A Study on the Profiling System in the Aviation Security (항공보안에서의 프로파일링 연구)

  • As intellectual terror threats increase, we feel the limit in coping with those threats and the things we do are placing traditional X-ray machines & ETD and increasing aviation security staffs. In fact, even if air transportation system is the fast and most efficient transportation methods, it is true that there are many inconveniences to endure due to terror threats. In the name of security, even if we make a lot of efforts and time to screen both good-natured passengers, baggage, cargo and suspicious passengers, it is impossible to screen perfectly and it is not an efficient methods. Therefore, we introduce profiling system that reduce the effort to screen good-natured passengers but focus on screening dangerous passengers and baggages. Profiling system strengthens aviation security, using the concept "Selection & Concentration". Israel started to introduce manual profiling system in aviation security, which is interviewing suspicious passengers and it has been used in crime investigation since 1960. And it has been upgraded and diversified to CAPPS(Computer Assisted Passenger Screening Program) and SPOT(Screening Passenger by Observation). So, this theses is to study on the concept & kind of profiling and profiling methods adopted in airlines. Also it presents the method of introduction of profiling system in Korea and the necessity of making law on it.

  • This study is to suggest some developmental policies by analyzing the activities of first aid party in Kwangju and Chonnam regions for two years from Jan. 1, 1991 to the end of December, 1995. First, the residents in Kwangju and Chonnam regions have the sufficient benefits of emergency medical center, but it will be desirable that general hospital should be established and managed in Kohung peninsula which forms the wide island area far away from big cities. Second, the classification of the degree of severe case in the field by rescue members should be strengthened as the means which can reduce the number of patients transferred to the emergency room and the legal method which rescue members can select the medical agency. Third, children less than 10 are most frequent emergent patients and it is due to parent's indifference and children's in sensibility to safety. So the safely education in the course of infant and elementary education should be strengthened and the method which can keep the self safety through the legal system. Fourth, to increase the rate of emergency measure by rescue members, the reasons of fail of emergency treatment are suggested, the treatment results of each rescue member are analyzed every year and it is desirable that the system which can evaluate the personal ability should be introduced. Fifth, the medical accidents occurred in the case of medical act, by rescue members must lake the legal responsibility, but such a problem can he solved with the compensation of insurance system by government. Sixth, to reduce the time required for transfer, traveling service system for the fixed period in beach should be complemented and extended more and service system at ordinary times should be examined at mountains, the area of traffic jams and large special industrial park. Seventh, since service system with one team of two members of 119 rescue party in expressway cannot be mobilized when multiple accidents occur at the same time, it is considered that service system of two teams of four members should be extended. Eighth, first-aid service in expressway is conducted with rescue and emergency treatment by the rescue party at the same time, but the professional rescue lacks and it may result in the injury of patients. Therefore the creation of rescue party in expressway is the urgent problem.

Consideration of Limitations related to the International Comparison of Statistics on Fatal Occupational Injuries per 100,000 Workers (산재 사망십만인률 국제비교와 관련된 한계점 고찰)

  • This study analyzes the differences in definitions and concepts of terms used in the statistical indicators of fatal occupational injuries per 100,000 workers among countries included in the ILOSTAT data explorer. In addition, improvement measures focusing on the limitations in international comparison are proposed. Five countries-the Republic of Korea, Germany, Japan, United Kingdom, United States-- were comparatively analyzed. These countries were selected according to the significance of differences in their definitions of workplace injuries, workers, and compensation insurance, and their reporting systems. Considering these differences before directly comparing statistical indicators of fatal occupational injuries per 100,000 workers among countries is necessary because the range of comparison groups and the definition of fatal occupational injury are different for each country. While one can also compare trends by country, it is necessary to investigate beforehand whether the criteria and methods for processing statistics have changed. Misinterpretation can be minimized by properly understanding the process and limitations of fatal occupational statistical indicators that may differ from country to country.

An Analysis of the Poverty Reduction Effect of Social Security Benefits in Korea (사회보장급여의 빈곤완화효과 분석)

  • Using 2006~2015 Korean Welfare Panel Survey data, this study analyzed the poverty reduction effects of social security benefits. The results show that social security benefits have substantial impacts on reducing the poverty gap. National Basic Livelihood Security, public pensions, and Basic Pension have relatively larger poverty reduction effects. Other benefits such as disability benefits, workers' compensation unemployment insurance, and childcare subsidies have much smaller poverty impacts. Two determining factors of the poverty reduction effect are (1)the amount and (2)the poverty reduction efficiency of social security benefits. With the expansion of the social security system in recent years, the poverty reduction efficiency has decreased in general. Due to a greater increase in the amount of benefits, however, the poverty reduction effect has gradually increased. In order to increase the anti-poverty effect of social security, it is important to find ways to improve efficiency while minimizing the disadvantages of the selectivistic welfare benefits.

