  • The legal protection issues of databases are rising to the surface. This study presents the adequacy of copyright protection for databases and gives the overview of the present international legal framework for additional database protection. Finally, this paper makes recommendations on the legal protection countermeasure for the domestic d a t a F industry growth.

Legal search method using S-BERT

  • In this paper, we propose a legal document search method that uses the Sentence-BERT model. The general public who wants to use the legal search service has difficulty searching for relevant precedents due to a lack of understanding of legal terms and structures. In addition, the existing keyword and text mining-based legal search methods have their limits in yielding quality search results for two reasons: they lack information on the context of the judgment, and they fail to discern homonyms and polysemies. As a result, the accuracy of the legal document search results is often unsatisfactory or skeptical. To this end, This paper aims to improve the efficacy of the general public's legal search in the Supreme Court precedent and Legal Aid Counseling case database. The Sentence-BERT model embeds contextual information on precedents and counseling data, which better preserves the integrity of relevant meaning in phrases or sentences. Our initial research has shown that the Sentence-BERT search method yields higher accuracy than the Doc2Vec or TF-IDF search methods.

  • The Database Industry Promotion Act was proposed at the National Assembly plenary session on July 26, 2012 and since then it has been in the process of enactment in consultation with all the governmental departments concerned. The recent trend of economic globalization and smart device innovation suggests a new opportunity and challenges for all industries. The database industry is also facing a new phase in an era of smart innovation. Korea is in a moment of opportunity to take an innovative approach to promoting the database industry. Korea should set up a national policy to promote the database industry for citizens, government, and research institutions, as well as enterprises. Above all, the Database Industry Promotion Act could play a great role in promoting the social infrastructure to enhance the capacity of small and medium-sized enterprises. This article discusses the background of the development of the Database Industry Promotion Act and its legislative processes in order to clarify its legal characteristics, including the meaning of the act. In addition, this article explains individual items related to the overall structure of the Database Industry Promotion Act. Finally, this article reviews the economic effects of the database industry for now and the future.

Thus thls paper provided the methods thatresolve the problems of the current copyright law in order to protect all types of database being producedby way of the cooperation between the libraries and the information service centers. Secondly, this paperprovlded the legal devlces to protect bibliographic database produced by the libraries wh~ch cannot beprotected due to the lack of the creatlvity in the selection or arrangement of the material.

  • The Library of Congress' proposal to license LC MARC database and the following debate over the proposal shows that the issue on ownership of bibliographic databases, which surfaced as a topic of concern in the international library community with the OCLC's a n.0, pplication for copyright of its databases in 1982, is not fading or dead into the 1990s. In particular, the way that technological developments are outpacing the ability of the relevant organizations and legal systems to make necessary adjustments is giving the library profession a warning that cooperative efforts for further development of the international library systems, such as the UBC program, might be seriously impeded without a swift and amicable agreement on the controversial 'database ownership' issue. Here, the purpose of this paper lies in discussing the 'database ownership' issue from a macro and long-term perspective, with emphasis on its potential impacts on, and implications for, international information flows. To the end, the specific questions covered in this paper include : 1) what are the major causes of the database ownership controversy? 2) what are the potential impacts of the database ownership issue on the library profession's cooperative efforts toward free bibliographic information flows at the international level? And finally, 3) what are the implications of the database ownership issue for the Korean Library Community, which is making efforts toward the establishment of a national library network in near future through linking various library automation systems.

Exploring the Lawyers' Legal Information Seeking Behaviors for the Law Practice (법무실무를 위한 변호사의 법률정보 추구행태 탐구)

  • The prior studies on the practical lawyer's information seeking behaviors, including Leckie et al. (1996) model showed that role of the work and nature of the work in attorney's practices had an significant influence on the attorney's information seeking behaviors. This study now asks if these prior analyses can be applicable to attorneys' practices nowadays. This study performed surveys and interviews with 21 practical attorneys in korea who were grouped by their experience period and the size of law firms. This study concludes that role of the work in Leckie et al. model still affects the attorneys' information seeking behaviors today and moreover, the attorney's experience and the size of law firms as variables also have made an impact on attorney's behaviors so far. By the way, this study further finds that the attorneys prefer the digital information in online database and formal information like statutes or case laws. These results are definitely different from them of the prior studies. In addition, this study suggests that the behavior such as meaningful using of the informal information in difficulties with improper information can be kinds of the attorney's information seeking behaviors.

  • The information in physical planning field shows the socio-economic potentials of land resources while cadastral data does the physical and legal realities of the land. The two domains commonly deal with land information but have different views. Cadastre has to evolved to the multi-purpose ones which provide value-added information and support a wide spectrum of decision makers by mixing their own information with other spatial/non-spatial databases. In this context, the demands of data exchange between the two domains is growing up but this cannot be done without resolving the heterogeneity between the two information applications. Both of either discipline sees the reality within its own scope, which means each has a unique way to abstract real world phenomena to the database. The heterogeneity problem emerges when an GIS is autonomously and independently established. It causes considerable communication difficulties since heterogeneity of representations forms unique data semantics for each database. The semantic heterogeneity obviously creates an obstacle to data exchange but, at the same time, it can be a key to solve the problems too. Therefore, the study focuses on facilitating data sharing between the fields of cadastre and physical planning by resolving the semantic heterogeneity. The core job is developing a conversion mechanism of cadastral data into the information for the physical planning by DB coupling techniques.

  • The research investigated definition, scope and feature of digital contents in order to discuss legal protection of digital contents. The protection law and current trend of protection of digital contents in United States of America, EU and Japan were examined. As the law which protects digital contents in Korea. the contents and characteristics, etc. of copyright act of Korea and online digital contents industry development act were examined and analyzed. And then relationship of digital contents and copyright, namely, the relationship of database and copyright, relationship of digital contents by translation. arrangement, alteration, dramatization, cinematization, etc. of an original work and copyright; relationship of other digital contents and copyright; relationship of file sharing of digital contents and copyright, were examined and copyright issues were discussed in library. And also the research suggested concretely necessary countermeasure of copyright which the library must take. Finally, this paper suggested the improvement direction for legal protection of digital contents we must aim ultimately.

  • Geographical data sets are expensive to create and are very easy to copy because the intellectual property rights for the distribution should be protected. The main object of copyright law is to encourage expression of ideas in tangible form and it extend only to original works, it is limited to control the balance of interests between data producers and user. Because the development of a useful legal framework for both private and public activity in this field is an important issue. This paper presents an intial attempt at such a the effective management strategy intended to support continuing research into the legal protection of geographical information.
