동북아국가들의 중재법상 중재판정의 비교법적 고찰 (Comparative Legal Study on the Arbitral Award under Arbitration Laws in Northeast Asian Nations)

  • Northeast Asian economies have achieved high levels of growth due to a stable economic environments and economic policy reforms for free trade. As Northeast Asia has been risen as big bloc in the world and in the future in case free trade agreement could be concluded, trade volume could be increased dramatically. And it is evident that disputes will be increased in Northeast Asian economic bloc. Arbitration must be popular in resolving international commercial disputes in Northeast Asian bloc in order to increase the volume of intra-trade in the bloc. Through arbitration, the parties can have full autonomy and can resolve disputes independently, impartially and without delay. But in order for the parties to make use of arbitration in the bloc, they must be fully aware of the arbitration laws of Northeast Asian nations in view of the similarity and difference of the laws. Therefore, this paper deals with arbitral award in Northeast Asian Nations' arbitration laws in view of comparative law.

  • 동남아의 1천년에 관한 우리의 얘기는 아직도 쌀의 8천년에 관한 아시아의 얘기를 시작조차 못하고 있다. 그러한 서사가 왜 우리의 역사책에는 실리지 않는가? 적어도 동남아에 있어서 역사는 여전히 민족주의를 맴돌고 있다. 따라서 모든 민족은 농민과 전답이 아니라 제왕과 전투가 역사의 주연으로 등장하는 각자의 얘기를 가지고 있다. 그 줄거리는 정치와 민족성이지 농업과 생태학이 아니며, 그 가르침은 갈등과 경쟁이지 협동과 상생이 아니다. 그렇다면 지금도 숨어있는 것은 쌀이 일찍이 만들었고 아직도 좋아하는 지방의 협동과 지역의 보편성이다(O'Connor 2004, 29).

Maritime Transport Services Liberalization: Directions for Northeast Asia

  • Competitive and reliable maritime transport services benefit the economy as a whole, and are key efficiency factors for the production of both goods and services. Although maritime transport sector is very liberalized compared to many other service sectors, certain obstacles must be overcome before full liberalization of the maritime transport can be realized. Particularly, maritime transport services in Northeast Asia are regulated by a complicated and outdated system. To remove these barkers two approaches can be used: a regional trading arrangement approach and a multilateral approach via WTO. However, multilateral efforts are not likely to be successful in achieving any concrete progress towards maritime transport liberalization in the short- to medium-term in Northeast Asia. Consequently, it may be the best to take the following two progressive approaches and to make them work towards liberalization of the maritime transport market: a bilateral approach and a trilateral approach. A gradual process of liberalization would expand the market, help operators achieve economies of scale, promote the international division of labor and specialization, enhance the effective management of shipping services, and promote the long-term interests and welfare of the user by improving service quality and diversifying services. A liberalized and integrated maritime transport market in Northeast Asia should achieve both of these long-run policy objectives by benefiting both the transport service users and the transport service providers. In order to move the maritime transport liberalization programs as quickly as possible, it is desirable to establish a "Regional Maritime Transport Liberalization Committee." We suggest it to be a Tripartite (China, Japan and Korea) Committee initially, which can later expand its membership to include other Northeast Asian countries.

A Strategic Approach for Regional Fisheries Organization Establishment in Northeast Asia

  • This study considers an approach for subregional fisheries organization in Northeast Asia. The fishery resources in the Northeast Asian waters surrounding Korea are among the most productive in the world because of their extremely high biological productivity and the natural features of the sea. However, the fishery resources of the region have long been subject to heavy fishing pressures, and many stocks are now believed to be seriously depleted or even in danger of extinction because of overfishing. To move to a run sustainable fishery in Northeast Asia waters area, cooperative fisheries management between Korea, China and Japan for common resource is probably necessary. Cooperative fisheries management is likely to be more effective in fishery resources management than individual fisheries management by countries. The effects of fisheries management by regional cooperation can be divided into resource management and economical performance. Cooperative fisheries management as RFO will bring satisfactory results. Currently these jurisdictional extensions and resulting disputes over maritime space and resources were thrust upon an already transitional and unstable political environment. However, They have to have a strategic approach for RFO establishment step by step. Cooperative fisheries management using the RFO can mitigate these disputes, and cooperative bilateral fisheries arrangements have been proliferating over the past 10 years and may provide the basis for possible trust-building multilateral agreements.

Land Cover Classification Map of Northeast Asia Using GOCI Data

  • Land cover (LC) is an important factor in socioeconomic and environmental studies. According to various studies, a number of LC maps, including global land cover (GLC) datasets, are made using polar orbit satellite data. Due to the insufficiencies of reference datasets in Northeast Asia, several LC maps display discrepancies in that region. In this paper, we performed a feasibility assessment of LC mapping using Geostationary Ocean Color Imager (GOCI) data over Northeast Asia. To produce the LC map, the GOCI normalized difference vegetation index (NDVI) was used as an input dataset and a level-2 LC map of South Korea was used as a reference dataset to evaluate the LC map. In this paper, 7 LC types(urban, croplands, forest, grasslands, wetlands, barren, and water) were defined to reflect Northeast Asian LC. The LC map was produced via principal component analysis (PCA) with K-means clustering, and a sensitivity analysis was performed. The overall accuracy was calculated to be 77.94%. Furthermore, to assess the accuracy of the LC map not only in South Korea but also in Northeast Asia, 6 GLC datasets (IGBP, UMD, GLC2000, GlobCover2009, MCD12Q1, GlobeLand30) were used as comparison datasets. The accuracy scores for the 6 GLC datasets were calculated to be 59.41%, 56.82%, 60.97%, 51.71%, 70.24%, and 72.80%, respectively. Therefore, the first attempt to produce the LC map using geostationary satellite data is considered to be acceptable.

