블랙컨슈머행동이 이직의도에 미치는 영향 -심리적 계약위반의 매개효과- (The Effect of Black Consumer Behavior on the Intention of Turnover: Focusing on the Mediation Effect of Psychological Contract Violation)

  • 본 연구는 블랙컨슈머행동이 조직구성원에게 미치는 부정적 효과를 실증적으로 분석하기 위하여 블랙컨슈머행동이 이직의도에 미치는 영향과 심리적 계약위반의 매개효과를 분석하였다. Baron & Kenny(1986)의 매개효과 검증절차에 따른 분석 결과 블랙컨슈머행동의 상습성, 기만성, 과도성은 이직의도에 유의한 정(+)의 영향을 미친다는 사실을 발견했다. 그리고 기만성과 과도성이 이직의도에 미치는 영향에 대하여 심리적 계약위반의 매개효과가 존재한다는 결과를 통해 심리적 계약위반에 대한 지각을 감소시키는 노력을 통해 이직의도를 낮출 수 있음을 밝혔다. 실증분석 결과를 바탕으로 조직구성원의 이직의도를 줄이기 위한 블랙컨슈머 접근 금지 정책이나 감정노동 수당 등의 보상시스템 등의 대책이 필요함을 제시한다. 본 연구는 고객의 행동과 조직구성원의 행동의 관계를 실증적으로 분석한다.

An Activation Plan of Electronic Contract Real Estate

  • In the 21st century knowledge and information society, Electronic Contracts made with the intention of electronic computer information networks are emerging as a new legal problem which can not be solved in the conventional legal system governing contracts. In other words, the indicator's decision determines the effect and formation of the contracts in the face-to-face or written contracts but electronic decision through computer information network is established the working process of electronic signals-electronic contracts are not only difficult to separate the decision-making process but questioned to be solved by the theory of the general legal action. Ministry of Transportation is scheduled to introduce real estate sales and lease contract using a variety of electronic devices such as computer, tablet PC, smart phones and so on without a paper contract. This system is conducted to global expansion of Seoul in demonstration zone on May 8, 2016 and will be implemented nationwide in the second half of 2017. Electronics contract Real estate has some benefits because made by linking electronic contract system and the electronic registration system - the economic effects discounts on various kinds of fees, the prevention from real estate fraud beforehand and the solution to the complexity of the process the seller and the buyer visits The Real estate agency. However, it has some problem- the disorder in the real estate contract market, the occurrence of the real estate agency accident and the author of the electronic real estate contracts have limited only to realtor. In this paper, I suggest the activation plan to search for establishment and effect of electronic contracts and declaration of intention in electronic depending on the Electronic Contract Real Estate system.

계약의 반석과 법의 적용 (Construction of Contract and Application of Law)

  • When the breach of contract is at issue between the contracting parties, the decision of the contents of obligation has an important meaning. The contents of obligation is decided by the construction of cont-ract. Therefore, the construction of contract has very important meaning for the decision of the contents of obligation. And the Civil Law of Korea includes provisions to settle disputes related to contract, and most of these provisions have the nature of voluntary law. And when there is no intention of the contracting parties, or it is not clear, the voluntary law comes into application(Civil code art. 105). Ultimately, voluntary law not only becomes the standard of the construction of the contract, but also it is applied as the law to settle dispute. Thus, it needs to clear what is the relation between the construc-tion of contract and the application of law. Therefore, this paper aims to clarify the relationship between the construction of contract and the appli-cation of law.

  • 본 연구는 파괴적 리더십 중에서도 가장 많은 관심을 받아오고 있는 상사의 비인격적 행위가 부하의 이직의도와 조직몰입에 미치는 부정적 결과를 살펴보았다. 또한 상사의 비인격적 행위와 부하의 이직의도 및 조직몰입 간의 관계를 조직의 심리적 계약 위반과 부하의 자기통제력이 조절하는지를 검증 하였다. 이와 함께 연구 결과를 토대로 본 연구의 시사점, 한계 및 향후 방향에 대해 논의하였다.

  • 본 연구는 최근 구매주문서 발송을 조건으로 한 매도인의 승낙을 주요 이슈로 하는 CISG상 판례가 있어 이를 소개하고 심층 분석한 논문에 해당한다. 이러한 분석을 위해 CISG상 계약의 성립 관련 조항을 청약과 승낙으로 나누어 고찰하고, 특히 이 판례의 주요 이슈가 되고 있는 대응청약과 승낙의 요건 및 연착된 승낙의 인용 관련 조항을 주로 고찰하였다. 이와 더불어 판례의 분석과 CISG상 관련 조항의 분석을 통해 CISG를 준거법으로 하여 국제물품매매거래에 임하는 거래 당사자들이 유의하여야 할 실무적 시사점을 도출하였다.

