지역주민과 건강행태와 국민건강증진법에 대한 인식과 태도 (Health Behavior and Attitude of Residents toward the National Health Promotion Law in Kyungsan City)

  • In order to ascertain the attitudes of residents to their health and the National Health Promotion Law, surveyors interviewed 1,220 subjects, 1% of men and women in Kyungsan city, who were twenty-year-old or more. The major findings are as follows: Men and women were 48.2% and 51.8%, respectively. The recognition rate of enacting and enforcing this law is 59.2% of men and 51.3% of women. With regard to the behavioral attitude to the health in the distinction of sex and age, current smokers are 31.2% of the interviewees, 61.6% of the men and 3.3% of the women. Current drinkers are 35.1%, 59.5% of the men and 12.3% of the women, but on the other hand there is little significance in the distinction of age. The acknowledgement proportion of enacting and enforcing this law is 59.2% of male and 51.3% of female. In terms of the recognition rate of the contents according to the general characteristics of interviewees, it appears that the indication of a warning expression on a packing paper of cigarette case and a liquor bottle is 92.4% and also the designation of a smoking free area in public facilities is 94.8%. Prohibition of cigarette-sale to the teenagers who are under 19, is 96.0%. Considering these facts, the recognition rate is high. On the contrary, 48.8% is accounted for encouraging a medical check-up before marriage which is in a low position. As a result of multiple behavior as a independent educational level, marital significant variables. In case of having undergone a periodic medical examination the recognition rate was high whereas frequent exercise led to the low recognition rate. Concerning the details of the undertaking in accordance with each factor of general characteristics, the greater part of them have been appraised successfully whether it is recognized or not. On the other side, no effect got answered about the result of the undertaking subjects to general and peculiar behavior attitude towards health was in effect or not. A great majority approved of more reinforcement of legal regulation about smoking and drinking regardless of whether they perceived the details of the law of promotion of National Health Promotion Law or not. Additionally there was significant difference in reinforcing legal regulation of smoking and drinking in compliance with the attitude of the substance of this law. With regard to education, public relations and evaluation about national health through public health centers by our government, the younger and the higher in education they are, the more deficient they feel. First of all, those who were aware of the enforcement of this law as well as plenty of scarcity answered that better service of disease prevention had to be expanded than ever. In consideration of the above-stated results, the education to public health and the business of public relations should be reinforced and a practical campaign for health life should also spread out for the purpose of encouraging to practise healthy life-style.

  • 최근 유럽연합이 잊혀질 권리를 폭넓게 인정하는 정보보호법 개정안을 공표하면서 전세계적으로 이에 관한 논의가 이루어지고 있다. 우리나라에서도 이와 관련된 논의가 이루어지고 일부에서는 입법화 움직임까지 있다. 현행법상 정보주체는 제한적으로 개인정보처리자나 정보통신서비스 제공자가 수집한 개인정보에 대해 정정 내지 삭제를 요구할 수 있을 뿐, 자신의 권리가 침해되지 않은 경우에는 온라인 게시판 등에서의 자신의 개인정보의 삭제를 요구할 수 없다. 이와 관련하여 앞으로의 입법과정에서는 정보주체 자신이 직접 올린 정보의 경우에만 잊혀질 권리를 한정할 것인지, 그리고 자신이 직접 올린 것이라면 제3자가 차후에 복사 등을 한 모든 경우에 대해 정보통신서비스 제공자 등에게 삭제할 의무를 부여할 것인지 충분히 검토되어야 한다. 최근 사이버 공간을 통한 국민 일반의 참여가 확장되고 직접민주주의를 향한 목소리도 커져가고 있는 상황에서 표현의 자유의 보장은, 설령 그것이 거대 미디어로 인한 정보를 통한 개인통제의 위험성에도 불구하고, 쉽게 포기될 수 없는 것이기 때문이다. 특히 표현의 자유와 관련하여 정보주체 자신이 직접 올리지 않은 정보에 대해서 잊혀질 권리를 인정하는 것이 자칫 사전검열에 해당할 수 있다는 점에서 신중히 접근될 필요가 있다.

Medical advertising on the current medical law had been to be checked by pre-deliberation of the executive power. However, due to unconstitutional, in the circumstances which a false hype is flooding and increasing, it has been realized that the fair competition of medical community, life and health rights of the people are threatened by in reverse. In this regard, the abolition of the pre-deliberation system of medical advertising can be welcomed by abolition of the old system which is the legal and institutional censorship. Since its abolition, the alternative policy direction is insufficient also it is not clear. Therefore we need to study this. Therefore, in this paper, we try to find general theoretical background and problem of pre-deliberation system of medical advertising. Also, as trying to find feasibility or ambiguity of regulation and issues about medical advertising on medical law, we argued the provision of special measures of the medical advertising for introduction of integrated medical advertising deliberation committee which can ensure the independence and autonomy, strengthening of the monitoring on the internet advertising, legal resolving through amendments, strengthening of penalties, and establish special measures of medical advertising for the medical privatization and demand for the foreign medical tourist, etc. Empirical study about practical regulatory measures of medical advertising which converged the various opinions of consumer groups, government and academia, and medical community, and we expect hope to see the more realistic alternative provision.

