A Study on Validity of Selective Arbitration Agreement (선택적 중재합의의 유효성에 관한 연구)

  • Arbitration agreement is an agreement by the parties to submit to arbitration all or certain dispute which have arisen or which may arise between them. Arbitration agreement is an important factor to judge the existence of the mutual arbitration agreement and it should be the object of examination before anything else to judge the existence of the mutual arbitration agreement. Recently the Supreme Court seemed to make negative position about validity of selective arbitration agreement. However theoretically and scientifically selective arbitration agreement is a valid arbitration agreement. Examine selective arbitration agreement throughly according to the autonomy of the parties rules, wide jurisdiction rules of interpretation, principle of kompetenz-kompetenz, and moses cone presumption rule of interpretation, selective arbitration agreement is a valid arbitration agreement. Also analyze precedents in accordance with validity of selective from all angles which are voluntary agreement of the parties, agreement in writing, principle of private autonomy, comparative study of domestic and foreign precedents and mutual relation of arbitration and trial, selective arbitration agreement based on principle of private by the parties is considered a valid arbitration agreement. Courts should actively accept selective arbitration agreement as a valid arbitration agreement to make foreign companies prefer arbitration in Korea and in oder for arbitration to be widely used in disputes.

Word class information in perception of prosodic prominence by Korean learners of English

  • This study aims to investigate how prosodic prominence is perceived in relation to word class information (or parts-of-speech) by Korean learners of English compared with native English speakers in public speech. Two groups, Korean learners of English and native English speakers, were asked to judge words perceived as prominent simultaneously while listening to a speech. Parts-of-speech and three acoustic cues (i.e., max F0, mean phone duration, and mean intensity) were analyzed for each word in the speech. The results showed that content words tended to be higher in pitch and longer in duration than function words. Both groups of listeners rated prominence on content words more frequently than on function words. This tendency, however, was significantly greater for Korean learners of English than for native English speakers. Among the parts-of-speech of the content words, Korean learners of English were more likely than native English speakers to judge nouns and verbs as prominent. This study presents evidence that Korean learners of English consider most, if not all, content words as landing locations of prosodic prominence, in alignment with the previous study on the production of prominence.

  • In the subway fire case, it is important that judge accuracy subway fire type and on the initial response minimize accident damage. But when the subway fire accident occurring, if it have know impossible that accuracy subway fire type to judge at once though witnessing driver or emergency response staff. This study suggests type of five senses that using information of five sense take to the subway fire accident information which analyses five senses as occurring subway fire accident. Also it is proposed that emergency response system though fire scenario by using Activity-Action Diagram(AAD).

  • Elliptical gears are used in the oval flowmeter and oval flow meter inspects volume of water thanks to space by the elliptical shape. The purpose of this study is to judge accuracy of processing of the elliptical gear and develop inspection system using machine vision. Demand of machine vision is increasing while the factory automation is spreading and principle factor in-process inspection. But, gear inspection using the machine vision rarely used because of complex shape of gear. In this study, it seems possible that elliptical gear is inspected by inspection software using machine vision and inspection program can judge accuracy of processing of the elliptical gear designed this study.

  • Forklift tend to work in place rather than moving due to work environment conditions, so they express only the engine operation time without expressing the moving distance unlike a general car's instrument panel. Therefore, various consumables constituting the forklift have a replacement cycle according to the operation time of the engine. However, it is very difficult to judge the exact replacement cycle only by the engine operation time because the working environment differs for each forklift. In this paper, we propose a system that provides position information and moving distance information of forklift to driver using GPS and IMU sensor. By using this system, it is expected that the forklift status information, which is difficult to judge by the existing instrument panel, is provided as easier information, and economic benefits for forklift management and maintenance are expected.

  • The ground oxidizer supply system in the launch site of NARO space center had operated 9 times from the start of tests with ILV on May, 2009 to the 2nd flight test of the NARO vehicle. This system operated successfully for twice launches of the NARO vehicle. To judge the successful operation of the ground facility, it should have reproducibility and reliability. In this report, we have analyzed the liquid oxygen consumption of the system to judge of its reproducibility and it can be a reference for using this system for the next generation of KSLV system.

