A Study on the Laytime and Demurrage Clauses (LD Clauses) in Contracts for the International Sale of Goods (국제물품매매계약에서 정박기간과 체선료조항(LD Clauses)에 관한 연구 - 영국관습법을 중심으로 -)

  • The fact that one of the parties to the sale contract has had to pay demurrage to the shipowner under LD clauses in the charterparty does not of itself mean that he can recover that loss from his sale counter party under the sale contract: the route to such recovery is through express clauses in the sale contract itself. LD clauses in a sale contract stand free and independent of their counterparts in the relevant charterparty. LD clauses in a sale contract should be construed and applied as clauses in sale contracts, not as adjuncts to charterparties. Their interpretation should therefore be coloured not by decisions on laytime and demurrage in charterparties, but by their relationship to the contractual duties of CIF and FOB sellers and buyers. The results discussed here have implications for the drafting of LD clauses in sale contracts. If unwelcome surprises are to be avoided, it seems to advisable to start from the principle: what exactly do traders want or need in LD clauses. They need a clause which covers them against charterparty losses where those losses are the result of dealy caused by the counterparty to the sale contract. The parties to the sale contracts are well advised to prepare LD clauses concentrating on that purpose and bearing in mind the followiing questions. First, should the loading and discharge code in the sale contract appear in traders' or trade associations' standard terms and conditions or should they be left to ad hoc negotiation in contract sheets? Second, should that code be as complete as possible, covering loading or discharge periods or rates, demurrage and despatch, or is it enough for only some of those matters to be covered explicitly, leaving other matters to be governed" as per charterparty"? Third, does the introduction or incorporation of a stipulation for the giving of a notice of readiness make the start of laytime more or less predictable as between seller and buyer? Finally should a loading and discharge code in a sale contract actully be called a "laytime and demmurrage clauses"?

On the Notion of 5 Sentence Patterns in English Grammar Learning Materials (영문법 학습 교재의 5문형 분류 체계)

  • This paper is intended as an investigation of 5 sentence patterns which have exerted a strong influence on the English education in Korea. The 'learning grammar', which is defined as the grammar in learning materials, was compared with 'reference grammar' derived from linguistic grammar with theoretical accuracy and validity. Although the notion of 5 sentence patterns has been assumed to be vestiges of old Japan textbooks, the classification system was originally established in 1929 by C. T. Onions. Particularly, new explanations regarding 'obligatory adjuncts' and 'marked construction' were provided in the learning materials, which could be seen as examples of the reflection of linguistic grammar theories on sentence patterns. If reference grammarbooks and the fruits of linguistic grammar research are used actively, material writers can avoid the errors of grammar description and more correct learning grammar can be taught to advanced learners.

A Role of Serum-Based Neuronal and Glial Markers as Potential Predictors for Distinguishing Severity and Related Outcomes in Traumatic Brain Injury

  • Objective : Optimal treatment decision and estimation of the prognosis in traumatic brain injury (TBI) is currently based on demographic and clinical predictors. But sometimes, there are limitations in these factors. In this study, we analyzed three central nervous system biomarkers in TBI patients, will discuss the roles and clinical applications of biomarkers in TBI. Methods : From July on 2013 to August on 2014, a total of 45 patients were included. The serum was obtained at the time of hospital admission, and biomarkers were extracted with centrifugal process. It was analyzed for the level of S-100 beta (S100B), glial fibrillary acidic protein (GFAP), and ubiquitin carboxy-terminal hydrolase-L1 (UCH-L1). Results : This study included 33 males and 12 females with a mean age of 58.5 (19-84) years. TBI patients were classified into two groups. Group A was severe TBI with Glasgow Coma Scale (GCS) score 3-5 and Group B was mild TBI with GCS score 13-15. The median serum concentration of S100B, GFAP, and UCH-L1 in severe TBI were raised 5.1 fold, 5.5 fold, and 439.1 fold compared to mild injury, respectively. The serum levels of these markers correlated significantly with the injury severity and clinical outcome (p<0.001). Increased level of markers was strongly predicted poor outcomes. Conclusion : S100B, GFAP, and UCH-L1 serum level of were significantly increased in TBI according to severity and associated clinical outcomes. Biomarkers have potential utility as diagnostic, prognostic, and therapeutic adjuncts in the setting of TBI.

