UNCITRAL 중재규칙(仲裁規則) 개정초안(改正草案) 내용(內容)의 분석(分析)과 방향검토(方向檢討) (Analysis of Deliberations by UNCITRAL Working Group on the Draft Revised Version of UNCITRAL Arbitration Rules)

  • At its thirty-ninth session(New York, 19 June - 7 July 2006), United Nations Commission on International Trade Law(hereinafter referred to as the Commission) agreed to give priority to the topic of revising the UNCITRAL Arbitration Rules. From the forty-fifth through the forty-seventh session, the Working Group checked various issues based on the draft revised version of the UNCITRAL Arbitration Rules prepared by the Secretariat. At its forty-eighth session, the Working Group is going to finish its first reading of articles 38 to 41 of the draft revised version of the UNCITRAL Arbitration Rules, and to commence its second reading of the draft revised version of UNCITRAL Arbitration Rules. Korea is keen on enticing foreign direct investment into its territory. From the 1960s, Korea has concluded more than 80 BITs. Korea is making efforts to conclude FTAs with its trading partners. As of January, 2008, 3 FTAs have taken into effect with respect to Korea. According to provisions on dispute settlement found in such BITs and FTAs involving Korea, the Rules can be chosen for Investor-State Arbitration. Furthermore, the Rules is followed by the arbitration rules for domestic and international arbitrations administered by the Korean Commercial Arbitration Board. If the Commission adopts the revised version of UNCITRAL Arbitration Rules, the Rules will be able to give impact on the arbitration law and practice around the world of arbitration. That is the reason why we should keep attention to the development of the deliberations of the Working Group.

연약점성토 지반에 타설된 십자형배수재의 등가직경 산정 (Estimation of Equivalent Diameter for Cross Shaped Vertical Drain Installed in Weak Clay Soils)

  • 본 논문은 실내시험과 수치모델을 이용하여 십자형 배수재의 압밀촉진효과와 등가직경을 검토하고 판형배수재와 비교하였다. 배수재의 등가직경은 실내시험으로부터 역계산하여 문헌에 의해 제시된 공식으로부터 산정된 결과와 비교하였고, 압밀효과는 3차원 흐름해석프로그램인 MODFLOW를 사용하였다. 해석모델의 신뢰성은 현장의 침하-시간 계측자료를 이용하여 검토하였다. 실내시험결과 산정된 판형 배수재의 등가직경은 Rixner의 제안식에 유사한 경향을 보였고, 십자형 배수재의 등가직경은 $d_w\;=\; \\tarc{3}{4}.(b+t)$로 산정되었다. 실제현장을 모델링한 수치해석결과 십자형 배수재는 압밀시간이 9-10% 감소하였고, 현장자료를 이용한 수치 흐름모델로부터 산정한 등가직경은 실내시험보다 3.5배 작은 것으로 나타났다.

부산과 인천점토의 퇴적상태를 고려한 압축지수 추정 (Prediction of Compression Index of Busan and Inchon Clays Considering Sedimentation State)

  • 압축지수는 점토의 압축특성을 나타내는 대표적인 물성치로, 압밀시험을 통해 직접 결정하거나 기본 물성으로부터 경험적으로 추정한다. 본 연구에서는 부산 및 인천점토의 퇴적상태를 파악하고 이것이 압축지수 추정식에 미치는 영향에 분석하였다. 이를 위해 부산 및 인천 점토의 재성형점토 압밀시험을 수행하고 자연점토 압밀시험 결과를 분석하였다. 분석결과 부산점토는 SCL보다 높은 간극지수를, 인천점토는 SCL보다 낮은 간극지수를 나타냈다. 퇴적상태를 나타내는 ${\Delta}e_r$을 압축지수 추정오차와 비교한 결과 액성한계 및 소성지수로 추정한 압축지수의 추정오차는 ${\Delta}e_r$이 증가함에 따라 감소하는 경향이 나타났다. 본 연구에서는 이러한 관계를 이용하여 부산 및 인천점토의 압축지수를 보다 정확히 추정할 수 있는 방법을 제안하였다.

LRFD 설계를 위한 쇄석다짐말뚝공법의 저항편향계수 산정 (Evaluation of the Resistance Bias Factors to Develop LRFD for Gravel Compaction Piles)

  • 본 연구에서는 연약지반개량공법의 하나인 쇄석다짐말뚝공법의 저항계수를 산정하기 위한 저항편향계수를 산정하였다. 쇄석다짐말뚝공법의 저항편향계수를 산정하기 위하여 국내외 현장에서 수행된 41개 말뚝의 재하시험 결과로부터 산출된 2.54cm 침하량기준의 극한지지력과 말뚝직경의 2~3배의 깊이에서 팽창파괴가 지배적인 파괴유형이므로 팽창파괴에 대한 7개의 극한지지력공식을 사용하여 저향편향계수를 분석한 결과 확률밀도함수는 쇄석다짐말뚝의 7개 팽창파괴에 대한 극한지지력식 모두 로그정규분포 형태를 보였고, 저항편향계수/변동계수는 Greenwood(1970) 제안식에서는 0.91/0.38, Hughes & Withers(1974) 제안식에서는 1.19/0.39로 팽창파괴에 대한 극한지지력식 중에서 저항계수설계법의 저항계수 산정 시 적합한 제안식으로 분석되었다.

