  • The purpose of this dissertation is finding the meaning and form of Euthanasia, Considering by Criminal law that the core of the debate over the 'pros and cons' of euthanasia, And seeking measures about needs of currently Euthanasia legislation and institutional establishment. Through the remarkable progress, today's medical science makes to cure the Incurable patients, and artificially prolong human life by life-support system. These changes of Healthcare Environments extending a permissible range of Euthanasia over the series of criminal discussions about Euthanasia. And medical treatment has been discussed from negative side to positive side. So, In the current legal system, seeking for realistic measure is demands of the times behind the penally and ethical problems. Therefore, I will study the needs of legal system and reestablish values about Respect for Human Life.

A Review on the International Criminal Law of the Murder Case on Board - Focus on the Fishing Vessel "803 Gwang-Hyeon" - (선상 살인사건의 국제형사법적 고찰 - 803광현호 사건을 중심으로 -)

  • It is necessary to respond to criminal cases on board of pelagic fishing boats in the international waters with domestic legal judgement and international legal judgement due to a natural limitation by geographical long distance while it is possible to deal with domestic criminal cases with prompt response by using air crafts or patrol vessels. In other words, according to the flag of the vessel, the legal status of the water where is the crime scene, the nationalities of the victim and the perpetrator, it is required to judge if Korea can exert their jurisdiction and there is an issue if Korea Coast Guard exert their law enforcement effectively with this natural problem. In this paper, I propose a systemic improvement for a swift investigation for henceforth similar case's occurrence by analyzing the jurisdiction, the suspect's handling, the basic cause of the murder on-board which are based on the case of the vessel No.803 Gwang-Hyeon which was happened recently.

The Effect of Investigator's Belief about Veracity of Suspect on Distortions of Paper Records (수사관의 심증이 조서의 왜곡에 미치는 영향)

  • The Statement evidence is an important method of proof in the criminal investigation and trial. Under certain conditions set by Korean Criminal Procedure Law, paper records of interrogations are admissible in criminal courts. However, it is shown that distortions are ever-present in paper records. Therefore, this study attempted to examine the effect of the investigator's belief about the veracity of a suspect on distortions of paper records. Ninety police investigators were randomly allocated into one of the three conditions('guilty belief', 'innocent belief', 'neutral belief'), and all the investigators were then asked to document a paper record while watching a prefilmed interrogation interview of the crime. The results showed that (1) the investigator's belief had significant effects on distortions. (2) All groups did more commissions than omissions. (3) matters subject to interrogation also had significant effects on distortions. In the conclusion, implications and limitations of the study were disscussed.

  • The bioethics as a comprehensive and normative control method of life sciences including the technology of advanced medical care, on the one hand, it has modified the conditions for allowing the progress of life sciences. On the other hand, it has put the brakes on attempts of life sciences violating the dignity and value of human beings, natural order. Positively, bioethics presents ethical bases, suggests organization of the legal and institutional conditions, and enables elimination of the legal and institutional obstacles, for the progress of life sciences. Negatively, it has presented justifiable prospects and road maps of life sciences, not to take indiscreet and intemperate turn of violating the dignity and value of human beings, natural order, and its such roles must be carried on.

The Study on Legal Analysis of the Abortion Regulations and National Survey (낙태죄 허용한계에 관한 규범해석과 사회인식도)

  • In Korea, abortion in the Criminal Law is an illegal act in exception of limited cases stated in the Mother and the Child Health Law. There are grounds on which abortion may be carried out - though the grounds are very limited and related such as emergency situation of woman's physical health, rape, incest and genetic diseases. The Criminal Law regulates the mother's act of abortion and the doctor's surgical performance of abortion. The Mother and the Child Health Law prescribes the medical, ethical, and genetic grounds for the legal permission of abortion. Many people tend to abuse of abortion even though they are fully aware of its illegality. The law lead to be inconsistent with its enforcement. In this paper, I would like to suggest some proposals about the legal analysis of the Abortion Regulations to reform the existing regulations and increase the effectiveness of the regulations. A national survey was carried out using telephone interview with Korean citizens from August 1th to August 31th in 2005. A total of 1,025 citizens (male: female = 49.2%:50.8%) were randomly sampled in proportion to the number of population of 17 regions. The major findings of this survey were as follows. First, 91.4% of the respondents approved of abortion based on the medical grounds. Second 83.3% of the respondents perceived that abortion may be carried out based on ethical grounds for example rape. Third, 74.3% were agreed to abortion based on genetic diseases. Forth, 64.7% were approved the abortion that unmarried woman may be carried out. In contrast 45.0% were approved the abortion that girls may be carried out, whereas 46.4% were perceived that the abortion may not be permitted. Fifth, 58.3% were disagreed the permission of abortion based on social and economic grounds. According to the survey Korean citizens seem to have positive perception on the abortion that may be carried out based on medical, ethical and genetic grounds. Whereas they worried about the abortion based on social and economic grounds. Now the Mother and the Child Health Law prescribes the medical, ethical, and genetic grounds for the legal permission of abortion. But this law does not include social and economic grounds. In cases of when the mother has a impossibility to breed her child because of her social situations and financial conditions, we should accepted the legal acceptance of abortion due to social and economic grounds.

