건축설비의 에너지보존 계획

  • 1997년 12월 일본 교토에서 개최된 COP3를 계기로 1999년 3월 에너지보존법이 대폭적으로 개정 및 강화되어졌다. 지구온난화의 주된 원인이 되는 이산화탄소는 에너지와 밀접한 관계를 가지고 있으므로, 에너지보존·자원보존의 추진은 지구온난화 대책의 추진과 동등한 의미를 가지고 있다고 하여도 과언이 아니다. 여기서는 건축설비계획의 관점에서 에너지보존법 개정의 요점과 그 대응책에 관해서 개요를 소개하였다.

  • Result from Amendment of Apartment Houses Decree Customer Service, Recently, the starting point of Defects Liability changed "Criteria of Completion date" to "Delivery date to Divided property". Through the Law amended, There are some inconsistency between "Claim for repairing defects" and "Period of security deposit for repairing defects claim". If someone bought a house after Completion date, Purchasing period of "Claim to security deposit for repairing defects" lapsed without renewal. This research is to identify problems and solutions for improving the system.

  • It was 15 years since the remodeling system was introduced in 2001 and the remodeling system was implemented due to the amendment of the housing law. From now on, the remodeling will be settled in the direction of important apartment houses, and planning will be the core plan of remodeling. Up to now, the remodeling system has changed according to the market situation, and the planning plan has also changed based on the laws and regulations. In this background, this study summarizes the changes of the regulations related to the remodeling plan and examines the characteristics of the plan according to the changes of the regulations. The remodeling plan can be divided into three periods according to the changes of the regulations, and the contents of the regulations and the characteristics of the plan have been clarified.

  • In this paper, the major changes of the national inspection in respect of the KAERI nuclear facilities were summarized. The frequency of the national inspection was decreased since the amendment of the Notification of the NSSC on the national inspection. But the national inspection broadened its scope and its implementation procedures and criteria were not clear. So, it is necessary to establish and enhance the national inspection system including the implementing guides and criteria. In addition, the internal regulation of the nuclear material accountancy for the nuclear facilities should be approved from the NSSC and observed by the KAERI in accordance with the national law. As the Notification of the NSSC on the national inspection was amended in Sep. 2014, it need to be revised to reflect the detail accountancy procedures and the preparation of the national inspection. So, KAERI will revise it to meet the international and national requirements as well as to implement the safeguards effectively at facility level.

  • After beginning the new medical system separating the prescription from the drug dispensary, the demand of bioequivalence test significantly increases to show the equivalence between the test and reference drugs as a result of amendment of the pharmaceutical affairs law which allows a generic substitution. Accordingly the standard protocols provided by the government are required for reducing the period andthe cost to perform the bioequivalence study. (omitted)

세무계획측면에서 분석한 동부그룹 물적분할 (Does Tax Really Matter in Planning the Dongbu Group's Spin-Offs?)