  • East Asia has played an important role in the economic and social development in the Asian pacific region and in the global arena. In the region the impact of companies centralizing their logistics activities around a few distribution centers has already led some leading ports such as Singapore, Hong Kong to transform and expand their functions and business activities to provide port users with value added logistics services. Other ports in the region also have an important part to play in the total logistics Chain. In these environments, the maritime activities of Jang BoGo, who was the maritime king of the commercial maritime empire in East Asia in the 9th century, give many implications to the international logistics network strategy that Korea has to take in order to become a power of International Logistics. Though the trading and economic environments at that time may be quite different from today, the super-national maritime management pattern that Jang Bo-go, founder of the Northeast Asian maritime trading kingdom devised, gives us many implications in the global trading and economic environments, in the respects of overseas direct investment and international logistics. Accordingly, the paper aims to examine the establishment of hub port in Northeast Asia, modelled after the maritime network management strategy of Jang BoGo.

Research on Construction of the Logistics Legal System in CJK FTA

  • With CJK FTA as a starting point, this paper mainly studied the role of the logistics legal system in promoting marine industrial cooperation, facilitating investment trade, establishing international transport logistics, building marine economy international cooperation demonstration zone and deepening the economic and financial cooperation between China, Japan and Korea, and explored the way to establish an integrated logistics system between China, Japan and Korea to match the e-commerce certification system, online payment system and logistics distribution, thereby gradually promoting economic development and logistics integration in Northeast Asia, improving logistics efficiency, reducing logistics costs and establishing a unified logistics industry standardization system. This will accelerate logistics industry integration in Northeast Asia, build a unified logistics management center in Northeast Asia, and promote a new model of integrated logistics cooperation in Northeast Asia. Therefore, it has a practical and reference significance. In short, the improvement for the logistics legal system in CJK FTA is not the responsibility of a country or several countries. It concerns the development and prosperity for the logistics industry in the three countries and is an inevitable choice to promote the vigorous development of CJK FTA and economic take-off of each country.

  • Recently, Korea is becoming a world-leading country in various industrial fields with it's advanced information technology. In the 20th century, Korea went through a chaotic period from Japanese colonization via the Korean war to IMF because of lack of globalization. Now, we have a mission and the abilities to lead world-wide trends in entire fields of society. This study, comparing the modern healthcare planning trends in Korea, China, Japan and the United States, proposes the Northeast Asia Healthcare Network Plan which Korea leads. United States is the starter of healthcare network, but it's location is too far from Asia and IT is also inferior to the Korean. Japan seems to have no concerns with this healthcare network. And the current China is a rapid growing period and is too much for building its domestic healthcare infra-structure. they still have no concerns with re-structuring of healthcare system and facilities. Because of these reasons, I think Korea should have to lead Northeast Asia Healthcare network.

A Suggestion for the Strategic Choice of Seoul to be a Network Center in Northeast Asia

  • The East Asian Region has experienced remarkable economic growth and transformation of interurban networking over the past three decades, and urban competiti veness for a networking hub in this region has become a critical issue confronting cities. Competitiveness of the Seoul capital region for a networking hub in Northeast Asia is outstripped by other competing cities in East Asia, notwithstanding its geo-politically and geo-economically advantageous location in this region. In this paper, we aim to appraise the Seoul capital region's competitiveness in terms of logistics distribution, financial function and logistics distribution, financial function and agglomeration of transnational corporations (especially of RHOs and other managerial functions), and to advance the networking strategies of the region for a Northeast Asia hyb. As a result of analysis, we suggest that the Seoul capital region be developed as a Northeast Asian center for regional headquarters or leading global corporations and financial services for being a strategic nodal point in Northeast Asia in the 21st century. A recent survey shows that where to locate an RHQ is influenced by various factors, such as potential market and manufacturing site in the city's hinterland, quality of life, such things as culture, health, safety, education, a well-educated, English-speaking population, reliable air transport, state-of-the-art communications, and an active policy to offer foreign companies generous incentives. The Seoul capital region, which is located at a strategic nodal point advantageous as a springboard for its Northeast Asian hinterland, cannot meet the other conditions mentioned above. To overcome these drawbacks in attracting transnational capital and to create competitiveness as a strategic hub of RHQs in Northeast Asia, it is urgent to initiate a structural reform of the Korean economy, politics, and overall society, to minimize the regulation of FDI, and to provide various incentives for foreign investment. Moreover, we propose the construction of an 'International Business Town' in the Seoul capital region, as a medium to intermediate these strategies and to shape them in a spatial scale. The projected 'International Business Town(IBT)' will be a 'free city' open to international business in which liberal economic activities are guaranteed by special legislation and administration, infrastructures needed for international and improved accessibility to the airport are furnished, and the preference of foreign high-income investors for cultural and living environment are satisfactorily met. IBT is conspicuously differentiated from a raft of other cities' incentives in that it combines deregulation and incentive programs to attract the investment of transnational capital, with a spatial program of offering an urban environment preferred by the high-income investors for cultural and living environment are satisfactorily met. In conclusion, 'International Business Town', in line with other legislative and administrative incentive programs, will function as a driving force to make the Seoul capital regional more competitive as a regional business hub in Northeast Asia.