Examining the Accountability and Effectiveness of the Elementary English Curriculum from the Present Testing System at Elementary Schools (초등영어 평가체계로부터 초등영어 교과과정의 책무성과 효율성의 검증)

  • The object of the present study was to examine whether it is possible to get appropriate data to examine the accountability and effectiveness of the elementary English curriculum from the present testing system at elementary schools. The present elementary education policy encourages using performance assessment relying mainly on teachers' observation of students' performanceinstead of objective tests of which the results are given in hierarchical number. To obtain objective data from the performance assessment, it is a prerequisite that teachers understand the achievement criteria set by the curriculum and be able to judge' performance objectively based on the same criteria. A questionnaire was used to examine the degree of teachers' understanding of the achievement criteria. A listening test was developed and given to 13 classes of 4th graders. The English teachers of the 13 classes were asked to judge whether each of their students had achieved the curriculum objective. The distributions of the test scores and teachers judgments were compared across the teachers to examine whether the teachers had the same achievement criteria. The survey showed that about a third of elementary school teachers reported that they did not have an understanding of the achievement criteria set by the curriculum. The comparison analysis showed that the levels of achievement criteria varied greatly among the elementary school teachers.

  • Professor Hasuk Song argues that every argumentum ad ignorantiam, i.e. the argument from ignorance is not fallacious, and social contexts play a crucial role to judge whether the argument is fallacious or not. I generally agree with him, but I think we cannot have help from his position without knowing what those contexts are. In this paper, I argue that the concept of burden of proof is the crucial one to judge whether ad ignorantiam is plausible or not, and then present four criterions who have the burden of proof. There is a burden of proof on one who argues first, who insists the doubtful ones, who has powers, and who thinks that a situation is not dangerous.

Development of four-finger force measuring system of a cylindrical type (원통형 4손가락 힘측정시스템 개발)

  • Stroke patients, etc. can't use their hands because of the paralysis of their fingers, and their fingers could be recovered by rehabilitating training. In order to judge the rehabilitating extent of their fingers, the patients should grasp a cylindrical object in hospital. At present, the used object in hospital is only a cylindrical object, and can't measure the force of fingers. Therefore, doctors judge the rehabilitating extent by touching and watching at their fingers. So, the four-finger force measuring system which can measure the force of their fingers should be developed. In this paper, four-finger force measuring system with four force sensors which can measure the grasping force is developed. The force sensors are designed and fabricated, and the force measuring device is designed and manufactured by using DSP(digital signal processing). Also, the grasping force test of men is performed by using the developed four-finger force measuring system. It was confirmed that the finger average force of right hand is about 214.6 N and that of left hand is about 212.8 N.

Development of the Gait Rehabilitation Equipment for Hemiplegic Patients after Stroke (편마비 환자를 위한 보행 재활기구 개발)

  • The aim of this study is to design and develop the gait rehabilitation equipment that judge patient's movement of his/her center of gravity using pressure sensors, and to aid hemiplegic patients to balance themselves using an automatic stepper that changes the patient's center of gravity. It is hard to bear the weight on the affected side for hemiplegic patients. The gait rehabilitation equipment detects the footing phase of hemiplegic patient during training and moves the unaffected footing side of the stepper up and moves the affected footing side down simultaneously so that the patient's center of gravity can shift from unaffected side to affected side. The gait rehabilitation system was developed and applied for hemiplegic patients during exercise. Eight hemiplegic patients and one normal adult were studied. The developed gait rehabilitation system could judge not only the normal adult's intention but also the patient's intention to move his/her center of gravity. Even though the most of hemiplegic patients exercised in automatic mode and a few hemiplegic patients exercised in manual mode, the developed gait rehabilitation system can aid the hemiplegic patients to train more easily.