재개발지역의 원주민 세입자 재정착률 제고방안 (An Analysis of the improving of resettlement for original tenant in redevelopment district)

  • Housing Re-Development business is to improve the environment of old residential area and secure insufficient infrastructure facilities for the public, and to provide housing of fine quality for the individuals and it is taken as an opportunity for the individuals to be able to increase their property. However, it is true that the benefits from the redevelopment has not offered to the original dwellers who has lived there for a long time. This research studies the related systems of the Rental House Redevelopment Supply Service and is to present the schema to raise resettlement rate through the investment on the rate of tenants who chose the rental house and their specific characters. This study is to present the reform measures about the following 3 problems, on the basis of prior theoretical studies which deals with the common factors having low rate to move in the rental house of the tenants. (1) Physical side, the problem of supply structure, which is not appropriate Housing Supply Structure, (2) Psychological side, the problem of socially excluded rental house residents (3) Economical side, low re-settlement rate of tenants caused from the unreasonableness of the estimated rental value. This study presents that the compulsory rental housing supply rate should be changed to the gross area not from the number of households, and the supply of rental houses should correspond to the household size of tenants through prior demand survey. Secondly, it proposes the housing complex layout for intermixing to solve the social problems to allow a housing for sale and rental houses mixing in a building. And it proposes that the rental value should be calculated considering the neighboring value and in the long run, it should be calculated considering the tenants' income instead construction cost estimate. Also, it should be arranged to provide an opportunity to create income through resident welfare center improvement and provide self-sufficiency functions leading residents to participate in the residential area's repairing and maintenances.

『승정원일기(承政院日記)』를 통해 본 침구택일(鍼灸擇日) 활용 방법 (A Study Of The Acupuncture & Moxibustion Fix-a-Day Method In Seunjeongwon-Ilgi)

  • The objective of this article is to analysis of Acupuncture & Moxibustion Fix-a-day Method (AMFDM;鍼灸擇日) shown in the Seunjeongwon-Ilgi(承政院日記). Through such inquisition, The practical application of AMFDM could be found. The authors used web database of Seunjeongwon-Ilgi(承政院日記) serviced by National Institution of Korea History. We searched the database twice. First, We check up the database using key words - '忌日', '吉日', '拘忌', '鍼', '針' and '灸'. Search words is "(忌日|吉 日|拘忌)&(鍼|針|灸)". Second, We check up the database using other key words - '瘟㾮', '爲吉', '爲受鍼吉'. 1. AMFDM was used whenever Royal Family was cared. Futhermore, Its application method was as same as medical documents said. 2. AMFDM in the Seunjeongwon-Ilgi consists of Taboo-day(忌日) and Favor-day(吉日). Taboo-day is classified into following 5 type. Weather, Moon phases, The 24 solar terms(節氣), Spirit-location(人神), KunJie-12-deity(建除十二神) and OnHuang-day(瘟㾮日). 3. Sometime contradiction was occurred when AMFDM was used. So AMFDM had the priority order. According to these's order, doctor picked up a date. 4. Doctor used AMFDM to control Interval of treatment. They thought that acupuncture treatment exhaust one's Qi(氣). Using AMFDM, they could give recovery period to patient.

Numerical simulation of the influence of interaction between Qanat and tunnel on the ground settlement

  • This paper presents analysis of the interaction between tunnel and Qanat with a particular interest for the optimization of Qanat shape using the discrete element code, PFC2D, and the results will be compared with the FEM results of PLAXIS2D. For these concerns, using software PFC2D based on Discrete Element Method (DEM), a model with dimension of 100m 100 m was prepared. A circular tunnel with dimension of 9 m was situated 20 m below the ground surface. Also one Qanat was situated perpendicularly above the tunnel roof. Distance between Qanat center and ground surface was 8 m. Five different shapes for Qanat were selected i.e., square, semi-circular, vertical ellipse, circular and horizontal ellipse. Confining pressure of 5 MPa was applied to the model. The vertical displacement of balls situated in ground surface was picked up to measure the ground subsidence. Also two measuring circles were situated at the tunnel roof and at the Qanat roof to check the vertical displacements. The properties of the alluvial soil of Tehran city are: γdry=19 (KN/㎥), E= 750 (kg/㎠), ν=0.35, c=0.3(kg/㎠), φ=34°. In order to validate the DEM results, a comparison between the numerical results (obtained in this study) and analytical and field monitoring have been done. The PFC2D results are compared with the FEM results. The results shows that when Qanat has rectangular shape, the tensile stress concentration at the Qanat corners has maximum value while it has minimum value for vertical ellipse shape. The ground subsidence for Qanat rectangular shape has maximum value while it has minimum value for ellipse shape of Qanat. The vertical displacements at the tunnel roof for Qanat rectangular shape has maximum value while it has minimum value for ellipse shape of Qanat. Historical shape of Qante approved the finding of this research.

