The Value of the Good Faith of the Occupier for Acquiring the Right of Ownership by Limitation of Possession

  • This scientific article is devoted to the study of the legal significance of such a category of legal status of the purchaser of another's thing, as its good faith. The essence of this phenomenon has been studied, it has been established that the criterion of good faith attaches significant importance to the claims of the participants of these relations for the acquisition or preservation of private property rights. The paper emphasizes that, in addition to the importance of good conscience at the time of possession of another's thing, which gives legal certainty the possibility of registration of the title and is part of the actual composition for the acquisition of property or the right of ancient possession, bona fides also characterizes the behavior of the occupier. In this case, good conscience only has some legal consequences when it is opposed to subjective law. Under such conditions, it acquires direct legal significance, including as a condition for the acquisition and protection of rights. Good faith possession of another's property is an internal indicator of the subject's awareness of a certain property status. This sense, the article assesses this status from the standpoint of the scientific concept of the visibility of law. According to this theory, prescription is also considered as a consequence of the appearance of law, however, because it arises and lasts against the will of the parties and despite their awareness of this fact. Therefore, bona fide continuous and open possession of property as one's own, during the acquisition period, was most significantly associated with the appearance of property. Therefore, the concept of good faith, in the sense of personal perception of real values, is closely related to the principle of protection of the appearance of law, as it is aimed at understanding it by third parties. The paper notes certain differences in the application of the theory of the appearance of the right in the acquisition of property by a bona fide purchaser from an unauthorized alienator and the acquisitive prescription. It is emphasized that such a mechanism must be used in presuming the attitude to the thing as its own, by the holder of movable property. But there should be exceptions to the rule, in particular, if the owner has grounds for vindication of the thing.

  • 1. Purpose This paper was written in order to understand the concept of ${\ulcorner}$DongMuYooGo YakSungGa${\lrcorner}$ (東武遣稿 藥性歌) which was descending as the material of Sasang pharmacology. So we are planning to make use of the fundamental material of the study on the Sasang Medications and Prescriptions. 2. Methods Through comparing each clause of ${\ulcorner}$DongMuYooGo YakSungGa${\lrcorner}$ on all the sasang -records, we understood that concept. 3 Result 1) ${\ulcorner}$DongMuYooGo YakSungGa${\lrcorner}$ of a literary work of DongMu(東武) which contain special elucidative-method of herb-nature has 18 type of YakSungGa which explain each 27 herbs for the Taeeumin, Soyangin and Soeumin. The period of authoship is supposed to the time just before ${\ulcorner}$DongyiSuseBowon Gabobon${\lrcorner}$ (東醫壽世保元 甲午本)(1894, DongMu 58 years old) or middle of fifties(53-57 years old). 2) YakSungGa of ${\ulcorner}$DongMuYooGo${\lrcorner}$ which is published by the BoGunsung(保健省) of North Korea is supposed to close to original type. The main meaning of that is the herb-nature which works on the weakst point of each Sasangin. And then the herbs were classfied by the diseases and symptoms possessing Bomyungjiju(保命之主), the herb's efficacy is explained at the each constitution. 3) The meaning of ${\ulcorner}$DongMuYooGo YakSungGa${\lrcorner}$ is exposure of the opinion of DongMu's early stage that proposed herb-nature which is applied to the principle of Jang(臟) of Sasangin, reason and purpose to enact newly created prescriptios by the constitutional diseases and symptoms, and the compositional principle of newly created prescription. 4) The selection of herbs or cogution of herb-nature of DongMu's pharmacological opinion of his early stage was changed by accumulating clinical experience. So all the newly created prescriptios of ${\ulcorner}$DongyiSuseBowon${\lrcorner}$ could not be explained by only the herb and the herd-nature on ${\ulcorner}$DongMuYooGo YakSungGa${\lrcorner}$. Therefore the purpose of DongMu's YaksungGa is not explaining the symptoms in charge of each herb or classifying the herb by constitution, but offering the principle of composition of prescription of Sasang, from the necessary herb which possess and expand Bomyungjiju to nature of herb which is applied to the constitution for treating all the diseases and sypmtoms by the heavy or light and slow or speedy.