  • The Advent of the global information structure and the do-called digital revolution raise countless new issues and questions. There are no limitations regulating the expressions on the cyberspace due to internet's of quality anonymity\ulcorner diversity\ulcorner spontaneity. Therefore, the freedom of speech is expanded in both areas of time and space, which was impossible with the old communicating system. The rapid development of the internet may not have occurred without techniques of linking and framing, which provide users flexible and easy access to other website. These techniques have enabled internet users to navigate the internet efficiently and sort through the products, services and information available on the internet. Although online technology raises many new legal issues, the law available to help us resolve them, at least today, is largely based on the world as it existed before online commerce became a reality. Thus the challenge is to predict how these new legal issues may be resolved using the current law. Especially, the damage from the above side effects on the cyberspace can be much more serious than in the real world because of promptness, wideness and anonymity. Therefore, regulating and controling the freedom of speech on the cyberspace became needed, and there are two kinds of opinion; one is that the laws in the real world should be applied for the cyberspace and the other is that regulating and controling the freedom of speech on the cyberspace should be performed by the users of cyberspace not by laws because the cyberspace is a free space and must not be interfered. In this study, the current judicial regulation of cyberspace, the side effects of cyberspace and the limitations of the freedom of speech are studied to solve the above problems with speech and the liabilities of on-line service providers are discussed around defamation the distribution of obscene pictures and information, and infringement of copyright.

A Study on the Normative Recognition of Blockchain Smart Contract

  • 본 논문에서는 블록체인기반의 스마트계약의 규범성 인식과 스마트계약의 규범성에 대한 주요 영향요인을 통해 스마트계약이 계약규범으로 정착되기 위한 몇 가지 요건을 확인할 수 있었다. 첫째, 스마트계약의 규범적 필요성 측면에서 기술적 오류에 대한 법적 보호장치, 정부 차원의 홍보교육, 스마트계약 비즈니스를 규율할 기본법이 필요하다. 둘째, 스마트계약의 이용성 측면에서 책임소재가 명확하도록 설계된 블록체인을 기반으로 계약규범이 구성되어야 수범자들이 이를 수용하려 할 것이다. 셋째, 스마트계약의 규제 측면에서는 스마트계약을 기존 법률에서 포섭하거나 새로운 기본법 제정방안을 고려하되 스마트계약의 규범성이 사용 편이성보다 우선시 할 수 없는 것으로 인식하고 있음을 알 수 있다.

디지털 헬스케어 발전을 위한 규제 개선 방안에 관한 연구 (A study for Promoting Digital Healthcare in Korea through an Improved Regulatory System)

  • 보건의료와 ICT가 결합된 형태인 디지털 헬스케어는 보건의료 패러다임을 진단 치료에서 예방 관리로 변화시키고 있다. 또한 부가가치가 매우 높은 경제 발전의 신성장 동력으로 인식되고 있으며, 우리 정부도 이의 발전을 위해 관련 제반 기술 및 정보에 대한 합리적 법적 기준과 규제체계를 마련하고자 노력하고 있다. 하지만 이러한 노력에도 불구하고, 정부의 디지털 헬스케어 발전을 위한 규제 개선 전략에 변화가 필요하다는 주장이 지속적으로 제기되고 있다. 이에 본 연구에서는 우선 우리나라와 해외 주요국의 디지털 헬스케어 발전을 위한 규제 개선 전략을 비교 분석하여 차이점을 확인하였다. 이어서 본 연구는 디지털 헬스케어와 관련된 신문기사 분석과 전문가 인터뷰를 실시하여 국내 디지털 헬스케어 관련 규제 쟁점과 발전을 위한 규제 개선 전략을 도출하였다. 전문가들은 디지털 헬스케어 관련 규제 개선을 위해 특히 부처 간 협업구조의 구축, 부처의 전문역량 강화와 전문가 확보, 폭넓은 이해관계자의 참여 보장, 그리고 의료 정보의 처리에 대한 명확한 기준 마련을 중요하게 인식함을 확인하였다. 마지막으로 본 연구는 전문가 인터뷰 결과를 중심으로 하여 연구의 시사점을 제시하였다.

절삭유(Metalworking Fluids)의 발암성에 대한 고찰 (Critical Review on Carcinogenicity of Metalworking Fluids)