  • 본 연구는 물적분할에 대한 법인세 과세제도가 개정된 2010년 7월을 전후해서 다수의 물적분할을 진행한 동부그룹의 구체적인 사례를 바탕으로 모든 거래당사자들의 관점에서 물적분할의 당사자인 분할법인과 분할신설법인의 법인세 부담이 최소화되도록 물적분할의 유형을 선택하는 거래를 구성했는지에 대하여 분석하였다. 2010년 6월 이전에 적용된 제1기 과세제도에서는 과세이연요건을 만족하는 적격물적 분할의 경우에 분할법인의 자산양도차익에 대한 과세이연을 통해 비적격물적분할에 비해 법인세 부담이 작아지는 것을 확인할 수 있다. 이에 반해 2010년 7월 이후부터 2011년 말까지 적용된 제2기 과세제도에서는 적격물적분할의 경우에 양도차익에 대해 분할법인과 분할신설법인에게 각각 장래의 주식처분시점과 자산의 처분 및 상각시점에서 과세함으로써 현재가치를 고려하면 비적격물적분할에 비해 상대적으로 세금부담이 커질 수도 있다. 본 연구에서 분석한 동부그룹의 4건의 분할 사례 중에서 1건((주)동부한농 사례)은 제1기 과세제도에서 이루어진 것이고, 3건((주)동부케미칼, (주)동부익스프레스 및 동부특수강(주) 사례)은 제2기 과세제도에서 이루어진 것인데, 조세비용의 측면에서 분석하면 (주)동부한농 분할사례는 적격분할일 것으로 예상되고, 나머지 3건의 분할사례는 구체적인 할인율 및 처분기간 등을 적용하면 비적격분할일 것으로 예상된다. 그러나, 해당 기업들의 합병 관련 공시 내용을 분석하면 이들 분할사례에서는 양도차익이 발생하지 않아서 분할방식의 선택을 통한 절세효과를 얻을 수 없었던 것을 확인할 수 있다. 이와 같이 조세비용의 측면에서는 전혀 유인이 없는 상황에서 동부그룹이 단기간에 4건의 물적분할을 한 것은 조세비용에 비해 비조세비용이 분할의사결정에 더욱 중요했던 것으로 추정할 수 있다. 즉, 이들 물적분할에 대하여 실무계에서는 악화된 그룹의 재무 구조를 개선하기 위한 것이라는 분석이 제기되었고, 실제로 물적분할을 통해 취득한 분할신설법인의 주식을 단기간에 매각한 사실도 확인할 수 있으므로 이러한 추론이 타당하다고 할 수 있을 것이다. 따라서, 본 연구의 분석을 통해 물적분할의 과정에서 분할법인과 분할신설법인의 세금부담을 동시에 고려하는 모든 거래당사자들(all parties)의 관점과 함께 조세비용과 비조세비용을 동시에 고려하는 모든 비용(all costs)의 관점도 중요하게 고려되어야 한다는 점을 확인할 수 있다. 또한, 이들은 효과적인 세무계획(effective tax planning)을 수립하기 위해 반드시 고려해야 하는 관점들이기 때문에 기업들이 중요한 의사결정에서 효과적인 세무계획을 실행하기 위해 다양한 측면에서 사전적으로 검토하는 사실도 간접적으로 확인할 수 있다.

유해작업 사내도급 금지와 관련된 논란 및 개정방안에 관한 고찰 (A Review on Recent Debate on Proposals of Amendment of the Article of Prohibition of Inhouse-Contract for Harmful Work in the Industrial Safety and Health Act)

  • Objectives: The purpose of this study is to review the debate on the Article 28(Prohibition of Inhouse-Contract for Harmful Work) of the Industrial Safety and Health Law. Methods: Literatures and recent debate for prohibition and permission of inhouse-contract for harmful work were reviewed. Proposals of revision for the Article 28 of the Industrial Safety and Health Law were also reviewed. Results: It was not found reasonable to revise the Article 28 based on increased fatal accidents or diseases in the electroplating work and heavy metals handling works that are currently listed in the Presidential Decree under the law as the harmful works. Regulation types of prohibition or authorization for any harmful work shall have inherently poor coverage since the scope of application is extremely limited. Contractors for maintenance and repair of chemical facilities may not be included in the scope of application if the harmful works are defined as chemical handling works. If harmful works are prohibited, the contractor workers may loose their jobs. Therefore, it is necessary to consider balancing job security and occupational safety and health safety. Conclusions: Various limitations were found in the Article 28 and the proposals to revise it. Currently in-house subcontracting is widely spread in the workplace. Therefore, it may be inappropriate to set one or two Article such as the Article 28 and 29 to protect in-house subcontract workers from injury and illness. It is believed that it needs fundamental redirection and new approach with new paradigm to impose occupational safety and health duty to prime contractors.

일부지역 임상치과위생사들의 치과위생사 의료인화에 대한 견해 (The opinions of some local clinical dental hygienists on medical personnel of dental hygienists)