Adherence of Salivary Proteins to Various Orthodontic Brackets (다양한 교정용 브라켓 표면에 부착하는 타액단백질에 관한 연구)

  • The principal aims of this study were to identify the composition of salivary pellicles formed on various orthodontic brackets and to obtain a detailed information about the protein adsorption profiles from whole saliva and two major glandular salivas. Four different types of orthodontic brackets were used. All were upper bicuspid brackets with a $022{\times}028$ slot Roth prescription; stainless steel metal, monocrystalline sapphire, polycrystalline alumina, and plastic brackets. Bracket pelicles were formed by the incubation of orthodontic brackets with whole saliva, submandibular-sublingual saliva, and parotid saliva for 2 hours. The bracket pellicles were extracted and confirmed by employing sodium dodecyl sulfatepolyacrylamide gel electrophoresis, Western transfer methods, and immunodetection. The results showed that low-molecular weight salivary mucin, ${\alpha}-amylase$, secretory IgA (sIgA), acidic proline-rich proteins, and cystatins were attached to all of these brackets regardless of the bracket types. High-molecular weight mucin, which promotes the adhesion of Streptococcus mutans, did not adhere to uy orthodontic brackets. Though the same components were detected in all bracket pellicles, however, the gel profiles showed qualitatively and quantitatively different pellicles, according to the origins of saliva and the bracket types. In particular, the binding of sIgA was more prominent in the pellicles from parotid saliva and the binding of cystatins was prominent in the pellicles from the form plastic brackets. This study indicates that numerous salivary proteins adhere to the orthodontic brackets and these salivary proteins adhere selectively according to bracket types and the types of the saliva.

  • There can be little dissension that the ultimate goal of all physical therapy interventions with the elderly is to restore or maintain the highest level of function possible for the individual. Whenever physical therapists take on this challenge, they assist elders in maintaining their identities as competent adults. Advancing age is associated with profound changes in body composition, including increased fat mass, decreased fat-free mass(particularly muscle), decreased total body water and decreased bone density. Along with these changes in body compositions, and perhaps as a direct result of them, elderly people have lower energy needs, reduced strength and functional capacity and a greatly increased risk for such diseases as noninsulin-dependent diabetes mellitus and osteoporosis. Resistance training is considered a promising intervention for reversing the loss of muscle function and the deterioration of muscle structure that is associated with advanced age. This reversal is thought to result in improvements in functional abilities and health status in the elderly by increasing muscle mass, strength and power and by increasing bone mineral density. In the past couple of decades, many studies have examined the effects of Resistance training on risk factors for age-related diseases or disabilities. We have explored the positive and negative aspects of older adults' participation in resistance training programs. The benefits to older adults are reported to be increased strength, endurance, muscle capacity, and flexibility; more energy; and improved self-image and confidence. The negative aspects include some pain or stiffness and other nonspecific problems. The positive and negative aspects of resistance training are therefore very similar to those in younger populations. Scientific investigations over the past 10 years have demonstrated that resistance training can be safely and successfully implemented in older populations. Even the frail and very sick elderly can benefit and improve their quality of life. Proper design and progression of a resistance training program for older adults is vital to optimal benefits from resistance exercise. The results of data provided by this research on resistance training for health shows that there is enough existing evidence to conclude that resistance training, particularly when incorporated into a comprehensive fitness program, can offer substantial health benefits which can be obtained by persons of all ages. These benefits, including improvements in functional capacity, translate into an improved quality of life.

A Study on A Phase of Denotation Expansion of Oriental Medicine in the late Joseon Dynasty (조선(朝鮮) 후기(後期) 한의학(韓醫學) 외연확대(外延擴大)의 일국면(一局面))