  • Exposure to metalworking fluids (MWFs) has significantly been associated with cancer developed in multi-organs, respiratory diseases and skin diseases. Several carcinogens to humans or animals are contained in MWFs. They have been reported to be mineral oils, polynuclear aromatic hydrocarbons (PAHs), formaldehyde and N-nitrosodiethanolamine (NDELA). The great hazards of MWF have forced the advanced country including United States to regulate carcinogens contained in MWF. In 2001, American Conference of Governmental Industrial Hygienists (ACGIHs) regarded MWF mist as suspected carcinogen to human (A2) and added it to “Notice of Intended Change (NIC)” list of 2001. In spite of the fact that much MWF has widely been used in many industries using machines, Korea has no legal actions for management of MWF. What is worse, even toxicity such as Carcinogenicity has not been reported. KS (Korean Standards) lists 7 advices of MWF but it does net state the hazards to health. It is very hard to control or minimize worker's exposure to MWF containing many carcinogens. Prier to the introduction of MWF to workplace, it is the most effective measure to regulate carcinogens below a certain level. Regulation on the content of PAH seems to be necessary because less amount of PAH in mineral oils improves the quality of MWF. Also, addition of nitrosating groups to MWF should be prohibited to minimize worker's exposure to NDELA. Employers and manufacturers should indicate the Carcinogenicity of all carcinogens in MWFs in Material Safety Data Sheets (MSDS) in order fer workers to recognize Carcinogenicity. Legal actions have to be taken to protect workers from health hazards due to exposure to MWF by further investigation on MWF.

갯벌복원의 함의와 복원추진체계 구축에 관한 연구 (Multiple Implications of the Restoration of Coastal Wetland Ecosystem and the Establishment of a Strategic Restoration Framework)

  • Korean society has been recently promoting the restoration of coastal wetlands. These efforts might become the basis of a policy framework that compensates for the limitations of a regulation-oriented policy such as the designation of Marine Protected Areas (MPAs). The shift in government policy could contribute to strengthening the socioeconomic infrastructure of coastal development through the accumulation of ecological capital. Although our scientific efforts and social demands in regard to the ecological restoration of the coastal wetlands have increased during the past years, the bases for restoration in Korea requires that scientific, technological, financial, social and legal aspects be enhanced. The present study re-examined the concept and attitudes behind coastal wetland restoration in the light of changing circumstances in Korea. Herein, we first defined coastal wetland restoration as "An act of recovering the functions of the ecosystem of coastal wetlands to a state that resembles conditions prior to being damaged." Next, this study discussed the limitations and future directions of such restoration efforts based on the descriptive analyses of recent restoration practices from social, economic, and technological aspects. Finally, we suggest future policy directions regarding coastal wetland restoration on the basis of a PFST (Policy, Financial, Social, and Technological) analysis; 1) re-arranging legal mechanisms, 2) setting multi-dimensional restoration goals, 3) establishing a multi-discipline- and convergence based R&D system, 4) linking spatial management and local development to the restoration, 5) building restoration governance at the local level, 6) implementing an ecosystem service payment system, and 7) applying test-bed projects in accordance with proper directions.

미국 영재교육법률의 변천 과정에 관한 연구: 말랜드 보고서를 중심으로 (A Research on the Changes of the Gifted and Talented Law in U.S.: Focusing on the Marland Report)

  • 본 연구에서는 말랜드 보고서를 중심으로 미국의 영재교육법률에 관한 변천 과정을 다루고 있다. 연구 결과, 연방 차원에서 제정된 법률 가운데 영재교육이 법적 차원에서 다루어진 최초의 법률은 1958년 국가방위교육법(National Defense Education Act)이라고 할 수 있으며, 영재에 관한 법률적 정의가 제시된 것은 말랜드 보고서(1972년)보다 앞선 1970년의 초중등교육법임이 확인되었다. 또한 말랜드 보고서는 영재에 대한 정의 외에도 차별화된 교육과정(differentiated curriculum) 개념을 제시하였으며 영재교육에 관한 연구와 운영을 총괄하는 국가 센터와 기구의 설립 제안 외에도 영재교육을 특정한 법률의 제정과 법률에 예산 조항이 반드시 포함되어야 하는 점을 제안함으로써, 이후 영재교육이 법과 제도에 근거하여 이루어지도록 하는 데 영향을 주었다.

강원지역 백두대간 산림의 보호기간에 따른 임분 발달 양상 검토 (A Review of Forest Development Patten by the Length of Protection Period in Gangwondo Baekdudaegan Mountains)

  • This study was carried out to review the pattern of forest stand development for six Gangwondo Baekdudaegan Mountains which experienced different type and duration of intensive legal protection. Vegetation data from point sampling method were employed to classify community types by cluster analysis on the basis of the importance values of canopy tree species for the study areas. The names of classified communities were given by the composition of dominant tree species. The communities were also compared one another in terms of stand structure by species diversity index. The results indicated that National Parks (Seoraksan and Odaesan) had greater proportion of mixed mesophytic forest type which was supposed to progress further forest succession process so as to have more complex and diversified stand structure. On the other hand, ordinary forest areas (Seokbyeongsan and Deokhangsan) had greater proportion of the forest types which was dominatively composed of Quercus mongolica and Pinus densiflora. The forest types with large amount of these two species would tend to develop for relatively short period of time of 40-50 years after artificial disturbances. Hyangnobong of Natural Protection Area and Hambaeksan of Natural Ecosystem Conservation Area showed intermediate stand development pattern in between National Parks and ordinary forest areas. The period of intensive legal protection of the forest area was positively correlated with species diversity index (R=0.736), and noted that the forest which received intensive protection regulation for longer period tended to show more complex and diversified stand structure.
