외국의 공적수출신용기관에 관한 연구 - 미국, 프랑스, 일본, 캐나다를 중심으로 - (A Study on the Foreign Export Credit Agency - Focused on the U.S.A., France, Japan, and Canada -)

  • Export Credit Agency(ECA) plays a role of importance in international trade and investment flows. The first ECA, the Export Credits Guarantee Department(ECGD) of the United kingdom, was established in 1919. Its original purpose was to encourage and support exports that would not otherwise have taken. Similar motivations led to the establishment, most of those in operation today. Their traditional role is to support and encourage exports and outward investment by insuring international trade and investment transactions, and in some cases by providing trade finance directly. ECA come in all shapes and sizes, and there in no such thing as a typical ECA model. Most of them insure both political and commercial risks on exports and until the last decade. They operated as government entities or on the account of their government, and many of them have changed and are still changing. This study focuses and analyzes the changes of those four major countries' ECAs, which are the U.S.A.(EXIM), France(COFACE), Japan(JBIC), and Canada(EDC).

한국의 싱글 윈도우 모범 사례를 통해서 본 중국 싱글윈도우의 실태 분석과 제언 (An Analysis and Suggestion for Chinese Single Window based on Korean Single Window)

  • 싱글 윈도우는 무역 촉진의 중요한 부분으로 세계 각국 특히 무역 의존도가 높은 아시아 국가들이 적극적으로 참여하고 있다. 한국은 지난 1990년대 무역자동화를 시작으로 2007년 한국형 싱글윈도우인 uTradeHub를 오픈했고 2010년에는 uTradeHub상의 전자네고시스템을 개발, 인터넷에서도 신용장 네고가 실현되었다. 특히 통관 부분에 국한된 많은 나라들의 싱글윈도우와 달리 한국의 uTraHub는 세계 최초의 웹 기반 싱글 윈도우로 바이어나 셀러를 찾는 단계에서부터 최종 결제까지 인터넷에서 이루어지는 것이 특징이다. 현재까지는 국내에서만 한해 이와 같은 싱글 윈도우서비스가 가능하지만 외국 싱글윈도우와의 연계를 통해 단절없는 싱글 윈도우 서비스를 제공한다는 목표이다. 중국은 싱글윈도우 구축에 있어서 여타 아시아 국가에 비해서 다소 늦게 출발했다. 골든게이트 프로젝트로 시작된 무역 자동화가 E-port 프로젝트를 통해서 전자 통판서비스로 이어졌다. 현재중국에서 싱글윈도우의 주체로 고려되는 대상은 전자통관시스템주체인 '차이나 E포트'와 한국의 KTNET과 유사한 CIECC, 싱글 윈도우를 운영하는 각 지방 정부 등이다. 싱글윈도우의 성공 조건인 적극적인 정부 지원, 법적 기반의 마련, 관련 기관간의 협조, 적절한 기술 조화 등을 고려했을 때 법적 기반이 다소 미흡하긴 하지만 중국은 이미 성공을 위한 요건은 대부분 갖추었다고 볼 수 있다. 중국의 싱글 윈도우를 이끄는 주체로는 경쟁 체제인 지방 정부보다는 중앙 정부의 적극적인 지원을 전제로 해서 기업인 CIECC가 진행하는 형태가 바람직할 것으로 생각한다, 특히 향후 외국 싱글윈도우와의 원활한 연계를 위해서도 기업이 비즈니스 파트너로서 나서는 것이 바람직하다고 분석되어진다.

산업체 유통 GHS MSDS의 영업비밀 적용실태 및 개선방안 연구 (A study on the Application Status to Trade Secret of GHS MSDSs distributed in the Workplaces and its Improvement Measures)

  • Objectives: This study is designed to survey the current status of trade secrets in GHS MSDS circulated in workplaces and indicate problems in the chemical information system. According to the survey results, we suggest management plans including political improvement of the trade secret system for MSDS and technical support to workplaces following enhanced chemical communication. Methods: To review this subject, we selected 153 manufacturers and six importers working in such fields as organic chemical production. We then investigated the retention status of GHS MSDS, application of trade secrets, and the content of trade secret components in MSDSs for mixtures. Results and Conclusions: Within the results, the content of trade secret ingredients was 67.4% (single: 9.0%, mixture: 75.6%). This is an increase compared with the previous results of 45.5% in 2011. Among 59,393 GHS MSDSs, 74.5% had ingredients less than 10% trade secret components, 19.1% had 10-30%, 1.8% had 30-50%, and 4.6% had more than 50%. To settle this issue, we recommend registration or evaluation of trade secrets as implemented in advanced countries. Also, business should be required to undergo regular evaluations of application status for trade secrets in workplace GHS MSDS.

  • As the international business increases among the nations of the world recently, it is an inevitable fact that its claims rise as well. The most reasons of the international business claims have been concentrated upon the unpaid issues. The other reasons are sequently the different interpretation of business contract's conditions, the inferior quality of the goods, the breach of shipping time, the uncertain market-claims and some problems of transportation, the quantity and bad package of the goods. As business transactions grow more complex, it becomes increasingly important to resolve claims as quickly and efficiently as possible. Recognizing the importance of comprehensive policy support for overall international trade and investment of local company in recent years, Korean government has reborn the Korea Insurance Corporation ("K-sure"). K-sure adopted a range of measures to improve management efficiency to strengthen national competitiveness and national economy by promoting oversea trade and investment. Especially, K-sure will be able cover not only export transactions but also import transactions to secure oversea natural resources and commodities vital the national economy. K-sure should be able to continue and expand the existing export insurance programs, support import transactions and lead export-oriented industrialization of Korea as the best trade insurance agency.

