미국 자동차보험에 있어서 무과실보험의 중재에 관한 고찰 - 미국 뉴욕주를 중심으로 - (A Study on No-Fault Arbitration in U.S.'s Automobile Insurance - Focus on the Case of New York State -)

  • No-fault automobile insurance system is a statutory scheme to provide automobile accident victims with compensation for certain expenses arising from personal injuries occurring in car accidents. New York State has enacted No-Fault Law to ensure that the injured in automobile accidents be paid rapidly by their own insurance company for medical expenses, lost earnings regardless of fault, replacing common law system of reparation for personal injuries under tort law. Its primary purpose is to facilitate compensation without the need to exhaust time-consuming litigation over establishing the existence of fault and the extent of damages. No-Fault Law allows arbitration as a method for settling the no-fault insurance disputes. No-fault arbitration, however, differs in a significant way from general arbitration system. First, No-Fault Law provides the parties with the option to submit any dispute involving no-fault automobile insurance to arbitration. Second, no-fault arbitration attempts to speed its procedure incorporating various methods. Third, the parties are required to seek review of arbitral awards by master arbitrator prior to seeking court's review. Fourth, the parties have right to bring de novo action in court if master arbitrator's award exceeds $5,000. Given the current state of law in Korea, it may not be easy to introduce no-fault arbitration system into Korea in the context of automobile insurance disputes settlement as its law has a long-established reparation system based on tort liability and no-fault arbitration system has its own features that differ from general arbitration system. Nonetheless, it could be suggested that no-fault arbitration be introduced in other fields which require speedy dispute resolution and a third party's decision to settle the disputes. The optional right of submitting disputes to arbitration as provided by No-Fault Law of New York State may offer a ground to supprot the effectiveness of an optional arbitration agreement.

  • Changwon City has the second highest accident rate with 79.6 according to the city bus accident rate. In fact, 250,000 people use the city bus a day in Changwon, The number of accidents is increasing gradually. In addition, a recent fire accident occurred in the engine room of a city bus (CNG) in Changwon, which has gradually expanded the public's anxiety. In the case of business vehicles, the government conducts inspections with a short inspection cycle for the purpose of periodic safety inspections, etc., but it is not in the monitoring stage. In the case of city buses, the operation records are monitored using Digital Tacho Graph (DTG). As such, driving records, methods, etc. are continuously monitored, but inspections are conducted every six months to ascertain the safety and performance of automobiles. It is difficult to identify real-time information on automobile safety. Therefore, in this study, individual automobile management solutions are presented through machine learning techniques of inspection results based on driving records or habits by linking DTG data and Vehicle Inspection Management System (VIMS) data for city buses in Changwon from 2019 to 2020.

사고기록장치 자료를 이용한 감속도 산출에 관한 연구 (A Study on the Calculation of Deceleration Using Event Data Recorder Data)

  • 사고기록장치(Event data recorder, EDR)에 기록된 운행정보 중 차량의 사고 이전 속도정보는 사고차량 운전자의 처벌, 가해자·피해자 구분, 사고회피 가능성 등을 결정하는 매우 중요한 요소이다. 또한 EDR 자료를 분석하면 사고차량의 감속도를 분석할 수 있다. 본 연구에서는 교통사고 분석에서 사고차량 운전자의 전방주의의무 이행 여부, 사고회피 가능성 등을 판단하는 주요요소인 정지거리 산출에 적용 가능한 적정 감속도 값을 제시하기 위하여 선행연구의 제동실험 결과와 교통사고차량의 EDR에서 추출한 자료를 분석한 결과를 비교하였다. 선행연구의 ABS 장착차량 제동실험을 분석 결과, 차량의 평균 감속도는 0.79g~0.94g로 나타났다. 또한 비교적 최근에 이루어진 교통안전공단 자동차 안전도평가 제동실험에서는 감속도 값이 0.92g~0.94g로 매우 높게 나타났다. 그리고, 본 연구에서 수행된 EDR 자료 분석을 통해서는 0.55g~0.71g의 감속도 값이 산출되었으며, 선행연구의 제동실험에서 측정된 감속도 값보다 작은 값이 나타났다.

트램사고 방지를 위한 사고유형 분석 및 교차로 제어방안에 대한 고찰 (A Review on Accident Type Analysis and Crossing Control Measures for Tram Accident Prevention)

  • Korea's first tram (so called "tram"), which was commenced the operation on May 4, 1899 of late Joseon Dynasty and run until 1968, played a pivotal role of public transportation. However, tram as new transportation mean is being recognized as traffic congestion problem becomes issue due to geometric automobile increase and reckless urban plan after stoppage of tram service. Tram has an advantage of inexpensive construction cost and eco-friendly means compared to existing and city railway, carrying more passengers rather than existing bus, excellent connectivity of existing transportation because of easy accessible to destination in the city center. Therefore, tram, what is called "Green Rvolution of Public Transportation", has a dreaming of revival and in the process of pushing. We suggest the accident type which might break out in the early stage of tram introduction and preventive measures by surveying the accident cases of tram advanced country, and study the crossing control measures.