  • Objectives: The purpose of the study is to investigate the opinions of some local clinical dental hygienists on medical personnel of dental hygienists. It will be for provide the Future dental hygienist basic data necessary for medical personnel. Methods: A self-reported questionnaire was completed by 171 dental hygienists in Busan and Gyeongnam from December 1, 2017 to January 31, 2018. Structured questionnaires were uesd for analysis. The questionnaire consisted of general characteristics of the subjects(7 items), medical personnel necessity and opinions of dental hygienist(2 items), the opinions of distinction of the task between dental hygienists and other personnel(2 items), many frequency task in the dental clinic. The collected data were analyzed using frequency, percentage, descriptive statistics and ANOVA using IBM SPSS VER 20.0. Results: 89.5% of the dental hygienists required medical personnel of dental hygienist, the opinions on the necessity were as follows: 'role and quality improvement as oral health professionals', 'lack of legislation and application of dental hygienists duties'. There was no difference reason between dental hygienists and other personnel on duties, the reason were investigated to uncertainty of dental hygienist system, lack of dental hygienist workforce, dentists lack awareness of dental hygienist expertise. There was surveyed by the current many frequency duties in the dental clinic, assist for dental treatment, Oral health education and counselling, Preventive dental treatment. Conclusions: Legal guarantees for clinical dental hygienists work are absolutely required. Therefore, relevant government agencies and related organizations should resolve the contradiction of the legal system of medical law and medical technicians. The clinical dental hygienists should be promoted to medical personnel through the amendment of the medical law so that the duties practiced by the dental hygienist can be matched with the legal practice.

민간시설 활성화를 위한 공공기록법 개정(안) : 쟁점과 과제 (Revising the Archives Law to Boost Commercial Records Facilities Industry : Issues & Tasks)

  • 우리 기록공동체는 규제완화를 명분으로 기록관리의 본령을 위축시키고자 하는 시도에 지속적으로 대응해왔으며, 이런 시도들을 현안이라고 불러왔다. 2015년에는 민간시설이 공공기관의 기록물보존업무를 수행하도록 허용하는 것을 골자로 하는 공공기록법 개정안이 현안이 되었다. '공공기관의 기록물관리 효율성을 제고'한다는 법 개정 이유 등 주요 쟁점을 놓고 주요 이해관계당사자들의 입장과 해석이 달라 큰 혼란이 야기되었다. 이 개정안은 2016년 1월 현재 국회에 계류 중이며, 이번에 통과되지 않을 수도 있다. 그러나 이와 유사한 이러한 위험한 시도가 계속될 것으로 예측된다. 따라서 이 논문은 '민간시설 활성화를 위한 공공기록법 개정 현안'의 진행과정에서 드러난 주요 쟁점을 검토하고, 향후 과제를 확인하기 위한 목적으로 작성되었다. 진행경과를 살펴보고, 쟁점사항을 검토한 후, (1) 균형 있는 기록생태계의 발전, (2) 전자기록 관리체제의 검토, (3) 공공기록법의 선제적 정비, 그리고 (4) 기록공동체 내부의 소통방식 개선 등의 향후 과제를 제안하였다.

프랜차이즈 가맹점의 노동조건 개선 및 상생지원 방안 (A Study on the Improvement of Working Conditions and Win-Win Support for Franchisees)

  • Purpose: The Korean franchise market has undergone drastic growth in recent years. Followed by expansion of franchise business types, relevant legal matters have diversified. Compared to conventional economic laws that focused on resolving problems related to unfair transactions between franchisors and franchisees, more diverse labor laws have emerged recently due to governance and economic dependencies of franchise structure. However, it was found that the business environment of franchisees and working conditions of franchisee employees have not changed accordingly due to the unique structure of franchise business. Though franchisees are entrepreneurs independent from franchisors, they are still under franchising contract with the franchisors. For instance, employees of franchisees have been exposed to malpractices in regard to pay, time, and other working conditions. These malpractices may show the ineffectiveness of current labor laws. Labor management is an important issue for sustainability of franchise businesses. Negative publicity of franchises generated from violating relevant labor laws may have significant negative impact on overall image of franchised brands. However, franchisors should not hold franchisees fully responsible for legal violations in terms of labor management but strive to prevent relevant risks. Thus, the recent amendment in labor law related to increased minimum wage and reduced worktime have called for more attention to effectively implementing the law. Research design, data, and methodology: This study was conducted through a review of franchise-related laws and various institutions and policies. Results: It is further needed for all parties, including franchisors, franchisees, and franchisee employees, to take collaborative actions to improve working conditions of franchisees. Therefore, this study aims to propose appropriate and effective response plans toward recent changes in the Minimum Wage Act, while strengthening sustainability of franchisors, franchisees, and their employees. Conclusions: The proposal mainly contains plans regarding profit-related aids and profit sharing/cost reduction strategies for franchisees, as well as collective bargaining in the franchisor-franchisee relation. More detailed suggestions are included. Conclusions: This proposal may help franchisors and policymakers develop business plans and policies in improving business conditions of franchisees and working conditions of franchisee employees.