외식 프랜차이즈 사업의 성과공유활동이 동태적 신뢰를 통해 재계약의도에 미치는 영향 (The Effects of the Benefit-Sharing Activities through Dynamic Trust on Recontract Intention in Foods-Service Franchisers)

  • Purpose - The aim of this study is to investigate the benefit-sharing activities. They affect contract renewal intention between franchisers and franchisees that are linked through a contract with the intention of building their relationship from the level based on dynamic trust. This study will show a new approach on qualitative growth and consolidation of competitive power and may well be able to suggest practical ways to strengthen directions in the field of franchise industries. Research design, data, and methodology - In this study, based on literature review, we separated logistical-supporting activities and non-logistical-supporting activities from benefit-sharing activities. We modeled how benefit-sharing activities influence contract renewal intention of franchisees by dynamic trust. In particular, considering the possibility of trading concepts and characteristics of trust between providers opportunistic behaviors was defined as variables, depending on the situation and dynamic characters reveal their relationship trust concept. That is, dynamic trust having the possibility of changing depending on opportunistic risks and interdependencies by Lewis & Weigert(1985, 2012) was classified into transitional-based trust, calculated based trust, relational-based trust and balance-based on trust. The total of 104 samples from domestic franchisees being with franchisees were collected by using a structural composed questionnaire. Results - The results are as following. Benefit-sharing activities in logistical supporting activities appeared to affect the multidimensional concept of transitional trust, calculated based on trust, relationship-based trust and balance based on trust dynamic trust with all-defined impact. Non-logistical supporting activities appeared to affect significantly the positive (+) to the dynamic trust concept except transitional trust. Lewis & Weigert(1985; 2012) have proposed a dynamic confidence calculated from relations within-based trust relationship based on trust appears to affect the significant positive (+) to the balance-based confidence transactions confidence mechanism of the system side in the verified relationship. Finally, a relationship based on trust and confidence in the balance based on the Influence of dynamic renewed confidence showed significantly affect the positive(+). In particular, the balance based trust showed the acts as a mediating factors between relational trust and confidence and renew calculated. Conclusion - From the above these results, the significance from this study is as following. First, the proposed activity is to share and validate the approach by identifying the potential in the relationship from the contract with building dynamic trust, and one of the ways from the franchise headquarters and affiliated merchants mutual growth through win-win cooperation in sharing activities. Next, the dynamic segmentation confidence to suggest the possibility can be broken down over the validity and reliability test for each concept. In addition, by identifying the relationship between the dynamic level of confidence granular multi-dimensional concept, to determine the level of trust with a dynamic relationship between risk and interdependencies can be possible in franchise industries. In order to maintain and develop their mutual relationship, franchise industries should propose confidence-building steps to promote their quality improvement.

매출 공유 계약의 공급망 품질 개선 효과 (Effect of a Revenue-Sharing Contract on Quality Enhancement in a Supply Chain)

  • This study investigates a buyer-supplier supply chain, in which a buyer delegates the production process to a supplier as in many practices. The consumer's buying intention and overall supply chain performance are affected not only by the buyer's decision on sales price but also by the supplier's decision on product quality. Therefore, the buyer has a motivation to control the supplier's quality investment. Among various incentive schemes that the buyer can adopt in practice, we consider a revenue-sharing contract and investigate its unique characteristics. By comparison with a typical wholesale price contract, we reveal that the revenue-sharing contract can enhance supply chain's overall performance, including quality, demand, and profits of not only overall supply chain but also each player. We contribute to the academia and the supply chain practice by providing important guidelines in adopting incentive schemes and effectively managing product quality in a supply chain.