The Surface Properties using various separating materials of dental gypsum products (다양한 석고 분리제를 이용한 치과용 석고의 표면 특성에 관한 연구)

  • Gypsum products are used for the preparation of stone casts of oral and maxillofacial structures and as important adjuncts to dental laboratory operations involved in the production of dental prosthesis. Accuracy and dimensional stability over time are properties of concern in fixed prothodontics. Gypsum products used in denstry are a form calcium sulfate hemihydrate and are classified as 1 of 5 types according to International Standard Organization(ISO) 6873. All die materials exhibit some dimensional change during setting, but expansion and contraction during setting and dimensional changes in response to varations in temperature and the water-powder ratio must be minimal. Although numerous investigators have studied the properties of die materials, several products have been introduced recently with manufacturer claims of superior dimensional stalility. The aim of this study was to determine the surface properties using various separating materials of dental gypsum products The results were as follows 1. In the comparison of first and second plaster distances before separation in different separating agent, there was no significant difference except using Trio separating agent. The interface using Trio separating agent forms like to pores. 2. In the comparison of first and second plaster distances after separation in different separating agent, there was significant difference. The interface of plasters using WD-40, Trio and Vaseline was showed some gaps. Each they were measured at average 7.97 $\pm$ 2.07 ${\mu}m$, 63.09 $\pm$ 23.25 ${\mu}m$, 27.59 $\pm$ 4.19 ${\mu}m$. 3. In the comparison of the surface, the surface of control sample(using none seperating agent) showed irregular properties and the surface using Trio and Vaseline become wrinkled. Specially the surface using Vaseline was showed shiny properties. But the surface using MAGIC SEP, Plaster seperating agent, WD-40 showed regular properties.

  • Currently, dental implants have become predictable and reliable adjuncts for oral rehabilitation. Osseointegrated implants can be used to provide rigid orthodontic anchorage and have advantages compared conventional orthodontic anchorage especially when there were edentulous areas and implants were scheduled as a treatment plan. Orthodontic force doesn't cause the bone loss of osseointegrated implants. Implant materials, surgical protocols and healing time before loading follow the conventional treatment protocol. Because the implants, once installed, can't change the location, meticulous treatment planning should be preceded. Further investigations are needed to standardize the treatment protocol.

Narrative Thought and ITS Implication on the Science Education (내러티브 사고의 과학교육적 함의)

  • In this paper, two modes of thought are assumed, which are known as the paradigmatic and the narrative mode of thought by Bruner(1985; 1986). The former leads to well-formed argument, but the latter to good story; each providing distinctive ways of ordering experience, of constructing reality. Though the two are complementary, but not reducible to one another. However modern schooling has focused on the paradigmatic mode. It has come to its peak in science education. Recently some educators began to gaze at the narrative mode in other humanities, but not science. Narrative is commonly considered to be foreign to science. But many scientists are convinced that modern science depends on speculation much more than observation. The speculation is conducted by intrapersonal or interpersonal narrative, which was called "science-making" by Bruner(1996). The purpose of this paper is to introduce the narrative mode of thought compared to paradigmatic mode as the new concepts and to discuss its implications on the science education. Three implications will be suggested. The first holds that science class should improve student's narrative sensibility throughout the live science-making. The second holds that the narrative mode of thought should be used with the support of the paradigmatic mode in science classroom. Exactly narrative interpretations are adjuncts to scientific explanations. The third holds that the evaluation method should be developed for the narrative work in science education.

한국어 부사어의 분류와 분포 제약

  • 문장에서 술어를 수식하는 대표적인 표현은 부사어이다. 부사어는 일반적으로 문장 구성에서 핵심적 역할을 하지 않는 첨가어(adjuncts)이기 때문에 핵심적인 역할을 하는 보충어(complements)에 비해 상대적으로 연구가 덜 이루어진 분야이다. 그렇지만 부사어는 피수식어의 의미를 구체화/한정하는 기능을 하기 때문에 정확한 의사소통을 위해서는 반드시 필요한 요소이며 어순, 호응(concord)등의 통사적 현상과도 밀접한 관련이 있다. 이 연구의 일차적 목적은 이러한 부사어를 통사적, 의미적 기준에 의해 정확하게 분류하고 그들의 분포제약을 밝히는 것이다. 그 다음으로, 부사어와 관련된 통사 현상으로, 부사어와 피수식어의 공 기(co-occurrence)관계 및 부사어와 술어 어미의 호응 관계에 대한 분석을 제공하려고 한다. 부사어는 통사적인 기준과 의미적인 기준으로 분류할 수 있다 (손남익 1995, 김경훈 1996, 임유종 1998). 통사적 기준으로는 단어나 구를 수식하는 성분부사와 문장을 수식하는 문장 부사로 나누는 방법과 위치에 대한 제약이 있느냐 없느냐에 따라 제약부사와 자유부사로 나 누는 방법이 있다. 이 두 통사론적 기준에 의해 분류되는 부사들은 서로 어떤 상관관계를 보이고 있는지 살펴 볼 것이다. 일반적으로 문장부사는 문두에 놓여야 한다는 위치적 제 약 이 있기 때문에 제약부사로 분류된다. 의미적 기준으로 부사어를 분류할 수도 있는데, 시간/ 공간 부사어, 양태/정도 부사어 등으로 나눌 수 있다. 의미적 기준에 의해 분류된 부사어는 통사적 기준에 의해 분류된 것들과는 어떤 상호 관련성을 맺고 있는지 살펴 볼 것이다. 일 반적으로 시간부사와 장소부사는 자유부사에 속하며 양태부사와 정도부사는 제약부사에 속 한다. 부사어와 피수식 요소와의 통사적 공기 관계 및 의미적 관계 그리고 그와 관련된 문 법 현상도 연구의 대상이 된다. 예를 들어, 자유로운 어순을 가진 부사들이지만 “*순이는 빨리 과연 달린다”에서 볼 수 있는 종류의 분포적 특성을 알아 볼것이다 (심재기 1982, 송 철의 1989). 또한 “길이/*길게 빛나다”와 “*길이/길게 드리워졌다”와 같은 대조에서 나타나는 통사, 의미적 기능의 상관 관계 및 제약들의 상호 작용도 살펴 볼 것이다.