서양복 제작용어에 관한 연구 -교육용어와 현장용어의 현황분석- (A Study on the Professonal Terminologies Concerning Manufacture of Western Costumes -An Analysis of the Status of Educational Terminologies and the Terminologies Used in Practice-)

  • This study is aimed at providing guidelines to settle unified terminologies that can be used in education, industry and factories by identifying the problems in the use of complicated terminologies concerning manufacture of western costumes. The results of the study reveal that educational terminologies tend to be more Korean languages whereas the terminologies used in practice consist of main streams of Japanese words which were transmitted erroneously, thus causing barriers of communication between the two fields, being same points to be called differently and being the terminologies pertinent to Korean costumes mistakenly used for western costumes. The confusion of use of professional terminologies is significant problem to be sotted in view point not only of the economic aspects of low productivity but also of the settlement and transmission of Korean culture. Therefore, the administrative measures are badly in need to solve all these problems. The following points are recommended to solve these problems on the basis of the findings of this study. 1) In principle the mistakenly transmitted Japanese words and the mixed up terminologies should be Koreanized, but those words for which there are no proper Korean words and complicated words difficult to commumicate can be replaced by the standardized pronunciation of the original words. 2) The words for Korean costumes which are mistakenly used for western costumes should be expressed by the standard of western costumes. 3) The readily localized foreign terminologies had better be used as they are. 4) The variety of terminologies indicating same points should be Koreanized in unification to best express the true meaning of the original words. 5) The misspelled Korean words and the dialect of Korean words should be standardized.

준설점성토의 압밀특성에 미치는 시간효과 (The Aging Effect of Dredging Clayey Soil on the Consolidation Characteristics)

  • 준설매립지의 현장계측결과에 의하면 실제의 자중압밀 침하량은 실내시험결과를 근거로한 설계치보다 작게 평가되고 있다. 이러한 원인중의 하나를 본 연구에서는 준설재료의 퇴적시 압축성의 저감에 의한 것이며 더욱이 이러한 시간효과는 펌프준설매립지와 같이 저응력범위의 압밀특성에서는 고려되고 있지 않는 실정이다. 본 논문에서는 준설점성토의 압축성에 대한 시간효과를 파악하기 위하여 퇴적된 공시체에 침투력을 작용시켜 일련의 침투압밀시험을 수행하였다. 또한 본 연구에서와 같이 초기함수비가 큰 경우에 발생하는 압밀해의 불안정성을 극복하기 위하여 예측자-수정자법을 이용한 유한차분에 석기법을 제시하였고 실험결과와 비교하여 좋은 결과를 얻었다. 최종적으로 준설점성토의 압축성은 자중압밀시간에 의존되고 있음이 관찰되었다.

EPS의 거동 예측 모델에 관한 실험적 연구 (An Experimental Study on the Modelling for the Prediction of the Behaviour of EPS)

  • 초 경량재인 E.P.S(20~30kg/m3)를 성토재로 사용하여 부족한 지지력과 침하에 대한 안정 성을 확보하는 방법이 최근 많이 사용되고 있다. 국내에서는 1993년 인천의 연약지반상 교대 됫채움재로 이 공법이 처음 사용된 이래 점차 활용이 늘어나고 있는 실정이다. 그러나 아직까지 EPS를 성토 재료로 사용한 지반에서 EPS의 거동을 예측하기 위한 합리적인 수치해석 모델이 제시되어 있지 않고 일축압축강도 및 크리프시험 결과에 따른 설계강도만이 제안되어 있는 실정이다. 따라서 본 연구에서는 성토재료로 사용된 EPS의 수치해석 모델을 제시하기 위하여 성토재로 사용되는 여러 종류 밀도의 EPS에 대해 구속압을 변화시키면서 삼축압축시험을 실시하였다. 삼축압축시험 결과를 분석하여 EPS의 축방향 변형률-응력 관계와 이의 도함수 그리고 포아송비를 밀도와 구속압에 의한 함수식으로 나타낼 수 있었다. 이 관계로부터 EPS의 거동을 예측하기 위한 비선형모델을 제안하였다.