Problems and Improvement Directions for Damage Investigation of Aquaculture Products from Natural Disaster (양식수산물 자연재해 피해조사의 문제점과 개선방향 연구)

  • This study aims to determine problems of the damage investigation system of aquaculture products resulting from natural disaster and to deduce improvement plans for such problems. The main problems revealed from this study were as follows: 1) detailed damage investigation is carried out only by one particular organization, 2) for aquaculture insurance subscribers another detailed damage investigation is conducted to reveal the causes of natural disaster by a joint investigator team formed according to a different legislation with a different purpose, 3) damage investigation is usually suffered from lack of labor, budget and time due to the restriction of natural damage to a certain period of season leading to the absence of quick reaction capability for irresistible natural disasters, and 4) there are no specified procedures and protocols for deciphering causes of a natural demage. The improvement plans to find solutions for such problems are as follows: 1) for the investigation, the object, method and role of the investigation organization should be clarified by improving the present legislation, 2) investigation methods for determining the demage causes should be systematized by making a manual to minimize disputes, and 3) supports for the investigation organization should be institutionalized to guarantee sufficient budget and manpower. Under the present circumstance with continuous natural damages, smooth procedures of damage compensation would lead to the management stability of aquaculture farms.

Trends of Industrial Injuries among Long-Term Health Care Workers in Korea (한국 요양보호사 산업재해의 연도별 변화추이)

  • Objectives: To investigate the trends of industrial injuries among long-term health care workers in Korea Methods: T7866 injuries were selected from the total industrial injuries approved by the Industrial Accident Compensation Insurance Act(Occupational Safety and Health Act) among long-term health care workers between 2007 and 2016 in Korea. We analyzied the trends of industrial injuries according to work process, occurrence type, and causes. Results: The industrial injuries among long-term health care workers increased since 2012. The mostly occurred area for industrial injuries were low back areas, which is related that the most serious industrial injuries occurred when the one long-term healthcare worker lift manually the recipient, from bed(ondol, Korean floor heating system) to a wheelchair, bed to bath bed, and wheelchair to bath chair. In addition to this, lack of workforce, increased work intensity due to overwork contributed the increasing of occupational injury. Conclusions: This study suggests that the main causes of industrial injuries were Lack of facilities and equipment for small private long-term care institutions, The physical load that goes into lifting the recipient directly, work intensity such as excessive workload and increased work speed. We suggest that the social publicization of long-term care service for the elderly, avoiding ways to lift recipients directly, introducing lifting machines as well as improving working methods, and reducing the workload of caregivers are required.

Study on Proactive Approach against a New Large-Scale Crisis of the Aviation and Tourism Industry such as COVID-19

  • In the face of the unprecedented crisis of coronavirus disease (COVID-19), the aviation and tourism industry fell without help. The bigger problem is that a crisis like COVID-19 can always come back. A new variant of the virus that is more powerful than COVID-19 may emerge, and another crisis such as a massive war may come. In addition, there may be an unexpected large-scale crisis that could shake the survival of the aviation and tourism industry in place. At that time, the aviation and tourism industry should not be pushed into a survival crisis defenselessly. Taking the experience of the crisis caused by COVID-19 as a crucial lesson, sufficient protection measures should be prepared in advance, and within the protection measures, the overall capabilities of the aviation and tourism industry should be preserved, and preparation should be made for the aftermath of the crisis. There is a need to establish a support system in which financial resources that can be used in crisis situation can be secured in advance, and various support measures can be implemented as effectively as possible by using the secured financial resources. Regarding the preparation for financial resources, various fundraising, insurance, and compensation for losses by the state or local government may be considered as a priority, and in addition, there is a need to continuously consider ways to prepare additional financial resources. On the other hand, in terms of system construction, establishment of the system inside the aviation and tourism industry may need to be considered first, but the improvement of related laws and systems needs to be more actively discussed and related legislation needs to be actively promoted.

Occupational Diseases among Health Workers (보건업 종사자의 업무상 질병)

  • Objectives: Occupational diseases that occur due to or aggravated by work have commonly been recognized in the manufacturing industry, but there are now more incidences happening in the service industry due to changes in the industrial structure. Health workers are exposed to direct factors and various other causes of occupational disease at work, such as physical, chemical, biological, and psyco-social factors. This study aims to identify work-related diseases affecting health workers that are recognized as occupational diseases. Methods: The research is based on the data of workers whose diseases were accepted as work-related by the Industrial Accidents Compensation Insurance, and filed by the Korean Occupational Safety and Health Agency. Amongst the approved claims during 2011 to 2015, we focused on healthcare workers and health-related workers of the Korean Standard Classification of Occupations. Descriptive statistics were performed. Results: The number of health workers(HWs) with approved work-related disease was 1,707 over 5 years. The number of healthcare workers(HCWs) excluding caregivers was 370 (21.7%) and of health-related workers (HRWs) it was 736 (43.1%). Out of HWs who were approved for their illnesses, females were 80% of HCWs and 88% of HRWs. The most common occupational disease in HWs was musculoskeletal diseases, while that of nurses was infectious disease. Conclusions: HWs are exposed to various risks from their profession and are affected by occupational diseases. It is necessary to focus on this issue and provide preventive measures.

