Time Limits in Challenging a Tribunal's Jurisdiction

  • One of the most defining characteristics of arbitration is that an arbitral tribunal's jurisdiction is established by parties' mutual agreement. If a party to the arbitral proceedings believes that a tribunal constituted lacks jurisdiction to conduct the arbitral proceedings, it may challenge the jurisdiction of the tribunal in different ways. Although the concept of kompetenz-kompetenz and the grounds to challenge the Tribunal's jurisdiction are readily accepted in the arbitration community, what parties often fail to observe is the time limit imposed by the relevant laws in bringing such objections. This article aims to examine several main ways of challenging the tribunal's jurisdiction and the applicable time limits in each scenario. The article will then focus on the consequences of a party's failure to adhere to the strict time limits and its effect at the post-award stage. These issues will be considered in the light of case law from different Model law jurisdictions with particular illustrations from the arbitration law of Singapore.

A Comparative Analysis of Costs in Arbitration between Korea and ICC (한국과 ICC 간 중재비용에 관한 비교 분석)

  • International arbitration has been recognized as an effective dispute resolution method. Among the arbitration institutions, the ICC(International Chamber of Commerce) international court of arbitration is one of the most well-known and frequently chosen organizations to which international claimants have resorted, when they were confronted with international disputes. In this paper, costs in the ICC arbitration are compared with those in the KCAB(Korean Commercial Arbitration Board) arbitration. seeking efficient ways to reduce the costs while maximizing the quality of arbitral awards. Three main points about costs in the ICC arbitration and the KCAB arbitration are discussed and analysed, First, the cost structures are analysed and decomposed into manageable units. Second, the cost allocation is discussed to clarify its proportional responsibility among the arbitration parties. Third, how advances in arbitration costs are conducted is examined to explore a well established procedure of arbitration. In conclusion, the KCAB arbitration procedure has been found faster and cheaper than the ICC arbitration procedure in terms of time and costs, respectively. However, it can be cautiously suggested that the quality of arbitral awards made by the KCAB is not necessarily higher than that made by the ICC.

  • Noise and vibration generated at construction sites become serious issues because of bigger construction projects and growing use of heavy equipment. Especially in downtown construction, noise and vibration easily exceed the legal standards that can suffer the most of surrounding residents. The number of complaints by the residents who are exposed to the noise increases as their consciousness grows. However, the Korean regulations for the construction noise and vibration only present the overall limits for target areas and times zones, and this make it difficult to take effective measures. Also in rural area, disputes between construction sites and residents arise, but the dispute resolution or taking measures are difficult because clear standards concerning cause-and-effect, estimation of effective levels, calculation of damages, and future precautions and examples lack. This paper describes legal standards regarding the noise and vibration and presents judging standards for the physical damages. This paper also introduces example public complaints that happened at Daewoo construction sites to describe the problems in the existing law and further to enable smooth construction progresses by emphasizing the seriousness of public complaints.

The Application and Prospects of UNIDROIT Principles(2004) in International Commercial Arbitration (국제상사중재에서 UNIDROIT원칙(2004)의 적용과 전망)

  • The International Institute for the Unification of Private Law (UNIDROIT) established UNIDROIT principles, which could be applicable as international unified rules. The UNIDROIT Principles plays the role of interpreting and complementing CISG and functions as a law applicable to international commercial disputes. As shown by cases of practical application so far, the principles are expected to be applied frequently to international commercial arbitration in the future. In the situation that there is no internationally unified judicature, it is necessary to promote rational dispute resolution and legal stability through arbitration by adopting the UNIDROIT Principles of Lex Mercatoria as a governing law of international commercial contracts. In conclusion, UNIDROIT principles, along with CISG, are expected to playa great role as the applicable law of international commercial contracts and as standards for resolving international commercial disputes.

  • 본 논문에서는 상거래과정에서 발생하는 분쟁해결을 위하여 적용가능한 ODR시스템의 특성과 선진국의 ODR의 시험 운영사례를 통하여 이에 따른 문제점을 분석하였다. 또한 국제상거래의 분쟁해결수단으로 일반화되고 있는 중재에 대하여 온라인중재의 도입에 따른 법적인 문제를 검토하고, 이러한 분석 검토결과를 토대로 ODR의 발전방안을 제시하였다. ODR은 신속성, 비용의 경제성, 해결방법의 개선 등의 장점으로 인하여 온라인에서 발생한 분쟁뿐만 아니라 오프라인에서 발생한 분쟁까지도 그 영역이 확대되어 가고 있으며, 앞으로 전자정부에서도 이를 채택하게 됨에 따라 급격히 발전할 것으로 생각된다. 최근의 상거래분쟁이 복잡하고 전문성이 요구되며, 신속한 해결을 지향하고 있으므로 종래 ADR제도의 장점과 정보 통신적 요소를 가미한 새로운 ODR제도를 도입 추진하는 것이 무엇보다도 중요하다고 할 수 있으며, 이를 위하여 ODR제도의 정통성과 실효성을 확보할 필요가 있다.

