Legal Study on the Explanatory Duty for Medical Practice in Korean Medicine by Judicial Precedent Analysis (판례분석을 통한 한의사의 설명의무에 관한 법학적 고찰)

  • Objectives : The purpose of this study is to set the explanatory duty on traditional Korean medical(TKM) treatment by analyzing the judicial precedents. Methods : The study was performed by analyzing nine cases of lawsuits related to Korean medicine doctor and explanatory duty among the medical dispute cases in Korea from 1968 through 2012. Results : Nine closed claims occurred regarding the violation of explanatory duties in the field of TKM practice. Two claims were decided by supreme court, three were decided by high court, and four were decided by district court. The causes of lawsuits were categorized as follows : bee venom pharmacopuncture, herb treatment, and an explanation for safety. Conclusions : To perform an explanatory duty has important legal implications for the protection of patients' rights and Korean Medicine doctors' autonomy on TKM treatment.

  • Purpose - This study aims to examine the antecedents of willingness to pay in the domain of duty free shop. Design/methodology/approach - This study chooses willingness to pay as explained variable. The candidates of explanatory variables are price fairness, brand awareness, employee service, product diversity, and crowding. This study uses survey to explore the linear relation between variables. This research collected data using online panel data collection service. The number of valid observation is 265. The research targe is Lotte duty free store. Statistical analysis was for statistical inference. To attain the information of survey respondents, frequency analysis is employed. Next, this study implemented exploratory factor analysis and reliability to ensure both validity and reliability of measurement items. This study executed multiple regression analysis to test research hypotheses Findings - Regrading results, brand awareness, employee service, and product diversity are positively associated with willingness to pay of duty free shop product. Moreover, the results of regression analysis suggest the inverted-U shape association between crowding and willingness to pay. However, price fairness appeared as non-significant variable to account for willingness to pay in the multiple regression analysis. Originality - This study contributes to the literature by examining duty free shop customers more.

  • Purpose - This paper analyzes how to interpret the legal view of the precedents to the UK Insurance Act 2015, comparing it to the UK Marine Insurance Act (MIA) 1906 with a focus on the relationship between the duty of uberrimae fidei and the duty of disclosure. Furthermore, this study focuses on the judgment of the Korean Supreme Court in a case, that examined whether the legal nature of the duty of disclosure or duty of uberrimae fidei in insurance law can be considered as a matter related to the insurer's liability when the applicable terms of English law are incorporated under the insurance contract. Design/methodology - This paper belongs to the field of explanatory legal study, which aims to explain and test whether the choice of law is linked to the conditions that occur in the reality of judicial practice. The approach that is used toward this problem is the legal analytical normative approach. The juridical approach involves studying and examining theories, concepts, legal doctrines and legislation that are related to the problem. Findings - Regarding the requirements and effects of breach of the duty of disclosure, if English law and the Korean Commercial Act are handled differently from each other and Korean law is recognized as the applicable law outside of the insurer's liability, it may be whether the insurer's immunity under English law is contrary to s.633 of the Korean Commercial Act. In considering the breach of the duty of disclosure as a matter of the insurer's liability, even if English law is applied as a governing law, the question of how to interpret the agreement of the governing law in this case may also be raised in the interpretation of Korean International Private Law in relation to the applicable law that applies to the rest of the matter, excluding the matters of liability. Originality/value - According to the Korean Supreme Court judgement under the governing law of the MIA 1906, the basis for recognizing the assured's pre-and post-contractual duty of disclosure is separate, and the only important matters to be notified by the assured after the conclusion of the insurance contract are those that are "relevant" and "material circumstances" that are "relevant" to the matter in question after the conclusion of the insurance contract.

Relationships among Work Environment, Job Satisfaction and Turnover Intention of Nurses in an Emergency Department (응급실 간호사의 업무환경, 직무만족도 및 이직의도 간의 관계)

  • Purpose: The purpose of this study is to identify relationships among work environment, job satisfaction and turnover intention of emergency department (ED) nurses. Methods: The survey was given to 220 ED nurses which are located in G metropolitan from May 1st to July 31st of 2012. The results were analyzed by descriptive statistics, t-test, ANOVA, pearson correlation coefficients and stepwise multiple regression using SPSS WIN 19.0 program. Results: The turnover intension according to the general characteristics of the subjects has significant difference between emergency room experience, current duty satisfaction, and turnover plan in 1 year. In the correlation between work environment, job satisfaction and turnover intention of the subjects, work environment and job satisfaction have positive correlation, job satisfaction and turnover intention either job satisfaction and turnover intention have a negative correlation. Factors influencing turnover intention are job satisfaction, career and current duty satisfaction, also the full explanatory power of the model was 24.4%. Conclusion: The results indicate factors that influence turnover intention are job satisfaction, career, and current job satisfaction. We hope these result help to provide effective intervention strategies for reducing ED nurses' turnover.

