A Study on the Present Situation of Landscape Management System through Analysis of the Landscape Review Results - Focused on Jeju Special Self-Governing Province Landscape Review- (경관 심의결과 분석을 통한 경관관리제도의 현황에 대한 연구 - 제주특별자치도 경관 심의를 중심으로 -)

  • The purpose of the study is to suggest ways to improve the Landscape Review system and Landscape Management System of Jeju Special Self-governing Province through Analysis of the Landscape Review Results and Jeju Special Self-governing Ordinance. For this purpose, the research methods were reviewed for preliminary study and reviewing the laws and ordinances related to landscape, and 318 cases of landscape review, which have been implemented since 2010, were analyzed by item by item along with the result of the review. The main results of the analysis are as follows. First, Jeju Special Self-governing Province, which currently operates an enhanced ordinance of development project review, is experiencing problems such as building the wrong construction projects due to the weak legal basis for follow-up management after landscape Review. Second, Jeju Special Self-governing Province expects efficient management of the province through expansion of the scope of the landscape review. Third, the current status of the decisions by the Landscape review showed that 57.7% of the bills passed, the lowest at 41.9% for the development projects. Fourth, analysis of the landscape review contents by categorization by item showed that ' Landscape Control Guideline' and 'Document not completed' are relatively high. Thus, eight years have passed since the start of the Landscape Management System and the Landscape Review, but systematic institutional stability is not sufficient, so it is necessary to make the Landscape Control Guideline easier to understand.

A Comparative Study of Sea WaybilI and Electronic B/L in the International Contract of Carriage (국제운송계약상 해상화물운송장과 전자선하증권의 비교연구)

  • The purpose of this study aims to analyse the key differences of the sea waybill and electronic B/L in the international transport documents. Sea waybills look remarkably like ordinary bills of lading. Indeed, in two important ways, they are just like bills of lading: the front of the document will near a description of the quantity and apparent condition of the goods; and the back of the document provides evidence of the terms of the contract of carriage. They differ from bills of lading in that, far from indicating that the goods described are deliverable to the order of the shipper or of the consignee, they will make it explicit that the goods are deliverable only to the consignee. Again, different carries will do thai in a variety of ways. For example, the document may call itself non-negotiable, omitting the word order from the consignee box on the front of the document, and stating explicitly that the goods will be deliverable to the consignee or his authorised representative on proper proof of identity and authorisation. The Hague-Visby Rules and Hamburg Rules give no guidance as to any right to instruct the carrier in respect of goods while they are in transit. However, in applying Article 50 of the Rotterdam Rules, in particular when applying it in the context of seawaybills, straight bills of lading or ship's delivery orders, regard would need to be had to preserve the shipper's rights under any of those three documents even after the buyer of goods covered by them has acquired rights of its own. And, the right of control is defined at Article 1.12 of the Rotterdam Rules. The right to give instruction is further limited by the terms of Article 50.1 to three particular types of instruction in respect of the goods, relating broadly to the goods, their delivery en route, and the identity of the consignee. And, the CMI formulated the CMI Uniform Rules for Sea Waybills for voluntary incorporation into any contract of carriage covered by such a document. Recognising that neither the Hague nor the Hague-Visby Rules are applicable to sea waybills, the CMI Rules provide that a contract of carriage covered by a waybill shall be governed by whichever international or national law, if any, would have been compulsorily applicable if the contract had in fact been covered by a bill of lading or similar document of title.

The Risks of Transport Documents under L/C Transaction (신용장거래에서 운송서류의 위험요인에 관한 연구)

  • L/C provides the exporter and the importer with safe assurance in the exchange of goods for payment in international trade. It involves a number of parties. Although the parties may have confidence in their client, bad faith or ignorance of international banking practice by any of these parties could cause the failure of transaction, which makes international trade a risky business. Most of the risks are found in transport document, which can cause disputes. There are many factors in the risk of transport documents under L/C transaction. One most common risk factor for the beneficiary in all transport documents is even if there is no discrepancy in document, the issuing bank or the applicant refuses to pay or delay payment insisting there is a discrepancy. In some very rare cases, the beneficiary may not get paid due to unfair injunction of the local court of the applicant. For the applicant, most common risk factors are fake bill and fraud. Risks classified according to the sorts of transport documents are as follows. 1. In B/L, payment can be refused because it is regarded as charter party B/L, although there is no real charter party contract. And the applicant can bear the potential risk of the loss or deterioration of cargo through transhipment of the cargo loaded on board in container if transhipment is prohibited without excluding of UCP 600 article 20 (c). 2. In charter party B/L, the applicant may take delivery without paying when charter party B/L is signed by charterer, which can result in a big loss for the beneficiary and the negotiating bank. And risks may arise when cargo is seized because the charterer does not pay the hire. The applicant and the issuing bank are also vulnerable to a risk - Against whom should they file a suit when cargo gets damaged during transportation? 3. In multimodal transport document, which is subject to a conflict because there is a big difference in viewpoints between transport industry and banks, conflicts may also arise when L/C requires ocean B/L and accepts multimodal transport document at the same time, but does not specify the details. 4. In air waybill, where the consignee is not the issuing bank but the applicant, risks may take place to the beneficiary when the applicant takes delivery but refuses to pay asserting minor discrepancies in document. The applicant may also bear the risk when cargo may not be loaded because air waybill is a received bill. Another risk may arise when although the applicant prohibits transhipment without excluding UCP 600 article 23 (c), the cargo may be transhipped, provided that the entire carriage is covered by one and the same air waybill.

