The foundation of the arbitration jurisdiction is the arbitration agreement entered into by the parties to a contract. Usually, only the signatory parties to a contract and the disputes arising from a contract that includes an arbitration clause or to which the arbitration clause relates are the ones that can be submitted to arbitration. This article discusses some of the arguments for extending the arbitration clause in complex arbitrations, that is, in those cases where there are more than two parties, more than two contracts or more than two parties and contracts. Particularly, this paper addresses multiple contract arbitration when the contracts are related. One of the arguments used by the arbitral tribunal for the extension of jurisdiction is the existence of a link between the contracts. Additional arguments include implied consent, participation in the negotiation and performance of a contract and good faith. The article also discusses some of the typical cases of linked contracts in many civil law countries, such as subcontracts, third party beneficiaries and standard terms of contracts, from which arbitral jurisdictions problems may arise. Finally, special attention is given to Article 14 of the 2008 Peruvian Arbitration Law as the first provision in an arbitration law in Latin America that extends the arbitration agreement to non-signatory parties using for this a mixed approach.
Using a sample of 107 married couples, this study investigated the influence of self-reported argument-communication behaviors on marital satisfaction. The results were as follows. (a) Wives used more criticism, contempt, and self-assertion during marital arguments than husbands. There were no significant gender differences in the levels of defensiveness, stonewalling, and active listening. (b) Multilevel analyses indicated that marital satisfaction was predicted by the person's own level of self-assertion and stonewalling(i.e., actor effects) and by his or her spouse's level of stonewalling(i.e., partner effect). No other significant actor and partner effects were found. Also, there were no significant gender differences in the sizes of effects. (c) A cluster analysis of both spouses' communication behaviors during marital arguments identified four distinct groups of married couples. : mutual constructive, husband constructive-wife destructive, husband destructive-wife constructive, and mutual destructive. Mutual constructive couples reported the best marital satisfaction.
The current study examined the ability to predict Gottman's four dysfunctional communication behaviors during marital arguments based on the level of surface and core problems in marriage. Core problems were composed of three factors: caring, power, and commitment problems. A self-report questionnaire was administered to 182 married women residing in Busan. The results of multiple regression analyses revealed that a woman's degree of criticism was predicted by surface and caring problems when controlling for the other variables. The degree of contempt was predicted by a commitment problem as well as surface and caring problems. Defensiveness was determined only by a commitment problem, while stonewalling was determined only by a power problem. Overall, these results showed the importance of core problems in understanding the causes of the four dysfunctional communication behaviors - especially contempt - and suggested that additional attention should be given to a commitment problem as a contributor to the expression of contempt and defensiveness.
News shows often deliver crosscutting information to their audiences by inviting commentators from rival political parties. If these news shows foster the formation of informed and balanced views of the audience, mass media could provide countermeasures against political polarization. To test the effect of such news shows, this study conducted an experiment with two variants of a simulated radio talk show. In the partisan scenario, the two guest commentators' affiliations suggested their ideological orientation. In the non-partisan scenario, the commentators had neutral affiliations. We divided participants into two ideology groups, liberals and conservative, and compared each group's evaluation of the commentators in the two scenarios. Two multivariate analysis of variance (MANOVA) tests were conducted to analyze the effect of the perceived ideology of the commentators on respondents' attitudes toward the commentators' arguments depending on their own ideological inclinations. The analyses results did not support the hypothesis that anticipated partisan attitudes towards the commentators' arguments. It was only the liberal respondents who showed statistically significant different attitudes toward commentators' arguments in each of the two scenarios. The findings suggest that such broadcast shows do not automatically trigger partisan message processing and may help the audience to develop informed and balanced opinions. While the current study failed to find conclusive evidence to support the hypotheses, it also found that the perceived ideology of the information source may trigger partisan attitudes for certain types of issues. Future studies with different experiment designs are needed to investigate the issue further.
In certain Asian countries, a third form of human Taenia, also known as the Asian Taenia, has been discovered. This Asian Taenia seems to be an intermediate between Taenia solium and T. saginata since in morphological terms it is similar to T. saginata, yet biologically, as it uses the same intermediate host (pigs) , it is more akin to T. solium. Taenia solium causes human cysticercosis, while T. saginata does not. It is not known whether the Asian taeniid is able to develop to the larval stage in humans or not. The arguments proposed by those authors who consider it unlikely that the Asian Taenia causes human cysticercosis are: (a) its molecular similarities with T. saginata: (b) the absence of cases of human cysticercosis in populations where the Asian adult is highly prevalent; and (c) the unsupporting results derived from an experimental infestation study. These three arguments are debated, although bearing in mind that at present there is still no clear scientific data to support that human cysticercosis can be caused by the Asian Taenia.
Mathematically, a proof is to create a convincing argument through logical reasoning towards a given proposition or a given statement. Mathematics educators have been working diligently to create environments that will assist students to perform proofs. One of such environments is the use of dynamic-geometry-software in the classroom. This paper reports on a case study and intends to probe into students' own thinking, patterns they used in completing certain tasks, and the extent to which they have utilized technology. Their tasks were to explore the shape-to-shape, shape-to-part, and part-to-part interrelationships of geometric objects when dealing with certain geometric problem-solving situations utilizing dissection-motion-operation (DMO).
In this paper, we construct eight infinite families of ternary linear codes associated with double cosets with respect to certain maximal parabolic subgroup of the special orthogonal group $SO^-$(2n, q). Here q is a power of three. Then we obtain four infinite families of recursive formulas for power moments of Kloosterman sums with square arguments and four infinite families of recursive formulas for even power moments of those in terms of the frequencies of weights in the codes. This is done via Pless power moment identity and by utilizing the explicit expressions of exponential sums over those double cosets related to the evaluations of "Gauss sums" for the orthogonal groups $O^-$(2n, q).
The purpose of this study was to reveal controversial issues on Stages of Concern(SoC), which is one of the dimensions of Concerns Based Adoption Model(CBAM). To achieve the purpose, documental analysis was employed. The theoretical framework to analyze literature consisted of three categories including stages, measurements, and applications. Based on the framework, controversial issues on SoC were discussed regarding arguments of CBAM developers and critics. The researchers of this study suggested their own opinions on the issues after thorough examination of CBAM developer's arguments and oppositions against them. Finally, suggestions for further studies on issues of SoC and studies measuring SoC were made.
In this study I investigate two implicit arguments in English middles: discharged argument and event argument. I argue that in middle formation external argument is discharged and event argument is suppressed. The proposal can account for the problems with the previous studies (Williams 1981; Keyser and Reoper 1984: Roberts 1987: Fagan 1988, 1992: Chung 2000). When a middle derives from the corresponding transitive verb, the subject argument is discharged, being an implicit argument. Argument discharge is different from argument suppression in the passives and argument deletion in the ergatives. I also argue that event argument is suppressed in middle formation. Event argument suppression is supported by the following: (i) The transitive verbs are always eventive but the corresponding middles are stative, and (ii) the middles are underlyingly eventive, (iii) the middles are “adorned” by certain manner adverbials.