외식 프랜차이즈 가맹본부 지원서비스와 재계약 의도 간의 관계품질의 매개효과에 관한 연구 (The Mediating Effects on Relationship Quality Between Support Services of Franchisor and Re-Contract Intention in Food Service Franchise)

  • 본 연구는 외식 프랜차이즈 가맹본부의 지원서비스와 재계약 의도 간의 관계품질이 매개역할을 하는지와 이들 변수 간에 유의한 영향을 줄 수 있는지를 검증하였다. 이러한 연구를 위하여 가맹본부의 지원서비스를 개점 전 지원서비스와 개점 후 지원서비스로 구분하였으며, 관계품질을 만족, 신뢰, 몰입으로 세분화하고 재계약 의도를 성과변수로 이용하였다. 이들 간의 관계분석을 위하여 구조방정식모형을 이용하였다. 본 연구의 가설 검정 결과는 다음과 같이 요약될 수 있다. 첫째, 가설(HI)은 외식 프랜차이즈 가맹본부의 개점 전 지원서비스는 관계품질(신뢰, 몰입)에 정(+)의 영향을 미치는 것으로 나타났다. 즉, 외식 프랜차이즈 가맹본부의 개점 전 지원서비스가 강화될수록 더 나은 관계품질을 기대할 수 있다고 해석된다. 특히 개점 전 지원서비스가 개점 후 지원서비스에 비해서 큰 영향을 미치고 있는 것으로 분석되었다. 둘째, 가설(HII)은 관계품질(만족, 신뢰, 몰입)은 재계약 의도에 정(+)의 영향을 미치는 것으로 나타났다. 특히 가맹본부와 가맹점 간의 신뢰가 중요한 긍정적인 요인으로 작용하는 것으로 분석되었다. 셋째, 가설(HIII)은 가맹본부 지원서비스와 재계약 의도 간에 관계품질이 부분매개역할을 하는 것으로 나타났다. 즉, 가맹본부의 지원서비스가 재계약 의도에 직접적으로 미치는 영향은 통계적으로 유의하지 않았으며 관계품질의 매개변수 중에서 신뢰에 의한 정보교류 및 상호소통이 영향을 미치는 것으로 분석되어 가맹본부와 가맹점 간의 관계품질(신뢰, 몰입)의 중요성이 입증되었다. 본 연구 결과, 외식 프랜차이즈 가맹본부가 가맹점에 대한 관계품질을 어떻게 적극적으로 대처하는 정도에 따라 재계약 의도에 영향을 미치는 것으로 확인되었다. 이러한 연구결과에 대한 실천은 상호 소통을 통한 가맹본부의 적극적인 프로그램개발 및 개선을 통해서 이루어질 수 있으며, 정부의 프랜차이즈 환경 및 제도(정책)의 개선이 바람직한 방향으로 외식 프랜차이즈가 성장할 수 있을 것으로 판단된다.

유럽 법제에서 오픈 프라이스 청약의 유효성에 관한 고찰 (A Study on the Validity of Open-price Offer in European Law)

  • I have observed the validity of open-offer from a point of European contract law in comparison with International Trade Law in this paper. Generally we know that an offer is an expression of willingness bo be bound to the contract. In English law if there are no intention it will be considered such as circulation of price lists or catalogues. As for French law these activities could be considered as an offer. However German law is closer to English law as to an offer. A contract which does not ascertained price is open-price terms and it can be applied not only for general commercial contracts but also for franchise or for distributorship agreements especially in Europe. When open-price terms applied to reserve a exclusive right to the contract the validity of contract can be a serious matter between principals. In English law an offer must be sufficiently complete to be capable of acceptaqnce. English law does not require that price terms should be indicated on offer. English law allow a open-price terms in the contract. In French law a contract will be valid in the absense of a price which is either determined or objectively determinable. A price by the market price of similar products is not enough to be valid offer. It should be recognized and accepted objectively by third parties. French law require that price terms should be indicated on offer. Open-price terms are not enough to be an effective offer. However German law shows more flexible than French law. In German law if the price is not fixed in the contract there are four ways to determine it. The seller may determine the price by the time of deliver. By reason of thess backgrounds I have made comparison with European contract law and International trade law on the validity of open-price offer in this paper. It seems that we are not familiar with open-price terms although franchise contract or special terms of contract have been increased in these days. So I hope this paper will be helpful to show a new point of view.

SA study of the Factors of Chinese Franchisor's Re-contract

  • Purpose - The objective of the paper is to explain the factors affecting on the Re-contract intension of franchisor in the uprising Chinese franchise market. Research design, data, methodology - The study conducted a survey on the 400 franchisors data in China from January to July 2012. By AMOS analyzing the data to examine these hypotheses empirically, we can confirm most hypothesis supposed. Results - This study shows that the high management performance and satisfaction of the franchise headquarters has a positive effect on the Re-contract intention of franchise. In the case of large markets such as China, the franchisor's strategy and the role is very important. Conclusions - This study provides franchisors and practitioners, who plan to extend their franchising business abroad into Chinese market, with some practical knowledge. in order to achieve stable profits, the franchise corporation needs to support the operation of the individual franchisee through incentives and standardization of services.