Mediating Effect of Cooperation with the Police on Compliance with the Law in Model of Procedural Justice and Police Legitimacy

  • The main purpose of the research is to examine the mediating effect of cooperation with the police on compliance with the law in the causal relationship between procedural justice and police legitimacy and criminal deterrence. This research employs a survey questionnaire to evaluate procedural justice, police legitimacy, cooperation with the police, and compliance with the law. The number of subject of the study is 312 citizens residing in Daegu metropolitan city and some cities of Gyeongsangbuk-do province. The study employs Structural Equation Model by using AMOS 24 to analyze the mediating effect of cooperation with the police on compliance with the law. As the result of analysis, the mediating effect of cooperation with the police on compliance with the law is statistically significant at the level 0.01. The key findings of this study is that in the community-based policing, cooperation with the police and compliance with the law are very important determinants in controlling and deterring crimes and the police need to reinforce a cooperative relationship with residents to reduce crimes through strengthening the willingness of compliance with the law.

  • The main subject of year 2016 Davos forum was "The 4th Industrial Revolution." Recently, interests and investment in drone market, so called industrial revolution in the sky is growing in many countries around the world. Before, drone was used for military purpose such as reconnaissance or attacking but today, it is used in various private sectors such as unmanned delivery service, agriculture, leisure activities, etc. Presently, many major countries in the world are already involved in the 'war without gunfire' to be dominant in this drone industry. Korean government also has announced an extreme relaxation of regulations for growing drone industry by opening a conference with Ministers related to economics. During the conference, business scope of drone which was limited to agriculture, photographing, and observation was expanded to all the fields except for cases hindering national safety and security. In terms of shooting purpose drone its process of receiving approval for flight and shooting is simplified to online registration. What is more, drone delivery service will be allowed in island areas such as Goheung, Yeongwol, etc from first term of year 2017. Finding the way to apply drone in criminal investigation is also speeding up. Recently, Public Safety Policy Research Center in Korean National Police University has inquired for research service and its result will be out around November. Likewise, although more and stronger foundation for supporting drone industry is made but there are still, some opinions saying that we should take a careful approach in consideration to the side effect such as abuse in crime. One may also try terror by placing a dangerous substance. If drone falls, it may hurt any civilians. Moreover, if shopping purpose drone is hacked, it may result in violation of privacy. Compared to America, Europe, and China, we are at the very beginning stage of drone industry and it is necessary to reorganize legal issues to grow this industry. This can be thought from two perspectives; first, the growth of drone industry is blocked by difficult regulations on Aviation Law and Radio Regulation Law. The second issue is the safety and privacy that are required for operating drone. For the advanced technologies to make human life more profitable, more active and proactive actions are required by criminal law side. In preparation to the second mechanical era where man and machines should go together, I hope that responsible preparation is required in all fields including the criminal law.