  • In the late Joseon Dynasty, a bulky volume of books, which had rarely been seen, poured out including "Imwongyeongjeji", "Japdongsani", "Songnamjapsik" and "Ohjuyeonmunjaangjeonsango". such sorts of books have a characteristic that an author collected various pieces of information, which were scatter away at that time, in one's own way and compiled them into a book rather than an author's own remarks or ideas. Most authors of such books were known to have made not a few book beside bulky books. Such a trend of the times doubled its revitalization with the influx of that books in a series that were popular especially in the period of Ming State & Ching State in China. The research work on such a trend once showed not a little progress by a few faithful researchers even under the circumstances where they were overwhelmed by the bulkiness of a book in a series itself and its target volume. However, in spite of not a little fruition of such studies, there has been no comments at all on the new factors of change faced by Oriental medicine in the climate of the intellect history in the late Joseon Dynasty. Thus, this study aimed at looking at the significance of medical-history-based studies on this matter on the basis of Park, Jiwon's "Keumryosocho", and Lee, Deokmu's "Iemokgushimseo", and suggesting the further task. The conclusions obtained from the analysis of "Keumryosocho" and "Iemokgusimseo" are as follows: 1.The prescriptions cited from the sorts of writings excluded entirely the medical theories on the principles of prescription, and they are composed of a single-medicine prescription or so, which made it easier even for those who lacked a special knowledge of medicine to use it; in addition, it was easy to get medicinal ingredients in most cases. It's presumed that such a composition of medicinal ingredients had a close relation with the difficulty in the supply of medicinal ingredients, which issue became a serious issue in the late Joseon Dynasty. 2. The prescriptions originating from the sorts of writings sometimes are mixed with the ones whose medical efficiency are doubted. This means the inherence of obstacles to delivering accurate medical knowledge couldn't be avoided because the initial purpose of such sorts of writings lay in popularity than practicality. 3. In spite of such problems, the prescriptions originating from writings seems to have not a few influences on the intellectuals in the late Joseon Dynasty, and it's possible for us to take a glance on the traces of their use of these prescriptions in an actual daily life. This fact is fully confirmed by the contents in the preface of "Keumryosocho" that Park-jiwon personally tried to write a prescription. Moreover, such facts can be also confirmed from the fact that the writings of China or our country are seen quite often among the writings which were incited by Seo, Yugu's "Injeji." Like this, the fact that the information of orthodox medicine and the one originating from general books other than medicine books were integrated at one place is plainly showing a phase of the intellect history in the late Joseon Dynasty deluged with information; because of such a characteristic, we can say that Oriental medicine became plentiful in the aspect of diversity with its expansion of denotation, but Oriental medicine could not but additionally assume the problem of having to distinguish good from bad in the midst of such a situation.

Enhanced Vasorelaxation of Banhabackchulchunma-Tang and Involved Mechanism (반하백출천마탕(半夏白朮天麻湯)의 조성에 따른 혈관이완활성과 기전)

  • This study was designed to potentiate the vasodilation effect of Banhabackchulchunma-Tang(BCT) prescription by change of mixture. Six different BCT compositions were made according to mixture of herbs. The vascular relaxation effects of 6 different BCT compositions were examined on phenylephrine(PE)-precontracted rat thoracic aorta. The BCT-1 composition exerted significant relaxation on phenylephrine- or KCI- contracted rat thoracic aorta. Its elaxation was endothelium- independent in both PE- and KCl-induced contraction. Treatment of glibenclamide or tetraethylammonium(TEA) did not affect the relaxation of BCT-1. Vasorelaxation efficacy of BCT-1 was also not influenced by low (25mM) or high (50mM, 80mM) KCl-induced contraction. Furthermore, the contraction by increasing $Ca^{2+}$ concentrations (0.3-10.0mM) to a $Ca^{2+}$-free high K+ (60mM) was significantly reduced by pretreatment with BCT-1 In addition, the relaxant effects were not inhibited by pretreatment of rat aorta with L-NAME, MB, indomethacin and atropine. These results confirm that BCT-1 may exerts its vasodilation effect by endothelium-independent manner. According to the above results, we suggest that the relaxation effect of BCT-1 is endothelium-independent and is related with block of $Ca^{2+}$ influx via $Ca^{2+}$ channel.

  • 1. Objectives : This paper was written in order to understand the origin and changes of Galgeunhaegi-tang. 2. Methods : We analysis Galgeunhaegi-tang through pathology and new prescription in "Donguibogam(東醫寶鑑)", "Chobongwon(草本卷)", "Gabobon(甲午本)" and "Sinchukbon(辛丑本)" of "Dongyi Suse Bowon". 3. Results and Conclusions : We can find the first origin of Galgeunhaegi-tang in "Sinchukbon(辛丑本)" in "Donguibogam(東醫寶鑑)" which invelves Galgeunhaegi-tang in the categories of pestilence(瘟疫) and Yangmyeonggyeongbyeong(陽明經病). Also, we can find the origin in Jugoeng(朱肱)' Jojung-tang. Seungeumgalgeun-tang in the "Chobongwon(草本卷)" developed by a Galgeunhaegi-tang of "Gabobon(甲午本)", and Galgeunnabokja-tang in the "Chobongwon(草本卷)" developed by a Galgeunhaegi-tang of "Sinchukbon(辛丑本)". It is considered that Galgeunhaegi-tang of "Gabobon(甲午本)" solves heat depression(鬱熱), due to not throwing off, by using Galgeun(葛根) and Daehwang(大黃), and accompanied dryness(燥) by using Hangin(杏仁) and Sanjoin(酸棗仁) which moisten dryness(燥). It is considered that Galgeunhaegi-tang of "Sinchukbon(辛丑本)" solves heat depression(鬱熱) by using Galgeun(葛根) and accompanied dryness(燥) by using Gobon(藁本) which sets free dryness(燥).