Developing a Meta-information System for Corporate Hyperdocuments (기업 하이퍼미디어 문서 관리를 위한 메타정보시스템 개발)

  • Recently many organizations have attempted to build hypermedia systems to expand their working areas to internet-based virtual work places. It is thus important to manage corporate hypermedia documents effectively. Metadata play a critical role for managing these documents. This paper identifies metadata roles and components to build its schema. Furthermore a meta-information system HyDoMiS(Hyperdocument Meta-information System) is proposed by the use of this metadata schema. HyDoMiS performs three functions; metadata management search and reporting The metadata management function is concerned with workflow document and database. The system is more likely to help implement and maintsain hypermedia information system effectively.

  • Technical Specifications (TSs) for a nuclear power plant is an important licensing document which defines various operational requirements or conditions. Recently, many researchers have evaluated the risk impacts associated with the TS requirements, using probabilistic safety assessments becoming widely available. This paper presents insights gained km our review of recent risk-based analyses of TSs, focussing on surveillance requirements and AOT (allowed outage time) requirements.

  • A case of radicular pain that resulted from a gas-filled intradural cyst in an 80-year-old male is described. Temporary improvement of radicular pain was observed after CT-guided aspiration. However, recurrent radicular pain led to surgical treatment. In this report, the authors document the radiologic and intraoperative features of a gas-filled intradural cyst that migrated into the nerve root, and propose an optimal treatment plan based on a review of the literature.

A Study on Development of Guideline on Writing Technical Document for Electrical Medical Devices: Dental X-ray Equipment (치과용엑스선장치의 기술문서 작성을 위한 가이드라인 개발 연구)

  • Due to recent population aging, the number of check-up for senior citizens has increased steadily. According to this trend, the market size of dental X-ray equipment and the number of approval and review for these devices have simultaneously increased. The technical document of medical device is required for approval and review for medical device, and medical device companies needs to have work comprehension and expertise, as the document needs to include the overall contents such as performances, test criteria, etc.. Yet, since most of domestic manufacturers or importers of medical devices are small businesses, it is difficult for them to recruit professional manpower for approval of medical devices, and submission of inaccurate technical documents has increased. These problems lead to delay of the approval process and to difficulties in quick entering into the market. Especially, the Ministry of Food and Drug safety (MFDS) standards of a dental extra-oral X-ray equipment, a dental intra-oral X-ray equipment, an arm-type computed tomography, and a portable X-ray system have been recently enacted or not. this guideline of dental X-ray equipment adjusting revised standards was developed to help relative companies and reviewers. For this study, first, the methods to write technical document have been reviewed with revised international and domestic regulations and system. Second, the domestic and foreign market status of each item has been surveyed and analyzed. Third, the contents of technical documents already approved by MFDS have been analyzed to select the correct example, test items, criteria, and methods. Finally, the guideline has been developed based on international and domestic regulation, through close review of a consultative body composed of academic, industrial, research institute and government experts.

  • Although an academic journal has had an important role in the diffusion of knowledge and the confirmation of knowledge advancement, it has revealed several difficulties : long processing time for publishing, uni - directional communication, closed review process etc. But an electronic journal (E-Journal) can solve these problems and add several new advantages such as the multimedia expression of documents, and pre and post publication review. Moreover, it should be noted that an E-Journal is not an alternative medium which simply replaces an existing journal, but a new paradigm for scholarly communication. Although this paper reviews several issues related to E-Journal, the introduction of the concept of universal service and informal document style for flexible communication are noticeable. For effective diffusion of E-Journal, information infrastructures such as high - speed telecommunication networks and digital libraries are urgently needed. Government subsidy as in Great Britain is necessary for E-Journal publishing.

A Study on the Environmental Impact Assessment System (환경영향평가제도에 관한 연구)

  • Section 102(2) (c) of the National Environmental Policy Act of 1969 of the United States requires an environmental assessment of the major federal actions that could significantly a-ffect environmental quality. The review is known as the NEPA assessment process, and the resulting document is called an Environmental Impact Assessment (EIS). Article 5 of the En-vironmental Preservation Law of ROK also introduced this system to a cereain extent. The purpose of this paper is, therefore, to review the general impacts of environmental pollution caused by newly proposed actions on air quality, water resources, and land use as well as specific impacts from the disposal of radiation wastes, operation of petroleum and ru-bber industries, construction of highways and dams, location of power plants and industrial co-mplexes, etc., in order to fully understand the importance of this system. Differences between American and Korean system are also briefly studied and reached to a conclusion that this important system should be understood in such a way as to link and uti-lize all conceivable disciplines and human knowledge in order to protect our environment by all means for ourselves and our coming generations as well.

  • In recent, unmanned Aircraft Systems (UAS) have been widely used for various purposes, such as safety inspection, facility condition inspection, progress monitoring, in the architecture engineering, and construction (AEC) industry. This technology can provide visual assets regarding the conditions of construction jobsites as well as constructed facilities during flying over the point of interests. With the significant interests in this advancement, the recent studies have presented how the UAS can be applied fro different types of facilities (e.g., buildings, power genereation systems, roads, or bridges) to inspect the current conditions of them for safe operations as well as public's safety. This study reviewed the receent studies to document their scientific findings and practical contributions, as well as provided the overview of further implications for future studies.