전자무역 플랫폼의 기본요건과 운영방안에 관한 연구 (A Study on the Basic Requirements and Operation Plan of E-trade Platform)

  • The rapid development of internet information technology has increased interest in e-Trade these days, but it is not activated greatly up to now. In order to promote e-Trade, it is essential to construct cooperative process such as connecting systems among trade related parties. Building e-Trade platform which is based on the infrastructure of the past trade automatic system is key point of promoting e-Trade. To do this, a study on the basic concept and specific components of e-Trade platform is needed absolutely. At this point of view, after this paper has examined domestic and foreign studies on the fundamental technologies about electronic commerce, it drew several key technologies that could be applied to e-Trade considering the current IT trend. Then it evaluates these technologies according to Technology Reference Model(TRM) of the National Computerization Agency. This will help us to show the operation strategy as well as the concept of future e-Trade platform and its composition. On the basis of the theoretical background, this paper classified NCA's technology model into 6 fields, which are application. data, platform, communication, security and management. Considering the key technologies, e-Trade platform has to be mutually connected and accept international standards such as XML. In the aspect of business side, trade relative agencies' business process as well as trading company's process has to be considered. Therefore, e-Trade platform can be classified into 3 parts which are service, infrastructure and connection. Infrastructure part is compared of circulating and managing system of electronic document, interface and service framework. Connecting service (application service) and additional service (application service) consist of service part. Connecting part is a linking mutual parts and can be divided into B2B service and B20 service. The organization operating this e-trade platform must have few responsibilities and requirements. It needs to positively accept existing infrastructure of trade automatic system and improving the system to complete e-trade platform. It also have to continuously develop new services and possess ability to operate the system for providing proper services to demanders. As a result, private sector that can play a role as TTP(Third Trust Party) is adequate for operating the system. In this case, revising law is necessary to support the responsibility and requirement of private sector.

전자무역을 위한 상역부문의 혁신에 관한 연구 (A Study on the Innovation of Export and Import Conditions for Electronic Trade)

  • The thesis examines the problems for innovation of export and import conditions and shows the various ways of overcoming them. The alternatives of export and import conditions are as follows. First, the government body including customs service should participate on positive lines for the construction of single window and standardization of the required documents. Second, it is required the development of efficient connection system among exporter and importer, customs service, requirement confirmation agency etc. to contribute the simplification of a operation. Therefore this research is intended to improve understanding of changes for innovation and to contribute in support basis, operation structure, legal and institutional side. Practical implications regarding the innovation of export and import conditions for electronic trade are discussed.

'기술유출방지 및 보호지원에 관한 법률'제정에 관한 연구 (Study on the Establishment of the Act on the Prevention and Protection of Technology Leakage)

  • 우리나라도 기술이나 영업비밀이 유출되는 사례가 빈번히 발생하면서 분쟁해결 시스템의 정비도 필요하게 되었다. 첫째, 관련 개별 법률을 제정 시행하면서 다양한 법률이 분산되어 제정 시행되어, 중복성의 문제, 개별 법률 간의 충돌, 포괄성 통합성 연계성 저하의 문제가 되고 있다. "기술유출방지 및 보호지원에 관한 법률"(가칭)체계로 독립적인 법체계가 필요하다. 이렇게 함으로써 현재, 중소기업청, 산업통상자원부, 특허청, 공정거래위원회, 무역위원회, 경찰청, 국정원 등 정부부처별로 분산되어 있는 기술보호지원제도를 제도적으로는 통합화 일원화하되, 기능적으로 분담을 통하여 정책을 추진할 필요성이 있다. 둘째, 특허법상의 '특허심판원', 발명진흥법상 '산업재산권분쟁조정위원회', 산업기술의 유출방지 및 보호에 관한 법률상의 '산업기술분쟁조정위원회', 중소기업기술보호지원에 관한 법률상, '중소기업기술분쟁조정 중재위원회'가 설치되어 있으나, '기술유출방지 및 보호 지원에 관한 법률'(가칭) 통합법을 제정하면서 중소기업청, 혹은 산업통상자원부 산하에 '기술분쟁심판조정위원회'(가칭)로 통폐합 설치 운영 두는 방안이 바람직하다.

중국 중소기업의 전자무역 활용과 성과에 영향을 마치는 요인에 관한 연구 (An Empirical Study on the Factors Affecting the Usage and Performance of E-trade in Chinese SMEs)

  • 본 연구는 중국 중소기업들이 전자무역을 활용하는데 어떤 요인들이 영향을 미치고 전자무역의 경제적 성과에는 어떤 영향을 주는지 실증 분석하는데 중점을 맞추고 있다. 이를 위해 전자무역에 관한 기존 문헌고찰을 통해 전자무역거래의 활용수준 및 성과와 관련하여 영향을 미칠 수 있는 요인들을 크게 기업외부 요인, 기업내부 요인, 관계특성 요인으로 구분하여 연구모형과 가설을 설정한 다음 중국 장강삼각주 소재의 중소기업들을 대상으로 각 요인들이 전자무역 활용 및 성과에 영향을 미치는 정도에 대한 가설들의 유의성을 실증적으로 검증하고자 하였다. 연구 결과 기업외부요인 중에서는 정부유관기관의 지원정도, 기업내부요인 중에서는 CEO의 지원이 전자무역 활용수준에 유의한 영향을 미치는 것으로 나타났으나, 관계특성요인은 전자무역 활용수준에 유의한 영향을 미치지 않는 것으로 나타났다. 그리고 전자무역 활용수준은 전자무역 활용성과에 유의한 영향을 미치는 것으로 나타났다. 이를 토대로 향후 중국 중소기업의 전자무역 활성화를 위한 시사점과 정책방향을 제시하였다.