The effects subjective fatigue symptoms to job satisfaction in Daejon city and south Chungcheong province of dental hygienists (대전·충남지역 치과위생사의 피로자각증상이 직무만족도에 미치는 영향)

  • In order to investigate the complaint rates of subjective fatigue symptoms and the degree of job-satisfaction among dental hygienists based on their socio-demographic and job characteristics and to find out the factors related with subjective fatigue symptoms and job satisfaction. The study subjects were recruited from 274 dental hygienists who worked at dental hospitals and clinics in Daejon city and South Chungcheong Province during the period between Jan. 5 and Feb. 11, 2008. They were asked to complete the self-administered questionnaires asking about their socio-demographic characteristics. job characteristics. daily life styles, job satisfaction and subjective fatigue symptoms, and the major finding of the results were as follows : 1. The mean scores of job satisfaction were 3.12V0.47 of the total full scores(5.00). and the highest scores were in the sub-domain of interpersonal relationship. and the lowest scores were pay. The scores of job satisfaction by socio-demographic characteristics and daily life styles were not significantly differences, but in job characteristics, significantly increased with those feeling satisfied with their job. those with appropriate amount of duty amount, those free of jop autonomy, those feeling satisfied with their monthly income. satisfactory personal relations at work. 2. The mean scores of subjective fatigue symptoms were 27.6V10.9 of the total full scores(60.0), and the highest scores were in the sub-group of bodily projection of fatigue(Group III), and they were followed by difficulty in concentration(Group II). dullness and sleepness(Group I) in their decreasing order of magnitude. The scores of job satisfaction by socio-demographic characteristics and daily life styles were significantly increased with the group of lower age, the group of irregularly breakfast habit and the worse subjective health status. Based on job characteristics. the score of subjective fatigue symptoms were significantly increased with those group of lower clinical career and monthly income, those feeling unsatisfied with their job, those with inappropriate amount of duty amount. those satisfactory personal relations at work 3. The correlation of subjective fatigue symptoms with job satisfaction showed a negative correlation with rM-0.198(pM0.000), and job satisfaction were higher according to the lower subjective fatigue symptoms. The correlation among the scores of sub-domain of job satisfaction and the sub-group of subjective fatigue symptoms were significantly positive correlation. 4. The affecting factors of significance on job satisfaction included clinical career, duty amount salary satisfaction, with the explanatory power of 32.9%. Those on subjective fatigue symptoms included the eucation and the subjective health statuts, with the explanatory power of 20.8%. When considering these results, the job-satisfaction and the subjective fatigue symptoms were significantly correlated with the job related factors than factors of socio-demographic characteristics and daily life styles. In addition. if job environments of dental hygienist can improved. their job-satisfaction and subjective fatigue symptoms are suggested to be betters.

End of life care stress and Nursing Work Environment in Geriatric Hospitals Nurses affect burn out (요양병원 간호사의 임종간호스트레스와 간호근무환경이 소진에 미치는 영향)

  • This research is a descriptive correlation research for comprehending the end of life care stresses, work environment, and reduction of nurses in geriatric hospitals and analyzing the factors influencing their burnout. We recruited 195 nurses from 8 geriatric hospitals in B metropolitan city and collected data on the end of life care stress, work environment and reduction using organized questionnaires. The data were analyzed with SPSS WIN 21.0 program. The average grade of end life care stress was $3.84{\pm}0.56$, nursing work environment $3.25{\pm}0.60$, and burnout $2.93{\pm}0.52$. There was a positive correlation between the end of life care stress and reduction(r=.206, p=.004) but a negative correlation between nursing work environment and reduction(r=-.431, p<.001). The most influential factor on the reduction was nursing satisfaction(${\beta}=-.302$), followed by work environment(${\beta}=-.294$), age(${\beta}=.286$), duty style(${\beta}=-.17$), and end of life care stress(${\beta}=.164$). The overall explanatory power was 41.2%.These results suggest that in order to minimize the reduction of nurses in geriatric hospitals, the provision of a supportive work environment which enhances their pride and responsibility as a nurse and offers incentives is required with effective distribution of duties, development of the end of life nursing education and administrative tools for reducing their stress.

Factors to Affect Turnover Intention of Nursing Workers at Long-Term care Hospitals (노인요양병원 간호종사자의 이직의도에 영향을 미치는 요인)

  • This study is a descriptive survey research on nursing workers at long-term care hospitals, who are largely divided into nurses and nurse aides, to identify the factors that affect their turnover intention. From August 12 to 16, 2022, the survey was conducted for 146 nursing workers in four long-term care hospitals located in G city. The survey results indicated that there were differences in their turnover intention depending on their age, religion, marital status, educational level, average monthly salary, job type, duty pattern and turnover experience, of all general characteristics (p<.05). Turnover intention had a significant positive correlation with job stress (r=.51, p<.001) and burnout (r=.62, p<.001), and had a significant negative correlation with organizational commitment (r=.-56, p<.001). Organizational commitment had a significant negative correlation with job stress (r=-.25, p=.002) and burnout (r=.-.67, p<.001), while burnout had a significant positive correlation with job stress (r=.56, p<.001). Factors influencing the nursing workers' turnover intention included job stress (β=.32, p<.001), organizational commitment (β=-.30, p=.001) and education level (β=.17, p=.022), with an explanatory power of 49.6%. Based on the results of this study, it is considered that efforts to improve the working environment for nursing workers at long-term care hospitals are needed by reducing their job stress and improving organizational commitment in order to reduce their turnover intention.
