270조제1항)은 2021년 1월 1일부터 효력을 상실한다. 따라서 아래에서 우선 형법상 낙태죄 규정에 대한 헌법재판소 헌법불합치 결정의 논거가 무엇인지를 살펴보고(II), 과거의 헌법재판소와 대법원의 논증구조와 어떠한 점에서 차이를 가지는지, 그리고 헌법재판소 헌법불합치 결정에서 나타난 쟁점을 무엇인지를 검토한 후(III), 헌법재판소가 제시한 기준에 따른 입법재량의 범위 안에서 입법방향과 이미 제출된 「형법」과 「모자보건법」의 개정안에 대하여 검토(IV)하였다.

한국(韓國)의 형사정책(刑事政策)에 관한 역사적(歷事的) 고찰(考察) (A Study on History of Criminal Policy in Korea)

  • During the ancient times, there was no separative judicial system and administrative , legislative and judiciary functions were ultimately concentrated in the all-powerful monarch. And the three states developed state organization , adopting hieratical structures and placing at the pinnacle . State Codes were promulgated to initiate a legal system to rule the people, these codes instituted under influence of China codes. The people tradition sees crime control as the preservation of the authority of hereditary rulers. In the period of the Koryeo dynasty, government accepted a serious of detailed penal code from Tang dynasty . Legal response to crime stressed preservation of the dynasty rather than making citizen behave according to certain rules. In the period of Early Joseon , the compilation of Grand Code for state administration was initiated, the Kyeongkuk Taejeon ,became comer stone of the dynastic administration and provided the monarchial system with a sort of constitutional law in written form. This national code was in portant means of criminal policy at that time, Late Joseon , the impact of Western culture entering through China gave further impetus to pragmatic studies which called for socio-economic reforms and readjustment. Approach to criminal justice policy emphasized more equitable operation of the criminal justice system ,rehabilitation and crime control. Korea-Japanese Treaty concluded on 22 August ,1910 and proclaim a week later ,Japan gave the coup de grace to the Korea Empire and changed the office of the Resident - General into the Government - General . Thus korean criminal policy were lost during a dark ages ,which lasted for 36 years after fall of Joseon Dynasty (the colnial period,1910${\sim}$1945). After 1945 Korea's liberation from Japanese colonial rule, the occupation of devided Korea by the United States and Soviet Union frustrated the efforts of Koreans to establish an independent government, and the transplantation of two conflicting political ideologies to south and the north of the 38th parallel further intensified the national split. U.S. military government office occupied the south of the 38 the parallel and placed emphasis on democracy of criminal policy. ln 1948, the U.S. military government handed over to the ROK government its administrative authority.

해사안전법상 안전관리책임자 및 안전관리자의 자격요건에 관한 연구 (A Study on the Qualifications of Designated Person on the Maritime Safety Act)

  • 해운산업이 발달하면서 해운업을 영위하기 위한 선박의 감항능력도 발달하게 되었다. 하지만 감항능력의 향상에도 불구하고 해상에서의 선박사고는 지속적으로 발생하고 있다. 대형 해양사고에 대한 대처방안의 일환으로 진행된 국제해사기구에서의 조사 및 연구는 선박의 물리적 감항성 이외에 선박을 운영하는 인적자원의 과실에 주목하게 되었다. 이러한 인적과실에 대한 대처방안으로 1994년에 '1974년 SOLAS 협약'의 부속서로 '국제안전관리규약'을 채택하게 되었다. 우리나라는 1999년에 'ISM Code'를 구 해상교통안전법(현 해사안전법)에 관련 조항을 신설하여 시행하고 있다. 최근 개정된 해사안전법에서는 해운선사가 선박의 안전운항 및 해양환경보호를 위한 안전관리체제를 수립하고, 이를 이행하기 위한 사업장의 인적 구성원들이 갖추어야 할 요건에 대해서 규정하고 있다. 하지만 선박소유자 또는 안전관리대행업자 등은 조문내용을 해석함에 있어 명확하고 통일된 의견을 내지 못하고 있어 혼란을 야기하고 있다. 이 논문에서는 해사안전법상 안전관리 책임자의 자격기준 등에 관한 법률상의 문제점을 살펴보고, 이에 대한 개선방안을 제시하고자 한다.