Research on improvement of law for invigorating autonomous vehicle

  • The Korean government announced its goal of commercializing autonomous vehicle by year 2020. With such changes, it is expecting to decrease car accident mortality by half. To commercialize autonomous car, not only worries on safety of autonomous vehicle has to be solved but at the same time, institutional system has to be clear to distinguish legal responsibilities in case of accident. This paper will present the legal improvement direction of the introduction of autonomous vehicles as follows. First, it is necessary to re-establish concept of 'driver' institutionally. Second, it is appropriate to focus on Level 3 autonomous vehicle which is about to be commercialized in year 2020 and organize legal responsibility. Third, we should have a clear understanding on how level 3 autonomous vehicle will be commercialized in the future. Fourth, it is necessary to revise The Traffic Law, Act on Special Cases concerning the Settlement of Traffic Accident, and Automobile Accident Compensation Security Law in line with level 3 autonomous vehicle. Fifth, it is necessary to review present car insurance system. Sixth, present Product Liability Law is limited to movable products (Article 2), however, it is necessary to include intangible product which is software. Seventh, we should review on making special law related to autonomous car including civil, criminal, administrative, and insurance perspectives.

한방병원에 입원한 교통사고 환자 500례에 대한 임상적 고찰 (The Clinical Study on 500 Cases with Traffic Accident Patients Admitted in Oriental Medical Hospital)

  • Objectives : The main purpose of this study is to find out the characteristic of patients admitted in the Oriental Medical Hospital due to traffic accident. Methods : 500 inpatients of traffic accident from Jan 1, 2005 to May 31, 2009 were analyzed according to medical charts. Results : The numbers of traffic accident patient in Oriental Medical Hospital in 2008 were bigger than in 2005. Most of patients were cared by western medicine right after accidents and several days later they started searching for oriental medical treatments. Most of the symptoms were not so severe at the beginning of the treatment. The method of the treatment were restricted by automobile insurance limitation in the field of oriental medicine. Conclusions : This study suggested that Oriental medical treatments are effective in traffic accident patients without surgical injury. Further studies are needed for progress report that after traffic accident patients are discharged from the Oriental Medical Hospital.

  • 우리나라의 경제 성장과 도로 환경의 변화를 통해 국내 자동차 시장이 성장하였으나, 이로 인해 교통사고율 또한 증가하였고, 인명 피해가 심각한 수준이다. 이에 따라, 정부에서는 교통사고 데이터를 개방하고 문제를 해결하기 위한 정책을 수립 및 추진 중이다. 본 논문에서는 교통사고 데이터를 이용하여 클래스의 불균형을 해소하고, Hybrid Model 구축을 통한 교통사고 예측을 위해 원본 교통사고 데이터와 Sampling을 수행한 데이터를 학습 데이터로 사용한다. 두 학습데이터에 연관규칙 학습기법인 FP-Growth 알고리즘을 이용하여 교통사고 상해 심각도와 연관된 패턴을 학습한다. 두 학습 데이터의 연관 패턴을 분석을 통해 같은 연관된 패턴을 추출하고 의사결정트리와 다항 로지스틱 회귀분석기법에 연관된 속성에 가중치를 부여하여 융합형 Hybrid Model을 구축하고 교통사고 피해자 상해 심각도를 예측하는 방법에 대해 제안한다.

  • As time goes by, ultrasonic wave is getting important and new technology, which is adapted to ultrasonic wave is used to industry such as home appliance, automobile, and high-tech industry. Especially, ultrasonic wave is used an alarm device whether there are things at the rear of I. It's do important device in automobile system because it can prevent car-accident from inattention of the driver. Actually, there has already been lots of the alarm device. But it's expensive and so difficult to set the device. So almost driver don't set device at their automobile. We focus on these problems. We want to make cheap md easy setting device. Ultrasonic wave sensor emits Ultrasonic-signal at outgoing part and receive part accept the signal. Sensor analyzes the signal and Distance is displayed on LCD of device. The device makes alarm if distance is near from something of rear. The device makes break-system operate to prevent drivers from crashing if distance is so near. This device is portable. So normal deriver can set it easily.

마찰력이 수반된 자동차 충돌의 동역학적 해석 (Dynamic Analysis of Automobile Collisions with Friction)

  • The most commonplace of collisions that directly affect people is that of vehicles. Safety studies have noted a correlation between vehicle occupant injury severity and velocity changes. Methods for estimating collision velocity changes are discussed here. This topic is part of what is referred to as accident reconstruction. Only planar collisions are considered. When a vehicle collides with another, impact dynamics with friction should be considered. This paper presents a general analysis methodology of impact. must dynamics incorporating friction. The presence of friction between sliding contacts during the impact makes the problem difficult since the events such as reverse sliding or sticking, which may occur at different times throughout the impact, must be determined. This paper uses the results of RICSAC experiments for verifying the developed methodology. The analysis and experimental results agree well.

Coil Spring Inspection for Reliability Assurance of Automobile Suspension System using Guided Wave

  • Coil spring of automobile suspension system is very important to safety and dynamics of passenger car and requires a highly advanced quality control during manufacturing processes. Surface cracks on the coil spring rod produced by mechanical machining and heat treatment may cause a severe accident and large cost to the manufacturer. In order to detect surface cracks of the rod, guided wave technique is applied for a fast total volumetric inspection. Pochhammer equation is studied to investigate the dispersion characteristics of the guided wave in the spring rod and optimal wave modes sensitive to the surface crack are selected experimentally to design the experimental arrangement for the generation of guided wave. Rod samples with different size of artificial axial EDM notch on the surface ranging from 50${\mu}{\textrm}{m}$ to 1 mm are examined by guided wave and inspection results discussed.