The Relationship between Hospital Selection by Employer and Disabilities in Occupational Accidents in Korea

  • Background; In the event of an industrial accident, the appropriate choice of hospital is important for worker health and prognosis. This study investigates whether the choice of hospital by the employer in the case of industrial accidents affects the prognosis of injured employees. Methods; Data from the 2018 Panel Study of Workers' Compensation Insurance in Korea were used in an unmatched case-controlled study. The exposure variable is "hospital selection by an employer," and the outcome variable is 'worker's disability." Odds ratios (ORs) were estimated by modified Poisson regression and adjusted for age, gender, underlying disease, injury severity, and workplace size and stratified by industrial classification. The group at increased risk was analyzed and stratified by age, gender, and area. Results; In the construction industry, hospital selection by the employer was significantly associated with increased risk of disability (adjusted OR 1.26; 95% confidence interval [CI]; 1.20-1.32) and severe disability (adjusted OR 1.38; 95% CI; 1.08-1.76) among the injured. Female and younger workers not living in the Seoul capital area were more at risk of disability and severe disability than those living in the Seoul capital area. Conclusions; Hospital selection by employers affects the prognosis of workers injured in an industrial accident. For protecting workers' health and safety, workplace emergency medical systems should be improved, and the selection of appropriate hospitals to supply treatment should be reviewed.

Review of 2015 Major Medical Decisions (2015년 주요 의료판결 분석)

  • There were also various decisions made in medical area in 2015. In the case that an inmate in a sanatorium was injured due to the reason which can be attributable to the sanatorium and the social welfare foundation that operates the sanatorium request treatment of the patient, the court set the standard of fixation of a party in medical contract. In the case that the family of the patient who was declared brain dead required withdrawal of meaningless life sustaining treatment but the hospital rejected and continued the treatment, the court made a decision regarding chargeable fee for such treatment. When it comes to the eye brightening operation which received measure of suspension from the Ministry of Health and Welfare for the first time in February, 2011, because of uncertainty of its safety, the court did not accept the illegality of such operation itself, however, ordered compensation of the whole damage based on the violation of liability for explanation, which is the omission of explanation about the fact that the cost-effectiveness is not sure as it is still in clinical test stage. There were numerous cases that courts actively acknowledged malpractices; in the cases of paresis syndrome after back surgery, quite a few malpractices during the surgery were acknowledged by the court and in the case of nosocomial infection, hospital's negligence to cause such nosocomial infection was acknowledged by the court. There was a decision which acknowledged malpractice by distinguishing the duty of installation of emergency equipment according to the Emergency Medical Service Act and duty of emergency measure in emergency situations, and a decision which acknowledged negligence of a hospital if the hospital did not take appropriate measures, although it was a very rare disease. In connection with the scope of compensation for damage, there were decisions which comply with substantive truth such as; a court applied different labor ability loss rate as the labor ability loss rate decreased after result of reappraisal of physical ability in appeal compared to the one in the first trial, and a court acknowledged lower labor ability loss rate than the result of appraisal of physical ability considering the condition of a patient, etc. In the event of any damage caused by malpractice, in regard to whether there is a limitation on liability in fee charge after such medical malpractice, the court rejected the hospital's claim for setoff saying that if the hospital only continued treatments to cure the patient or prevent aggravation of disease, the hospital cannot charge Medical bills to the patient. In regard to the provision of the Medical Law that prohibit medical advertisement which was not reviewed preliminarily and punish the violation of such, a decision of unconstitutionality was made as it is a precensorship by an administrative agency as the deliberative bodies such as Korean Medical Association, etc. cannot be denied to be considered as administrative bodies. When it comes to the issue whether PRP treatment, which is commonly performed clinically, should be considered as legally determined uninsured treatment, the court made it clear that legally determined uninsured treatment should not be decided by theoretical possibility or actual implementation but should be acknowledged its medical safety and effectiveness and included in medical care or legally determined uninsured treatment. Moreover, court acknowledged the illegality of investigation method or process in the administrative litigation regarding evaluation of suitability of sanatorium, however, denied the compensation liability or restitution of unjust enrichment of the Health Insurance Review & Assessment Service and the National Health Insurance Corporation as the evaluation agents did not cause such violation intentionally or negligently. We hope there will be more decisions which are closer to substantive truth through clear legal principles in respect of variously arisen issues in the future.