Comparative Analysis of ITS Sequences from Acer Species (Aceraceae) in Korea

  • Sequences from the internal transcribed spacer (ITS) regions of nuclear ribosomal DNA were determined to assess their potential as a phylogenetic tool for Korean Acer species, including A. okamotoannum and A. takesimense which are endemic on Ullung Island of volcanic origin. Although the genus Acer has been studied by various authors, different infrageneric dispositions have been suggested, and the phylogeny of the genus has been in dispute. The variation of ITS sequences from seven species of Acer was very low among species within the same section, but comparative analysesof the molecular data obtained suggest that ITS sequences may provide enough phylogenetic resolution for sectional relationships in the genus.

  • The Original Equipment Manufacturer(OEM) Export is one of the most frequent trading system in international transactions, especially for Korean export companies. Even with vast majority of benefits of OEM Export, it still has two sides: bright and dark. Frequently, uneven position between parties drives a party to endure transactional practices harsh and unconscionable. A Recent case in one Korean court shows another aspect of OEM transactions. For the provisional measure against unilateral termination of the contract, it contain essential legal issues that can arise in international OEM transactions, like international jurisdiction, interpretation of contracts, termination of contracts, etc. Deep analysis of several issues in the case, apart from the court's decision, is expected to give insight into the legal status of the parties for strategic operations of OEM practices.

Recent Developments in the EU Investment Policy : Towards an Investment World Court?

  • The controversies that have surrounded the negotiation of both the Comprehensive Economic and Trade Agreement (CETA) and the Transatlantic Trade and Investment Partnership (TTIP) have underlined the difficulties arising out from the adoption of a truly common EU investment policy. Non-governmental organizations have called into question transparency and legitimacy of international investment arbitration during the negotiations. The article presents a reflection about current developments of the EU investment policy addressing, in particular, the criticisms towards the whole investor-to-State system and the EU's efforts in developing a "tailor-made" investment agreement and Investor-to-State Dispute resolution system. Along these lines, the article critically assesses the recently announced proposal for the establishment of an 'Investment Court System' put forward by the EU during the TTIP negotiations.

  • That the arbitration will begin with an arbitrator to be done by the arbitrator is not too much to say. The arbitrator shall have a decisive influence on the outcome of an arbitration in any arbitral right to award arbitration. As demonstrated in sayings like "Good arbitration is a good arbitrator" and "Arbitration is as arbitrator", professionalism and fairness are the basis for the arbitration procedure. Parties qualifications and authority of the arbitrator shall be a dispute-resolution process, requiring special attention and special care because the careful review of the arbitration award itself exerts a significant influence on the selection of an arbitrator. Therefore, this paper, first, analyzes the meaning of international arbitrators as a general overview of international arbitrators, qualifications, etc. and looks for focuses of the role. Next, the purpose of this paper is to seek ways to expand trade and international arbitration institutions in international transactions by examining training plans such as for international arbitrators.

Adolescents' Moral Reasoning & Attribution about Peer Violence (청소년의 또래폭력 귀인양식과 도덕적 판단에 대한 삽화연구)

  • To identify adolescents' moral reasoning and attribution about peer violence, vignette study was conducted. 178 subjects selected from 4 inner city schools were asked to evaluate provoked violent situations. 4 situations depicting the provocation/retribution condition and 3 short vignettes depicting peer violence were presented, and adolescents were asked to judge the violent behavior and the morality of story characters. Analyses revealed that many adolescents focused more on the immorality of the provocation and perceived "hitting back" as a form of reciprocal justice. And a number of adolescents attributed the responsibility to the both of prosecutors and victims with situations which have obscure informations to judge the violent behaviors. In addition, adolescents having more violent characteristics were more likely to attribute the responsibility of violence to the victims than non-violent adolescents. Several suggestions based on these results are as follows: First, school or class-based conflict resolution program should be implemented to intervene in a dispute between peers. Second, it is necessary for comprehensive program such as Aggression Replacement Training including moral education as well as behavior modification to resolve peer violence.