  • The result is the followings after investigating composition, dosage and usage of Sagunjatang(四君子湯), Samultang(四物湯), Palmultang(八物湯), Sipjeondaebotang(十全大補湯) in literature by country and Era 1. Sagunjatang has become equal to Panax ginseng(人蔘), Atractylodes japonica(白朮), Poria cocos(복령) each for 2 Jeon(錢), Glycyrrhiza uralensis(甘草) 1 jeon since the Ming Dynasty in China and it is standardized by Panax ginseng, Atractylodes japonica, Poria cocos and Glycyrrhiza uralensis each for 1 Jeon 2 Pun(分) 5 Ri(里) since Dongeuibogam in Korea. 2. Samultang has become equal to Angelica gigas(當歸) and Rehmannia glutinosa(地黃) each three Jeon, Cnidium officinale(川芎) is 1 Jeon 2 Pun or 1 jeon and Paeonia lactiflora(芎藥) 2 Jeon since the Ming Dynasty in China and it is standardized by Angelica gigas, Cnidium officinale, Paeonia lactiflora and Rehmannia glutinosa each for 1 Jeon 2 Pun 5 Ri since Dongeuibogam in Korea. 3. In the case of Palmultang, compositional usage of medicine was different in the Ming Dynastry and the Ching(靑) Dynastry in China. Total dosage was increased and ratio of Angelica gigas and Rehmannia glutinosa was increased comparatively in the Ching Dynasty. All prescription of medicine was consisted of 1 Jeon 2 Pun and specific dosage was presented except Euirimchwalyo(醫林撮要) that dosage was not recorded in Korea. 4. Sipjeondaebotang tended to increase total dosage in the latter part in China. Dosage was mostly used 1 Jeon thus Dongeuibogam but Bangyakhap(方藥合編) used 1 Jeon 5 Pun differentially.

A Study on the Frequencies of Medicinal Herb Mombinations in the Prescriptions of "Wenbingtiaobian(溫病條辨)" ("온병조변(溫病條辨)" 수록(收錄) 처방(處方) 내(內)의 약물(藥物) 조합 빈도(頻度) 연구)

  • Through analyzing the frequencies of medicinal herb combinations in the prescriptions of "Wenbingtiaobian(溫病條辨)", we could understand the characteristics of prescription composition and author's medical thoughts. So we conducted this study that analyze combination of 258 medicinal herbs in 206 prescriptions, and found meaningful combinations of 700. Among these, the most meaningful combinations are the two of 8 herbs. One consists of Glycyrrhiza uralensis Fischer, Platycodon grandiflorum, Lonicera japonica Thunberg, Sojae Semen Praeparatum, Mentha piperascens (Malinv.) Holmes, Forsythia suspensa, Phyllostachys nigra var henonis, Schizonepeta tenuifolia var. japonic, the other consists of Glycyrrhiza uralensis Fischer, Platycodon grandiflorum, Lonicera japonica Thunberg, Mentha piperascens (Malinv.) Holmes, Forsythia suspensa, Arctium lappa, Phyllostachys nigra var henonis, Schizonepeta tenuifolia var. japonica. The former is Yeonkyo-san without Arctium lapp, the letter is Yeonkyo-san without Sojae Semen Praeparatum. It means these combinations are kind of modified Yeonkyo-san which is effective in outthrustting through the exterior with pungent-cool and clearing heat and detoxify. In conclusion, prescriptions of "Wenbingtiaobian(溫病條辨)" involve herbs mostly used to outthrust through the exterior with pungent-cool and clear heat and detoxify. Through this study, we know the author' s one of medical view points on outthrustting through the exterior with pungent-cool and clearing heat and detoxify.