Protective effect of Hizikia fusiforme on radiation-induced damage in splenocytes (방사선을 조사한 마우스에서 비장세포에 대한 톳의 보호 작용)

  • The immune system is specifically sensitive to oxidative stress induced by ionizing radiation because of its rapid proliferative activity. For this reason, an instructive immune system is one of the best ways to minimize side effects, such immunodeficiency, of gamma radiation. Over the past few decades, several natural plants with antioxidant and immunomodulatory properties have been identified as adjuncts for nontoxic and successful radiotherapy. Hizikia fusiforme extract (HFE) containing plentiful dietary fiber and fucoidan is known for its instructive antioxidant capacity, immunomodulation abilities, and immune activation. In this study, we determined whether HFE protects radiosensitive immune cells from gamma radiation-induced damage. C57BL/6 mice were irradiated with gamma-ray. The effect of HFE on the ionizing radiation damage of immune cells was then evaluated with an MTT assay, 3H-thymidine incorporation assay, and PI staining. We found that HFE stimulated the proliferation of gamma-ray irradiated immune cells without cytotoxic effects. We also observed that HFE not only decreased DNA damage but also reduced gamma radiation-induced apoptosis of the immune cells. Our results suggest that HFE can protect immune cells from gamma-ray damage and may serve as an effective, non-toxic radioprotective agent.

The effect of two phosphodiesterase inhibitors on bone healing in mandibular fractures (animal study in rats)

  • Objectives: Despite advances in maxillofacial surgery, impaired bone healing remains a concern for surgical teams. Many studies have evaluated the effects of sildenafil and pentoxifylline on bone healing. However, their effects on healing of bone fractures have not been well investigated. This study aimed to assess the effects of the phosphodiesterase inhibitors sildenafil and pentoxifylline on healing of mandibular fractures in rats. Materials and Methods: A total of 60 rats were randomly divided into six groups of 10. Mandibular fracture was induced in all rats. After the surgical procedure, group C1 received saline, group S1 received 10 mg/kg sildenafil and group P1 received 50 mg/kg pentoxifylline. The rats were sacrificed after 1 week. Groups C4, S4, and P4 received pharmaceutical therapy as in groups C1, S1, and P1 but were sacrificed after 4 weeks. The samples then underwent histological analysis. Results: The mean rate of bone healing of mandibular fractures in groups S1 and P1 was significantly higher than in group C1 at 1 week (P<0.001). The mean rate of bone healing of mandibular fractures in group P1 was higher than in group S1 at 1 week (P=0.04). The mean rate of bone healing of mandibular fractures in groups S4 (P=0.001) and P4 (P=0.004) was significantly higher than in group C4 at 4 weeks, but no significant difference was noted in the rate of healing between groups P4 and S4 (P=0.53). Conclusion: Sildenafil and pentoxifylline can be used as adjuncts to enhance bone healing in rats.

Reduction of Body Weight by Capsaicin is Associated with Inhibition of Glycerol-3-Phosphate Dehydrogenase Activity and Stimulation of Uncoupling Protein 2 mRNA Expression in Diet-induced Obese Rats

  • Capsaicin is a pungent component of red pepper, which is widely consumed as food adjuncts. The present study was performed to investigate anti-obesity effects of capsaicin in diet-induced obese rats. Male Sprague-Dawley rats (n=14) were fed with a high-fat diet (Control) or high-fat diet containing 0.016% capsaicin (w/w) (Capsaicin) for 8 weeks. The final body weight and the mass of white adipose tissue were significantly lower in capsaicin supplemented group compared to control. Dietary capsaicin ameliorated lipid profiles with decrease in the plasma concentrations of triglycerides and total cholesterol, and decrease in the levels of total lipids and triglycerides in the liver. Activity of glycerol-3-phosphate dehydrogenase (GPDH), an indicator of triglyceride biosynthesis in white adipose tissue, decreased by 35% in the group supplemented with capsaicin. However, consumption of capsaicin increased the expression of uncoupling protein 2 (UCP2) in white adipose tissue, which is related to energy consumption. Our data suggests that capsaicin may reduce body weight and fat accumulation in high fat diet-induced obese rats. These effects may be mediated, at least partially, by the upregulation of UCP2 gene expression and its ability to inhibit GPDH activity.