The Trend of Internet Related Crimes and their Solution (Internet 관련 범죄(犯罪)의 동향(動向)과 그 대책(對策))

  • Internet related crimes are a crime which is inter-related with high specialization ${\cdot}$ technicality ${\cdot}$ leakage of information ${\cdot}$ intellectual-offence and deviant behavior. Without the accurate countermeasure, we can't achieve the desired end. So we should find out multilateral and general measure. Always crimes go in advance of the measure, so the counter measures against, computer crime can not be final. Nevertheless, we can't be careless in making the measure, but we should always consider a counter measure. 1995. 12. 29. our country revised criminal law and consolidated direct provisions, especially on the computer-hacking. But, inspite of the revision, especially on the computer-hacking. But, inspite of the revision, we have many problems'. So, first of all, through the positive and empirical study, we should revise criminal law and computer crime related provisions systematically. As the aspects and techniques of internet related crimes are always changing with the development of computer technology, there will be many problems with principle of legality, when we apply the existing abstract provisions to the new crime. We can not be lazy in studying the emerging internet related crimes and taking concrete shape of the provision. And it will be a big help to that desirable to import the foreign provision without consideration of our reality. Without the positive and empirical study on internet related crimes, sometimes important crime will be out of reach of the punishment. Due to these day's development of computer and technology of communication, the personal computers are widely supplied and especially PC communication and exchange of the informations became the most important function. With the advent of internet, new aspects of crimes are appearing. Up to now, the fraud by using the computer or the interference in the execution of duty by the illegal operation of computer was the leading aspects of computer crime, but nowadays with the advent of internet, database crime or network crime like the computer hacking became the important aspects of internet related crimes. These new aspects of internet related crimes are defusing into domains of traditional crimes. Nevertheless to follow and punish the acts on the internet is not technically easy, and as it is emerging international shape, to settle it by international law is not that easy. Harmful acts in the information-oriented society are very diverse in kinds and aspects, and it is difficult to enumerate. The point is that among the new acts in the information-oriented society we should decide which acts are to be punished and which acts are not to be punished. It is needless to say that the criminal law should be the last resort. But owing to the characters of the characteristics of the information-oriented society, when the traditional standards can be applied, the question of what is the basis and how it can be applied in a concrete way is not settled. And if it cannot be applied, how can we make new standard is also an unsettled question.

Usefulness of Data Mining in Criminal Investigation (데이터 마이닝의 범죄수사 적용 가능성)

  • Data mining is an information extraction activity to discover hidden facts contained in databases. Using a combination of machine learning, statistical analysis, modeling techniques and database technology, data mining finds patterns and subtle relationships in data and infers rules that allow the prediction of future results. Typical applications include market segmentation, customer profiling, fraud detection, evaluation of retail promotions, and credit risk analysis. Law enforcement agencies deal with mass data to investigate the crime and its amount is increasing due to the development of processing the data by using computer. Now new challenge to discover knowledge in that data is confronted to us. It can be applied in criminal investigation to find offenders by analysis of complex and relational data structures and free texts using their criminal records or statement texts. This study was aimed to evaluate possibile application of data mining and its limitation in practical criminal investigation. Clustering of the criminal cases will be possible in habitual crimes such as fraud and burglary when using data mining to identify the crime pattern. Neural network modelling, one of tools in data mining, can be applied to differentiating suspect's photograph or handwriting with that of convict or criminal profiling. A case study of in practical insurance fraud showed that data mining was useful in organized crimes such as gang, terrorism and money laundering. But the products of data mining in criminal investigation should be cautious for evaluating because data mining just offer a clue instead of conclusion. The legal regulation is needed to control the abuse of law enforcement agencies and to protect personal privacy or human rights.

The Possibility with Other Ways to Protect an Unborn Child in Terms of Illegal Abortion in Crown Law (분만 전 태아에 대한 낙태죄 이외의 형법상 보호가능성 - 대법원 20007.6.29. 2005도3832에 대한 평석 -)

  • Current crown law punishes crime related to unborn child with abortion crime. So we might think that any infringement on unborn child is pretty well protected. But, in terms of illegal abortion, a charge of injuring person and homicide, there are lots blind spots in punishing criminals. Especially, there are numerous unclear cases in illegal abortion. If a doctor killed an unborn child by accident in medical operations, we can't punish him because it was an accident. There still exist controversial cases such as, if an unborn child was somehow damaged and was dead after birth, or was born with disabilities, how are we supposed to punish that? Recently, in a case where a doctor left alone a mother who had a baby and the baby died, our Supreme Court of Korea (Supreme Court of Korea 2007.6.29 2005do 3832) had given a verdict of "not guilty". It looked like they were very fair with current crime law. But, we want this case to be investigated if there weren't any logical contradictions as well as concurrent translation within Constitution Law.
